PGPA Act Determination (Establishment of Ranger Rehabilitation Special Account 2017)

The instrument uses a compact set of statutory mechanics to create and populate a purpose-limited budget vehicle. Core concepts are:

• Special account: The Ranger Rehabilitation Special Account 2017 is established as a distinct special account under paragraph 78(1)(a) of the Act (s 5). The instrument defines the special account (s 4) and ties it to the Commonwealth’s Official Public Account by reference in permitted debit purposes (s 7(d)).

• Receipts eligible for crediting: Section 6 restricts creditable receipts to (a) amounts received in the course of performing functions that relate to the account’s purposes, and (b) amounts received from any person for the purposes of the special account (s 6). This designates two legal bases for income: receipts generated by relevant functions and voluntary or contractually required payments from third parties.

• Permitted debit purposes: Section 7 states the authorised uses of money in the account. The primary purpose is rehabilitation of the Ranger Project Area consistent with the Ranger Uranium Project Government Agreement, as amended (s 7(1)). Secondary purposes include repaying original payers after necessary rehabilitation payments (s 7(2)), funding ancillary activities such as administration and addressing direct and indirect costs (s 7(c)(i)-(ii)), reducing the account balance without a monetary outflow to give effect to remittances agreed between ministers (s 7(d)), and effecting repayments required or permitted by an Act or other law (s 7(e)).

• Transitional linkage to former arrangements: The Determination identifies the former determination and former special account (s 4), inserts an additional power into the former determination to credit amounts to the 2017 special account (s 8), and authorises transfer of any balance in the former special account to the new special account so long as the amount transferred does not exceed the existing credit (s 9). These steps preserve continuity and allow consolidation.

• Accountable authority: The Secretary of the Department of Industry, Innovation and Science is named as the accountable authority for the special account (s 10). The instrument places responsibility for the account with a specific departmental head.

• Commencement mechanics: The Determination does not set a calendar date; it takes effect on the day identified in paragraph 79(5)(a) of the Act as applying to determinations made under subsections 78(1) and 78(3), and notes that information in the instrument’s column 3 (in the commencement table) is not part of the instrument (s 2(1)-(2)).

These concepts frame how funds will be captured, held, and spent. The Determination is tightly focused: it creates a vehicle to ring-fence money for a specified rehabilitation purpose, allows administrative charges to be met from the account, and provides for transfers and repayments consistent with the Ranger Government Agreement and applicable law.

The Determination affects several classes of actors, each exposed to particular legal and practical consequences under the terms of the instrument:

• The accountable authority: The Secretary of the Department of Industry, Innovation and Science is named as the accountable authority responsible for the special account (s 10). That office is the decision point for the account’s administration, including receiving credits, authorising debits for the specified purposes, and handling transfers and repayments permitted by the Determination. The Secretary’s office bears administrative and fiduciary responsibilities implicit in being the accountable authority; the Determination expressly permits administrative costs to be debited from the account (s 7(c)(i)).

• The Finance Minister and the responsible minister: Section 7(d) permits reduction of the special account’s balance without a real or notional payment by giving effect to remittances to the Official Public Account as agreed between the Finance Minister and the responsible minister. That clause allocates inter-ministerial decision-making power with respect to remittances that reduce the account’s available appropriation. The Determination therefore implicates two ministerial actors as decision-makers for remittances.

• Entities performing functions related to rehabilitation: Those Commonwealth entities or bodies that perform functions “in the course of the performance of functions that relate to the purposes of the special account” can credit amounts received in that course to the special account under s 6(a). That creates an accounting pathway for operational receipts generated through rehabilitation-related functions to be held in the special account.

• Third parties and original payers: Section 6(b) allows amounts “received from any person for the purposes of the special account” to be credited. The Determination therefore affects private or non-governmental parties who may contribute funds, including parties who, under the Ranger Uranium Project Government Agreement or otherwise, make payments intended to fund rehabilitation. Section 7(2) contemplates repaying “an original payer” amounts credited to the special account or the former special account after necessary rehabilitation payments are made, so original payers have a potential claim to repayment subject to satisfying the contingency described.

• The Official Public Account and Commonwealth appropriations: The instrument references the Official Public Account as the Commonwealth’s central bank account in its definitions (s 4) and allows remittances to it as a mechanism to reduce the special account balance without creating a notional payment (s 7(d)). That ties activity in the special account to central Treasury cash management and appropriation accounting.

• Administrators and auditors: Because administrative expenses and indirect costs may be charged to the account (s 7(c)(i)-(ii)), persons or units tasked with record-keeping, account reconciliation, and audit must manage and report the special account’s transactions in line with the Determination and the Act. The instrument authorises such charges but does not set reporting mechanics; those will sit with the accountable authority and any Agency Financial Statements or audit framework required by the PGPA Act.

Collectively, the Determination creates legal entitlements to receive and spend money for narrow purposes and allocates responsibility for administering those entitlements. The instrument gives standing to a range of actors (agency officials, ministers, third parties) but leaves the detailed operational rules and governance to the accountable authority and the Act under which the Determination is made.

The Determination sets a compact set of rights (to credit and debit funds) and allocates duties to specified actors. These are the operative duties and rights derived from the text:

• Right to establish and operate the special account: By s 5 the special account is formally established. That confers the right on the Commonwealth (acting through the accountable authority) to hold funds in a distinct special account with the narrow purposes specified in s 7.

• Rights to credit the account: Section 6 grants the right to credit the special account with two categories of receipts: amounts received in the course of performing functions that relate to the account’s purposes (s 6(a)), and amounts received from any person for the purposes of the special account (s 6(b)). The former establishes a pathway for operational receipts; the latter allows third-party contributions or payments to be captured directly into the account.

• Duty to debit only for authorised purposes: Section 7 circumscribes the duty to apply account balances solely for the listed purposes: principally rehabilitating the Ranger Project Area in accordance with the Ranger Uranium Project Government Agreement (s 7(1)); repaying original payers after necessary rehabilitation payments (s 7(2)); carrying out incidental activities like administration and dealing with direct and indirect costs (s 7(c)(i)-(ii)); reducing the account balance via agreed remittances to the Official Public Account (s 7(d)); and effecting repayments required or permitted by law (s 7(e)). The accountable authority therefore must ensure that debits align with these statutory purposes.

• Duty to administer and meet administrative costs: The Determination explicitly contemplates that administration of the special account and dealing with direct and indirect costs may be debited from it (s 7(c)(i)-(ii)). This creates the operational right to meet the account’s transactional costs from the account balance, and the corresponding duty to manage those costs within the account’s resources.

• Duty to transfer balances from the former special account where appropriate: Section 9 permits an amount up to the balance of the former special account immediately before commencement to be debited from the former account and credited to the new special account. That creates an obligation to effect such transfers when they are required to consolidate balances, subject to the cap of the existing balance.

• Right to reduce the balance without an outflow by ministerial agreement: Section 7(d) gives the Finance Minister and the responsible minister the right, by agreement, to remit amounts to the Official Public Account thereby reducing the special account balance without a real or notional payment. This is a specific mechanism that changes available appropriation without a conventional debit transaction.

• Duty to comply with transitional variation of the former determination: Section 8 inserts a crediting power into subsection 5(1) of the former determination so that the former determination authorises crediting amounts to the Ranger Rehabilitation Special Account 2017. That creates a duty on those operating under the former determination to recognise the new account as a proper destination for permitted credits.

• Accountability and oversight: By naming the Secretary as the accountable authority (s 10), the Determination places ultimate responsibility for meeting the duties above on that office. The specification of an accountable authority implies duties of stewardship, record-keeping, and lawful application of funds under the Act, though the instrument does not itself reproduce the Act’s accountability and reporting rules.

Rights and duties in the Determination are narrow and process-oriented: they permit the collection and application of funds for a discrete rehabilitation purpose, allow certain administrative costs to be met from the account, and establish inter-ministerial mechanisms for remittance. The document assigns clear roles but delegates the operational detail of compliance, reporting, and internal governance to the accountable authority and the broader framework of the Act.

The Determination itself does not specify criminal penalties, administrative sanctions, or enforcement mechanisms within its text. It operates as a statutory instrument made under the Public Governance, Performance and Accountability Act 2013 and therefore must be read as part of the Act’s framework; the Determination identifies its enabling provisions (ss 78(1) and 78(3)) in s 3. The Determination’s enforcement architecture is therefore implicit rather than explicit in the instrument: obligations to apply the account in accordance with its purposes and to observe the roles allocated to the accountable authority will be subject to the compliance, audit, and accountability provisions contained in the Act and any subordinate rules or departmental governance arrangements, but those are not reproduced in the Determination.

Notable enforcement-related mechanics that appear in the instrument are procedural rather than punitive:

• Specified purposes constrain legal authority to debit funds: Section 7 functions as a statutory boundary. Expenditure consistent with s 7 is authorised; expenditure outside those purposes would lack statutory authorisation. Lack of authorisation creates administrative and legal exposure under the Act’s broader regime, though the Determination does not itself provide remedial steps or sanctions.

• Accountable authority identification: Naming the Secretary of the Department of Industry, Innovation and Science as the accountable authority (s 10) establishes who will be responsible for meeting the Act’s accountability and reporting requirements. Enforcement of those duties would flow from the Act’s oversight structures and Commonwealth financial management rules as applied to that accountable authority.

• Remittance and appropriation adjustments: Section 7(d) allows remittance to the Official Public Account as agreed between the Finance Minister and the responsible minister, thereby altering available appropriation without a transactional payment. Enforcement of correct remittances depends on ministers’ agreement and subsequent appropriation accounting; the Determination provides the legal basis for such remittances but no internal enforcement process.

• Transitional transfers: Section 9 permits transfers from the former special account to the new account up to the balance then standing. Correctly implementing such transfers will be an operational requirement; misapplication could trigger audit findings or administrative consequences under the Act.

Because the Determination does not prescribe penalties, affected parties must look to the PGPA Act and any related Commonwealth financial management rules for specific enforcement measures, sanctions, and audit remedies. The instrument establishes authorised uses and responsible actors; enforcement is to be located in the broader statutory and governance framework that it invokes by reference.

The Determination is explicitly made under subsections 78(1) and 78(3) of the Public Governance, Performance and Accountability Act 2013 (s 3), and must therefore be read as a subordinate instrument in relation to that Act. The instrument also cross-references a number of legal and administrative touchpoints that affect its operation:

• Relationship to the PGPA Act: The Determination cites the Act as the legal basis for establishing a special account (s 3), and it references paragraph 78(1)(a), (b), (c) and (d) and paragraph 78(3) in describing establishment, receipts, purposes and responsible authority (ss 5-7, 10, 8). The Determination’s legal validity and any constraints on its operation therefore depend on the PGPA Act’s provisions, including the Act’s definitions, responsibilities, appropriation rules and accountability framework. The instrument does not reproduce those PGPA Act provisions, so readers must consult the Act to see the full legal interaction, including any restrictions, reporting requirements and audit regimes that apply to special accounts more generally.

• Reference to the Ranger Uranium Project Government Agreement: The primary substantive purpose in s 7(1) is to rehabilitate the Ranger Project Area “in accordance with the Ranger Uranium Project Government Agreement (as amended).” That makes the Determination operationally dependent on the content of that Agreement. The Determination imports the agreement’s requirements as the standard against which rehabilitation must be performed, but it does not itself set those rehabilitation obligations. Compliance with, and any enforceability of, obligations under that Agreement will therefore be relevant to whether debits from the account satisfy s 7(1).

• Interaction with the former Financial Management and Accountability Determination 2006/70: The Determination identifies the former determination and former special account in s 4 and then varies the former determination by inserting a crediting power to the Ranger Rehabilitation Special Account 2017 into subsection 5(1) of the former determination (s 8). Section 9 permits transfer of any balance from the former special account to the 2017 account. These steps create a legal bridge between the previous legal instrument and the new one and enable continuity of funds and obligations across determinations.

• Relationship to the Official Public Account and appropriation accounting: The Determination defines the Official Public Account as the Commonwealth’s central bank account (s 4) and permits remittances to it that reduce the special account’s balance without making a real or notional payment, where agreed between the Finance Minister and the responsible minister (s 7(d)). That clause implicates central Treasury cash management and appropriation law in the practical treatment of the special account’s balance.

• Acts or other laws requiring repayment: Section 7(e) permits repayments where an Act or other law requires or permits repayment. This creates an explicit interaction with other Commonwealth laws or statutory schemes that may impose repayment obligations; the Determination provides the account-based mechanism to discharge such legal obligations.

Practical implication: the Determination is a narrowly framed financial instrument that depends on and interfaces with other legal instruments , the PGPA Act for its legal authority and accountability framework, the Ranger Government Agreement for the substantive rehabilitation standard, the former determination to enable legacy transfers, and central appropriation practice for cash management. The Determination does not itself set out the detailed duties, standards, or penalties that may arise under those other legal instruments.

The instrument itself is the 2017 Determination and records its origin and immediate amendments of prior instruments. The source identifies and effects the following discrete amendment events and historical cross-references:

• Replacement/variation of the former determination: The Determination identifies the "former determination" as the Financial Management and Accountability Determination 2006/70 , Ranger Rehabilitation Special Account Establishment 2006, as in force immediately before the commencement of s 4 (definitions). Section 8 effects a variation of the former determination by inserting a new paragraph into subsection 5(1): namely, paragraph (f) to permit crediting amounts to the Ranger Rehabilitation Special Account 2017. This is an explicit textual amendment to the earlier instrument to recognise and direct funds to the new special account.

• Transfer of balances: Section 9 provides a transitional rule to transfer any amount standing to the credit of the former special account immediately before commencement into the new special account, up to and equal to that amount. That provision operationalises a continuity amendment so that existing funds are not stranded in the former account.

• Commencement specification: Section 2 states that the whole of the instrument commences on the day mentioned in paragraph 79(5)(a) of the Act as the day on which a determination made under subsections 78(1) and 78(3) takes effect. The Determination was signed and dated 15 March 2017 by the Minister for Finance. Section 2(2) clarifies that information in the commencement table’s column 3 is not part of the instrument and that that column may be edited or populated in versions published on the Federal Register of Legislation. That procedural notation governs how subsequent publications may present non-operative metadata.

• No amendments beyond this instrument recorded in the source: The text supplied does not record any subsequent amendments to this Determination, nor does it purport to revoke the former determination other than by inserting the crediting paragraph and enabling balance transfers. The instrument effects continuity by variation and transfer rather than explicit repeal language within the supplied text.

In sum, the amendment history recorded in the Determination is limited and specific: it varies the 2006 determination by insertion of a crediting power to the 2017 special account, authorises transfer of existing balances from the former special account to the new one, and fixes commencement by reference to the PGPA Act. The source does not document any further historical variations, revocations or later amendments.

The text of this Determination does not reference any litigation, court decisions or judicial interpretation. The instrument is an administrative financial determination that establishes a special account, specifies crediting and debiting rules, identifies an accountable authority and contains transitional provisions varying a prior determination. The source contains no mention of court proceedings, judicial challenges, or case law citations.

Consequently, based solely on the instrument as provided:

• There is no litigation recorded in the instrument itself.

• There are no named cases, judgments, or proceedings within the text that interpret or apply the Determination’s provisions.

• Any dispute over interpretation, compliance with the Ranger Uranium Project Government Agreement, repayments to original payers, or the lawful use of account funds would be resolved through the applicable legal channels under the PGPA Act, contractual or statutory regimes referenced (such as the Ranger Government Agreement), or through administrative review and judicial processes. The Determination does not stipulate dispute resolution mechanisms nor does it assert a privative clause or bar to judicial review.

Readers seeking litigation history should therefore consult external sources, including court databases and administrative law records, to identify whether any matter has been litigated that concerns the special account, the former special account, the Ranger Government Agreement, or related administrative actions. The instrument itself does not provide that information.

This instrument is concise but contains features that may produce operational or legal pitfalls if overlooked. The following are concrete points to watch, each grounded in the text:

• Commencement is defined by reference, not by date: The Determination’s commencement depends on the day mentioned in paragraph 79(5)(a) of the Act for determinations under ss 78(1) and 78(3) (s 2(1)). The instrument does not specify a calendar date in its operative text. Operators must therefore verify the precise commencement date in the PGPA Act or authoritative commencement records rather than relying on the Determination’s signature date.

• Column 3 metadata is explicitly non-operative: Section 2(2) states that any information in column 3 of the commencement table is not part of the instrument and may be edited in published versions. Do not treat explanatory or publication metadata in that column as legally operative.

• The primary rehabilitation standard is external: Section 7(1) conditions the rehabilitation purpose on performing rehabilitation “in accordance with the Ranger Uranium Project Government Agreement (as amended).” The Determination does not set substantive rehabilitation standards itself; compliance with s 7(1) therefore requires reference to that Agreement. Misreading s 7(1) as a standalone standard risks non-compliance with the Agreement’s requirements.

• “Any person” is broad: Section 6(b) permits amounts “received from any person” to be credited to the account. That is an expansive textual formulation that potentially includes private entities, lessees, contractors, or other non-governmental actors. No statutory proviso is included to limit the category, so agencies should confirm whether any other law, policy, or contract restricts external payments into the account.

• Repayment to original payers is conditional: Section 7(2) permits repayment to an original payer of amounts credited to the special account or former special account “after any necessary payments made for the purposes mentioned in paragraph (a).” The textual condition means original payers’ entitlement to repayment is contingent on expenditure needed to achieve rehabilitation outcomes; implementing this requires careful accounting and determination of what counts as “necessary payments,” a term not defined in the Determination.

• Reducing the balance without a payment: Section 7(d) allows the account balance to be reduced “without making a real or notional payment” by effecting remittances to the Official Public Account as agreed between the Finance Minister and the responsible minister. That unusual bookkeeping device can alter the special account’s available appropriation without a normal debit; practitioners must ensure ministerial agreement is properly documented and that appropriation accounting treatment is consistent with Treasury requirements.

• The Determination authorises administrative charges: Section 7(c)(i)-(ii) explicitly allows administration and dealing with direct and indirect costs to be debited from the account. While operationally useful, this permits the account to self-fund its administration and reduces funds available for rehabilitation, so budgeting and cost-monitoring are necessary to avoid erosion of the account’s primary rehabilitation purpose.

• Transition relies on a particular former determination: The source identifies a specific former determination (the 2006 instrument) and varies it by insertion of a paragraph to permit crediting to the 2017 account (s 8). Implementers must ensure that the former determination is identified correctly and that the inserted paragraph is properly recorded in the operative version of that instrument.

• Accountable authority named by position: Section 10 names the Secretary of the Department of Industry, Innovation and Science as the accountable authority. Changes in departmental structure, machinery-of-government changes, or Secretary appointments must be managed to ensure that the designated accountable authority at any given time is the correct legal entity to exercise the functions and responsibilities the Determination prescribes.

These are textual and operational “gotchas” that flow directly from reading the Determination. They point to places where implementers should double-check external documents, ministerial agreements, accounting entries and definitions, and the interaction with the Ranger Government Agreement and the PGPA Act to avoid unintended outcomes.

Compliance under this Determination requires aligning receipts, expenditures and governance with the instrument’s text and the broader PGPA Act framework. Practical steps, based strictly on the instrument’s provisions, are:

1. Confirm commencement date and operative text:

   • Verify the precise commencement day referred to in paragraph 79(5)(a) of the Act for determinations under ss 78(1) and 78(3) (s 2(1)). Do not assume the signature date is the commencement date.
   • Ensure any publication metadata in the commencement table’s column 3 is not treated as law (s 2(2)).

2. Ensure accounting channels are established:

   • Set up the Ranger Rehabilitation Special Account 2017 within the department’s financial systems consistent with s 5.
   • Record the Official Public Account as the central bank account reference (s 4) for any remittances.

3. Control receipts in line with s 6:

   • Accept credits only where they fall into permissible categories: amounts received in the course of performing functions that relate to the account’s purposes (s 6(a)), and amounts received from any person for the purposes of the special account (s 6(b)).
   • For third-party payments, require written confirmation of purpose and authority for crediting to the special account; maintain documentation demonstrating that the payment is for the account’s purposes.

4. Authorise debits strictly within s 7 purposes:

   • Use funds primarily to rehabilitate the Ranger Project Area in accordance with the Ranger Uranium Project Government Agreement (as amended) (s 7(1)). Maintain a reference copy of that Agreement to demonstrate conformity.
   • If repaying an original payer under s 7(2), document that necessary payments for rehabilitation have been made prior to repayment.
   • Charge administration and direct/indirect costs to the account only where they are incidental to the rehabilitation purpose and are adequately documented (s 7(c)(i)-(ii)).

5. Manage remittances and appropriation effects:

   • For any reduction of the account balance without a payment, secure written agreement between the Finance Minister and the responsible minister as contemplated by s 7(d). Retain ministerial agreements and supporting advice to show lawful remittance and appropriation treatment.
   • Coordinate with central finance and Treasury units to ensure remittances and any appropriation adjustments are recorded correctly in the Official Public Account.

6. Implement transitional requirements:

   • If there is a balance in the former special account immediately prior to commencement, effect a debit from the former special account and credit the new special account up to that balance in accordance with s 9. Record the transfer clearly, matching amounts and ensuring that the transfer does not exceed the balance then standing.
   • Ensure the former determination reflects the inserted crediting power (s 8) so that future action under the former determination recognises the new account.

7. Assign and document accountability:

   • Reflect in internal delegations and governance records that the accountable authority for the special account is the Secretary of the Department of Industry, Innovation and Science (s 10).
   • Ensure the accountable authority is aware of duties to bank, record, reconcile and report special account activity under the Act’s broader accountability framework.

8. Recordkeeping and audit readiness:

   • Maintain transaction-level documentation for each credit and debit demonstrating legal authority under ss 6 and 7 respectively.
   • Keep documentation of ministerial agreements, repayments to original payers, and the rationale for any administrative charges to the account.
   • Prepare to show auditors that debits were applied only for the Determination’s permitted purposes.

9. Review contractual and legal interfaces:

   • Where rehabilitation work is delivered under contract or the Ranger Uranium Project Government Agreement, ensure contract terms permit savings, rebates, or third-party payments to be directed into the special account.
   • For repayments required by other Acts or laws, ensure that the legal basis for repayment is documented before debiting the account (s 7(e)).

10. Monitor departmental changes:

• If departmental responsibilities or the accountable authority change, update internal governance and public records to ensure the named accountable authority remains the correct legal officer to act under this Determination (s 10).

Following these procedural steps will align practice with the Determination’s textual commands: accept only authorised receipts, debit only for authorised purposes, document ministerial agreements and transfers, and maintain accountable authority oversight. Because the Determination sits within the PGPA Act framework, operators should also ensure compliance with any relevant reporting, audit and financial management rules contained in that Act and related Commonwealth financial guidance, notwithstanding that those external rules are not reproduced in the Determination itself.
