sec.128 How property may be dealt with
This section applies if, under section 127 , a thing becomes the property of the State. The council may deal with the thing as the council considers appropriate, including, for example, by destroying the thing or giving it away. The council must not deal with the thing in a way that could prejudice the outcome of an appeal against the decision to forfeit the thing under this division. If the council sells the thing, the council must, after deducting the costs of the sale, make reasonable efforts to return the proceeds of the sale to the person who owned the thing immediately before the thing became the property of the State. This section is subject to any disposal order made for the thing. s 128 amd 2025 No. 21 s 20 (sec.128-ssec.1) This section applies if, under section 127 , a thing becomes the property of the State.
