44B Attempt to defraud in execution of instruments prohibited—the Act, Sch 2, cl 15

44B Attempt to defraud in execution of instruments prohibited—the Act, Sch 2, cl 15

(1) A party to a relevant instrument of transfer must not, with intent to defraud, execute the instrument unless the instrument fully sets out—

(a) the consideration for the instrument, and

(b) other facts and circumstances affecting the amount of stamp duty payable for the instrument.

Maximum penalty—

(a) for a corporation—2,000 penalty units, or

(b) for an individual—400 penalty units.

(2) In this section—

relevant instrument of transfer means—

(a) an instrument of transfer of a licence referred to in the Act, section 42(3)(a), or

(b) an instrument of transfer of legal or equitable interest as referred to in the Act, section 45.
