PGPA Act Determination (Christmas Island Phosphate Mining Rehabilitation Special Account 2016) — Establishment

The instrument turns on a set of PGPA Act concepts applied to a single targeted funding vehicle. Key concepts appearing in the instrument are: special account; credits to the special account; purposes for which debits may be made; accountable authority; commencement, effect and automatic expiry; and transitional variation of an earlier determination. Each of these is instantiated in short, precise clauses.

Special account: The instrument establishes a named special account “for the purposes of paragraph 78(1)(a) of the PGPA Act” (s 5). Under the PGPA Act framework special accounts are discrete accounts that permit money to be set aside for specified purposes; the instrument’s text uses that statutory framework to define the account’s existence and scope.

Credits to the special account: Section 6 lists three classes of amounts that are allowed to be credited. These are (a) amounts received by the Commonwealth from other governments or persons for the purposes of the special account; (b) amounts received in the course of performing functions relating to the purposes of the special account; and (c) amounts debited from the existing 2006 special account (the FM Act Determination 2006/11). The instrument also expressly reminds administrators that Appropriation Acts may provide for amounts to be debited against an appropriation item and credited to the special account (Note 1 to s 6), and that repayment of what was debited may be credited back subject to PGPA Act and Rule provisions (Note 2 to s 6 referring to para 74(1)(b) and s 27(5) of the PGPA Rule).

Purposes for debiting (permitted uses): Section 7 identifies three permitted uses of amounts standing to the credit of the special account: (a) payments for rehabilitating phosphate mine sites on Christmas Island in accordance with environmental management and rehabilitation plans; (b) to reduce the balance of the special account without making a real or notional payment; and (c) to repay, as required by law, amounts that have been credited to the special account. The instrument adds explanatory notes including cross-reference to subsection 78(4) of the PGPA Act which provides an appropriation from the Consolidated Revenue Fund up to the balance of the special account at time of payment, and notes about debiting for balance reduction or correction of clerical or fundamental mistakes (including the recommended step to obtain legal advice before debiting on that mistaken-fact or law basis).

Accountable authority: Section 8 designates the Secretary of the Department of Infrastructure and Regional Development as the accountable authority responsible for the special account, fulfilling the PGPA Act requirement in paragraph 78(1)(d).

Transitional variation: Part 2 varies section 5 of the earlier Financial Management and Accountability Determination 2006/11 by adding an item that permits the earlier determination to credit amounts to the new 2016 special account. This creates an operational bridge between the 2006 account and the 2016 account.

Temporal concepts: The instrument’s commencement and termination are governed by statutory rules. Commencement follows the disallowance period under paragraph 79(5)(a) of the PGPA Act (s 2 Note 1), and the instrument will cease to have effect automatically on 1 October 2026 under Legislation Act 2003 s 50(1) (s 2 Note 2), unless further legislative action is taken.

These concepts define a narrowly tailored financial instrument. The instrument does not specify detailed procedural rules for contracting, procurement, or detailed reporting beyond appointing the accountable authority and setting the permitted credit and debit categories. It does, however, produce binding administrative constraints on the handling of funds by describing what can be credited and debited and by linking to statutory appropriation and repayment mechanisms.

The instrument affects a range of public-sector actors and third parties that transact money in connection with the rehabilitation of phosphate mining sites on Christmas Island. The text itself identifies the Secretary of the Department of Infrastructure and Regional Development as the accountable authority (s 8), so responsibility for administering the account, maintaining records, and ensuring compliance with the instrument’s credit and debit rules rests with that office.

Primary affected parties inside government:

• The Secretary of the Department of Infrastructure and Regional Development, as accountable authority (s 8). That office must implement controls to receive credits, make debits for the permitted purposes, and reconcile the special account with the Consolidated Revenue Fund appropriation framework.
• Officers and units in that department responsible for financial management, appropriations, and program delivery who will need to apply the PGPA Act framework when making payments under s 7(a) or debiting or crediting the account under s 6 and s 7.
• The Treasurer and Appropriation Acts processes indirectly, in so far as Appropriation Acts may be used to debit an appropriation item and credit a special account (note to s 6).

External affected parties:

• Other governments and persons who provide amounts for the purposes of the special account. Section 6(a) explicitly permits amounts received by the Commonwealth from other governments or persons for the purposes of the special account to be credited. Those contributors will need to document the purpose and any conditions attached to funds so the departmental administrators can correctly classify credits.
• Entities contracted or paid to undertake rehabilitation work on Christmas Island phosphate mine sites, because payments for rehabilitation are an express permitted purpose (s 7(a)). Those contractors will be paid from the special account subject to compliance with environmental management and rehabilitation plans.
• Parties to the earlier 2006 special account: s 6(c) and the Part 2 variation allow amounts debited from the 2006 account to be credited to the 2016 account. The administrators of the earlier account and any counterparties must coordinate transfers or reclassifications.

Indirect public effects:

• The Consolidated Revenue Fund’s appropriation envelope is affected through the PGPA Act appropriation mechanism, as amounts debited from the special account at the time of payment are appropriated under subsection 78(4) of the PGPA Act (note to s 7). This means that the Commonwealth’s capacity to spend on these rehabilitation activities is linked to the account balance, affecting budgetary presentation and funds availability.

Who does not appear to be affected, as per the text:

• The instrument does not create new regulatory obligations for private landholders or tenants beyond the funding and payment mechanics described. It does not, in itself, allocate liability for rehabilitation costs to any private actor; it only sets funding rules for Commonwealth payments.

Timing and longevity implications for affected parties:

• Contributors and recipients need to be aware that the instrument ceases to have effect on 1 October 2026 unless re-made or extended (s 2 Note 2). That affects planning horizons for projects and for transferring amounts from the earlier 2006 account.

In short, the accountable authority is the central decision-maker, departmental finance and operational staff are the implementers, private donors and contractors are the principal external transactors, and the Commissioner/Treasury appropriation processes are the fiscal framework within which the account operates.

The instrument imposes a constrained set of duties and rights grounded in the PGPA Act special account framework. It is administrative rather than primarily regulatory, and it allocates accounting powers and boundaries rather than prescriptive operational obligations.

Accountable authority duties and responsibilities:

• The Secretary of the Department of Infrastructure and Regional Development is named as the accountable authority responsible for the special account (s 8). That appointment gives that Secretary the duty to ensure the account is managed in accordance with the instrument and the PGPA Act. The instrument does not enumerate detailed reporting obligations, but the accountable authority’s duties derive from the PGPA Act framework referenced repeatedly in the instrument (see s 3, the definition in s 4, and cross-references in the notes to s 6 and s 7).

Rights to credit the account:

• The instrument grants the right to credit certain amounts to the special account: contributions from other governments or persons for the account’s purposes (s 6(a)); amounts received in the course of performing functions relating to the account’s purposes (s 6(b)); and amounts debited from the 2006 special account (s 6(c)). The instrument also notes that Appropriation Acts may provide for amounts to be debited against an appropriation and credited to the special account (note to s 6). These are rights to classify and accept funds into the special account when they meet the enumerated descriptions.

Rights to debit the account:

• The instrument authorises the account to be debited for three purposes under s 7: (a) payments for rehabilitation in accordance with environmental management and rehabilitation plans; (b) reducing the account balance without making a real or notional payment; and (c) repaying, as required by law, amounts that have been credited to the special account. Paragraph 7(b) establishes an explicit bookkeeping power to reduce the balance without payment.

Constraints and procedural pointers:

• The instrument contains notes that constrain how certain actions should be approached. It cites subsection 78(4) of the PGPA Act to highlight that the Consolidated Revenue Fund is appropriated up to the balance of the special account at the time of payment (note to s 7). For debiting to correct clerical mistakes or fundamental mistakes of fact or law, the instrument includes an explicit advisory note that legal advice should be obtained before an amount is debited on that basis (note to s 7). This creates a de facto procedural duty to seek legal advice in certain correction scenarios.

Interaction with appropriations:

• By referencing the appropriation mechanism (PGPA Act s 78(4)) and Appropriation Acts (note to s 6), the instrument creates a fiscal right for the Commonwealth to spend for the purposes set out in s 7 up to the balance of the account, subject to the mechanics of appropriation law. Those mechanics grant the Commonwealth the right to expend money from the Consolidated Revenue Fund up to the available appropriation represented by the account balance.

Limits on duty and entitlement:

• The instrument does not create legal claims by third parties to the funds. It authorises the Commonwealth to receive and spend funds for specified purposes but does not establish entitlements or contractual rights for private claimants beyond normal Commonwealth contract and procurement law. The instrument also does not detail delegation arrangements; the accountable authority may have power to delegate under the PGPA Act, but no delegation text is included here.

Temporal duties:

• The account exists until the instrument ceases to have effect (automatic repeal under the Legislation Act 2003 s 50(1), noted at s 2 Note 2), so duties and rights tied to the instrument are bounded by its duration unless re-enacted.

In summary, the instrument imposes the duty on the Secretary to administer the account, grants rights to accept specified credits and to debit for defined purposes (including a non-payment reduction mechanism), and points to procedural safeguards (notably advising legal advice for corrections) and appropriation interactions that together set the practical legal boundaries for the account’s operation.

The instrument itself does not establish criminal or civil penalties, nor does it prescribe an enforcement regime specific to this special account. It is a financial determination that operates within the PGPA Act framework and therefore interacts with the broader compliance, audit and accountability mechanisms provided by that Act and other relevant Commonwealth financial law. The instrument contains no penalty provisions, infringement notices, or enforcement procedures of its own.

Enforcement and accountability mechanisms implicit in the instrument:

• Accountable authority oversight: By naming the Secretary of the Department of Infrastructure and Regional Development as the accountable authority (s 8), the instrument places day-to-day compliance and record-keeping responsibility on that office. Under the PGPA Act framework (which the instrument invokes by reference), accountable authorities are subject to statutory duties of financial management, reporting, and internal control; although those PGPA Act duties are not reproduced in this instrument, the special account exists only within that statutory context (see s 3 and s 4 defining the PGPA Act as the relevant statute).
• Appropriation and audit pathways: The instrument references subsection 78(4) of the PGPA Act (note to s 7), which links the special account balance to appropriation from the Consolidated Revenue Fund. Because Commonwealth expenditure and special accounts are subject to audit by the Auditor-General and parliamentary scrutiny, the practical enforcement of compliance will come through existing Commonwealth audit and oversight processes implicit in the PGPA Act and audit law; the instrument does not create any new enforcement channel.
• Procedural advice for corrections: The instrument recommends obtaining legal advice before debiting amounts to correct what it describes as clerical mistakes or exercises of discretion based on fundamental mistakes of fact or law (note to s 7). That instruction is procedural rather than punitive, but it imposes an internal control expectation: administrators should not unilaterally correct certain mistaken credits without legal advice.

Absence of direct penalty clauses:

• Because the instrument contains no express penalties, any sanction for misuse, misapplication, or misstatement of the special account would arise under existing Commonwealth statutes (not included in the instrument text) such as the PGPA Act’s general accountability and offence provisions, audit findings, or other relevant statutes. The instrument’s silence on penalties means enforcement will follow the standard Commonwealth administrative and financial accountability pathways rather than a bespoke enforcement design.

Practical enforcement consequences:

• Failures to administer the account correctly can lead to administrative consequences including adverse audit reports, requirements to repay mistakenly spent amounts under the PGPA Act’s repayment and crediting rules (notes to s 6 and s 7 referencing para 74(1)(b) and PGPA Rule s 27(5)), and internal departmental discipline or review. The instrument does not itself grant any third party standing to enforce use of the funds beyond normal prudential and transparency mechanisms that apply to Commonwealth expenditure.

In short, enforcement and penalties are not specified in this determination. Accountability and correction rely on the PGPA Act’s general governance regime, audit and parliamentary oversight, and the internal controls mandated by the instrument’s assignment of an accountable authority and the instrument’s procedural notes.

The determination explicitly operates as a statutory instrument under the PGPA Act and cross-refers to several statutory provisions and an earlier FM Act determination. Its text contains cross-references and notes that situate the special account within Commonwealth appropriations, the Legislation Act’s automatic repeal regime, and existing financial management instruments.

Primary statutory interactions in the instrument:

• Public Governance, Performance and Accountability Act 2013 (PGPA Act): The entire instrument is made under subsection 78(1) of the PGPA Act (s 3). Section 5 establishes the account “for the purposes of paragraph 78(1)(a) of the PGPA Act”. Sections 6 and 7 expressly invoke paragraph 78(1)(b) and (c) respectively to identify permitted credits and debits. The instrument also relies on paragraph 79(5)(a) of the PGPA Act for commencement rules (s 2 Note 1). Additionally, the instrument’s note to s 7 references subsection 78(4) of the PGPA Act in relation to appropriation from the Consolidated Revenue Fund up to the account balance.
• Legislation Act 2003: The instrument cites s 50(1) of the Legislation Act 2003 to record that legislative instruments are automatically repealed on the first of 1 April or 1 October ten years after registration on the Federal Register of Legislation; consistent with that rule the instrument notes it ceases to have effect on 1 October 2026 (s 2 Note 2).
• Public Governance, Performance and Accountability Rule 2014 (PGPA Rule): The instrument refers to subsection 27(5) of the PGPA Rule in a note to s 6 regarding situations where amounts repaid may be credited to the special account and cross-references paragraph 74(1)(b) of the PGPA Act.
• Financial Management and Accountability Determination 2006/11: Part 2 of the instrument varies section 5 of that 2006 determination by adding a clause permitting amounts to be credited to the new 2016 special account. This creates a statutory linkage between the old and new instruments.

Operational interaction points and practical implications:

• Appropriation law: The instrument’s notes make clear that appropriation mechanics under the PGPA Act and Appropriation Acts are directly relevant. The note to s 6 states that Appropriation Acts may provide that if a special account purpose is covered by an item in an Appropriation Act, amounts may be debited against that appropriation and credited to the special account. The note to s 7 reminds administrators that subsection 78(4) appropriates the Consolidated Revenue Fund for expenditure for the purposes of the special account up to the balance of the account. These cross-references signal that the special account’s operation is embedded within the Commonwealth’s broader appropriation and fiscal architecture.
• Reclassification and correction rules: The instrument notes the rule that where an amount equal to an amount debited from a special account is repaid, the amount may be credited to the special account, citing paragraph 74(1)(b) of the PGPA Act and subsection 27(5) of the PGPA Rule (note to s 6). That ties refunds, repayments, or reclassifications to the statutory repayment rules in the PGPA framework.
• Administrative law and legal advice: The instrument’s note recommending legal advice prior to debiting to correct clerical or fundamental mistakes of fact or law places legal-procedural interaction with the legal-advice and administrative-law frameworks. Seeking legal advice is not, in itself, a statutory requirement embedded in the instrument, but the instrument makes that advisory instruction explicit, thereby creating an internal governance expectation anchored in legal review and administrative law practice.
• Temporal interaction: The commencement depends on the disallowance mechanics in the PGPA Act (para 79(5)(a)) and the instrument is subject to the Legislation Act’s s 50(1) automatic expiry rule, which will extinguish the instrument on 1 October 2026 unless re-enacted or extended.

Matters not addressed by the instrument but governed by other laws:

• Procurement, environmental liability, and contractual rights: The determination authorises payments for rehabilitation in accordance with environmental management and rehabilitation plans (s 7(a)), but it does not itself establish the environmental standards, procurement procedures, or contract law terms. Those matters will be governed by relevant environmental law, procurement rules, contract law, and departmental policy , none of which are set out in the instrument.
• Offence and penalty provisions: The instrument contains no penalty provisions; enforcement and sanctions would therefore arise under the PGPA Act, criminal statutes, or other applicable laws where misconduct or unlawful expenditure occurred.

In short, the determination is tightly interwoven with the PGPA Act and its rules, the Legislation Act’s expiry regime, and the predecessor 2006 determination. Practical administration will require engagement with appropriation law, refund/repayment mechanics in the PGPA framework, departmental procurement and environmental regulatory regimes, and legal advice processes.

The text provided is self-contained and records a single instrument: the PGPA Act Determination (Christmas Island Phosphate Mining Rehabilitation Special Account 2016) , Establishment, made by the Minister for Finance, Mathias Hubert Paul Cormann, and dated 23 August 2016. The instrument contains an express transitional variation to an earlier Financial Management and Accountability Determination 2006/11 (FMAdet 2006/11) but does not itself record any prior amendments to the 2016 instrument.

Explicit amendment action recorded in the instrument:

• Part 2 , Transitional Variation: The instrument varies section 5 of the Financial Management and Accountability Determination 2006/11 by adding at the end the text “; and (d) credit amounts to the Christmas Island Phosphate Mining Rehabilitation Special Account 2016.” This is the only textual amendment recorded in the instrument to an earlier instrument. That variation allows the 2006 determination to credit amounts to the new 2016 special account.

Lifecycle metadata and temporal limitations:

• Commencement and effect: The instrument commences on the day provided for by paragraph 79(5)(a) of the PGPA Act (s 2). The instrument records the mechanism used by the PGPA Act for commencement (note to s 2). This means the instrument’s operational commencement was tied to the parliamentary disallowance timeline applicable to legislative instruments under the PGPA Act.
• Automatic expiry: The instrument explicitly notes the Legislation Act 2003 s 50(1) automatic repeal rule and states that, consistent with that rule, “this instrument ceases to have effect on 1 October 2026” (s 2 Note 2). No extension or later amendment is recorded in the instrument. Any continuation beyond that date would therefore require a new or varied instrument prior to expiry.

Absence of subsequent amendments or revocations in the text:

• The instrument does not include later amending schedules, revocations, or variations to itself. The only modification it makes is to the 2006 instrument via Part 2. The instrument is silent on any subsequent administrative instruments that might vary its operation after 2016; absent further instruments, its lifecycle ends automatically on 1 October 2026 per the Legislation Act rule cited.

Implications for practitioners:

• The transitional variation is the only direct historical amendment captured in the text; practitioners should treat the 2016 instrument as the operative, standalone instrument establishing the account and as the authorising instrument for credits and debits until its automatic expiry date. If the special account is to continue beyond 1 October 2026, the accountable authority or minister will need to re-establish or vary the determination in accordance with the Legislation Act and PGPA Act processes.

In short, the instrument itself records one amendment to a prior instrument and sets an automatic expiry date; it contains no further amendment history within the text supplied.

The instrument as supplied does not record any litigation history. It is a short determinate instrument that establishes an administrative financial mechanism and includes no references to legal proceedings, judicial decisions, or dispute resolution arising from its operation. The instrument names no cases and cites no judicial authority within the text.

Consequences of absence of litigation in the instrument:

• No precedential judicial interpretation: Because no cases are named, there are no binding judicial interpretations of the instrument within the text provided. Any disputes arising from the account’s establishment, the receipt or repayment of funds, or the use of funds for rehabilitation would be resolved under the general legal framework (PGPA Act, related statutes and rules, contract law and administrative law), but the instrument contains no record of such litigation.
• Reliance on statutory regime: Enforcement, review and remedy in case of disagreement or alleged misuse will therefore fall back on statutory review mechanisms (e.g. judicial review of administrative decisions where appropriate), auditing, and the PGPA Act’s compliance and accountability frameworks. The instrument itself gives no indication of contested legal questions specific to its terms.

Practical note for legal teams:

• Because the instrument contains an instruction that legal advice should be obtained before debiting on the basis of a fundamental mistake of fact or law (note to s 7), departments implementing the account are directed to consult legal counsel in certain circumstances. That advisory step suggests the instrument anticipates possible legal complexity in correcting mistaken credits, but the instrument does not indicate whether such issues have in fact been litigated.

If litigation arises after the date of this instrument, any decisions or cases would need to be located in external legal databases or later instruments; the text provided does not include or summarise any such material.

The instrument appears simple on its face, but several concrete operational and legal issues arise directly from its text. Below are specific items that practitioners should note because they may present implementation, budgetary or legal surprises.

1. Automatic expiry date and planning horizon (s 2 Note 2)

• The instrument notes that legislative instruments are repealed automatically under the Legislation Act 2003 s 50(1) ten years after registration, and states the instrument “ceases to have effect on 1 October 2026” (s 2 Note 2). If rehabilitation projects, funding arrangements, or intergovernmental agreements extend beyond that date, administrators must plan for re-establishment or transition before expiry. Failure to act would remove the statutory basis for the special account at expiry.

2. Commencement uncertainty until disallowance period ends (s 2 and note)

• Commencement is tied to paragraph 79(5)(a) of the PGPA Act (s 2). Practically, there is a short window between registration and the date the instrument comes into effect, during which the instrument may be disallowed by Parliament. Administrators should not assume the account is operative until the disallowance period has passed.

3. Balance-reduction debits without payment (s 7(b) and note)

• Section 7(b) authorises debiting to “reduce the balance of the special account (and, therefore, the available appropriation) without making a real or notional payment.” That bookkeeping power can change the available appropriation without any external beneficiary receiving funds. This is a mechanism for adjusting fiscal presentation and appropriation availability. Practitioners should document the justification and accounting treatment for any such non-payment debits because they directly affect budget ceilings and the scope of money the Commonwealth may lawfully spend under subsection 78(4) of the PGPA Act (note to s 7).

4. Requirement to obtain legal advice before correcting certain mistakes (note to s 7)

• The instrument advises that legal advice should be obtained before debiting to correct amounts “incorrectly credited by virtue of a clerical mistake or exercise of a discretion based on a fundamental mistake of fact or law.” This creates a practical gate: administrators must involve legal counsel before performing certain corrections. That can delay corrections and requires legal resourcing.

5. Credits from the previous 2006 account and transitional variation (s 6(c) and Part 2)

• The instrument allows amounts debited from the 2006 account to be credited to the 2016 account (s 6(c)) and adds text to the 2006 determination to permit credits to the new account (Part 2). This implies migration of funds or reclassification between instruments. Practically, careful reconciliation and documentation are required to ensure funds moved from the 2006 account are authorised by both instruments and properly recorded.

6. Reliance on Appropriation Acts and PGPA Act mechanics (note to s 6; note to s 7 referencing s 78(4))

• The notes make clear that Appropriation Acts can debit from appropriations and credit special accounts and that subsection 78(4) appropriates the Consolidated Revenue Fund up to the balance of the special account at the time of payment. Administrators must ensure that payments align with appropriation law and that the special account’s balance is reconciled with appropriation items; failures here could raise questions of unlawful expenditure.

7. Narrow permitted use for payments (s 7(a))

• Payments are permitted only “in relation to rehabilitating phosphate mine sites on Christmas Island in accordance with environmental management and rehabilitation plans.” The precise interpretation of “in relation to” and whether ancillary costs (project management, monitoring, contracting costs, legal costs) fall within the permitted purpose is not defined in the instrument. Departments should document the nexus between any proposed expenditure and the rehabilitation plans.

8. No express third-party entitlements or procurement rules

• The instrument does not create contractual entitlements for third parties and does not describe procurement processes. Contractors and recipients of funds will rely on separate contracts and procurement authorisations; absence of procurement detail can create operational ambiguity if contracting is not coordinated with the accountable authority’s financial controls.

9. Auditing and public transparency expectations

• The instrument does not state reporting or publication obligations specific to the account, though standard PGPA Act reporting applies. Practitioners should ensure audit trails and documentation are in place for parliamentary and Auditor-General scrutiny.

10. No penalty provisions or bespoke enforcement

• Because the instrument contains no penalties, detection of misuse will rely on other statutes and audit/reporting mechanisms. This means that technical mistakes may be handled administratively, but significant errors could have consequences under broader Commonwealth law.

These are practical “gotchas” that arise directly from the instrument’s text. Each item identifies a point where administrative practice and legal compliance intersect and where failure to observe the instrument’s constraints or to coordinate with related statutory and budgetary mechanisms can produce governance, legal or fiscal risks.

To implement and comply with this determination, the accountable authority (the Secretary of the Department of Infrastructure and Regional Development, s 8) and departmental financial officers should adopt a set of concrete administrative steps and controls that align with the instrument’s text and its cross-references to the PGPA Act framework. The following actions are grounded in the instrument’s provisions and the notes it contains.

1. Record establishment and legal basis

• Maintain a clear record of the instrument as the legal basis for the special account, including the instrument’s date (23 August 2016) and the statutory authority (subsection 78(1) of the PGPA Act, s 3). Keep the instrument on file with registration metadata for disallowance and expiry monitoring.

2. Confirm commencement and monitor disallowance timeline

• Do not treat the account as operative until the disallowance period under paragraph 79(5)(a) of the PGPA Act has passed (s 2 and note). Document the date the instrument came into effect and confirm registration on the Federal Register of Legislation. Monitor the instrument’s expiry set by Legislation Act 2003 s 50(1) and plan for re‑establishment or variation well ahead of 1 October 2026 (s 2 Note 2).

3. Establish chart of accounts and reconciliation processes

• Create a distinct bookkeeping code for the Christmas Island Phosphate Mining Rehabilitation Special Account 2016 and ensure financial systems can record credits and debits consistent with s 6 and s 7. Reconciliation processes should ensure that amounts credited under s 6(a)-(c) are supported by documentation (agreements, receipts, records of amounts debited from the 2006 account).

4. Controls around permitted credits

• Verify that funds credited fit one of the permitted classes in s 6: (a) amounts from other governments or persons for the special account’s purposes; (b) amounts received in the course of performing functions related to the account’s purposes; or (c) amounts debited from the 2006 special account. Maintain contributor agreements and activity records establishing the nexus to the account’s purposes.

5. Controls around permitted debits

• Ensure all proposed debits fall within the express permitted purposes in s 7: payments for rehabilitation in accordance with environmental management and rehabilitation plans; balance reductions without payment (book entries); or repayments required by law. Require documentation demonstrating that payments for rehabilitation are consistent with the applicable environmental management and rehabilitation plans. For balance-reduction entries under s 7(b), require senior sign-off and audit trail documentation explaining the rationale and accounting treatment.

6. Legal advice and correction protocols

• Implement the instrument’s advisory instruction to obtain legal advice before debiting amounts to correct clerical mistakes or where a discretion was exercised based on a fundamental mistake of fact or law (note to s 7). Put an internal process in place that triggers legal counsel review and written legal advice before such corrective debits are carried out.

7. Coordinate with the 2006 special account administrators

• Where credits are to be transferred from the Financial Management and Accountability Determination 2006/11 account, follow the transitional provision in Part 2 and ensure records evidencing amounts debited from the 2006 account are prepared and retained. Reconcile transfers with both instruments’ records.

8. Appropriation and budgeting coordination

• Liaise with central budget and appropriation officers to ensure that accounting treatments align with Appropriation Acts and with subsection 78(4) of the PGPA Act (note to s 7) which appropriates the Consolidated Revenue Fund up to the balance of the special account at the time of payment. Ensure payments do not exceed the available appropriation and that any reclassification or balance-reduction entries are reflected in appropriation reporting.

9. Procurement, contracting and program delivery alignment

• For payments made under s 7(a), ensure procurement and contracting processes align with Commonwealth procurement rules, and that contracts and invoices link explicitly to the rehabilitation plans referenced by the instrument. Retain environmental management and rehabilitation plans to demonstrate the nexus of each payment to the permitted purpose.

10. Audit trail, reporting and transparency

• Keep detailed transaction-level records, agreements, contracts, and approvals supporting credits and debits. Prepare documentation to facilitate Auditor-General reviews and parliamentary scrutiny. Although the instrument does not set bespoke reporting, standard PGPA Act reporting and audit obligations apply; ensure readiness for audit.

11. Delegations, approvals and segregation of duties

• Within the department, establish clear delegation authorities for accepting credits, approving debits, making balance-reduction entries, and engaging legal counsel for corrections. Segregate duties so that authorisation, recording and reconciliation are independent functions.

12. Plan for expiry or re-establishment

• Because the instrument ceases to have effect on 1 October 2026 (s 2 Note 2), plan for continuity of funding and legal authorisation if rehabilitation activity continues beyond that date. Initiate the process for renewal, variation, or transition well in advance of expiry.

13. Manage third-party contributions and conditions

• Where funds come from other governments or persons (s 6(a)), ensure formal agreements record conditions of the funding, reporting expectations, and the permissible use of funds to avoid misclassification. Obtain any required approvals for accepting conditional funds under departmental and national rules.

14. Training and policy updates

• Train financial officers, program managers and legal advisers on the account’s permitted credits and debits, the required nexus to environmental management and rehabilitation plans, the balance-reduction mechanism, and the need for legal advice in prescribed correction scenarios.

Following these practical steps will align departmental administration with the instrument’s statutory text. The focus must be on documenting the nexus between receipts and the account’s purposes, ensuring legal review for corrections, reconciling transfers from the 2006 account, coordinating appropriation treatment, and preparing for the instrument’s automatic expiry.
