45 When development permit taken to be issued If, after a planning scheme is made or amended under Part 2, a particular use of land is permitted only with the consent of the consent authority, a development permit consenting to that use is taken to have been issued if, immediately before the amendment: (a) the particular use was permitted on the land without the consent of the consent authority; and (b) that particular use was being made of the land.
