56 Minister not to issue licence unless certain requirements met (1) If the proposed route of a pipeline is on private land, the Minister must not issue the licence for the construction of the pipeline unless the Minister is satisfied that any necessary interests have been acquired by agreement with the owner or are to be acquired compulsorily in accordance with Part 6. (2) If there is a native title holder in relation to land in the proposed route of a pipeline, the Minister must not issue the licence for the construction of the pipeline unless the Minister is satisfied that a relevant procedure under the Native Title Act has been followed. (3) The applicant is liable to pay any compensation, interest, charges and expenses— (a) incurred in acquiring interests referred to in subsection (1), whether compulsorily or otherwise; or (b) incurred in following a relevant procedure referred to in subsection (2); or (c) payable under the Native Title Act in respect of the grant of the licence.
