138 Application for environmental significance opinion (1) A proponent may apply for an environmental significance opinion for a proposal if a regulation states that an opinion may be given for the Note An EIS is not required for a proposal if an environmental significance opinion is given for it (see s 105 (2)). (2) A regulation may prescribe an agency to which a proponent may apply for an environmental significance opinion (the relevant agency).
