What it does
This instrument establishes a new Commonwealth special account, the Superannuation Clearing House Special Account 2020 (the special account), and sets the permissible credits and debits for that account. It is made by the Minister for Finance under subsections 78(1) and 78(3) of the Public Governance, Performance and Accountability Act 2013 (the Act) (s3). The instrument names itself (s1) and ties its commencement to the day specified in paragraph 79(5)(a) of the Act (s2). It designates the Commissioner of Taxation as the accountable authority responsible for the special account (s6).
Mechanically, the determination does four discrete things:
- Establishes the special account for the Superannuation Clearing House (s5).
- Specifies what may be credited to the account , namely, amounts received by the Superannuation Clearing House from any person, including employers (s7).
- Specifies the authorised purposes for which amounts may be debited from the account, in particular payments to superannuation funds, retirement savings accounts and superannuation schemes on behalf of small business employers, repayments to original payers, reductions of the account balance without making a real or notional payment, and repayments where required or permitted by court order, Act or other law (s8).
- Revokes the prior Financial Management and Accountability Determination 2010/05 - Superannuation Clearing House Special Account Establishment 2010 (the SBSCH determination), and transfers the opening balance of the previous SBSCH special account into the new special account immediately on establishment (s9-s10).
The instrument defines its key terms (s4). The Superannuation Clearing House is expressed to mean the Australian Taxation Office in its capacity as an approved clearing house under the Superannuation Guarantee (Administration) Act 1992 (s4). The opening balance of the new account is equal to the amount standing to the credit of the SBSCH special account immediately prior to commencement and must be credited immediately after establishment (s9(1)-(2)). The instrument revokes the SBSCH determination (s10) and contains transitional repeal provisions that remove certain definitions after a seven day period while preserving the effects of Part 3 (s11).
In short, the instrument creates a PGPA special account administered by the Commissioner of Taxation, provides the legal basis for the ATO (in its clearing-house role) to credit amounts it receives to that account, specifies four classes of debitable purposes for those funds, transfers the existing balance from the 2010 special account, and revokes the older determination that created the former account.
The instrument does not include operational procedures, reporting obligations or penalties within its text. It confines itself to establishment, permitted credits and debits, the accountable authority designation, an immediate opening-balance transfer and revocation of the prior establishment instrument (ss1-11). All quotations and operative permissions below are taken from the instrument’s provisions as cited.
