35 Use of title (1) Despite anything to the contrary under the Health Practitioner Regulation National Law, it is not an offence under that law for a person to use the name or title "pharmacist" in respect of a pharmacy business, where a person is licensed to carry on a pharmacy business, if the pharmacy services are provided by or under the supervision of a registered pharmacist. (2) A registered pharmacist who— (a) carries on a pharmacy business; and (b) does not personally provide pharmacy services from the pharmacy— is not to be treated for the purpose of the Health Practitioner Regulation National Law as practising as a pharmacist in respect of that pharmacy business.
