PGPA Act Determination (Social Services SOETM Special Account 2021)

The instrument rests on a small set of concepts and mechanisms that determine its legal and fiscal function. Those concepts appear in the definitions at section 4 and in the operative provisions in Parts 1-3.

• Special account: The instrument establishes, by explicit declaration, the Social Services SOETM Special Account 2021 as a special account for the purposes of paragraph 78(1)(a) of the Act (s 5). The instrument therefore creates a distinct appropriation vehicle within Commonwealth financial management, described and operated by the terms of the instrument.

• Accountable authority: The instrument assigns responsibility for the special account to the Secretary of the Department of Social Services for purposes of paragraph 78(1)(d) of the Act (s 6). The instrument therefore identifies who is accountable in respect of the account’s management.

• Sources of credit (receipts): The instrument identifies three categories of amounts that may be credited to the special account for purposes of paragraph 78(1)(b) of the Act (s 7). Those categories are:

  1. amounts held on trust, or otherwise on behalf of or for the benefit of a person other than the Commonwealth;
  2. amounts received in the course of performing functions that relate to one or more purposes of the special account;
  3. amounts received from any person for one or more purposes of the special account.

  The first category signals that trust moneys held for non-Commonwealth beneficiaries may be placed in the account. The second and third categories capture receipts that arise from services or transactions linked to the account’s purposes, including payments from third parties.

• Permitted debits (purposes): The instrument lists the permitted purposes for which amounts may be debited from the special account under paragraph 78(1)(c) of the Act (s 8). Those are six discrete types:

  1. disbursing an amount held on trust or otherwise for the benefit of a person other than the Commonwealth;
  2. disbursing an amount in connection with services performed for, on behalf of or together with another Commonwealth entity, Commonwealth company, another government, organisation, body or person;
  3. disbursing an amount in connection with joint activities performed for, on behalf of, or together with, another Commonwealth entity, Commonwealth company, another government, organisation, body or person;
  4. disbursing an amount in connection with an agreement between the Commonwealth and another government;
  5. repaying an amount where a court order, Act or other law requires or permits repayment of an amount received;
  6. reducing the balance of the special account (and therefore the available appropriation) without making a real or notional payment.

  These purposes establish the authorised uses of funds held in the account and, in particular, permit movements of funds that reflect trust obligations, inter-entity service arrangements and government-to-government agreements, as well as statutory or judicial repayments.

• Transitional transfer / opening balance: The instrument requires that, immediately after establishment, the opening balance equal the amount standing to the credit of the prior SOETM special account immediately prior to commencement (s 9(1)-(2)). The instrument therefore provides for a one-off balance transfer into the new account.

• Revocation and repeal sequencing: The instrument expressly revokes the prior SOETM instrument (s 10). It then provides that Part 3 of this instrument (which contains the opening balance transfer and revocation) is to be repealed at the end of the seventh day after the revocation of the prior instrument, and that two definitions in section 4 will be repealed on that date (s 11(1)-(2)). Notably, however, subsection 11(3) preserves the effects of Part 3 notwithstanding that the Part is repealed.

• Commencement linkage: The commencement clause ties commencement of the instrument to paragraph 79(5)(a) of the Act (s 2(1)). The instrument records that the whole of the instrument commences on the day mentioned in that paragraph. Column 3 of the commencement table is expressly not part of the instrument (s 2(2)).

Taken together, these concepts produce a discrete financial vehicle for holding and disbursing funds that originate from trust relationships, service delivery activities, or payments from third parties, and that are used for trust disbursements, inter-entity services and joint activities, repayments required by law, and a non-payment reduction mechanism that adjusts appropriation availability. The accountable authority for that vehicle is the Secretary of the Department.

This instrument affects a limited and identifiable set of actors, identified explicitly in its operative text.

• The Department of Social Services and its Secretary: The instrument names the Secretary of the Department as the accountable authority responsible for the special account (s 6). That assigns operational responsibility for the account to the Department. As the named accountable authority, the Department will be the entity required to ensure the account is administered in accordance with the instrument and the Act.

• Holders and beneficiaries of trust moneys: The special account may be credited with amounts held on trust, or otherwise on behalf of or for the benefit of, a person other than the Commonwealth (s 7, first category). That means persons who are beneficiaries of trust arrangements that the Department administers will be affected because funds attributable to them may be recorded in and disbursed from the special account (s 8(1)).

• Payors and third parties who make payments to the Department: The instrument authorises credits that arise from amounts received in the course of performing functions that relate to the account’s purposes and from amounts received from any person for those purposes (s 7(b)-(c)). The legal phrase “any person” is used in the instrument. Consequently, private individuals, businesses, other governments, organisations, bodies or entities that provide funds to the Department for the specified purposes may have those amounts credited to this special account.

• Other Commonwealth entities and Commonwealth companies: The permitted debits include disbursements connected to services performed for, on behalf of or together with another Commonwealth entity or a Commonwealth company (s 8(2)-(3)). Those entities are potential recipients of disbursements from the account when joint activities or service arrangements are in place.

• Other governments, organisations, bodies and persons: The instrument expressly lists other governments, organisations, bodies or persons in its permitted debit purposes for services and joint activities (s 8(2)-(3)) and for agreements between the Commonwealth and another government (s 8(4)). Thus, foreign governments or state/territory governments, non-government organisations, community organisations and private parties who enter into agreements or joint activities with the Commonwealth may be paid from this account, where the payments fall within the listed purposes.

• Entities and stakeholders connected to the prior SOETM special account: The instrument revokes the prior SOETM instrument and requires the opening balance to equal the amount standing to the credit of the prior account immediately before commencement (s 9(1)-(2), s 10). That means any party with an interest in funds previously held in the prior SOETM special account will see those funds transferred into the new account on establishment.

• The Minister for Finance: The instrument is made by the Minister for Finance and bears his signature (cover sheet). The Minister is the legal actor who exercises the making power under the Act in respect of special account determinations.

Who does not appear in the instrument: The instrument does not mention other specific Commonwealth departments aside from the Department of Social Services, does not specify third party contracting arrangements or procedural rules for the account’s operation, and does not name specific beneficiaries, contractors or partners. It also does not set out reporting, auditing or compliance steps; it identifies only the accountable authority and the classes of permissible credits and debits.

In short, the primary obligations and discretion created by this instrument fall on the Department of Social Services as the named accountable authority, and the instrument will apply to persons and bodies that deliver funds to, or receive disbursements from, the special account under the defined categories.

The instrument confers a small set of legal duties and rights, expressed mainly through the establishment of the special account, the naming of an accountable authority and the delineation of permitted receipts and disbursements.

Key duties and responsibilities:

• Establishment duty: The instrument itself establishes the special account (s 5). That establishment creates a legal appropriation vehicle to be managed within Commonwealth financial arrangements. The duty implicit in that establishment is for the designated accountable authority to manage the account in accordance with the instrument and the Act; the instrument expressly identifies the accountable authority as the Secretary of the Department (s 6).

• Accountable authority responsibility: Section 6 states that, for the purposes of paragraph 78(1)(d) of the Act, the accountable authority responsible for the special account is the Secretary of the Department. That gives the Secretary the formal role the Act contemplates for an accountable authority in relation to a special account. The instrument does not specify procedural duties or powers beyond that identification; it delegates those regime-level obligations to the statutory framework in the Act via the cross-reference.

• Receipt handling: The instrument permits specified classes of amounts to be credited to the account (s 7). The Department therefore has the responsibility to ensure that amounts falling into the listed categories are credited appropriately. In particular, amounts held on trust or otherwise for the benefit of persons other than the Commonwealth may be credited, which imposes a fiduciary or custodial function in practice, albeit the instrument does not specify trust-administration rules beyond permitting the credit (s 7 first category, and s 8(1) regarding disbursement).

• Disbursement authority and constraints: The instrument lists the purposes for which amounts may be debited (s 8), creating the legal entitlement to debit the account only for those purposes. The Department is therefore authorised to make disbursements in circumstances listed at s 8(1)-(6). The instrument thereby restricts the Department’s right to use the account to those enumerated purposes.

• Opening balance transfer: Section 9 creates an obligation to credit the opening balance equal to the amount standing to the credit of the prior SOETM special account immediately prior to commencement. That is an immediate operational duty upon establishment.

• Revocation and repeal sequencing obligations: Section 10 revokes the prior SOETM instrument; section 11 sets time-limited repeal steps for Part 3 and the scheduled deletion of two definitions. The Department must implement those revocation and repeal steps in line with the instrument’s timing.

Key rights or entitlements created or preserved:

• Right to hold trust moneys: By permitting amounts held on trust or otherwise on behalf of persons other than the Commonwealth to be credited to the account (s 7 first category), the instrument establishes the right for the Department to receive and hold such moneys within this particular special account, and to disburse them (s 8(1)).

• Right to receive payments from third parties: The instrument authorises credits for amounts received from any person for the account’s purposes (s 7(c)), so the Department and the special account are legally able to accept payments from private and public third parties for those purposes.

• Right to effect non-payment appropriation reductions: Section 8(6) authorises debiting the account to reduce its balance and the available appropriation without making a real or notional payment. That creates a specific administrative right for the Department to adjust appropriation availability through such debits, subject to the instrument’s terms.

Constraints and limits:

• Purpose limitation: The list of permitted debits in section 8 limits the ways in which the special account’s funds can be used. Debits must be for one or more of the listed purposes. The instrument does not permit the account to be used for purposes outside that list.

• Definition scope: The instrument’s section 4 contains definitions that frame how key expressions in the instrument are to be read. Two of those definitions are scheduled for repeal as part of the transitional structure, which may constrain reliance on those defined terms after the specified repeal date (s 11(2)). The instrument mitigates that by preserving the effects of Part 3 despite the repeal (s 11(3)).

What the instrument does not do (and therefore what duties/rights it does not create):

• The instrument does not, on its face, create or vary contractual rights or obligations between the Department and third parties except to the extent that payments may be credited to or debited from the special account for specified purposes. It does not set out payment procedures, reporting obligations, approval thresholds, audit regimes or detailed fiduciary rules. Those operational duties will arise from other parts of the statutory framework and internal Departmental procedures, but they are not set out in the instrument.

In sum, the instrument gives the Department the legal authority to receive, hold and disburse specified types of funds in a defined special account, places responsibility on the Secretary as the accountable authority, and confines uses of the account to a listed set of purposes. It also mandates a transitional balance transfer and revokes an earlier instrument.

The instrument itself contains no bespoke penalty clauses, offence provisions or internal enforcement mechanisms. The text does not create civil penalties, criminal offences, administrative fines or express enforcement procedures within its own provisions. Instead, the instrument operates by establishing a special account, naming an accountable authority and limiting permitted receipts and payments; enforcement of compliance with those constraints will therefore be through the wider statutory and administrative framework indicated by the instrument’s repeated cross-references to the Act.

Key points from the instrument itself:

• No standalone penalty provisions: There is no section in the instrument that prescribes penalties, fines or sanctions for failure to comply with the instrument’s requirements. The instrument confines itself to establishing the account, specifying allowable credits and debits, naming the accountable authority and providing transitional and revocation mechanics (Parts 1-3).

• Reliance on the Act: The instrument is made under subsections 78(1) and 78(3) of the Act (s 3), and many operative paragraphs are described as being “for paragraph 78(1)(a)” or similar. The instrument therefore situates its legitimacy and the enforceability of its terms within the Act’s governance framework. Although the instrument does not reproduce the Act’s enforcement provisions, its cross-references imply that compliance and remedies for non-compliance will be governed by the Act and associated financial management law and procedures.

• Accountable authority role: By naming the Secretary of the Department as the accountable authority (s 6), the instrument places responsibility for lawful administration with that office. The Act’s accountability apparatus (not reproduced in this instrument) ordinarily establishes ministers’ and officials’ duties and the consequences of failing to meet them. The instrument, however, does not itself articulate what internal enforcement steps the Secretary must take or what external oversight body has enforcement powers.

• Practical enforcement levers implicit in the instrument: The account’s permitted uses are enumerated (s 8). Administrative controls that enforce those limits will be internal to the Department and derived from the Act’s framework. For example, restricting debits to the specified purposes creates a legal boundary; departures from it would be an unauthorised use of the appropriation. The instrument does not provide a mechanism for third parties to challenge debits or credits; any such remedies would arise from other law.

• Transitional repeal caveat: The instrument revokes the prior SOETM instrument (s 10) and provides for repeal of Part 3 and certain definitions after a seven day period following revocation (s 11). Section 11(3) expressly provides that the effects of Part 3 remain in force after the date of repeal. This sequencing may affect how enforcement of transitional obligations is framed in practice; the instrument confirms that the legal effects of the transfer and revocation persist even if the textual Part is removed.

What must be done in practice to ensure enforceability:

• Departmental procedures and financial controls will be the immediate enforcement mechanism to ensure that only permitted amounts are credited and that debits are only for listed purposes. The instrument does not set out those controls but its structure necessarily requires their operation.

• Oversight and audit functions, which commonly exist under the Act (but are not set out in this instrument), will be the external enforcement avenues to ensure compliance with the instrument’s constraints.

Summary: The instrument does not itself impose penalties or an enforcement regime. It establishes legal boundaries for the receipt and use of funds and assigns accountability to the Secretary. Enforcement and penalties, if any, are therefore to be sought in the parent statutory framework and administrative systems referenced by the instrument rather than within the instrument itself.

The instrument is explicitly framed as an exercise of power under the Public Governance, Performance and Accountability Act 2013 (the Act) and repeatedly aligns its provisions with specified paragraphs and subsections of that Act. The instrument therefore interacts with the Act in the following concrete ways set out in its text.

Direct statutory linkage:

• Made under the Act: The instrument states it is made under subsections 78(1) and 78(3) of the Act (s 3). Each operative clause is repeatedly prefaced with “For paragraph 78(1)(...) of the Act” or “For subsection 78(3) of the Act”, indicating the instrument’s content is designed to satisfy the requirements of those parts of the Act (see ss 5-11). The instrument’s legal effect is therefore bound to, and operates only within, the powers and limits conferred by the Act.

• Commencement linked to the Act: The instrument’s commencement is tied to paragraph 79(5)(a) of the Act (s 2(1)). The instrument records that the whole instrument commences on the day mentioned in that paragraph. This means the timing of the instrument’s legal operation depends on the Act’s commencement mechanics.

Interaction with the prior SOETM instrument:

• Revocation of prior instrument: The instrument expressly revokes the Financial Management and Accountability Determination 2010/14 - Services for Other Entities and Trust Moneys - Department of Families, Housing, Community Services and Indigenous Affairs Special Account Establishment 2010 (referred to in the instrument as the SOETM instrument) (s 10). The revocation transfers the statutory authorisation from the prior instrument to this new determination.

• Transitional carry-over: The instrument requires the opening balance of the new special account to be equal to the amount standing to the credit of the prior SOETM special account immediately prior to commencement (s 9(1)-(2)). This is an expressly transitional interaction intended to preserve balances across the change in instruments.

Definitions and their scheduled repeal:

• Definitions in section 4 include “Act”, “Department”, “SOETM”, “SOETM special account”, and “SOETM instrument”. Those definitions tie this instrument to the prior instrument (by naming it) and to the Department. Section 11 schedules the repeal of the definitions of “SOETM instrument” and “SOETM special account” on the date Part 3 is repealed, while preserving the effects of Part 3 (s 11(1)-(3)). That creates a temporal interaction with earlier law and the instrument’s own definitions.

Implicit interactions (as signalled by the instrument’s structure):

• Operation within PGPA financial management architecture: By establishing a special account and naming an accountable authority, the instrument situates itself within the PGPA regime’s financial management architecture. The instrument does not reproduce the PGPA Act’s requirements for reporting, audit, procurement, or ministerial direction, but it is explicitly designed to work in tandem with that regime. Therefore, compliance with the instrument’s limits on credits and debits must operate alongside the broader obligations imposed by the Act.

• Court orders, Acts and other laws: One of the debitable purposes in s 8(5) is repayment where a court order, Act or other law requires or permits repayment. That acknowledges that the special account interacts with judicial orders and other statutes that may impose repayment obligations. The instrument does not define the mechanisms by which such repayments are to be identified or processed, but it expressly permits the account to be debited for that purpose.

Limits on cross-instrument effects:

• The instrument revokes the prior SOETM instrument but does not purport to alter substantive rights or obligations created under other statutory instruments or contracts except as necessary to move balances and the legal basis for the account into the new determination. The instrument does not purport to settle disputes about contractual rights or liabilities arising from the prior instrument; it merely provides an appropriation vehicle and transitional transfer.

• The instrument does not expressly modify other Acts, nor does it purport to displace other laws governing trusts, contract performance, procurement, taxation or criminal liability. It does, however, create a narrowly defined appropriation vehicle within which money may be held and used consistent with the purposes listed.

Practical consequence:

• Administratively, the Department must manage the special account in compliance with both the instrument and the Act. Transactions that relate to courts or other statutes are accommodated via s 8(5). The instrument’s repeal and revocation mechanics create a straightforward rollover from the prior instrument to the new determination, preserving prior balances, subject to the timing rules the instrument sets out.

In summary, the instrument interacts directly and exclusively with the PGPA Act and the prior SOETM instrument as documented in the text. It establishes a special account that will function within the wider PGPA statutory framework and accepts that repayments mandated by court orders or other laws can be made from the account.

The instrument contains its own internal history statements and transitional steps and records a discrete change relative to the prior SOETM instrument. All amendment history and sequencing that appears in the instrument is contained in the following operative statements.

• Date and maker: The instrument is dated 3 February 2021 and is signed by Simon Birmingham, Minister for Finance (cover sheet).

• Authority for the instrument: The instrument is made under subsections 78(1) and 78(3) of the Public Governance, Performance and Accountability Act 2013 (s 3). Those subsections are repeatedly cited as the statutory basis for each operative provision.

• Revocation of previous instrument: Section 10 expressly revokes the Financial Management and Accountability Determination 2010/14 - Services for Other Entities and Trust Moneys - Department of Families, Housing, Community Services and Indigenous Affairs Special Account Establishment 2010, referred to as the SOETM instrument in this determination. The revocation is the central replacement event: the new determination supplants the prior establishment instrument.

• Transitional opening balance: Section 9 requires that immediately after the new special account’s establishment, the opening balance must equal the amount standing to the credit of the prior SOETM special account immediately prior to commencement (s 9(1)-(2). This records a direct, mechanical carry-over: the prior account’s funds are to be credited to the new account as its opening balance.

• Repeal of Part 3 and definitions: Section 11 contains a built-in short-term repeal mechanism. It provides that:

  1. Part 3 of this instrument will be repealed at the end of the seventh day after the revocation of the prior SOETM instrument under section 10 (s 11(1));
  2. On the date of that repeal, two definitions in section 4 are to be repealed: the definitions of “SOETM instrument” and “SOETM special account” (s 11(2));
  3. Despite the repeal of Part 3, the effects of Part 3 remain in force after the date of repeal (s 11(3)).

  This produces a limited-lived textual presence for the transitional provisions while preserving their legal effect.

• Commencement linkage: The instrument’s commencement is linked to paragraph 79(5)(a) of the Act (s 2(1)). The instrument records the whole instrument commences on the day mentioned in that paragraph. The instrument’s commencement table includes a Column 3 where information may be inserted or edited on the Federal Register of Legislation, but the instrument states that that Column 3 information is not part of the instrument (s 2(2)). The instrument therefore leaves the precise calendar commencement date to the Act’s mechanisms but records the commencement recording convention.

• No subsequent amendments recorded in the text: The instrument text provided includes no later amending clauses, schedules or notes that alter its content beyond the revocation of the prior instrument and the internal scheduled repeal. Therefore, within the text supplied, the amendment history is confined to the revocation/replacement relationship with the 2010 instrument and the internal time-limited repeal of Part 3 and related definitions.

Operational note arising from the instrument’s own history: The instrument’s transitional design shows an intention to replace the 2010 SOETM instrument cleanly while transferring financial balances promptly, and then to tidy up the instrument text by removing the transitional Part 3 and definitions after a short period while preserving the legal outcomes of the transition. The instrument itself records the maker and date and ties the commencement to the Act’s commencement provisions.

The instrument does not reference any legal proceedings, litigation history, disputes, court judgments or tribunal determinations. There are no cases or litigation events named in the text provided. The instrument is a statutory determination; its text focuses on establishment, permitted receipts and payments, accountable authority, revocation of a prior instrument and transitional provisions.

Concrete observations from the instrument about litigation-related interaction:

• Repayment for court orders or other laws: The instrument recognises that repayments may be required where a court order, an Act or other law requires or permits repayment. Section 8(5) expressly authorises the special account to be debited to repay an amount where such a legal requirement or permission exists. This signals that the special account may be used to satisfy repayment obligations arising from judicial determinations or statutory obligations, but the instrument itself does not recount any past litigation or provide examples.

• No litigation history recorded: The instrument includes no section that lists existing disputes, unresolved claims, or litigation risks connected with the prior SOETM special account or the new special account. It does not record any orders, settlements, or adjudicated decisions that are to be implemented through the new special account.

• No enforcement or remedial schedule relating to litigation: The instrument does not prescribe a process for how a court order would be fed into departmental accounting or for publication of repayments. It simply creates a permitted debit purpose to enable repayment where required by court order, Act or other law (s 8(5)).

As a result, there is no litigation history to summarise within this instrument’s text. Any litigation involving the Department, the prior SOETM instrument or the new special account would lie outside the information contained in the determination. This instrument therefore must be read as silent on prior or pending litigation, save for authorising repayments ordered or permitted by courts and other laws.

The instrument is short and technical, but it contains several drafting and operational features that merit careful attention because they can affect administration, accounting and legal interpretation. The following are concrete “gotchas” drawn only from the instrument’s text.

1. Commencement depends on a cross-reference to the Act rather than an explicit day: Section 2(1) states the whole instrument commences “the day mentioned in paragraph 79(5)(a) of the Act.” The instrument does not reproduce that date. Practically, users must consult the Act’s paragraph 79(5)(a) to determine the instrument’s commencement day, or the version published on the Federal Register of Legislation where Column 3 may record start dates (s 2(2)). The instrument emphasises that Column 3 material is not part of the instrument, so administrators should not treat editorial or registration notes as legally operative.

2. Odd numbering in section 7: Section 7 lists credits to the special account but the numbering/lettering in the supplied text is irregular: it begins with a numbered line “1. an amount held on trust...” and then continues with “(b) an amount received...” and “(c) an amount received from any person...”. That irregular presentation could create ambiguity in citation or reference. Practical users should refer to the instrument text carefully and, where necessary, quote the full wording rather than rely on the internal label.

3. “Amount held on trust” is not defined here: The instrument permits amounts held on trust, or otherwise on behalf of or for the benefit of a person other than the Commonwealth, to be credited to the account (s 7 first category and s 8(1) for disbursement). The instrument does not define “held on trust” or set out trust-administration standards. That may leave uncertainty about when amounts are appropriately classified as trust moneys able to be credited to the account.

4. Broad crediting power , “any person”: Section 7(c) permits amounts received from “any person” for purposes of the account. That is broad wording. Departments should be attentive to the legal and tax consequences of receiving funds from diverse sources and ensure appropriate documentation before crediting such receipts to the special account.

5. Non-payment reduction of appropriation: Section 8(6) authorises disbursing “to reduce the balance of the special account (and, therefore, the available appropriation for the special account) without making a real or notional payment.” This is an unusual administrative mechanism: it permits accounting debits that reduce appropriation without an underlying cash payment. Departments must ensure internal control systems and financial statements properly reflect such non-payment debits and that they are appropriately authorised.

6. Short-lived textual Part 3 with preserved effects: Section 11(1) schedules the repeal of Part 3 seven days after revocation of the prior SOETM instrument, and section 11(3) declares that the effects of Part 3 remain in force after repeal. That means the transitional text will be removed from the instrument but its legal effects (for example, the opening balance transfer and the revocation) endure. Administrators and auditors should take care to track and preserve records of the Part 3 operation because the textual reference will be removed soon after revocation.

7. Definitions scheduled for repeal: Section 11(2) schedules the repeal of the definitions of “SOETM instrument” and “SOETM special account” in section 4 on the same date that Part 3 is repealed. Removing these definitions may create awkwardness for anyone reading the instrument after the repeal date. The instrument’s saving provision in s 11(3) preserves the effects, but the text that named and described the prior instrument and prior account will be removed. Users should maintain an archival copy of the instrument as it appears before the scheduled deletions to avoid confusion.

8. No operational detail on approvals or reporting: The instrument specifies permitted credits and debits and names the accountable authority, but it does not specify approval thresholds, who signs vouchers, reporting frequency, internal authorisations, or external reporting to Parliament. Those operational details will be found elsewhere in the Act or departmental financial rules; reliance on this instrument alone will not be sufficient to implement day-to-day controls.

9. Revocation of prior instrument may affect settled practices: Because the prior SOETM instrument is revoked (s 10), any procedures or expectations anchored to that instrument may need revisiting even though balances are carried over. The instrument does not enumerate transitional operational steps beyond balance transfer. Administrators must check whether contracts, client information or external arrangements reference the prior instrument and update documentation.

10. Ambiguity about the relationship between “services performed” and “amounts received”: Sections 7(b) and 8(2)-(3) link credits and debits to services performed for, on behalf of, or together with other entities. The instrument does not precisely define the boundary between services that generate receipts which may be credited and the circumstances that permit debits. Departments will need to apply proper legal and accounting interpretation to determine whether particular activities fall within the account’s purposes.

Users should therefore treat the instrument as establishing a legal framework while recognising these drafting and operational points that require careful administration and cross-referencing to the Act and departmental procedures.

The instrument creates a narrow set of compliance actions that a Departmental finance team and the accountable authority must take to lawfully operate the special account. Compliance requires working within the instrument’s text and the Act’s broader financial management regime. The following steps and controls flow directly from the instrument.

1. Confirm commencement date and record it: Section 2 ties commencement to paragraph 79(5)(a) of the Act. Before any credits or debits are processed, the Department must determine and record the instrument’s commencement day. That may require consulting the Act and the Federal Register of Legislation entry (Column 3 advisory text is not part of the instrument but may record helpful administrative details). Maintain a dated record of the commencement determination.

2. Record and preserve the instrument’s original text: Because Part 3 and certain definitions are scheduled for repeal shortly after revocation of the prior SOETM instrument (s 11), preserve the pre-repeal version of the determination for audit, historical and legal reference. Section 11(3) preserves the effects, but the textual references will be removed. Archive the version showing the opening balance transfer and the revocation.

3. Ensure formal designation of the accountable authority is implemented: Section 6 names the Secretary of the Department as the accountable authority. The Department must ensure internal control frameworks, delegations, and responsible officer records correctly document that designation, and allocate internal responsibilities for day-to-day administration consistent with that appointment.

4. Carry out the opening balance transfer immediately after establishment: Section 9 requires that the opening balance be credited immediately after establishment and equal the amount standing to the credit of the prior SOETM special account immediately prior to commencement. Practically, that requires the Department to determine the prior account’s closing balance at the relevant moment and credit that amount to the new special account without delay. Document the reconciliation and supporting entries.

5. Implement accounting controls for permitted credits and debits: Sections 7 and 8 set out the only categories of receipts and purposes for payments. Departments must:

   • Configure ledger accounts and coding so that only receipts that meet the descriptions in s 7 are credited to the special account;
   • Require transaction-level documentation proving a receipt falls within one of those categories (for example invoices, agreements, trust documentation);
   • Ensure debits from the account are authorised only where they fall into one of the six permitted purposes at s 8;
   • Incorporate approval checklists into payment processes so that payments are only released when they fit a permitted debit purpose.

6. Manage trust money separately and with clarity: Because the account may hold amounts “held on trust, or otherwise on behalf of or for the benefit of a person other than the Commonwealth” (s 7 first category) and because disbursements of trust moneys are a permitted debit (s 8(1)), the Department must maintain documentary proof of the trust relationship, beneficiary identity and entitlement criteria. Although the instrument does not set out trust administration procedures, standard trust accounting practices should be applied: segregation of funds, beneficiary records and traceable disbursement authorisation.

7. Apply caution when accepting payments from “any person”: Section 7(c) allows credits from “any person.” Adopt procedures to screen payors, record the legal basis for each payment, and confirm that the purpose of the payment aligns with the instrument. Capture contracts, memoranda of understanding, or invoices that justify the payment and map them to the account’s purposes.

8. Implement authorisation for non-payment debits: Section 8(6) permits reducing the account balance without making a real or notional payment. Where such an accounting movement is contemplated, set out an internal approval protocol documenting the legal basis and the accounting treatment. Ensure auditors are notified and that financial statements and appropriation records reflect such debits transparently.

9. Address repayments required by court order or law promptly and with documentation: Section 8(5) allows the account to be debited where a court order, Act or other law requires or permits repayment. Track any potential liabilities arising from litigation or statutory obligations and ensure prompt execution on repayment instructions, with supporting legal instruments recorded on file.

10. Update contracts, external communications and public records: Because the prior SOETM instrument is revoked (s 10) and the new account is established, update contract references, payment instructions and public-facing material to reflect the new account name and any new account numbers. Ensure third parties who previously paid into the prior SOETM account are informed about the transfer and the new account details if necessary.

11. Coordinate with audit and finance oversight functions: Although the instrument does not specify reporting obligations, the account will sit within the Act’s financial governance framework. Notify internal audit, financial controllers and any ministerial or parliamentary reporting functions about the account’s establishment, the opening balance transfer, and the special purposes for which funds will be used.

12. Maintain a compliance and reconciliation trail: For every credit and debit, keep a contemporaneous justification mapped to the specific sub-paragraph of s 7 or s 8. Carry out periodic reconciliations to ensure the special account’s balance matches ledger and bank records, and retain supporting documents for audit, oversight and potential legal inquiries.

13. Review and update the Department’s financial procedures and delegations: The Department must reflect the Secretary’s role as accountable authority, the account’s permitted receipts and payments, and the opening balance transfer in delegations schedules and instruction manuals used by staff who process transactions.

14. Prepare for the scheduled repeal of Part 3 textually while preserving the documented effects: Because the instrument schedules Part 3 and two definitions for repeal shortly after revocation, ensure that the legal outcomes of those provisions (most importantly the opening balance transfer and the revocation of the prior instrument) are recorded in internal policy and transaction records so that removal of the text will not create operational confusion.

Following these steps will implement the legal requirements created by the instrument as set out in its own text. Departments should ensure all operational controls referenced above are implemented in accordance with the broader financial rules and policies that give effect to the Act, and should maintain documentary evidence for each transaction credited to or debited from the special account consistent with the categories and purposes enumerated in this determination.
