246 Meaning of offset manager offset manager, for an offset management plan— (i) if a lease of land includes a condition that requires the lessee of the land to comply with an offset management plan in relation to an offset—the lessee of the land; or (ii) if the offset management plan applies to unleased land or public land—the custodian of the land; or (iii) in any other case—the person identified in the offset management plan as the offset manager; but (b) if paragraph (a) (i) does not apply—does not include the lessee of the land.
