PGPA Act Determination (Enforcement Special Account 2016) — Establishment

Special account established (s 5). The central legal object is the Enforcement Special Account 2016 (the special account). As a PGPA Act determination under subsection 78(1) of the PGPA Act, the instrument brings that special account into the PGPA governance and appropriation architecture (s 3).

Credits permitted (s 6). The instrument identifies three categories of allowed credits:

• amounts received in the course of performing functions that relate to the account’s purposes (s 6(a));
• amounts received from any person for the purposes of the special account (s 6(b)); and
• amounts debited from the earlier Enforcement Special Account established by the 2006 Determination (s 6(c)).

Purposes for debits (s 7). The instrument provides a defined list of purposes for which amounts standing to the credit of the special account may be debited. These are narrowly tied to enforcement activity and associated liabilities:

• payments to investigate and/or bring legal or administrative proceedings in the exercise of ASIC’s functions and powers, in relation to suspected breaches that are of significant public interest; the list explicitly includes alleged breaches of the Corporations Act 2001 and the Australian Securities and Investments Commission Act 2001 (s 7(a)(i)-(ii));
• court costs which may be awarded against ASIC arising from such investigations or proceedings (s 7(b));
• other amounts for which ASIC may be liable arising out of those proceedings or investigations, or anticipated proceedings or investigations, including amounts arising from agreements in relation to these proceedings (s 7(c));
• disbursements or repayments in relation to incidental activities (s 7(d));
• a specific power to reduce the balance of the special account without making a real or notional payment (s 7(e)); and
• repayments required by law of amounts that have been credited to the special account (s 7(f)).

“Significant public interest” defined (s 4). The instrument defines “significant public interest” for the Determination’s purposes: a suspected breach is of significant public interest if it relates to a breach, or a class of breaches, determined in writing by the accountable authority of ASIC. The accountable authority for the special account is set out as the Chairperson of ASIC (s 8), so the written determination power is vested internally in ASIC’s accountable authority.

Transitional variation (Part 2). The instrument amends the 2006 Financial Management and Accountability Determination 2006/31 by adding an item that authorises credits to the Enforcement Special Account 2016 (Part 2). This creates an explicit link between the previous special account arrangements and the new 2016 special account.

Statutory lifecycle (s 2, Note 2). The instrument’s commencement is tied to PGPA Act timing rules (s 2 and Note 1 to s 2), and the instrument notes the automatic ten-year repeal mechanism in the Legislation Act 2003 that will cause the instrument to cease having effect on 1 October 2026 (Note 2 to s 2).

Appropriation interaction (Notes to s 6 and s 7). The instrument expressly contemplates interaction with Appropriation Acts and the Consolidated Revenue Fund: the notes point to the possibility that an Appropriation Act item covering a special account purpose could permit amounts to be debited against that appropriation and credited to the special account, and that subsection 78(4) of the PGPA Act appropriates the Consolidated Revenue Fund for expenditure for the purposes of the special account up to the balance of the special account at the time of payment (Notes to s 6 and Note 1 to s 7). The instrument therefore operates inside the broader Commonwealth appropriation framework and signals how payments from the special account interact with ordinary appropriation mechanisms.

Correction mechanism (note to s 7). The instrument contemplates debiting amounts where they have been incorrectly credited because of clerical mistake or exercise of discretion based on a fundamental mistake of fact or law, and signals that legal advice should be obtained before debiting on that basis (Note to s 7). This creates a correction conduit subject to internal legal advice.

Primary accountable entity. The primary administrative actor designated by the Determination is the Chairperson of the Australian Securities and Investments Commission, who is specified as the accountable authority for the special account (s 8). That officer is legally responsible for administering the account within the PGPA Act framework.

ASIC as operator and beneficiary. The Determination is designed around ASIC’s enforcement functions. The debiting purposes are payments to investigate and/or bring proceedings in the exercise of ASIC’s functions and powers in relation to suspected breaches of law that the accountable authority determines are of significant public interest (s 7(a)). ASIC therefore both controls access to the account and is effectively the operational beneficiary of its funds when conducting enforcement activity.

Persons who provide funds. The Determination authorises credits to the special account from “amounts received from any person for the purposes of this special account” (s 6(b)). That wording captures private parties, settlement payers, statutory recoveries, or third-party contributors, provided the amounts are received for the account’s purposes. The instrument does not further constrain the identity, form, or conditions attaching to such receipts; it simply permits their crediting.

Entities facing investigations or proceedings. Parties who are the subject of ASIC investigations or proceedings are indirectly affected because the Determination establishes a dedicated, ring-fenced funding channel for investigations and litigation described in s 7(a). The Determination also foresees payment of court costs awarded against ASIC arising from such matters (s 7(b)), which makes those litigation outcomes relevant to the resources in this account.

Treasury/Consolidated Revenue Fund. The Determination interacts with Commonwealth appropriation mechanisms. The notes refer to the role of Appropriation Acts and the Consolidated Revenue Fund in making payments for the purposes of the special account up to its balance (Notes to s 6 and s 7). That ties the account’s use to the broader Commonwealth appropriations and payment architecture.

Minister(s) and previous account arrangements. The instrument defines “relevant Minister” as a Minister who administers the Corporations Act 2001 or the Australian Securities and Investments Commission Act 2001 (s 4). It also affects prior institutional arrangements by permitting amounts debited from the prior Enforcement Special Account established under the 2006 determination to be credited to the new account (s 6(c)), and by amending that earlier determination to permit credits to the 2016 account (Part 2).

Courts and third parties awarding liabilities. Because s 7(b) allows payments in relation to court costs which may be awarded against ASIC, courts and litigants who successfully obtain costs orders against ASIC will have a direct bearing on the special account balance. Likewise, agreements reached in relation to proceedings (s 7(c)) that create liabilities for ASIC will directly engage the account.

Administrative staff and internal legal advisers. The note to s 7 contemplates the account being debited to correct clerical or fundamental mistakes and recommends obtaining legal advice before doing so. That requires internal legal review capability and administrative controls.

No criminal penalties in the instrument itself. The Determination contains no provisions imposing civil or criminal liability on private persons or agencies; its effects are administrative and financial, not punitive. It establishes where certain enforcement-related funds are to be parked and how they may be used.

Accountable authority duties (s 8; s 4). The instrument assigns clear responsibility to an accountable authority: the Chairperson of ASIC is the accountable authority responsible for the special account (s 8). Under the Determination, that accountable authority has the power to determine what constitutes a suspected breach “of significant public interest,” because the definition of “significant public interest” ties the concept to a written determination by “the accountable authority of the ASIC” (s 4). That creates an internal duty to record in writing which breaches or classes of breaches are considered of significant public interest before using the account for the enforcement activity described in s 7(a). The Determination therefore creates a documentation duty: a written determination must exist for the account’s s 7(a) funding purpose to be engaged for a given suspected breach class.

Powers to receive and disburse funds (s 6, s 7). The Determination gives the accountable authority the administrative power to credit and debit the special account within the statutory parameters. Credits allowed (s 6(a)-(c)) create an entitlement for the Canberra accounting system to accept certain receipts into the special account. Debits allowed (s 7(a)-(f)) create entitlements to make payments for the enumerated enforcement-related purposes, and to reduce the account balance without payment (s 7(e)). The Chairperson, acting as the accountable authority, must ensure these credits and debits are effected only for the permitted categories.

Record-keeping and legal-advice duty in corrections (note to s 7). The Determination expressly contemplates debits for incorrectly credited amounts “by virtue of a clerical mistake or exercise of a discretion based on a fundamental mistake of fact or law,” and the instrument advises that legal advice should be obtained before making a debit on that basis (note to s 7). This imposes an internal process duty: where correction of mistaken credits is contemplated, the accountable authority is expected to obtain legal advice and presumably to document the basis for the correction.

Appropriation interaction (Notes to s 6 and s 7). The Determination records that Appropriation Acts can operate in such a way as to permit amounts to be debited against an appropriation and credited to the special account (Note 1 to s 6), and that subsection 78(4) of the PGPA Act appropriates the Consolidated Revenue Fund for expenditure for the purposes of the special account up to the special account’s balance at the time of payment (Note 1 to s 7). These notes signal that responsible officers must observe appropriation and payment rules for outlays from the special account and ensure any interplay with Appropriation Acts is properly handled.

No private-party obligations beyond payments made voluntarily or by agreement (s 6(b)). The Determination allows amounts “received from any person for the purposes of this special account” (s 6(b)) to be credited. This creates a right for the accountable authority to accept and record those receipts. It does not create statutory compulsion for private parties to pay; any payments from persons will arise from separate arrangements, settlements, or statutory recoveries. The Determination does not specify conditions for accepting such amounts, leaving the terms and processes to ASIC’s administrative practice.

Repayment duty (s 7(f)). The Determination includes a duty to repay amounts that have been credited to the special account as required by law (s 7(f)). Where law requires repayment, the account may be used to make that repayment, which imposes a legal obligation to satisfy statutory or contractual repayment requirements.

Transitional duty (Part 2). The instrument varies the 2006 Determination to permit crediting of amounts to the Enforcement Special Account 2016. Administrators must therefore ensure the 2006 Determination is read as including that power after the variation.

No penalties in the Determination. The instrument does not create offences, fines, or administrative sanctions. Its duties and rights are predominantly administrative, financial, and documentation-focused, centred on the accountable authority’s responsibilities to manage credits, debits, and written determinations about significant public interest.

No penal provisions in the instrument. The Determination contains no express criminal or civil penalty clauses. It establishes administrative rules for credits and debits to a special account, assigns accountable authority responsibility to the Chairperson of ASIC, and specifies permitted purposes for the use of funds (ss 5-8). It does not, however, create offences, infringement notices, pecuniary penalties, or personal liability for independent actors within its text.

Enforcement in this context is the use of funds, not the imposition of sanctions. The Determination funds ASIC’s investigative and enforcement activity (s 7(a)). It does not itself authorise or prescribe enforcement action against third parties, nor does it alter the substantive enforcement powers contained in the Corporations Act 2001 or the Australian Securities and Investments Commission Act 2001; it provides a funding vehicle for ASIC to exercise its existing functions and powers. The instrument therefore affects enforcement capacity rather than enforcement law.

Court costs and liabilities are contemplated (s 7(b)-(c)). The Determination permits payments from the special account for court costs which may be awarded against ASIC arising out of investigations or proceedings, and for other amounts for which ASIC may be liable arising out of those proceedings or anticipated proceedings, including as a result of agreements made in relation to those proceedings (s 7(b)-(c)). These provisions set out the account as the pool for meeting liabilities arising from litigation, but they do not prescribe enforcement mechanisms to compel third parties to pay into the account. They do, however, create an administrative channel to satisfy liabilities if and when they arise.

Correction mechanism for mistaken credits (note to s 7). The instrument expressly contemplates debiting the special account to correct an incorrect credit that resulted from a clerical mistake or a discretionary exercise based on a fundamental mistake of fact or law, and it advises obtaining legal advice before making such a debit. That guidance operates as an internal control measure rather than as a statutory penalty, but it does impose a procedural precaution tied to potential financial adjustments.

Appropriation and payment rules apply (Notes to s 6 and s 7). The notes refer to interaction with Appropriation Acts and subsection 78(4) of the PGPA Act´s appropriation of the Consolidated Revenue Fund for payments up to the balance of the special account. Those appropriation mechanics constrain how and when the Commonwealth can make payments related to the account. Compliance with those appropriation rules is a legal requirement under the PGPA Act architecture; the Determination’s notes highlight that payments must be made in the appropriation framework and that the special account’s balance interacts with Consolidated Revenue Fund availability.

Monitoring and accountability implications. Because the accountable authority (Chairperson of ASIC) must record, in writing, what is a “significant public interest” breach or class of breaches (s 4), there is an implied accountability pathway: decisions to use the account for particular investigations should be documented. The Determination’s administrative character thus creates an audit trail that could be relevant to oversight bodies, but the Determination itself does not set out specific reporting or audit obligations beyond existing PGPA Act requirements referenced in the instrument.

PGPA Act foundation (s 3; notes to ss 2, 6 and 7). This Determination is made under subsection 78(1) of the Public Governance, Performance and Accountability Act 2013 (s 3). The instrument therefore operates within the PGPA Act special account regime. The notes explicitly reference subsection 79(5) of the PGPA Act in relation to commencement (s 2 Note 1) and subsection 78(4) in relation to appropriation from the Consolidated Revenue Fund for expenditure for the purposes of the special account up to the balance of the special account at the time of payment (Note 1 to s 7). The Determination therefore must be read and applied in the context of PGPA Act processes for special accounts, appropriations, and accountable authority responsibilities.

Legislation Act 2003 automatic repeal (s 2 Note 2). The instrument notes that subsection 50(1) of the Legislation Act 2003 provides for automatic repeal of legislative instruments ten years after registration on the Federal Register of Legislation, and states that the instrument ceases to have effect on 1 October 2026 (s 2 Note 2). This creates a statutory lifecycle for the determination and a requirement to re-enact or extend arrangements if they are to continue beyond that date.

Corporations Act 2001 and ASIC Act referenced in purposes (s 4; s 7). The Determination’s purposes explicitly include funding for investigations and proceedings relating to suspected breaches of the Corporations Act 2001 and the Australian Securities and Investments Commission Act 2001 (s 7(a)(i)-(ii)). The definition section also links ASIC to the Australian Securities and Investments Commission Act 2001 (s 4). The Determination does not change, supplement, or alter the substantive provisions of those Acts; it provides a funding mechanism for ASIC’s exercise of powers already contained in those statutes.

Interaction with Appropriation Acts (Note 1 to s 6). The instrument notes that Appropriation Acts may provide that if any of the purposes of a special account are covered by an item in an Appropriation Act,whether or not that item refers to the special account,then amounts may be debited against the appropriation for that item and credited to the special account (Note 1 to s 6). This signals that the special account is not isolated from annual appropriation processes: where appropriation items overlap with the special account’s purposes, funds may be moved between appropriations and the special account in a way consistent with Appropriation Act provisions.

Public Governance, Performance and Accountability Rule 2014 (note to s 6). The instrument cites subsection 27(5) of the PGPA Rule 2014 in relation to repayment mechanics (Note 2 to s 6). That indicates that repayment of amounts debited from the account interacts with PGPA Rule processes and that repayments may be credited back to the special account where appropriate. Administrators must therefore apply the PGPA Rule mechanics for repayments and crediting.

Financial Management and Accountability Determination 2006/31 (Part 2). The Determination amends the prior 2006 Determination by adding permission to credit amounts to the Enforcement Special Account 2016 (Part 2). This establishes continuity between the old and new special account arrangements and requires administrators to interpret the 2006 Determination as varied to permit crediting to the 2016 account.

Internal administrative law and audit frameworks. While the Determination does not specify reporting or audit detail, it sits within the PGPA Act and Rule frameworks which contain obligations on accountable authorities for financial management, record-keeping, and reporting. The instrument’s notes and references imply that administrators must conform to those existing PGPA obligations when operating the special account.

Limits of the Determination. The Determination does not amend substantive enforcement laws (for example, it does not expand ASIC’s statutory powers under the Corporations Act or ASIC Act) and it does not itself create new offences or enforcement mechanisms enforceable against third parties. Its legal effect is financial and administrative: it creates a source and sink for certain enforcement-related monies and liabilities inside the PGPA Act financial governance framework.

Single instrument dated and made by Minister (front page and signature). The Determination is dated 23 August 2016 and is made by the Minister for Finance, Mathias Cormann (front matter). The instrument establishes the Enforcement Special Account 2016 (title and s 1).

No subsequent amendments recorded in the instrument text. The body of the supplied instrument contains no later amendments, revocations, or schedules other than the transitional variation in Part 2 that updates the earlier Financial Management and Accountability Determination 2006/31. There are no internal schedules amending other sections beyond the specific changes set out.

Transitional variation to 2006 Determination (Part 2). The only textual variation recorded is a single addition to the end of subsection 5(1) of Financial Management and Accountability Determination 2006/31, by inserting “; and (g) credit amounts to the Enforcement Special Account 2016.” That is the sole amendment of another instrument contained in this Determination.

Statutory expiry mechanism in Legislation Act (s 2 Note 2). The Determination notes that, under subsection 50(1) of the Legislation Act 2003, a legislative instrument is repealed automatically on the first of 1 April or 1 October ten years after being registered on the Federal Register of Legislation, and states that the instrument ceases to have effect on 1 October 2026. That creates an automatic expiry date for the Determination unless action is taken under the Legislation Act to re-register or replace it.

Compositional history limited to the instrument. The supplied text does not record any prior versions of the 2016 Determination, nor any legislative history such as exposure drafts, consultation, or parliamentary debates. The instrument itself makes an internal cross-reference to the 2006 Enforcement Special Account, but it does not purport to amend any other instruments beyond the single addition to the 2006 Determination.

No revocation of predecessor accounted for in text. The Determination permits credits of amounts debited from the earlier Enforcement Special Account established by the 2006 Determination to be credited to the new account (s 6(c)) and amends the 2006 Determination to permit that crediting (Part 2). The instrument does not explicitly state that it revokes the 2006 Determination or any prior instrument, nor does it alter the substantive terms of that earlier determination except to add the crediting permission. Any revocation, replacement, or further amendment would need to appear in subsequent instruments or legislative action; none is recorded in the supplied text.

No litigation referenced. The Determination text supplied contains no references to court decisions, statutory interpretation cases, or past litigation outcomes that have shaped the instrument. It cites statutory provisions in the PGPA Act, Legislation Act 2003, the Corporations Act 2001, the Australian Securities and Investments Commission Act 2001, and the PGPA Rule 2014, but it does not mention any judicial authorities or cases.

No judicial challenge recorded in the instrument. The instrument does not disclose any challenges to its validity, operation, or scope, and the supplied text contains no history of litigation involving this Determination.

Implication for practitioners. Because the Determination contains no litigation history or cited cases, practitioners will need to rely on the text itself and on the PGPA Act framework (which the Determination cites) for legal interpretation. The Determination’s operative provisions are administrative and financial; where legal contestation arises in future (for example, disputes over whether a credit was properly received or whether a debit was properly made to correct a mistaken credit), relevant authorities would be the PGPA Act, the PGPA Rule, and any applicable general law, none of which are recited in the Determination as precedent.

Monitoring for future case law. The Determination’s mechanisms,particularly the accountable authority’s written determinations of “significant public interest” and the correction mechanism for mistaken credits,could, in theory, give rise to judicial review or other proceedings in the future. The supplied instrument does not record such litigation, so it is a live point for practitioners to monitor if disputes about discretion, administrative decision-making, or payment mechanics arise.

“Significant public interest” is an internal determination (s 4; s 8). The Determination defines “significant public interest” by reference to a written determination “by the accountable authority of the ASIC” (s 4). The Determination then specifies that the accountable authority responsible for the special account is the Chairperson of ASIC (s 8). In practice this means that a single accountable officer’s internal written determination controls whether the special account can be used under s 7(a) for a given suspected breach or class of breaches. Practitioners should note that the trigger for the account’s use is not an external or statutory test but an internal written decision by the accountable authority.

Broad permitted credits (s 6(b)). The Determination allows amounts “received from any person for the purposes of this special account” to be credited (s 6(b)). The text does not limit the kinds of persons who may provide such amounts, nor does it place express conditions on the nature of receipts that can be accepted under that heading. That leaves the scope of permissible third-party receipts administratively broad, and may require careful internal policy and disclosure handling to manage potential conflicts, conditional payments, or reputational considerations.

Repayment and correction mechanics (s 7(f); note to s 7). The Determination permits debiting the special account to repay amounts credited as required by law (s 7(f)) and contemplates corrective debits for clerical mistakes or decisions based on a fundamental mistake of fact or law (note to s 7). The note recommends obtaining legal advice before debiting on that basis. Practically, an administrative error that credits funds in error can be corrected, but the Determination requires legal assessment and careful process. Mistimed corrections or failure to obtain advice may risk misapplication of funds inside the PGPA framework.

Reduction of balance without payment (s 7(e)). The instrument authorises debiting the special account to “reduce the balance of the special account (and, therefore, the available appropriation) without making a real or notional payment” (s 7(e)). That mechanism can change the account’s available appropriation without an associated cash flow. For administrators and auditors, this creates an accounting tool whose use should be documented and justified; misuse could affect reported appropriation availability or undermine transparency if not properly recorded.

Interplay with Appropriation Acts (Note 1 to s 6). The Determination notes that where a purpose of the special account is covered by an Appropriation Act item, amounts may be debited against that appropriation and credited to the special account. Practitioners must be alert to the procedural steps and approvals required under Appropriation Acts and the PGPA Act when moving funds between appropriation items and the special account, because simple administrative treatment without compliance with appropriation rules could create legal risk.

Lifecycle expiry (s 2 Note 2). The Determination notes automatic expiry on 1 October 2026 under the Legislation Act mechanism. If the special account is needed beyond that date, either a replacement determination or a re-registration process is required. Practitioners must manage that timeline to avoid a lapse in the statutory basis for the special account.

No operational detail on acceptance of third-party funds. While the Determination authorises crediting amounts from any person, it does not prescribe how such funds must be accepted, any conditions on acceptance, or what governance arrangements apply to mitigate conflicts of interest or reputational risk. That governance vacuum requires ASIC to adopt internal procedures if it intends to accept third-party funding.

No penalty or sanction provisions. The Determination is an administrative funding instrument. It does not authorise enforcement or add to ASIC’s statutory powers; it simply funds ASIC’s exercise of existing powers. Practitioners must therefore look to the Corporations Act and the ASIC Act for substantive enforcement authority.

Transitional continuity issues (s 6(c); Part 2). The Determination allows amounts debited from the prior Enforcement Special Account established by the 2006 Determination to be credited to the new account (s 6(c)) and amends the 2006 Determination accordingly (Part 2). Reconciliation of legacy balances and administration of transferred items may require special attention to ensure no double-counting or misallocation occurs.

Audit and reporting not specified in the text. The Determination does not itself set out reporting, publication, or parliamentary notification requirements specific to this account; these obligations would be supplied by the PGPA Act and rules or internal ASIC practice. Practitioners should verify applicable reporting obligations under the PGPA Act and internal finance policies.

Document written determinations about “significant public interest” (s 4, s 7(a)). Before using the special account under s 7(a), the accountable authority must determine in writing that a suspected breach or class of breaches is of significant public interest. Compliance requires producing and retaining that written determination, and linking it to the decision to use account funds for the related investigation or proceedings.

Maintain clear records for credits (s 6). The account permits specific classes of credits: amounts received in the course of relevant functions (s 6(a)), amounts received from any person for the purposes of the account (s 6(b)), and amounts debited from the prior 2006 Enforcement Special Account (s 6(c)). Administrators should maintain a ledger that records the source, legal basis, and purpose of each credit, together with related approval or documentation showing the funds meet the statutory criteria for crediting.

Ensure debits are for permitted purposes only (s 7). Payments from the account must be for the narrow list of purposes in s 7. Operationally, each proposed debit should be checked against the statutory categories: s 7(a)-(f). Where a debit is contemplated because it is required by law (s 7(f)) or is to correct a mistaken credit (note to s 7), obtain and retain contemporaneous legal advice as recommended by the instrument’s note.

Obtain legal advice before correcting mistaken credits (note to s 7). The Determination explicitly advises obtaining legal advice before debiting the account to correct a clerical mistake or a discretionary decision made on a fundamental mistake of fact or law. Compliance practice should therefore require a formal legal clearance and a written rationale before any corrective debit is executed.

Adopt internal policies for accepting third-party receipts (s 6(b)). Because the Determination allows amounts from any person to be credited if received for the purposes of the account, ASIC should have an internal policy covering acceptance criteria, conflict-of-interest checks, conditions on receipts, accounting treatment, and transparency. That policy should document approvals required to accept such funds and how they are attributed to the account.

Track court costs and liabilities (s 7(b)-(c)). Because the account is expressly available for court costs awarded against ASIC and other liabilities arising from proceedings or anticipated proceedings (s 7(b)-(c)), finance officers must monitor litigation positions, cost exposure, and settlement agreements to ensure sufficient funds are available and properly recorded against the special account balance.

Coordinate with appropriation processes (Note 1 to s 6; Note 1 to s 7). If an Appropriation Act item covers the purposes of the special account, administrators must follow the procedural rules for debiting against the appropriation and crediting the special account. Likewise, where payments are to be made from the Consolidated Revenue Fund up to the special account balance (as signalled by Note 1 to s 7), ensure that payment processing complies with PGPA Act and departmental appropriation procedures.

Plan for the instrument’s expiry and continuity (s 2 Note 2). The Determination will cease to have effect on 1 October 2026 under the Legislation Act’s ten-year rule. If the special account is to continue beyond that date, plan for replacement, re-registration, or other legislative/instrument action in advance to avoid an unintended lapse in the statutory basis for the account.

Reconcile legacy accounts and follow transition variation (s 6(c); Part 2). If amounts are being transferred from the prior 2006 Enforcement Special Account, ensure the transfers are reconciled, documented, and consistent with the added subsection (g) to the 2006 Determination. Financial reconciliation should show the provenance of funds and any residual obligations tied to those receipts.

Implement internal audit and oversight procedures. The Determination places financial responsibilities on the accountable authority. Good practice requires internal audit coverage of the special account’s transaction streams, processes for approval of credits and debits, reconciliations with the general ledger, and review of compliance with PGPA Act obligations. While the Determination does not prescribe a reporting regime beyond PGPA Act obligations, internal reporting to ASIC’s governance bodies about the account’s balance, incoming receipts, and liabilities arising from proceedings will be prudent.

Retain documentation linking actions to statutory text. For each credit and debit, keep a short legal note that cites the relevant Determination provision (for example, s 6(a) or s 7(b)), the date, the amount, the source or recipient, and any approvals or legal advice obtained. This will assist in demonstrating that all transactions were within the statutory scope of the Determination and will be useful for audits, parliamentary questions, or oversight processes.
