Phylloxera and Grape Industry Act 1995

The Act’s core statutory concepts are narrowly defined and drive who falls within its operative reach and what powers may be exercised.

• Board (s3): The Phylloxera and Grape Industry Board of South Australia is continued in existence and given corporate capacity (s4(1)-(2)). The Board is the central decision-making and administrative body under the Act. It is empowered to accept money, contract, hold property, employ staff (s16(a)-(e)), and to delegate its functions in writing (s17).

• Chief Inspector (s3): The Act uses the term Chief Inspector, defined by reference to the Plant Health Act 2009. The Chief Inspector is a member of the Board (s5(1)(a)) and, together with the presiding member, has specific outbreak-response duties (s14).

• Disease (s3): The Act adopts a broad biological/legal definition of “disease” that includes bacteria, fungi, insects, mites, arthropods, protozoa, viruses or other organisms, and “any other condition” that may affect vines. This expansive definition (s3) captures phylloxera and other pest, pathogen and physiological conditions.

• Vine, vineyard, and cutting (s3): “Vine” includes any grape vine alive or dead or parts or cuttings; “vineyard” means a parcel of land where vines are planted, growing or found (s3). The Register threshold is 0.5 hectares of planted vines (s19(1)), so the statutory regime applies to smaller plantings only where that threshold is met or crossed.

• Register and registered person (Part 3, s19): The Board must maintain a Register of persons who own vineyards of 0.5 hectares or more. The Register must record name and address, vineyard location (detailed cadastral particulars), varieties, area of each variety, vine age, vine source and other information the Board considers relevant (s19(2)(a)-(g)). The Board may correct entries, subject to procedural protections if corrections increase contributions (s22).

• Contributions and Fund (Part 4, ss23-24): The Board may require contributions by notice in the Gazette from registered persons, winemakers or distillers to meet the Board’s costs (s23(1)). Contribution rules must be approved by the Minister (s23(1), (2)). Contributions are to be levied and collected by the Commissioner of Land Tax as if they were land tax and will be a charge on the land until paid (s23(3)-(4)). The Fund held at Treasury stores contributions and other authorised amounts (s24(1)-(5)).

• Five year plan and reporting (s18, s26): The Board must prepare a five year plan within 12 months of commencement and present it at a public meeting, with annual revision and public presentation required (s18(1)-(3)). The Board must prepare audited accounts annually and submit a report to the Minister by 31 July each year, including audited accounts and the five year plan (s25-26). The Minister must lay the report before Parliament within 12 sitting days (s26(3)).

• Inspection powers (s20): For the purposes of maintaining the Register, the Board may make searches in the Lands Titles Registration Office and inspect and take extracts from council or authority records relating to rates, charges or taxes under the Local Government Act 1934, the Irrigation Act 1994 or the Land Tax Act 1936 (s20). No payment is required for these inspections.

• Data confidentiality (s13(1)(i), (3)): Though the Board may collect and supply data on vineyard health, s13(3) prohibits supplying data that reveals details of a particular person or business without that person’s consent.

• Offences and regulatory instruments (ss29-30): The Act makes it an offence to provide false or misleading information in furnishing information under the Act (s29). The Governor may make regulations for the Act (s30), with the power to prescribe fines up to Division 7, and save/transitional regulations connected to other reforms (s30(2)-(4)).

These core definitions and constructs situate the Board as a statutory body with surveillance, planning, accreditation and funding powers, focussed on disease control in vineyards and industry support. The legal thresholds (for example, 0.5 hectare) and mechanisms for funding (contributions collected as if land tax) are key levers that determine the Act’s practical effects.

The Act’s operative reach touches a range of actors in the grape, wine and broader agricultural administration ecosystems. The principal affected groups and statutory roles are:

• Vineyard owners of 0.5 hectares or more (s19(1)): Owners who own vineyards comprising 0.5 hectares or more fall squarely within the Register requirement and return obligations (s21). The definition of “owner” includes fee simple owners, persons entitled under an agreement to purchase from the Crown, and lessees or licensees holding under Crown lease or licence (s3). Owners are the primary funding base for the Board since the Board may require registered persons to pay contributions (s23(1)(a)).

• Winemakers and distillers (s23(1)(b)-(c)): The Board may require contributions from winemakers and distillers as specified by Gazette notice and Minister-approved rules (s23). These classes are explicitly included in the funding model and therefore are second-tier payers alongside registered vineyard owners.

• Registered persons (s3, s19): Those entered in the Register must supply and update particulars, and they are the persons from whom the Board can collect contributions (ss19-21, 23). They also receive notice for the five year plan meeting (s18(2)(b)).

• Minister and State government (ss5, 23(2), 26(3)): The Minister appoints Board members (s5), approves rules determining contributions (s23(2)), and is the recipient of the Board’s annual report which must be laid before Parliament (s26). The Minister also has delegable functions under s28. The Treasurer holds and may invest the Fund (s24(3)), and the Commissioner of Land Tax collects contributions (s23(3)).

• The Chief Inspector and Plant Health administration (s3, s14, s27): The Chief Inspector under the Plant Health Act 2009 is a Board member (s5(1)(a)), co-responsible with the presiding member for outbreak response decisions and advice to the Minister (s14), and Board members are ex officio inspectors under the Plant Health Act 2009 (s27). This ties Board activity into statutory plant health enforcement machinery.

• Regional committees and industry bodies (ss15, 26(4)): The Board must establish regional committees representing each prescribed region for advice (s15(1)). The Board is required to report after each meeting to regional committees and named industry bodies such as the Wine Grape Council of South Australia and the South Australian Wine Industry Association Incorporated (s26(4)). The Minister’s appointment rules also require nominations by organisations with significant involvement in grape growing or winemaking (s5(1)(b)(ii)).

• Nurseries and propagative material suppliers (s13(1)(h)): The Board can approve nurseries capable of producing propagative material free of specified diseases or approve industry accreditation schemes for such nurseries (s13(1)(h)). This affects nursery operators and seed/plant sourcing chains.

• Local government and land title authorities (s20): The Board can inspect land title and local government records relating to rates and taxation without payment, which involves councils and the Lands Titles Registration Office as sources of data (s20).

• Persons who supply information (s29): Anyone furnishing information under the Act must not make statements that are false or misleading (s29), potentially capturing agents, advisers and professionals who prepare returns.

The Act also creates incidental impacts. For example, because contributions are levied and collected by the Commissioner of Land Tax as if land tax, enforcement mechanisms and penalties applicable to land tax collection apply in practice (s23(3)), affecting property sale and financing contexts where a charge on the land could influence conveyancing or mortgagee behaviour. The Board’s ability to set conditions on movement of machinery, equipment and vines (s13(1)(b)) can impose additional transaction costs on contractors, machinery hirers, nurseries, and cross-border transporters.

Finally, the Act’s regulatory architecture gives the Minister and the Board significant discretion in designing contribution rules and accreditation requirements, which means that organisations that nominate members and those participating in the named industry bodies have practical influence over governance without being statutory decision makers.

This section sets out primary statutory duties imposed by the Act, and rights and procedural protections that affect how those duties operate.

Duties on the Board

• Core functions (s13): The Board’s primary functions are to identify and assess disease threats and risks of spread (s13(1)(a)), develop policies on movement restrictions and quarantine (s13(1)(b)), develop eradication plans (s13(1)(c)), support research and publish results (s13(1)(d)-(e)), raise public and industry awareness and disseminate good practice (s13(1)(f)-(g)), approve nurseries or accreditation schemes for disease-free propagative material (s13(1)(h)), collect and supply aggregate data subject to confidentiality constraints (s13(1)(i)-(3)), and perform other assigned functions (s13(1)(j)). The Board also has an additional function to assist and support the grape industry in initiatives (s13(2)).

• Planning and public accountability (s18): The Board must prepare a five year plan within 12 months, present it at a public meeting with public notice, and thereafter update and present revised plans at least once every 12 months (s18(1)-(3)). The notice procedures require both publication in a newspaper or a Board-determined website and sending a copy by post to each registered person (s18(2)).

• Reporting and audit (ss25-26): The Board must keep proper accounts, have them audited annually by a registered company auditor or the Auditor-General (s25), and provide a report to the Minister by 31 July each year containing the audited accounts and the five year plan (s26(1)-(2)). The Minister must lay the report before Parliament within 12 sitting days (s26(3)).

Duties on owners/registered persons

• Registration and returns (ss19-21): Owners of vineyards of 0.5 hectares or more must be entered in the Register, and must provide the particulars set out in s19(2). Specific events triggering returns are transfer or acquisition of ownership of a qualifying vineyard, establishment of such a vineyard, extension to cross the 0.5 ha threshold, or removal of vines so that the vineyard ceases to meet the threshold; returns are required within three months (s21). Failure attracts a Division 8 fine and possible expiation fee (s21; Appendix).

• Truthfulness and accuracy (s29): Any person furnishing information under the Act must not make a false or misleading statement in a material particular; the penalty is a Division 7 fine (s29; Appendix).

• Submission right on register correction that increases contributions (s22(2)): If the Board proposes a correction to the Register that would increase a contribution payable under Part 4, the Board must give the vineyard owner written notice and allow at least one month to make submissions before making the correction (s22(2)).

Rights and procedural protections

• Confidentiality constraint on data release (s13(3)): The Board must not supply data that reveals details about a particular person or business without that person’s consent. This gives vineyard owners a statutory right to withhold consent before identifiable data is released.

• Quorum, voting and meeting rules (s8): Board procedure is regulated, five members constitute a quorum, each member has one vote, the presiding member has a casting vote in the event of equality, and electronic participation counts as presence (s8). The presiding member is elected annually by the Board (s7).

• Ministerial oversight and appointment conditions (s5): The Minister appoints up to eight members (in addition to the Chief Inspector) and must ensure no more than one member from each prescribed region is on the Board and that all members have proven experience and commitment to the industry (s5(3)). Nominating organisations must provide written reasons for nominations and satisfy other Ministerial requirements (s5(2)).

• Delegation and revocation (s17, s28): The Board may delegate functions in writing to members, committees, a particular person or office-holder; delegations can be absolute or conditional and are revocable at will (s17(1)-(2)). The Minister may also delegate functions with similar formality and revocability (s28).

Distinct statutory interactions that create practical rights/obligations

• Collection as if land tax (s23(3)-(4)): Contributions are levied and recovered by the Commissioner of Land Tax as if they were land tax, meaning the practical enforcement toolkit and penalties of land tax collection apply. Contributions remain a charge on the land until paid, which affects property rights and sale/conveyancing processes.

• Inspector status under Plant Health Act (s27): Board members are inspectors ex officio under the Plant Health Act 2009; that status may carry inspection, seizure or other powers under that Act,this Act does not itself specify those powers but creates the linkage (s27).

These duties and rights allocate responsibilities between the Board (planning, data collection, policy and accreditation), the Minister (appointments and approval of contribution rules), and private actors (registration, truthful returns, payment of contributions). Procedural protections, notice and submission on corrections that would increase contributions and the data confidentiality requirement, are notable constraints on the Board’s information use and financial adjustments.

The Act establishes a regulatory regime relying on information collection, financial levies and criminal/administrative penalties for non-compliance. Enforcement instruments are both direct (offences) and indirect (use of tax collection machinery).

Offences and monetary penalties

• False or misleading statements (s29): A person who, in furnishing information under this Act, makes a statement that is false or misleading in a material particular commits an offence. The penalty is “Division 7 fine.” The Appendix ties Division 7 to a maximum fine of $2,000 and an expiation fee of $200. The text of the Act does not provide other sentencing details; the Appendix is the legislative tool for divisional maxima (Appendix).

• Failure to file required returns (s21): The duty to file a return within three months is backed by a “Penalty: Division 8 fine. Expiation fee: Division 8 fee.” Division 8, per the Appendix, carries a maximum fine of $1,000 and an expiation fee of $150.

• Regulatory offences (s30(2)): The Governor may make regulations and prescribe a fine not exceeding a Division 7 fine for contravention of regulations. This gives the executive power to create additional, lower-level offences with penalties up to Division 7 magnitude.

Enforcement mechanisms and collection

• Collection via Commissioner of Land Tax as if land tax (s23(3)): Contributions determined by the Board and notified in the Gazette must be levied, collected or recovered by the Commissioner of Land Tax on behalf of the Board as if they were land tax and are subject to the same penalties for delay or default. This establishes an administrative enforcement channel leveraging land tax collection mechanisms: assessments, interest, recovery processes, and potentially seizure/remedies applied in land tax law.

• Charge on the land (s23(4)): A contribution remains a charge on the land where the vineyard, winery or distillery is situated until payment. Practically, this creates a registered encumbrance risk that may affect conveyancing, mortgagee priority and financing of vineyard properties.

Inspection and investigatory powers

• Searches and inspections (s20): For Register purposes, the Board may make searches in the Lands Titles Registration Office, and inspect and take extracts from council or authority records relating to rates, charges or taxes under the Local Government Act 1934, Irrigation Act 1994 or Land Tax Act 1936. These searches are without payment. The Act does not itself authorise entry onto private land for inspection but links Board members to inspector status under the Plant Health Act 2009 (s27). The Plant Health Act will therefore be the operative source of powers for physical inspections and biosecurity enforcement attributable to Board members as inspectors ex officio.

Delegatory enforcement architecture

• Delegation and revocation (s17, s28): The Board may delegate functions to members, committees or specified persons and revoke delegations (s17). The Minister may likewise delegate functions (s28). Delegation by its nature distributes operational enforcement and administrative tasks across officials and committees, and the revocability provides a unilateral tool for the Board or Minister to withdraw delegated authority.

Procedural protections affecting enforcement

• Notice and right to make submissions where register correction increases contribution (s22(2)): The Board cannot correct the Register in a way that increases a contribution without first serving written notice and allowing not less than one month for submissions. This is a statutory procedural protection against retrospective increases in financial burden caused by administrative correction.

Compliance remedies and administrative transparency

• Audit and parliamentary reporting (ss25-26): The Board’s accounts must be audited and reported to Parliament annually. These transparency obligations serve as indirect enforcement levers by making financial administration subject to public and parliamentary oversight.

Overall enforcement is a mix of administrative collection tools with criminal penalties for false or misleading information and statutory fines for late or missing returns. The use of land tax collection mechanisms strengthens recoverability but also embeds contributions into property encumbrance regimes that operate beyond simple administrative debt recovery.

The Act expressly references and connects to several other statutes and administrative systems, embedding the Board’s powers into existing legal frameworks.

Connection to the Plant Health Act 2009

• Chief Inspector and inspector status (ss3, 14, 27): The Act defines Chief Inspector by reference to the Plant Health Act 2009 (s3), makes the Chief Inspector a member of the Board (s5(1)(a)), requires the Chief Inspector and the presiding member to determine appropriate outbreak action and advise the Minister (s14), and declares Board members to be inspectors under the Plant Health Act 2009 ex officio (s27). These provisions integrate the Board’s disease-response responsibilities with the statutory inspection, quarantine and enforcement mechanisms set out in the Plant Health Act. The Act itself does not restate the Plant Health Act’s inspection or enforcement powers but creates the institutional link to them.

Interaction with land-related and local government statutes

• Lands Titles Registration Office searches and local records (s20): The Board may search the Lands Titles Registration Office and local government records (rates, charges or taxes) maintained under the Local Government Act 1934, the Irrigation Act 1994 or the Land Tax Act 1936. Although some referenced Acts may have been modernised or replaced, the provision authorises the Board to use cadastral and taxation records for Register maintenance and verification.

• Collection via Commissioner of Land Tax (s23(3)-(4)): Contributions are levied and recovered by the Commissioner of Land Tax as if the contribution were land tax and are subject to the same penalties for delay or default. This attaches the Board’s financial claims to the tax-collection machinery and remedies of land tax law, bringing in the full suite of administrative remedies and enforcement practices used for land tax.

Statutory cross-references and amendment effects

• Regulations and consequential amendment provisions (s30(3)-(5)): The Governor may make regulations to give effect to consequential changes following the Statutes Amendment (Boards and Committees,Abolition and Reform) Act 2015 (s30(3)). The text of the Act’s Legislative history shows multiple amendments and deletions associated with other reforms; those interplays are preserved in the Act’s amendment logs (Legislative history).

• Potential interaction with Biosecurity Act 2025 (Legislative history): The Act’s legislative history records an entry for the Biosecurity Act 2025, Schedule 6 (clauses 6-9) as uncommenced. If brought into force, those provisions may alter administrative or enforcement arrangements related to biosecurity, which would interact with this Act’s disease control purposes.

Privacy and data release constraints

• Data confidentiality (s13(3)): The Board may collect and, on request by an interested person, supply data relating to vineyards and vine health, but s13(3) prohibits the Board from supplying data revealing details relating to a particular person or business without that person’s consent. This clauses creates an interaction with privacy law principles and restricts the Board’s capacity to publish identifiable data unless consented to, even if disclosure might be sought under other laws. The Act does not state its relationship to South Australian privacy statutes or Freedom of Information laws; practitioners should check those instruments where necessary.

Property and conveyancing interfaces

• Charge on land until payment (s23(4)): Because contributions are a charge on land until paid, the Act intersects with conveyancing and mortgage law practices. Outstanding contributions may need to be disclosed in sale processes and could affect priorities and purchaser/financier risk assessments.

Administrative law and delegation

• Delegation regimes (s17, s28): The Act’s delegation provisions create interactions with administrative law doctrines on delegation, revocability and delegation to sub-delegates. Delegations must be in writing and may be conditional, but they do not preclude the delegator from acting. The Minister’s delegation power also interacts with governmental administrative practices.

Records and auditing

• Audit by registered company auditor or Auditor-General (s25): The Act requires annual audit of accounts which interfaces with public sector audit standards where the Auditor-General is used, or private auditing standards where a registered company auditor is engaged.

Practitioners must therefore read the Act in conjunction with the Plant Health Act 2009 for inspection and enforcement powers, consult land tax legislation and practice for contribution recovery and enforcement, and consider privacy, conveyancing and administrative law frameworks where those systems intersect with the Board’s activities.

The Act’s legislative history section recorded in the text provides a chronology of amendments, repeals and related consequential changes up to the publication date of this version. The amendments listed in the Act itself are the authoritative starting point for any analysis of current text.

Key entries in the legislative timeline (as recorded in the Act):

• 1995 (No 19): Enactment of the Phylloxera and Grape Industry Act 1995, with assent on 13 April 1995 and commencement on 31 August 1995 (Gazette reference).

• 2006 (No 43): Statutes Amendment (Domestic Partners) Act 2006 made an amendment (Pt 63 s168) that commenced 1 June 2007. The legislative history notes s9 was amended in that instrument historically.

• 2009 (No 2): Plant Health Act 2009 (assent 12 February 2009) amended this Act by adding cross-references; specifically, Sch 1 cls 3 & 4 commenced 1 August 2009. The Act’s definition of Chief Inspector was amended by the 2009 Act (recorded at s3 in the table).

• 2009 (No 84): Statutes Amendment (Public Sector Consequential Amendments) Act 2009 (assent 10 December 2009) substituted s9; the substitution commenced 1 February 2010 (Pt 113 ss265 & 266).

• 2015 (No 8): Statutes Amendment (Boards and Committees,Abolition and Reform) Act 2015 introduced multiple changes to Part 2 (Pt 29 ss184-190), including deleting or amending selection and appointment provisions. The commencement date for those amendments was 1 July 2015. The amendments affected s5 (constitution of Board), s5(2), and s5(3), and deleted Pt 2 Div 2 (selection committee), among others. Transitional provisions in that Act (s190) caused members of the former Selection Committee to vacate office (Transitional provision 190).

• 2019 (No 25): Statutes Amendment and Repeal (Simplify) Act 2019 introduced an amendment to s18(2), commencing 3 October 2019 (Pt 35 s77).

• 2025 (No 5): Biosecurity Act 2025 (assent 13 February 2025) is recorded with Schedule 6 (clauses 6-9) as uncommenced in this text. The presence of this entry indicates a potential future interaction if those clauses are brought into force.

Provision-level amendments recorded in the Act

• s3 (definition of Chief Inspector) was amended by the Plant Health Act 2009 (Sch 1 cl 3) effective 1 August 2009.

• s5 underwent substitution/amendment by the 2015 Boards and Committees reform (8/2015 s185), effective 1 July 2015. The amendment changed nomination and appointment mechanics and removed prior selection committee arrangements.

• s9 was substituted by the 2009 Public Sector Consequential Amendments Act (84/2009 s265) effective 1 February 2010. This is the s9 that now addresses conflict of interest under the Public Sector (Honesty and Accountability) Act.

• Pt 2 Div 2 (Selection Committee) was deleted by 8/2015 s186 effective 1 July 2015.

• s18(2) (notice requirements for five year plan public meeting) was amended by 25/2019 s77 effective 3 October 2019.

• s26(4) (reporting after meetings to industry bodies) was amended by 8/2015 s187 effective 1 July 2015.

• s27 (members are inspectors) was amended by Plant Health Act 2009 Sch 1 cl 4 effective 1 August 2009.

• s28 was deleted by 84/2009 s266 effective 1 February 2010 but later reinstated or reinserted by 8/2015 s188 effective 1 July 2015,the legislative history records deletion and re-insertion.

• s30(3)-(5) (provisions authorising saving or transitional regulations consequent on the 2015 Boards and Committees reforms and their retrospective effect limits) were inserted by 8/2015 s189 effective 1 July 2015.

Transitional notes embedded in the Act

• Schedule transitional provisions preserved continuity with the repealed Phylloxera Act 1936, including continuing the Phylloxera Districts as prescribed regions until regulations were made (Schedule cl 4), and continuing existing contributions until a new determination by the Board (Schedule cl 5). The Schedule also provided for vacation of offices held before commencement to enable appointments under the 1995 Act (Schedule cl 3).

Limitations on the legislative history in the Act text

• The Act’s own Legislative history section notes that amendments that are uncommenced are not incorporated into the printed text and that references to other legislation or titles may be obsolete. Practitioners should therefore check the current consolidated text on the official legislation site and verify commencement dates for any amendments, particularly the Biosecurity Act 2025 entries noted as uncommenced.

In short, since 1995 the Act has been amended at several points to align with Plant Health administrative frameworks, to reform Board appointment processes and selection committees, to introduce modernised reporting and public meeting notice requirements, and to accommodate broader statutory reform of boards and committees. The recorded amendment history should be checked against up-to-date sources for any further changes or commencement of uncommenced provisions.

The Act’s text as provided does not record judicial decisions or a case law history. The document’s Legislative history lists statutory amendments and transitional provisions but contains no reference to judicial determinations applying or interpreting the Phylloxera and Grape Industry Act 1995. Therefore, the Act’s published text does not itself disclose any litigation history.

Implications for researchers and practitioners

• Absence of cases in the statute text is not proof of absence of litigation. The Act’s legislative text is silent on judicial interpretation. To establish litigation history or precedent, practitioners must consult legal databases (for example, AustLII, JADE, LexisNexis AU, Westlaw AU or court registries) for decisions that mention or apply the Act or its provisions, and search administrative tribunal decisions concerning contribution assessments or register corrections.

• Likely judicial flashpoints, given the Act’s content, would be disputes over contribution levies and their collection as if land tax (s23(3)-(4)), data disclosure and confidentiality obligations (s13(3)), Board corrections to the Register where contributions increase (s22(2)), and procedural fairness issues linked to the Board’s delegations and decisions (s17). Additionally, enforcement actions under the Plant Health Act 2009 using Board members as inspectors could produce litigation on search and seizure, or biosecurity control measures, but that litigation would be recorded against the Plant Health Act provisions as well.

• For conveyancing and property disputes, the charge on land arising from unpaid contributions (s23(4)) could be contested in disputes over priority, mortgagee obligations, or vendor disclosures. Those disputes would rely on interplay between this Act and property law principles.

Suggested due diligence steps

• Before advising a client on novel questions of statutory interpretation or enforcement under the Act, search reported and unreported decisions referencing the Act, including tribunal decisions, and review any determinations or administrative rulings by the Commissioner of Land Tax concerning collection as if land tax.

• Check the Plant Health Act 2009 case law, because many practical enforcement powers used by Board members will be sourced there (s27), and dispute resolution or judicial review is likely to invoke Plant Health Act authorities.

In short, the Act itself provides no litigation record. Practitioners must search external legal databases to assemble any litigation history relevant to issues arising under the Act.

The Act contains a number of practical traps, procedural pitfalls and potential unintended consequences that advisers should flag. The following points derive from the statutory text and its mechanics.

1. 0.5 hectare threshold is a bright-line trigger (s19(1), s21)

• The Register and return obligations apply at 0.5 hectares of planted vines. Small growers close to this threshold should be alert: establishment, extension, transfer or removal events require a return within three months (s21). Failure risks a Division 8 fine (Appendix). The threshold can cause abrupt compliance obligations when plantings cross the line, for instance via acquisition or productive expansion.

2. Contributions are collected as land tax and are a charge on the land (s23(3)-(4))

• The Board’s funding model externalises collection and enforcement to the Commissioner of Land Tax, subjecting contributions to land tax-like penalties and recovery processes. Unpaid contributions remain a charge on the land until paid. That can complicate sales, mortgages and refinancing: purchasers, mortgagees and conveyancers need to check for outstanding contributions and for any corrections to the Register that could increase levies.

3. Register corrections that increase contributions trigger a statutory notice and one-month submissions window (s22(2))

• If the Board proposes a correction that would increase a contribution, it must give written notice and at least one month to make submissions. Practitioners advising on transfers or disputes should monitor and act within this window, as it is the only statutory pre-deprivation procedural protection specified.

4. Board data collection versus confidentiality (s13(1)(i), (3))

• The Board may collect and supply data on vineyards, but it must not supply data revealing details about a particular person or business without consent. Practically, this creates tension: the Board needs accurate, granular data to perform risk assessments and planning, but owners have a statutory safeguard against identifiable disclosure. Advisers should consider how consent mechanisms, aggregated reporting, or anonymised datasets can be used to meet both needs.

5. False or misleading information carries a heavier penalty than late returns (s29, s21)

• Providing false or misleading statements when furnishing information is a Division 7 offence (Appendix: max fine $2,000), which is a higher category than the Division 8 penalty for not filing a return (Appendix). Accuracy of returns and cross-checking of declared varieties, areas and vine sources is therefore important.

6. Ministerial discretion in appointments and contribution rules (s5, s23(2))

• The Minister approves rules for contributions and appoints members, subject to regional distribution and experience requirements. This centralises influence and creates a potential political or administrative point of contest when contribution rules are set or when board composition affects policy. Nomination procedures require written reasons (s5(2)), which may be a locus for interest groups.

7. Delegation and accountability (s17, s28)

• The Board and Minister can delegate functions, and delegations are revocable at will and may be absolute. This can speed administration but may raise accountability questions; practitioners should obtain and review written delegation instruments where decisions with commercial implications are made.

8. Historical references to older legislation (s20)

• s20 references the Local Government Act 1934, Irrigation Act 1994 and Land Tax Act 1936. These references may be obsolete or superseded by later statutes , the Act itself cautions that cross-references may be outdated. Practitioners must check current statutory instruments for up-to-date procedural details and for the actual records systems to be inspected.

9. Board members are ex officio inspectors under a separate Act (s27)

• While the Act confers inspector status via the Plant Health Act 2009, the powers that come with being an inspector are not restated here. A practical consequence is that enforcement action using inspection, seizure or biosecurity controls will be governed by the Plant Health Act’s terms as applied to Board members, which may be more expansive than what the Phylloxera Act spells out.

10. Contribution rule changes and transitional carryover (Schedule cl 5)

• The transitional provisions allow previously determined contributions under the repealed 1936 Act to continue until the Board makes a fresh determination (Schedule cl 5). Depending on governance timing, historical contribution formulas might persist for a period after the 1995 Act’s commencement or after later amendments.

11. Public accountability timelines that do not match financial year (s26)

• The Board’s report must be submitted to the Minister by 31 July for a financial year ending on 30 April. That is an unusual fiscal reporting window and may complicate audit or budgeting cycles for organisations used to a 30 June year end. Practitioners advising Boards or auditors must map these dates carefully to ensure timely reports and audits (s25-26).

12. Regulatory fine ceilings and the Governor’s power (s30(2))

• Regulations may prescribe an offence fine not exceeding Division 7. Because regulations can create fresh offences and penalties close to the Division 7 threshold, industry participants should monitor subordinate legislation as closely as primary statute for new obligations.

13. Potential future interaction with Biosecurity Act 2025 (Legislative history)

• The legislative history notes uncommenced Biosecurity Act 2025 provisions. If commenced, they may change the biosecurity framework in ways that affect the Board’s functions, inspector powers or disease-response mechanisms. Advisers should track commencement and transitional provisions.

These “gotchas” arise from the statute’s technical features: thresholds, data rules, funding collection methods and cross-references. Practitioners should combine statutory readings with checks of current subordinate legislation and Plant Health Act provisions to avoid surprises.

This section sets out a practical, section-specific compliance checklist for common actors: vineyard owners, winemakers/distillers, industry associations and Board members. It focuses on discrete duties, timelines and recordkeeping measures that flow from the Act text.

For vineyard owners (0.5 hectares or more)

• Determine applicability: measure planted vines to confirm whether the 0.5 hectare threshold in s19(1) is met. If near the threshold, treat any planting, extension or removal as potentially triggering statutory obligations (s21).

• Register and returns: Prepare to provide the particulars required by s19(2) in a return within three months of any of the events listed in s21 (transfer/acquisition, establishment, extension, or removal bringing the site to or from the 0.5 ha threshold). The particulars include name and address, vine location (Section Number, District and Hundred), varieties, area of each variety, age of vines, source of vines, and any other information the Board thinks fit.

• Accuracy and recordkeeping: Maintain documentary evidence for declared particulars, title and cadastral data, plant-source invoices, planting dates, variety identification records, and vine age evidence,to guard against s29 (false or misleading statements).

• Engage with register corrections: If the Board gives written notice of a proposed correction that would increase contributions (s22(2)), prepare submissions promptly as the Act requires at least one month’ notice. Use the submission window to dispute inaccuracies with primary documents.

• Monitor Gazette and Board notices: Contributions are set by Gazette notice using Minister-approved rules (s23(1)). Regularly check the South Australian Government Gazette and Board communications for contribution determinations, five year plan notices and public meeting dates (s18(2)).

• Financial planning: Budget for contributions and treat them as potentially being levied and collected as if land tax (s23(3)-(4)). Consider including an inquiry into outstanding contributions in due diligence for sales or refinancing, given the charge on land until paid.

For winemakers and distillers

• Monitor Gazette notices for contribution rules (s23(1)(b)-(c)): The Board can require contributions from winemakers and distillers; confirm whether your operation has been designated and budget accordingly.

• Records and confidentiality: If providing data about vine sources or purchasing, ensure accuracy and understand the Board’s confidentiality constraints when sharing third-party information (s13(3)).

For industry bodies and nominating organisations

• Nomination process compliance: When nominating candidates for Board appointment, provide written reasons to the Minister per s5(2) and ensure nominees meet s5(3) criteria (no more than one member per prescribed region, proven experience and commitment).

• Participate in regional committees: The Board must establish regional committees (s15). Industry bodies should engage with these committees to provide local intelligence and to influence Board planning within the framework set by s15 and s26(4) report sharing obligations.

For Board members and Board governance

• Observe quorum and meeting formalities: Ensure a quorum of five members is present for decisions (s8(1)) and that presiding member elections occur each July (s7(1)).

• Prepare and present the five year plan: Produce the five year plan within 12 months of commencement (or subsequently maintain annual revisions) and give public notice at least two weeks before the meeting both by posting on a Board-determined website or a State newspaper and by post to each registered person (s18(1)-(2)). Ensure the notice meets the statutory content requirements.

• Financial controls and audit: Keep proper accounts (s25(1)), cause annual audit by a registered company auditor or Auditor-General (s25(2)), and submit the annual report to the Minister by 31 July each year including the audited accounts and five year plan (s26(1)-(2)).

• Use delegations formally: Any delegation of powers must be in writing, may be absolute or conditional, and is revocable (s17(1)-(2)). Keep clear written delegation instruments and ensure those to whom functions are delegated understand limits and reporting obligations.

• Data handling and consent: Ensure mechanisms to obtain and record consent before disclosing identifiable data as constrained by s13(3). For aggregated or anonymised reporting, document methods to demonstrate non-identifiability.

For compliance with inspections and searches

• Be prepared for records checks: As the Board may inspect land title and local government records without payment (s20), maintain clear property and rate/tax records so that searches and extracts align with Board data and reduce risk of corrections that could trigger increased contributions.

• Coordinate with Plant Health Act inspectors: Recognise that Board members are inspectors under the Plant Health Act 2009 (s27). Clarify with the Chief Inspector the scope of inspection powers, notice requirements, and sample handling procedures in practice.

Practical operational checklist

• Create a calendar: Track the three-month return deadline for events affecting the 0.5 ha threshold, annual five year plan meeting notice periods (s18(2)), election of presiding member each July (s7(1)), and the 31 July deadline for the Board’s annual report to the Minister (s26(1)).

• Financial controls: Set aside reserves for contributions, verify any contribution notices in the Gazette promptly, and liaise with tax advisers about treatment and recovery methods if contributions are outstanding.

• Conveyancing diligence: Require a statement from vendors about outstanding contributions and check with the Commissioner of Land Tax or relevant body for encumbrance information where a property transfer is contemplated.

• Communications and consent forms: Prepare standard consent forms for disclosure of identifiable information to expedite requests where owners are willing to allow the Board to publish or share data.

• Records: Maintain detailed planting and procurement records, cadastral references (Section Number, District, Hundred), and receipts for vine sources to defend against corrections and to provide accurate returns.

• Legal review: Before responding to notices proposing register corrections or contribution increases, obtain legal advice promptly to assess grounds for challenge and to prepare submissions within the statutory one-month window (s22(2)).

Compliance under this Act is therefore a combination of timely information reporting, accurate recordkeeping, active participation in consultation processes, budgeting for levies collected as land tax, and attention to the cross-over with Plant Health Act enforcement mechanisms.
