208 Exception to s 206 (1) (b)—waiver of notification requirement Despite section 206 (1) (b), the decision-maker may waive the requirement to publicly notify an application to amend a development approval if satisfied that— (a) the amendment will not involve any change that would be inconsistent with an essential design element; and (b) the amendment will do no more than minimally increase— (i) the adverse impact of the development otherwise than on the applicant; and (ii) the environmental impact of the development.
