165 Announcement before entry S. 165(1) amended by No. 13/2025 s. 85(1)(2). (1) Before executing a warrant under section 163A or a search warrant, the inspector named in the warrant or a person assisting the inspector must announce that he or she is authorised by the warrant to enter the premises or land and give any person at the premises or land an opportunity to allow entry to the premises or land. S. 165(2) amended by No. 13/2025 s. 85(2). (2) The inspector or a person assisting the inspector need not comply with subsection (1) if he or she believes on reasonable grounds that immediate entry to the premises or land is required to ensure— (a) the safety of any person; or S. 165(2)(b) amended by No. 13/2025 s. 85(3). (b) that the effective execution of the warrant under section 163A or the search warrant is not frustrated. S. 166 amended by No. 13/2025 s. 86.
