58 Procedure of a panel (1) At a panel hearing— (a) the proceedings must be conducted with as little formality and technicality as the requirements of this Act and the proper consideration of the matter permit; (b) there is no right to legal representation at the panel hearing; (c) the licensee or registration holder is entitled to be present and to make submissions and to be accompanied by another person who may be a lawyer; (d) the panel is not bound by rules of evidence but may inform itself in any way it thinks fit; (e) the panel is bound by the rules of natural justice; (f) the proceeding must not be open to the public; (g) the procedure of the panel is otherwise in its discretion. S. 58(2) inserted by No. 13/2022 s. 51. (2) A panel may decide to conduct a panel hearing by means of audio visual link. S. 58(3) inserted by No. 13/2022 s. 51. (3) A licensee or registration holder is taken to be present at a panel hearing if the licensee or registration holder is physically present at the hearing or appears before the hearing by means of audio visual link. S. 58(4) inserted by No. 13/2022 s. 51. (4) If a licensee or registration holder appears before a panel hearing by means of audio visual link, any person accompanying the licensee or registration holder may attend the panel hearing by means of audio visual link.
