37 Eligibility to apply for a licence (1) A person is eligible to apply for a licence to carry on a pharmacy business if the person— (a) satisfies the requirements under section 5; and (b) is not prohibited from carrying on the pharmacy business under Division 2 of Part 2. (2) A person is eligible to apply for a licence to carry on a pharmacy department if the person is— (a) a registered funded agency; or (b) a registered community health centre; or (c) a private hospital or privately-operated hospital— within the meaning of the **Health Services Act 1988** that is acting in accordance with the provisions of the **Health Services Act 1988**.
