PGPA Act Determination (Australian Federal Police SOETM Special Account 2021)

This instrument establishes a dedicated special account for the Australian Federal Police called the Australian Federal Police SOETM Special Account 2021 (the special account). The instrument is a Public Governance, Performance and Accountability Act 2013 (PGPA Act) determination made under subsections 78(1) and 78(3) of the Act (s3), and it formally creates the account for purposes set out in the determination (s5, s8). The account takes effect on the later of the day mentioned in paragraph 79(5)(a) of the Act or 1 July 2021 (s2).

Mechanically the determination does four things. First, it defines the accountable authority responsible for the special account: the accountable authority of the Australian Federal Police (AFP) (s6). Second, it sets out the types of amounts that may be credited into the account: amounts held on trust or for the benefit of a person other than the Commonwealth; amounts received in the course of performing functions related to the special account’s purposes; and amounts received from any person for the account’s purposes (s7). Third, it sets out explicit purposes for which amounts may be debited from the account, listing six categories including disbursements for trust funds, services performed for or with other Commonwealth or non-Commonwealth bodies, joint activities, intergovernmental agreements, repayments required by law or court order, and a mechanism to reduce the account balance without a real or notional payment (s8). Fourth, it provides transitional arrangements by carrying forward the opening balance from the previously established SOETM special account and revokes the previous SOETM instrument (s9, s10). Part 3 contains limited temporal provisions that are themselves repealed shortly after revocation, but the effects of Part 3 remain in force (s11).

The instrument does not set out penalties or a compliance enforcement regime in itself. Its legal basis and operational effect are framed against the PGPA Act (not reproduced here), and it largely establishes accounting and administrative rules for money flows to and from the account (ss3, 5-11).

The instrument uses a small set of recurring statutory concepts. Each is defined or used in a specific accounting or administrative way that determines how funds flow into, are held in, and may be drawn from the special account.

• Special account (establishment): The instrument creates, under paragraph 78(1)(a) of the PGPA Act, a special account named the Australian Federal Police SOETM Special Account 2021 (s5). A special account is an appropriation mechanism under the PGPA Act; here the instrument supplies the particular account rules for the AFP’s Services for Other Entities and Trust Moneys function.

• Accountable authority: The person or entity responsible for the special account is identified as the AFP’s accountable authority (s6). That links administration, decision-making and stewardship obligations for the account to the AFP leadership structure rather than to a generic Commonwealth central agency.

• Credits and eligible receipts: Three categories of receipts may be credited to the account (s7): (a) amounts held on trust or otherwise on behalf of, or for the benefit of, a person other than the Commonwealth; (b) amounts received in the course of performing functions that relate to one or more purposes of the special account; and (c) amounts received from any person for one or more purposes of the special account. These categories combine fiduciary-type receipts (trust money) with transactional receipts arising from services performed and with more general receipts paid by third parties.

• Purposes and permissible debits: Section 8 lists six specific purposes for which funds may be debited: disbursement of trust or third-party funds (s8(1)); disbursements connected with services performed for, on behalf of, or together with Commonwealth or non-Commonwealth entities (s8(2)); disbursements for joint activities (s8(3)); disbursements connected with intergovernmental agreements (s8(4)); repayments required or permitted by court order, Act or other law (s8(5)); and a mechanism to reduce the balance (and therefore appropriation) without making an actual payment (s8(6).)

• Transitional mechanics: The account’s opening balance is expressly set equal to the amount standing to the credit of the prior SOETM special account immediately before commencement (s9). The prior enabling instrument (Financial Management and Accountability (Establishment of Special Account for Australian Federal Police) Determination 2011/03) is revoked (s10). Part 3 includes temporary definitions and repeal mechanics that are themselves scheduled for repeal but with an express preservation of their effects (s11).

Direct legal actors

• Australian Federal Police (AFP): The AFP is the accountable entity for the special account. The instrument explicitly names the accountable authority responsible for the special account as the accountable authority of the AFP (s6). That places operational responsibility, record-keeping and control over credits and debits with AFP’s senior financial officers and governance structures.

• Third parties with monies held on trust: The first category of receipts permitted to be credited are amounts held on trust, or otherwise on behalf of or for the benefit of a person other than the Commonwealth (s7(1)). Those third parties include individuals, organisations or foreign governments for whom the AFP holds funds in a fiduciary or custodial capacity.

• Contracting counterparties and service recipients: The second and third credit categories capture amounts received in the course of performing functions related to the account’s purposes and amounts from any person for those purposes (s7(b), (c)). That covers entities that pay the AFP for services, including other Commonwealth entities, Commonwealth companies, governments, organisations, bodies or persons named in s8(2)-(4).

• Commonwealth entities and companies: The purposes for debiting explicitly include services performed for, on behalf of, or together with Commonwealth entities and Commonwealth companies (s8(2)). Those entities may be counterparty payers or recipients of joint activity payments.

• Foreign governments and intergovernmental partners: Purposes include disbursements in connection with agreements between the Commonwealth and another government (s8(4)), and joint activities (s8(3)). Therefore, foreign governments that enter into agreements with the Commonwealth or directly with AFP-related activities are affected, as are their representatives handling funds.

Indirect or administrative actors

• Finance officers and internal auditors: Operational management of receipts and disbursements will fall to AFP finance staff; the instrument creates explicit accounting categories and an opening balance requirement (s9) that auditors will need to verify.

• The Commonwealth’s appropriation system and budget central agencies: Section 8(6) provides a mechanism to reduce the balance of the special account and therefore the available appropriation without making a real or notional payment. That directly affects appropriation totals and the presentation of funds in Commonwealth accounts, which will be relevant to finance agencies and appropriation managers.

The determination organises a set of administrative entitlements and constraints rather than substantive duties in the penal or regulatory sense. The key duties and rights, as framed by the instrument, are primarily accounting and stewardship obligations imposed on the AFP as the accountable authority.

Accountable authority’s duties and rights

• Responsibility for the account: The AFP’s accountable authority is expressly made responsible for the special account (s6). That assigns to the AFP the right to control crediting and debiting consistent with the purposes and permitted credits in the instrument.

• Crediting funds: Under section 7, the AFP may accept and credit to the special account amounts that fall into the listed categories: amounts held on trust for non-Commonwealth persons (s7(1)), amounts received when performing relevant functions (s7(b)), and amounts received from any person for the account’s purposes (s7(c)). The AFP therefore has the right to receive and hold these funds in the special account.

• Debiting funds: Section 8 lists the purposes for which amounts may be debited. The AFP has the right to effect disbursements in the enumerated cases: disbursing trust or beneficiary funds (s8(1)); disbursing for services performed for or together with Commonwealth and non-Commonwealth entities (s8(2)); disbursing for joint activities (s8(3)); disbursing connected to intergovernmental agreements (s8(4)); repaying amounts where law or court order requires or permits repayment (s8(5)); and reducing the account balance to reduce available appropriation without making an actual payment (s8(6)).

• Opening balance obligation: The instrument requires that, immediately after establishment, the opening balance equal the amount standing to the credit of the prior SOETM special account immediately before commencement (s9(1)-(2)). That is a mandatory accounting step to ensure continuity and means the AFP must ensure a precise carry-over of balances.

Constraints and implied duties

• Purpose-bound use: Credits and debits are constrained to the categories set by the instrument (ss7-8). The AFP must ensure that any credit or debit aligns with the listed descriptions; the instrument does not authorise uses beyond those stated.

• Administrative and legal compliance: The instrument is made under the PGPA Act (s3) and refers to provisions of the Act for commencement and other mechanics (s2). That links the special account to the broader PGPA governance and accountability framework. While the instrument itself does not spell out reporting obligations, that linkage implies the AFP’s duties under the PGPA Act generally apply to the account (s3).

The instrument does not include express penalty provisions, fines or criminal sanctions within its text. It operates as a PGPA Act determination that sets accounting rules for a special account rather than as a standalone enforcement statute.

Direct observations from the instrument

• No internal sanctions: The text contains no clauses that create offences, monetary penalties, infringement notices, or administrative sanctions for non-compliance with the determination itself. Sections 3, 5-11 frame establishment, credits, purposes and transition, but do not attach penalty mechanisms to breaches of those provisions.

• Reliance on PGPA Act framework: The instrument is made under subsections 78(1) and 78(3) of the PGPA Act (s3) and repeatedly references provisions of the Act for commencement (s2) and for the legal force of revocation and repeal (ss10-11). Enforcement, audit, and penalty mechanisms that apply to mismanagement of Commonwealth money are therefore located within the PGPA Act and related finance legislation and guidance, not in this determination. The determination does not reproduce those mechanisms; it delegates account design to the PGPA framework.

Who enforces and monitors

• Accountable authority duties and internal control: The accountable authority of the AFP is explicitly responsible for the account (s6). Under that designation, day-to-day responsibility for ensuring that credits and debits comply with the instrument’s categories will fall on AFP finance and governance structures. Internal controls, record-keeping and audit readiness will be administratively enforceable within the AFP under its governance arrangements.

• External oversight implied: Because the instrument is a PGPA Act determination, external oversight mechanisms under the PGPA Act (for example, audit by the Auditor-General or compliance reviews) are implicated by reference, although the instrument does not set those mechanisms out. Any external enforcement or sanctioning therefore will come through the PGPA Act and its enforcement regime rather than from this instrument’s text.

Practical effect for non-compliance

• Administrative consequences likely: The instrument places obligations on the AFP as accountable authority to admit only permitted receipts and make disbursements for permitted purposes (ss7-8). If these obligations are not met, the likely consequences are administrative (internal discipline, audit findings, reporting to the Auditor‑General or to the Finance Minister under the PGPA framework), but the instrument itself does not set out those consequences.

The determination is drafted tightly to slot into existing Commonwealth finance and agency law. It makes minimal normative law but aligns the AFP’s SOETM account mechanics with the Public Governance, Performance and Accountability Act 2013 and other identified instruments and sources of legal obligation.

Interaction with the PGPA Act

• Source of authority: The instrument is expressly made under subsections 78(1) and 78(3) of the PGPA Act (s3). The special account is established "for paragraph 78(1)(a) of the Act" (s5), the credits are set out for paragraph 78(1)(b) (s7), the purposes for paragraph 78(1)(c) (s8), and the accountable authority is appointed for paragraph 78(1)(d) (s6). The instrument therefore operationalises paragraph 78(1)'s elements in the context of the AFP.

• Commencement cross-reference: The instrument’s commencement date is the later of the day mentioned in paragraph 79(5)(a) of the Act or 1 July 2021 (s2). That explicitly ties its operative date to a separate PGPA Act provision, which will determine when the account starts to have legal effect.

Interaction with prior special account instrument

• Revocation: The instrument revokes the Financial Management and Accountability (Establishment of Special Account for Australian Federal Police) Determination 2011/03 (the SOETM instrument) (s10). The revocation transfers control to the new determination and requires transitional handling (s9).

• Opening balance continuity: The opening balance requirement (s9) makes the closing balance of the prior SOETM special account the opening balance of the new account. This preserves continuity of funds and obligations between instruments.

Interaction with the Australian Federal Police Act 1979

• Definition linkage: The determination’s definition of AFP references the Australian Federal Police established by the Australian Federal Police Act 1979 (s4). That connects institutional identity and possibly related statutory duties to the account, insofar as those duties affect how funds are acquired, held or disbursed.

Interaction with other laws and orders requiring repayment

• Repayment clause: Section 8(5) expressly contemplates repayment where a court order, Act or other law requires or permits repayment. This creates a point of legal interaction: funds in the special account may be used to satisfy externally imposed repayment obligations, so obligations under other Acts or court orders can override the account’s internal purposes to the extent they require repayment.

This instrument, presented as the PGPA Act Determination (Australian Federal Police SOETM Special Account 2021), contains its own single-stage amendment and revocation mechanics and records one explicit revocation of the prior instrument. The text itself is the primary legislative instrument in play; no subsequent amendments are recorded in the text supplied.

Key chronological items in the instrument

• Making and signature: The instrument is dated 31 May 2021 and signed by Simon Birmingham, Minister for Finance. The date appears at the front of the instrument and is consistent with the commencement mechanism that follows (opening lines).

• Commencement: The instrument provides that its operative date is the later of the day mentioned in paragraph 79(5)(a) of the PGPA Act or 1 July 2021 (s2). It also states that any information in Column 3 of the commencement table is not part of the instrument and may be edited in versions published on the Federal Register of Legislation (s2(2)). The instrument therefore anticipates updates to accompanying publication material without changing the instrument’s substance.

• Revocation of the prior SOETM instrument: Section 10 revokes the Financial Management and Accountability (Establishment of Special Account for Australian Federal Police) Determination 2011/03. There is no textual amendment of that 2011 instrument; revocation is absolute under s10.

• Transitional carry-over: Section 9 requires that the opening balance equal the amount standing to the credit of the SOETM special account immediately prior to commencement (s9(1)-(2)). That ensures an automatic carry-over of funds and obligations from the prior 2011 account into the 2021 account.

• Time-limited Part 3 and definitional repeal: Section 11 provides that Part 3 of the instrument (the transitional, revocation and repeal provisions) is itself repealed at the end of the seventh day after the revocation of the SOETM instrument under section 10 (s11(1)). It further provides that on the date of repeal, the definitions in section 4 of "SOETM instrument" and "SOETM special account" are repealed (s11(2)). Subsection 11(3) makes clear that despite the repeal of Part 3, its effects remain in force. That design creates a short-lived set of transitional provisions that are then removed from the instrument text but leave their intended operational consequences intact.

No further amendments recorded in instrument text

The instrument’s text contains no references to litigation, judicial decisions, or legal challenges. It does not name any cases, nor does it include any material suggesting that the determination has been the subject of judicial review or litigation proceedings. The document is a discrete administrative determination that establishes accounting and administrative rules for a Commonwealth special account.

What the instrument records about external legal effects

• Court orders as a debit trigger: Section 8(5) recognises that repayments required by a court order, Act or other law are a permissible debit purpose. That contemplates payment to meet judicially‑imposed obligations, but it does not itself report any existing litigation or orders needing effect.

• Absence of litigation references: There are no clauses that mention ongoing proceedings, settlements, or disputed trust funds in the text supplied. The instrument does not record case law or pre-existing court determinations related to the items it governs.

What practitioners should note

• No precedential guidance in the text: Because the instrument contains no litigation history or judicial interpretation citations, readers must rely on the plain text provisions and on the PGPA Act framework for any interpretive questions. The instrument does not supply judicially-informed definitions or examples that might appear in case law.

• Potential for future litigation: While the instrument does not reference past litigation, disputes may arise in the future over the classification of receipts as trust monies, the proper application of s8(6) (reduction of balance without payment), or the transition mechanics under s9-11. Any such litigation would not be indicated in the instrument itself and would need to be tracked through court records.

In short, the instrument record contains no litigation history. It anticipates legal interaction with court orders only in specifying that repayments required by court order are a valid debit purpose, and otherwise leaves enforcement and interpretation questions to the PGPA Act and the courts should disputes arise.

This instrument is short and technical, but it contains several features and drafting choices that create practical risks and administrative traps if not carefully managed. Each "gotcha" below is grounded in, and cites, the instrument’s text.

1. Definitions that vanish after a short period (s11)

• The instrument schedules the repeal of Part 3 at the end of the seventh day after revocation of the prior SOETM instrument (s11(1)). On that same date, the definitions of "SOETM instrument" and "SOETM special account" in section 4 are repealed (s11(2)). Despite those repeals, subsection 11(3) preserves the effects of Part 3. Administratively, that means the instrument’s text will change soon after revocation, but the substantive transitional consequences remain. Users must ensure they rely on substantive effects (carryover balance, revocation) rather than on the now-repealed in-text definitions. Failure to track the text changes in official publications could cause confusion when reviewing the instrument.

2. Opening balance must equal prior account credit (s9)

• The instrument requires the opening balance to equal the amount standing to the credit of the SOETM special account immediately prior to commencement (s9(1)-(2)). Practically this requires precise reconciliation with the prior special account. Any mismatches, unrecorded liabilities, or misclassified receipts from the prior account could produce administrative disputes over the correct opening balance. The instrument leaves this reconciliation duty to the accountable authority without specifying a dispute mechanism.

3. "Amounts held on trust" broadness and fiduciary risk (s7(1), s8(1))

• The crediting rules permit "an amount held on trust, or otherwise on behalf of or for the benefit of a person other than the Commonwealth" (s7(1)), and debits include disbursing such amounts (s8(1)). The instruments offers no further definition of "trust" or explanation of fiduciary standard. This ambiguity can complicate classification of receipts: are funds held under an express trust, a constructive trust, or simply held for safekeeping? Misclassification could expose the AFP to claims by beneficial owners or to audit findings.

4. Broad "received from any person" language (s7(c))

• Section 7(c) allows amounts received "from any person for one or more purposes of the special account" to be credited. That is broad and potentially captures diverse payments, including deposits, grants, fees or reimbursements. Without internal controls, payments could be credited incorrectly, leading to mistaken use of funds or to cross-subsidisation between government activities.

The instrument sets accounting permissions and constraints; compliance therefore consists primarily of administrative steps the AFP (as accountable authority) must take to ensure credits and debits conform to the determination and that the transitional mechanics are observed. The guidance below is an operational checklist grounded in the instrument’s text.

1. Establish clear governance ownership (s6)

• Assign responsibility to the AFP’s accountable authority and ensure senior officers understand they are explicitly the accountable authority for the special account (s6). Document delegations, approval thresholds and lines of accountability in accordance with the AFP’s internal governance arrangements and the PGPA Act framework under which the instrument is made (s3).

2. Reconcile and set the opening balance precisely (s9)

• Immediately after establishment, credit the special account with the opening balance equal to the amount standing to the credit of the prior SOETM special account immediately prior to commencement (s9(1)-(2)). Prepare a formal reconciliation package between the prior account and the new account, including bank statements, ledger balances, and schedules of trust monies. Given the mandatory nature of s9, retain contemporaneous evidence demonstrating the carry-over calculation.

3. Classify receipts to the prescribed categories (s7)

• Implement a receipt classification protocol aligned to s7: (a) amounts held on trust or for the benefit of non‑Commonwealth persons (s7(1)); (b) amounts received in the course of performing functions related to the account’s purposes (s7(b)); and (c) amounts received from any person for one or more of the account’s purposes (s7(c)). For each incoming payment, maintain documentation (agreements, invoices, trust instruments) that justifies the classification and supports crediting to the special account.

4. Limit disbursements to the enumerated purposes (s8)

• Authorise debits only where they fall within one of the six purposes in s8: disbursing trust funds (s8(1)), disbursing for services performed for/on behalf of/with other bodies (s8(2)), disbursing for joint activities (s8(3)), disbursing for intergovernmental agreement purposes (s8(4)), repaying where law or court order requires (s8(5)), and reducing the account balance without a real payment (s8(6)). Where a proposed debit is not clearly covered, obtain formal legal or finance advice before acting.
