### 71KD Consideration of application for approval of alteration to pharmacy business premises > [*\[Section 71KD Inserted by No. 22 of 2016, s. 30, Applied:01 Jan 2017\]*](/view/html/inforce/2017-01-01/act-2016-022#GS30@EN) > > > (1)  The Authority, after considering an application for an approval under [section 71KB](#GS71KB@EN) , may – > > > > > > (a) grant the application subject to any conditions that the Authority thinks fit to impose; or > > > > > > > (b) refuse the application. > > > (2)  However, the Authority must not grant the application unless it is satisfied that, the pharmacy business premises, as proposed to be altered – > > > > > > (a) will be suitable to be used for the purposes of a pharmacy business; and > > > > > > > (b) will not be – > > > > > > > > > > (i) located wholly or partly within a supermarket; or > > > > > > > > > > > (ii) capable of being entered from within a supermarket; or > > > > > > > > > > > (iii) capable of being used to gain entry to a supermarket. > > > (3)  The matters that the Authority may have regard to for the purposes of [subsection (2)(a)](#GS71KD@Gs2@Hpa@EN) include the matters referred to in [section 71E(3)](#GS71E@Gs3@EN) .
