PGPA Act Determination (Services Australia SOETM Special Account 2020)

The instrument hinges on the PGPA Act special account mechanism referenced throughout as paragraph 78(1) and subsection 78(3). It operationalises that mechanism in three linked concepts: establishment, permitted credits and permitted debits or purposes. Establishment is explicit: the Services Australia SOETM Special Account 2020 is established as a special account for the purposes of paragraph 78(1)(a) of the Act (s5). The accountable authority is named rather than left to default administrative practice; the Chief Executive Officer of Services Australia is the accountable authority under paragraph 78(1)(d) (s6). Naming the accountable authority focuses administrative responsibility and internal reporting lines on Services Australia.

Permitted credits are limited to three types. First, amounts held on trust, or otherwise on behalf of or for the benefit of a person other than the Commonwealth, may be credited (s7(1)). Second, amounts received in the course of performing functions that relate to one or more purposes of the special account may be credited (s7(b)). Third, the account may receive amounts from any person for one or more purposes of the special account (s7(c)). The language covers both trust‑style receipts and receipts arising from fee‑for‑service or contractual performance, and it allows receipts from third parties for the account purposes.

Permitted debits are defined by purpose rather than by specific transaction methods (s8). The listed purposes are sequentially specific: disbursing trust holdings to non‑Commonwealth beneficiaries (s8(1)); payments connected with services performed for or on behalf of other governments and bodies, including Commonwealth entities (s8(2)); funding joint activities with other Commonwealth entities, companies, governments, organisations or persons (s8(3)); meeting obligations under agreements between the Commonwealth and another government (s8(4)); repaying amounts when required or permitted by a court order, an Act or other law (s8(5)); and an express power to reduce the account balance and thereby reduce the available appropriation without making a real or notional payment (s8(6)). The last item is a bookkeeping device with appropriation consequences, as it explicitly notes the available appropriation for the special account is reduced when the account balance is reduced without a payment (s8(6)).

Transitional mechanics are another central concept. The instrument requires that the opening balance equal the amount standing to the credit of the DHS SOETM special account immediately prior to commencement (s9(2)). The DHS SOETM determination is revoked (s10), and the instrument provides for repeal of Part 3 seven days after that revocation while declaring that the effects of Part 3 remain in force despite the repeal (s11(1) and s11(3)). Definitions are limited and include the Act, the DHS SOETM special account and determination, and SOETM as shorthand for Services for Other Entities and Trust Moneys (s4). The instrument therefore creates a legal and operational continuity: the funds and permitted uses transfer to Services Australia, with a short transitional window in which the Part 3 provisions operate and then are formally removed while their effects persist.

The instrument creates effects for three principal groups of persons and organisations, identified directly by the text. First, Services Australia is affected as the accountable agency and operator of the special account; the instrument expressly makes the Chief Executive Officer of Services Australia the accountable authority responsible for the special account (s6). That positioning places governance, financial management and reporting obligations on Services Australia for all credits to and debits from the account, within the framework of the Act (s3, s5-s8, s9).

Second, those who pay or receive trust or service moneys are affected. The account expressly permits amounts "to be held on trust, or otherwise on behalf of or for the benefit of a person other than the Commonwealth" to be credited (s7(1)), and it authorises disbursements of those amounts to the relevant non‑Commonwealth beneficiaries (s8(1)). That means private persons, organisations, other governments, or entities with beneficiary interests in trust moneys previously held by DHS are now subject to Services Australia processes for receiving any disbursement. In practice, counterparties who previously interacted with the DHS SOETM special account will need to route future transactions to the Services Australia account and to engage with Services Australia for disbursement decisions permitted under s8.

Third, other governments, Commonwealth entities, Commonwealth companies, organisations and persons that contract, co‑operate or otherwise engage in joint activities or service delivery with Services Australia are affected. The instrument authorises disbursements connected with services performed for or on behalf of other governments and bodies, including Commonwealth entities (s8(2)), and disbursements in connection with joint activities performed for, on behalf of, or together with a Commonwealth entity, company, another government, organisation or person (s8(3)). Those counterparties will encounter Services Australia as the custodian of funds and the decision maker for payments out of the account.

Indirectly, the instrument affects the administrative owners and users of the former DHS SOETM special account because the amount standing to the credit of that account is transferred into the Services Australia special account as the opening balance (s9(1)-(2)). The DHS SOETM determination is revoked (s10), and definitions relating to the DHS instrument and account are slated for repeal shortly after revocation (s11(1)-(2)). The instrument therefore shifts legal title, custodial responsibility and the accountable authority from DHS to Services Australia for the specific category of moneys covered.

Finally, courts and statutory administrators are marginally affected in that s8(5) recognises the account can be used to repay amounts where a court order, Act or other law requires or permits repayment. Parties engaged in litigation or subject to statutory repayment obligations that intersect with the moneys in the account will deal with Services Australia in satisfying those orders or statutory requirements.

The instrument establishes specific entitlements and constraints rather than a broad new statutory regime. The core entitlements are the rights to credit the account with certain classes of receipts and the right to debit the account for specified purposes. These rights are conditional on the definitions and purposes set out in the instrument.

Accountable authority designation: The Chief Executive Officer of Services Australia is named as the accountable authority responsible for the special account (s6). This designation creates a duty on Services Australia to ensure that transactions comply with the Act and the parameters of this determination, because the instrument was made under subsections 78(1) and 78(3) of the Act (s3). The instrument does not detail reporting lines, but naming the accountable authority allocates legal responsibility for the account administration.

Permitted credits are a limiting duty on payers and Services Australia. Only the three categories of amounts may be credited to the special account: trust amounts for non‑Commonwealth beneficiaries, receipts from performing functions relating to account purposes, and amounts received from any person for account purposes (s7). Entities providing funds must ensure their transaction fits one of these categories; Services Australia must verify that inbound receipts are within the permitted classes prior to crediting the special account.

Permitted debits impose duties on Services Australia to use the account only for the enumerated purposes (s8). Those purposes include disbursing trust funds to beneficiaries (s8(1)), paying for services performed for or on behalf of other governments and bodies (s8(2)), funding joint activities (s8(3)), meeting obligations under agreements between the Commonwealth and other governments (s8(4)), repaying amounts where law requires or permits it (s8(5)), and reducing the account balance without payment to reduce available appropriation (s8(6)). Each debit must be linked to one of these purposes to be valid under the determination.

Opening balance duty: The instrument requires that the sum standing in the DHS SOETM special account immediately prior to commencement be credited to the Services Australia special account as the opening balance immediately after establishment (s9(1)-(2)). That creates an administrative duty to transfer balances and to reconcile the amounts being carried forward.

Revocation and repeal duties: The instrument revokes the DHS SOETM determination (s10) and schedules repeal of Part 3 after seven days (s11(1)). It further provides that certain definitions are repealed on that date (s11(2)) but that the effects of Part 3 remain in force despite repeal (s11(3)). These provisions impose recordkeeping and interpretative duties on Services Australia and on any external parties that reference the earlier DHS instrument.

Rights of beneficiaries: Persons other than the Commonwealth identified as beneficiaries of trust moneys have an enforceable interest insofar as the account is permitted to hold and to disburse funds held on trust for their benefit (s7(1), s8(1)). The instrument provides the mechanics for lodging and disbursing those funds, but details of trust law, claim procedures and dispute resolution are not specified in the instrument itself.

Limits and constraints: The instrument does not create an open appropriation. Instead, it defines credits and debits narrowly. The presence of s8(6), allowing reduction of the balance without payment, imposes an internal accounting constraint with direct appropriation consequences, because reducing the account balance is described as reducing the available appropriation for the special account.

The instrument does not itself create criminal offences, administrative penalties, or explicit enforcement mechanisms. It is a determination under the PGPA Act specifying establishment, permitted receipts and permitted payments for a special account, and revocation and repeal of a prior determination. The text contains no sanctions, fines, or enforcement provisions.

Enforcement in practice will therefore be indirect. Compliance with the determination is a condition of proper administration of the special account under the Act framework, and the accountable authority named in s6 is the Chief Executive Officer of Services Australia. Any consequences for failing to comply with this determination would flow from the Act’s governance and accountability regime referenced by the instrument (s3), including potential administrative remedies, audit, internal control action, or exercise of the regulator’s powers under the Act. The instrument itself does not set those mechanisms out.

The instrument contemplates payments required by court order, Act or other law (s8(5)). That provision indicates that judicial and statutory obligations can drive debits from the account, but it does not specify enforcement pathways. If a court order or statutory requirement arises that interacts with moneys in the account, enforcement of the obligation occurs through judicial or statutory processes external to the instrument. The instrument simply authorises the account to be debited to meet such obligations.

Given the lack of express penalties, enforcement will be operational and administrative. Services Australia, as accountable authority, is responsible for ensuring transactions are within the credit and debit parameters. Noncompliance would likely manifest as accounting irregularity or misapplication of funds, which would be subject to internal controls, audit and any remedies available under the Act. The instrument provides no new investigatory powers or penalty provisions; it is an authorising and organisational measure rather than a penal statute.

The instrument is explicitly made under subsections 78(1) and 78(3) of the Act (s3), and it repeatedly references paragraph 78(1) in relation to establishment (s5), permitted credits (s7) and permitted debits or purposes (s8). Commencement is contingent on paragraph 79(5)(a) of the Act (s2(1)). Therefore, the determination operates within the PGPA Act framework and derives its authority from that Act. The instrument prescribes permitted transactions for the special account in that statutory context.

The instrument revokes the DHS SOETM determination, namely the Financial Management and Accountability (Establishment of Special Account for Department of Human Services) Determination 2011/13 (s10). It therefore replaces the prior instrument-based arrangement under DHS with a new Services Australia arrangement. The opening balance provision requires that the amount standing to the credit of the DHS SOETM special account immediately prior to commencement be credited to the new account (s9(1)-(2)), preserving funds continuity between the two instruments.

Section 8(5) expressly links the account to external legal obligations by permitting disbursements to repay an amount where a court order, Act or other law requires or permits repayment. That cross‑reference recognises that other statutes and judicial determinations may impose repayment obligations that the account must satisfy, and it authorises using the special account for that purpose. The instrument does not specify how competing legal claims are to be prioritised; it simply authorises debits to satisfy such instruments and orders.

The instrument also interacts with administrative law and trust law in practice. It authorises the account to receive amounts held on trust or otherwise on behalf of or for the benefit of a person other than the Commonwealth (s7(1)) and to disburse trust amounts to beneficiaries (s8(1)). How trust or fiduciary obligations operate will continue to be governed by the substantive law of trusts and any applicable statutory rules, but the instrument provides the financial vehicle for holding and disbursing such funds within the Commonwealth accounts framework.

The power in s8(6) to reduce the balance of the special account without making a payment interacts with appropriation and budgetary rules because the instrument notes that reducing the balance reduces the available appropriation for the special account. The instrument does not detail the accounting entries, reporting requirements, or the downstream effect on consolidated funds, but it imports appropriation consequences as part of its operation.

Finally, repeal mechanics in s11 interact with legal drafting and statutory interpretation. The instrument schedules repeal of Part 3 seven days after the revocation of the DHS SOETM determination while simultaneously preserving the effects of Part 3 despite the repeal (s11(1) and s11(3)). That structure links the transitional treatment of balances to the life of the instrument and to the broader statutory scheme.

The instrument itself contains no amendment schedule beyond its own commencement, revocation of an earlier instrument, and the internal repeal timetable for Part 3. The instrument was made by the Minister for Finance on 9 June 2020 (front matter). Commencement is governed by s2(1), which provides the commencement formula as the later of 30 June 2020 or the day mentioned in paragraph 79(5)(a) of the Act. Section 2(2) clarifies that any information placed in column 3 of the commencement table is not part of the instrument and may be edited in versions published on the Federal Register of Legislation.

The only express revocation or amendment action is the revocation of the DHS SOETM determination under s10. Part 3 contains the transitional and repeal provisions and will itself be repealed at the end of the seventh day after the revocation of the DHS SOETM determination (s11(1)). On that date of repeal, the definitions in s4 that relate to the DHS instrument and account are also repealed (s11(2)). However, s11(3) makes clear that, despite the repeal of Part 3, the effects of Part 3 remain in force. In practical terms the sequence is: (1) revocation of DHS determination (s10); (2) immediate crediting of the opening balance from the DHS account to the new Services Australia account (s9); (3) seven days later, formal repeal of Part 3 and deletion of the DHS‑related definitions from s4 while preserving the enacted effects.

The instrument contains no later amendments listed within its text. Any subsequent amendments to this determination would appear as separate determinations under the Act or as consolidations published on the Federal Register of Legislation; the instrument itself does not catalogue such future changes. The commencement table indicates that the instrument’s effective date is contingent on the PGPA Act paragraph 79(5)(a), but the instrument does not explain what event that paragraph references. The instrument therefore establishes a single transition and transfer event and ties down a short window for formal repeal of the transitional provisions.

The instrument contains no litigation history. It does not mention any court proceedings, contested administrative decisions, or judicial interpretation. There are no cases named in the instrument text and no reported judicial orders included as part of the determination. The only reference to courts is in the operational list of account purposes, which allows disbursement to repay an amount where a court order, Act or other law requires or permits the repayment of an amount (s8(5)). That reference is prospective and authorising in nature; it anticipates that court orders may arise which will require use of the special account to satisfy repayment obligations.

Potential litigation vectors implicit in the instrument are limited to disputes that might arise over trust holdings, entitlement to funds, or the proper application of monies held for third‑party beneficiaries. Because the instrument authorises Services Australia to hold and disburse amounts held on trust for persons other than the Commonwealth (s7(1) and s8(1)), disagreements about beneficiary entitlement, priority or the adequacy of disbursement processes could lead to court proceedings in the future. The instrument itself does not prescribe dispute resolution mechanisms for such conflicts.

Another prospective source of litigation or review would be any challenge to the revocation of the DHS SOETM determination (s10) or to the transfer of balances. However, the instrument expressly requires the opening balance to be credited to the new account (s9), making the transfer an authorised administrative action. Any legal challenge would therefore need to engage with the Act and the powers given to the Minister and to accountable authorities under it. The instrument contains no litigation record, but it anticipates situations where court orders can trigger account debits.

In summary, the instrument has no embedded litigation history. The instrument’s text does recognise that legal obligations imposed by courts or other laws can interact with the account (s8(5)), but it does not recount or refer to any judicial decisions or disputes.

Several operational and interpretative points in the instrument merit attention because they could produce friction if overlooked.

Commencement timing linkage. The instrument’s commencement is not a simple fixed date. It commences on the later of 30 June 2020 or the day mentioned in paragraph 79(5)(a) of the Act (s2(1)). The instrument does not spell out what the paragraph 79(5)(a) day is; users must check that provision in the Act to determine the actual commencement date. Column 3 entries in the commencement table are explicitly not part of the instrument (s2(2)), so do not rely on ancillary commencement notes without checking the Act.

Opening balance immediate crediting. The instrument requires that the opening balance equal the amount standing to the credit of the DHS SOETM special account immediately prior to commencement and that this be credited immediately after establishment (s9(1)-(2)). Failing to capture an accurate snapshot of the DHS account at the moment before commencement could lead to reconciliation issues. The instrument fixes the basis of the opening balance in time, which creates a cliff‑edge that financial officers must reconcile precisely.

Short transitional repeal with persistent effects. Part 3 is to be repealed seven days after revocation of the DHS SOETM determination (s11(1)), and on that date certain definitions in s4 are repealed (s11(2)). However, s11(3) states that despite the repeal, the effects of Part 3 remain in force. This drafting creates a potential interpretative gotcha: the text removes the transitional provisions from the instrument while preserving their effect, which may complicate consultation, subsequent amendment or external citation. Practitioners relying solely on printed or earlier consolidated copies should ensure they track the Federal Register of Legislation record to confirm that effects have been preserved even where the text form changes.

Definitions and deleted references. The instrument defines the DHS SOETM determination and DHS SOETM special account and then schedules those definitions for repeal after seven days (s4, s11(2)). If third parties reference the definitions in external documents or in their own agreements, those references may cease to exist in the instrument text while the underlying effects remain. That can cause confusion in contract drafting and in historical records unless the opening balance transfer and revocation are carefully documented.

Accountant and appropriation implication. Section 8(6) authorises reducing the balance of the special account without making a real or notional payment, and expressly notes that doing so reduces the available appropriation for the special account (s8(6)). This is a technical accounting lever with appropriation consequences. Users must understand the bookkeeping implications and ensure the reduction is properly authorised, documented and reported. Failure to treat such reductions correctly could lead to misstatements in appropriation reporting.

Narrow classes of permissible receipts and payments. The account accepts only three classes of receipts (s7) and permits debits only for six limited purposes (s8). Services Australia must ensure inbound receipts are categorised correctly and that disbursements map to one of the listed purposes. Misapplication of funds outside these boundaries would be inconsistent with the instrument’s authority.

No penalty provisions. The instrument provides no express sanctions or enforcement mechanisms (see Penalties and enforcement). Any enforcement will be through the Act’s wider governance framework or through external legal processes. Parties expecting explicit penalty triggers in the instrument will not find them.

Dependence on external law for repayments. The instrument contemplates repayments required by court order, Act or other law (s8(5)). That means the account may be called upon in response to external legal processes. Services Australia must be prepared to respond to such instruments quickly, and counterparties should be aware funds may be used to satisfy external legal obligations.

Recordkeeping and beneficiary claims. Because the account may hold trust moneys for persons other than the Commonwealth (s7(1)), Services Australia needs robust trust accounting and claims procedures. The instrument does not set those procedures, so their absence or inconsistency could create disputes.

Services Australia as accountable authority is the primary compliance actor. The instrument names the Chief Executive Officer of Services Australia as the accountable authority responsible for the special account (s6). Compliance therefore requires that Services Australia implement governance, financial controls and procedures that ensure all credits and debits conform to the classes and purposes specified in the instrument (s7-s8), and that the opening balance from the DHS SOETM special account is credited immediately after establishment (s9(1)-(2)).

Practical steps for Services Australia:

• Reconciliation and transfer of opening balance. Prior to commencement, obtain an authoritative, timestamped ledger position of the DHS SOETM special account so the opening balance required by s9(2) can be credited to the new account immediately after establishment. Maintain audit trail documentation demonstrating the precise amount taken as the opening balance, and retain contemporaneous records of the revocation of the DHS SOETM determination under s10.

• Establish accounting classifications and rules. Create clear internal rules to identify receipts that fit the three permitted credit classes in s7. Ensure incoming receipts are coded to the special account only where they are trust holdings for non‑Commonwealth beneficiaries, receipts from performance of functions related to the account purposes, or amounts received from any person for the account purposes.

• Create disbursement procedures mapped to the six purposes. Draft standard operating procedures that require staff to document the connection between a proposed debit and the appropriate s8 purpose. For trust disbursements, implement beneficiary verification and trust accounting controls. For service delivery and joint activity payments, require contractual or agreement references tying the payment to the account purpose. For repayments under court order, Act or other law, require legal team sign‑off and documentary proof of the order or statutory obligation.

• Controls around s8(6) reductions. Establish a governance pathway for any reduction of the account balance without making a real or notional payment, because this action reduces the available appropriation (s8(6)). Document the legal basis, authorisation, and appropriation reporting impact. Coordinate with departmental finance and central appropriation authorities to ensure reporting and budget statements reflect the reduction.

• Recordkeeping and retention. Maintain records of all credits and debits, the rationale linking transactions to instrument provisions, and the supporting documents (trust deeds, agreements, invoices, court orders). Given that Part 3 will be repealed seven days after revocation while effects persist (s11(1)-(3)), preserve records that evidence the transitional transfer and its legal basis.

• Update external counterparties and templates. Notify counterparties that previously interacted with the DHS SOETM special account that the account has transferred to Services Australia and that future receipts and disbursement requests should be directed to Services Australia. Update contractual templates and service agreements to reference the Services Australia SOETM Special Account 2020 where necessary and confirm that counterparties’ payments fit the permitted credit classes under s7.

• Legal review and contingency planning. Instruct legal counsel to review the instrument, particularly s8(5) and s8(6), to prepare for potential court orders, statutory repayment obligations and appropriation adjustments. Ensure the legal team is prepared to respond to requests for disbursements to satisfy external legal obligations and to advise on trust claims.

• Audit and assurance. Ensure internal audit plans include the special account and its transitional transfer from DHS. Audit criteria should include conformity of credits to s7, debits to s8, correctness of the opening balance transfer (s9), and appropriate handling of any reductions under s8(6).

• Public and statutory reporting. Ensure the account’s presence and activity are reflected in financial statements, appropriation schedules and any statutory reporting that Services Australia is obliged to produce under the Act. Although the instrument does not itself specify reporting formats, the accountable authority should ensure the account’s operations are traceable and auditable.

For other affected parties:

• Payers and beneficiaries should confirm transactions fall within the permitted classes. Entities intending to credit the account must ensure their payment is a trust holding for a person other than the Commonwealth, a receipt tied to services performed consistent with the account purposes, or otherwise a payment for one of the account purposes (s7). Beneficiaries of trust moneys should establish proof of entitlement and supply Services Australia with necessary documentation to support disbursement requests under s8(1).

• Counterparties to agreements or joint activities should ensure agreements reference the account appropriately and provide the documentation Services Australia will require to authorise disbursements under s8(2)-(4).

Finally, maintain awareness of the commencement trigger (the later of 30 June 2020 or the day mentioned in paragraph 79(5)(a) of the Act) and manage the operational cutover accordingly (s2). Ensure Federal Register of Legislation versions are consulted for any editorial changes or clarifying notes that are not part of the instrument (s2(2)).
