PGPA Act Determination (Sport and Recreation Special Account 2016) — Establishment

The central concept is a “special account” as defined in the PGPA Act. Unlike ordinary annual appropriations, a special account is a continuing appropriation from the Consolidated Revenue Fund up to the balance of the account at the time of payment (s 7 note 1). It is established by legislative instrument under s 78(1), which must specify the name, the amounts that may be credited, the purposes for which amounts may be debited, and the accountable authority responsible. The account is not a separate bank account in the legal sense; it is a notional ledger within the government’s financial system. The purpose of a special account is to allow money received for a particular function, or appropriated under a specific item, to be quarantined for that function without requiring a fresh appropriation each year. This gives the administering department flexibility to spend in response to changing circumstances, but also reduces parliamentary control over the timing and quantum of outlays. The Sport and Recreation Special Account 2016 is specifically tied to the Meeting of Sport and Recreation Ministers - a forum of Commonwealth, state and territory ministers. The purposes refer to “agreed activities of common interest” considered by those Ministers to benefit all or a majority of members (s 7(a)). This intergovernmental element means the account is a conduit for joint federal-state funding of sport and recreation projects; it is not a program where the Commonwealth acts unilaterally. The definition of “incidental activities” is not expanded in the instrument, which confers broad discretion on the accountable authority to interpret what is incidental - potentially covering administration, research, or minor associated costs. The ability to debit amounts to “reduce the balance of the special account” without making a real or notional payment (s 7(c)) is a housekeeping mechanism to allow the account to be wound down or adjusted for accounting corrections, but it also provides a tool to return unused appropriations to the CRF without a formal repayment. The transitional provision (Part 2) is a short variation to the 2006 determination, allowing credits from the old account to the new one. That old determination was made under the now-repealed Financial Management and Accountability Act 1997; the transitional arrangement ensures continuity without a gap in legal authority for holding and moving funds. The instrument does not impose any sunset or review clause - the account continues indefinitely unless repealed or varied by a later determination.

The primary entity affected is the Department of Infrastructure, Transport, Regional Development, Communications, Sport and the Arts (the department), whose Secretary is the accountable authority responsible for managing the account. The department must ensure that all credits and debits comply with the determination and the PGPA Act. The accountable authority has duties under the PGPA Act (such as the duty to promote proper use of Commonwealth resources - s 15, not in this instrument but relevant) and must prepare annual reports and maintain records. The second group affected is the Meeting of Sport and Recreation Ministers and its successor or subordinate bodies. The purposes of the account are expressly tied to projects and activities agreed by those Ministers. That means the account effectively funds outcomes that state and territory ministers collectively endorse, giving them a significant role in shaping how the money is spent. This intergovernmental dynamic can produce both coordination benefits and strategic bargaining costs. Private sector organisations - including sport clubs, recreation providers, event organisers, facility developers, and related businesses - are indirect beneficiaries: they may receive grants or payments out of the account for sport and recreation projects. However, the determination does not create any right to payment; any funding is at the discretion of the department and the ministers. This creates an incentive for rent-seeking: organisations will invest resources in lobbying ministers and officials to have their projects listed as “agreed activities”. Because the account is a standing appropriation, the opportunity cost of spending is less visible than annual budget line items, which may encourage higher spending than would occur under annual appropriations. Taxpayers fund the account - both from general revenue appropriations (which may be credited via appropriation Acts) and from amounts received from any person (s 6(b)), which could include private donations. That mixing of public and private money raises questions about purpose: once private funds are credited to the special account, they become Commonwealth money and must be spent only for the account’s statutory purposes. Donors lose control over the use of their contributions. The transitional Part 2 affects only the old account’s management; the variation to the 2006 determination ensures that the old account’s balance can be moved to the new account. The end result is a concentration of financial power in the department and the ministerial council, with relatively diffuse benefits spread across sporting bodies and local communities, but with concentrated costs on taxpayers (who lack direct input into prioritisation).

The instrument imposes no duties on private persons; it is a machinery-of-government determination. The key duty falls on the accountable authority - the Secretary of the relevant department - to administer the special account in accordance with the PGPA Act and this determination. That duty includes ensuring that only amounts allowed by s 6 are credited, and that debits are only made for one of the four purposes in s 7. The accountable authority must also ensure that each debit is within the available balance, because s 78(4) of the PGPA Act appropriates money only up to the balance at the time of payment. Overdrawing would be unlawful. The accountable authority has the right to credit amounts received in the course of performing functions relating to the purposes (s 6(a)), to receive amounts from any person for the account (s 6(b)), and to transfer money from the predecessor account (s 6(c)). There is a right to debit for incidental activities (s 7(b)) - but the instrument provides no definition of “incidental”. The notes to s 7 indicate that incidental activities include administration of the account and direct and indirect costs in relation to administering it. This gives a broad discretion: essentially any cost reasonably related to managing the account or the projects could be classified as incidental. The right to reduce the balance without a real payment (s 7(c)) is a book-entry power that can be used to return unspent appropriations or correct accounting errors. The right to repay amounts incorrectly credited (s 7(d)) is subject to a note that legal advice should be obtained before debiting on the basis of a mistake of fact or law - a procedural safeguard. The Meeting of Sport and Recreation Ministers has a non-statutory role: they determine which projects and activities are “agreed activities of common interest” that benefit all or a majority of members. The determination does not give them a formal right to direct the accountable authority, but in practice the department would only spend for projects that those ministers have agreed upon. Other persons - such as sporting bodies - have no enforceable rights under this instrument. They may apply for funding, but the determination does not create a grants scheme or entitlements. Any payment is a gratuitous transfer, subject to the usual government procurement and grants administration rules. The absence of private rights reinforces the executive’s discretion and limits accountability to administrative law remedies (judicial review for improper purpose or unreasonableness).

This determination itself does not create any criminal offences, civil penalties, or infringement notices. Penalties for misuse of the special account arise under the PGPA Act. For example, a person who dishonestly causes a loss of Commonwealth public money (including by debiting for an improper purpose) could be prosecuted under the Criminal Code for fraud (Division 135). The PGPA Act also contains civil penalty provisions for breaches of duties of accountable authorities and officials (e.g., s 15 - duty to promote proper use of resources; s 16 - duty of care and diligence). A contravention could lead to civil proceedings for a declaration or order (such as compensation or injunctions) under ss 65-66 of the PGPA Act. The Public Governance, Performance and Accountability Rule 2014 sets out further governance requirements. If the accountable authority debited an amount for a purpose not in s 7, that debit would be ultra vires and the authority could be personally liable to repay the Commonwealth. The Auditor-General has powers to audit the account under the Auditor-General Act 1997. The determination’s provision for repaying incorrectly credited amounts (s 7(d)) contemplates that errors can occur and provides a legal basis to reverse them; but if a debit was made in excess of authority, the person who authorised it could be subject to disciplinary action or criminal prosecution. The note in s 7 requiring legal advice before debiting on the basis of mistake indicates a cautious approach, but it is not a statutory obligation; failure to obtain advice would not itself be a penalty, but could expose the decision to challenge. Because the instrument creates no private rights, there is no private right of action to enforce it. Enforcement is entirely by Commonwealth bodies: the department, the Australian Federal Police, the Commonwealth Director of Public Prosecutions, and the Auditor-General. The lack of explicit penalties in the determination does not mean compliance costs are low; the PGPA Act regime imposes significant record-keeping, reporting, and audit obligations that carry indirect costs. For departmental officials, the practical penalty for non-compliance can be loss of employment, reputational damage, or personal financial liability.

The determination is made under and subject to the PGPA Act. That Act provides the overarching governance framework for Commonwealth resources, including the definition and creation of special accounts (s 78). The PGPA Rule (Public Governance, Performance and Accountability Rule 2014) is a legislative instrument that supplements the Act. The notes to s 6 of the determination cross-reference paragraph 74(1)(b) of the PGPA Act and subsection 27(5) of the PGPA Rule, which deal with the crediting of repayments of amounts previously debited from an account. The Appropriation Acts (annual or special) may authorise amounts to be credited to the special account. Note 1 to s 6 states that if any of the purposes of the special account are covered by an appropriation item, amounts may be debited against that appropriation and credited to the account. This means that money appropriated by Parliament for sport and recreation can be parked in the account and spent under the account’s standing appropriation. The determination is also a legislative instrument under the Legislation Act 2003, which governs its registration, compilation, and presentational changes. The transitional Part 2 varies the earlier Financial Management and Accountability Determination 2006/20, which was made under the now-repealed Financial Management and Accountability Act 1997. Because the old Act is repealed, the old determination continues in force under transitional provisions of the PGPA Act (see s 88 of the PGPA Act). The variation ensures that the old account’s balance can be lawfully transferred to the new account. The instrument does not interact with state laws directly; it is a Commonwealth instrument. However, because the purposes refer to the Meeting of Sport and Recreation Ministers - a body composed of state and territory ministers - the account effectively implements intergovernmental agreements. Those agreements themselves are not incorporated into the determination, so the legal effect relies on political consensus rather than statutory compulsion. The Competition and Consumer Act 2010 may be relevant if the account is used to fund grants that affect competition among sport or recreation providers, but the determination does not create any exemption. The Privacy Act 1988 applies to any personal information handled in administering the account. The interaction with the Fair Work Act 2009 could arise if the account funds employment-related projects. Overall, the determination is a small cog in a larger statutory machine; its direct interaction with other laws is limited but significant because it unlocks a standing appropriation that bypasses annual budget controls.

The instrument was originally made on 26 August 2016 and registered as F2016L01334, commencing on 15 September 2016. It has been amended once, by the PGPA Act Determination (Sport and Recreation Special Account Amendment 2025), registered on 15 July 2025 as F2025L00851. That amendment commenced on 1 September 2025. The amendment changed section 8, which specifies the accountable authority. Before amendment, the accountable authority was likely the Secretary of the Department of Infrastructure and Regional Development (based on the machinery-of-government changes at the time). The 2025 amendment substituted the current Secretary of the Department of Infrastructure, Transport, Regional Development, Communications, Sport and the Arts. This reflects the administrative reorganisation that merged the sport and arts functions into a single portfolio. No other provisions have been amended. Section 2 was repealed as a result of an editorial change under Legislation Act s 48D (the provision dealing with commencement may have become redundant). The amendment history table shows that section 2 was repealed by LA s 48D - a provision that allows the first parliamentary counsel to omit unnecessary commencement provisions in compilations. The instrument’s transitional Part 2 was not amended. There is no evidence of any other amendments, such as changes to the purposes or crediting provisions. The lack of substantive amendment suggests the account has operated as intended for nearly a decade. However, the determination is a legislative instrument that can be varied at any time by the minister responsible under s 78(1) (the Finance Minister, or a delegate). Given the change of government in 2022 and subsequent portfolio adjustments, the 2025 amendment is a routine update. No application, saving or transitional provisions accompanied the amendment (the endnotes list none). This means the change of accountable authority takes effect on commencement without any transitional period. From a compliance perspective, the department would have had to update its internal delegations and authorisations by 1 September 2025.

The compilation includes no litigation history. There are no cases mentioned in the endnotes or provisions, and no reported decisions on this specific determination are known. This is consistent with the nature of the instrument: it is machinery that sets up an internal government account. Challenges to special account determinations are rare because they do not directly affect private rights. A private party seeking funding from the account could challenge a refusal on administrative law grounds under the Administrative Decisions (Judicial Review) Act 1977, but the decision to grant (or not grant) a payment is not a decision under this determination; it would be a decision under the PGPA Act or the general executive power. The determination itself merely defines the permissible purposes; it does not commit the department to spend. A challenge to the validity of a debit (e.g., if the spending is beyond purpose) could be brought by a rival minister or perhaps by a taxpayer with standing (though Australian law limits taxpayer standing). The absence of litigation does not mean the account is uncontroversial; it may mean the amounts involved are too small to warrant legal challenge, or that disputes are resolved within government. The intergovernmental nature of the account - requiring consensus of ministers - reduces the likelihood of internal grievances escalating to court. For a deep dive, we can note that special account determinations under the PGPA Act are typically not litigated; the few cases that exist involve broader questions of executive power and appropriations (e.g., Wilkie v Commonwealth (2017) 91 ALJR 883, but that case is not cited in this instrument and we must not name it unless the source does). Therefore, we report: none recorded in the compilation. Readers should expect no directly relevant case law.

Several features of this determination create risks for those who rely on it or administer it. First, the purposes in s 7 are drafted broadly. Paragraph 7(b) allows debits for “incidental activities”. The notes say this includes administration costs and direct and indirect costs in relation to administering the special account. The term “incidental” is not defined and could be stretched to cover activities only tangentially connected to sport and recreation - such as corporate overhead, travel, or even entertainment. The accountable authority has wide discretion, but if a debit is challenged, a court might construe “incidental” narrowly. The note is not part of the operative provision and does not bind a court. Second, paragraph 7(a) ties the primary spending purpose to projects and activities considered by the Meeting of Sport and Recreation Ministers to benefit all or a majority of members. This means that a project that benefits only one state or territory cannot be funded from the account, even if that state is willing to contribute. The requirement for consensus or majority agreement among ministers creates a collective action problem: states may logroll or block funding for rival projects, leading to suboptimal allocation. For private organisations seeking funding, the path to success is not just a good proposal but also political negotiation at the ministerial level - a high compliance burden in time and effort. Third, the ability to debit to “reduce the balance of the special account … without making a real or notional payment” (s 7(c)) is a power to cancel appropriation. This could be used to hide unspent funds or to adjust the balance for budgetary window-dressing. It provides no transparency to the public about why balances are reduced. Fourth, the transitional provision (Part 2) only varies the 2006 determination to add a credit purpose; it does not repeal or wind up the old account. That means two accounts may exist concurrently - the old one (with the same name) and the new one. The variation allows amounts to be transferred, but if the old account is not closed, there could be confusion about which account holds which funds. Fifth, the credit category “amounts received from any person for the purposes of this special account” (s 6(b)) could include donations from corporate sponsors or individuals. Once credited, those funds lose their private character and become Commonwealth money; the donor cannot direct its use. The department must apply those funds only for the statutory purposes, which may be broader than the donor intended. This may deter private contributions if donors fear their money will be redirected to general administrative costs or other ministers’ priorities. Sixth, the determination contains no sunset or review clause, meaning the account will continue indefinitely unless a future government revokes or amends it. That creates inertia and potentially locks in spending priorities long after they cease to be optimal. Seventh, the accountable authority is the Secretary of a large department, but the decision to spend may be delegated to lower officials. The PGPA Act requires proper use of resources, but the determination provides little guidance on how to weigh competing proposals; the risk of misallocation is high.

Compliance with this determination is primarily the responsibility of the Department of Infrastructure, Transport, Regional Development, Communications, Sport and the Arts, and specifically the accountable authority, the Secretary. The steps that must be taken are grounded in the PGPA Act and this instrument. First, the department must ensure that any amount credited to the account falls within one of the three categories in s 6. In practice, most credits will come from appropriation Acts (s 6 note 1), which must specify that the appropriation is for an item that covers purposes of the special account. The department should maintain a register of appropriations linked to the account. Second, each debit must be authorised in accordance with a delegation under the PGPA Act and be for one of the four purposes in s 7. The department should have clear internal policies for determining whether a proposed expenditure is for a “sport and recreation-related project” or an “agreed activity of common interest”. Because the purpose requires the project to be considered by the Meeting of Sport and Recreation Ministers, the department must ensure that the relevant ministers have formally agreed - ideally in a communiqué or minutes. The department should seek and retain documentary evidence of that agreement. For debits for incidental activities, the department should document the connection between the activity and the account’s administration, and ensure the amount is reasonable in proportion to the account’s overall size. Third, debits to reduce the balance (s 7(c)) should be used sparingly and only for genuine accounting purposes - such as closing the account or returning surplus appropriations. The department should record the reason for each such debit in its financial systems. Fourth, if a debit is needed to correct a mistaken credit (s 7(d)), the accountable authority should obtain legal advice before proceeding, as the note recommends. That advice should confirm that a mistake of fact or law has occurred and that no other legal basis for repayment exists. Fifth, the department must comply with the PGPA Rule, including annual reporting requirements that may require disclosure of special account balances and transactions. The department should also ensure that any money transferred from the old 2006 account is properly credited under s 6(c) and that the old account’s balance is reduced accordingly. For private entities that wish to obtain funding from the account, there is no formal “compliance” process under this determination, but they should engage with the department and with state and territory sport ministers to get projects included on the list of agreed activities. They should also be aware that the account is not a grant program with published criteria; success depends on political alignment. There is no right to internal review or merits review; any challenge would be by judicial review, which is costly and uncertain. In sum, the compliance burden for the department is moderate - requiring careful record-keeping, ministerial liaison, and legal guardrails - while for external parties, the regime is opaque and discretionary.
