PGPA Act Determination (Art Rental Special Account 2016) — Establishment

The primary legal concepts in this determination are special account establishment, permissible credits, permissible debits (purposes), appropriation interactions, accountable authority designation, transitional variation, commencement and expiry.

Special account establishment: Clause 5 effects the statutory creation of a special account for the purposes of paragraph 78(1)(a) of the PGPA Act, naming it Art Rental Special Account 2016. The device of a special account under the PGPA Act permits monies to be held and used for specified purposes while interfacing with consolidated appropriation law as noted in clause 7 Note 1, which references subsection 78(4) of the PGPA Act that appropriates the Consolidated Revenue Fund for expenditure up to the balance of the special account at the time of payment.

Permissible credits: Clause 6 defines three categories of money that may be credited: (a) receipts in the course of performing functions that relate to the account’s purposes; (b) amounts from any person for the account’s purposes; and (c) amounts equal to amounts debited from the earlier Art Rental Special Account established by FMAD 2006/18. The clause is supplemented by notes that draw in Appropriation Acts as a possible source of credits and references to the PGPA Rule 2014 for repayments to the Commonwealth (clause 6 Notes).

Permissible debits and purposes: Clause 7 lists the authorised purposes for debiting the account. These purposes are broad and operationally framed: acquiring, deaccessioning, leasing, promoting, developing, exhibiting, lending, conserving, and otherwise managing an art rental collection for the Commonwealth; incidental activities and direct and indirect administrative costs; reducing the balance of the special account without making a real or notional payment; and repaying amounts required by law. The clause is accompanied by explanatory notes that explain how debits for administration or to correct erroneous credits should be treated and that legal advice should be sought before debiting amounts on account of fundamental mistakes of fact or law (clause 7 Notes).

Appropriation interface: The instrument repeatedly ties the special account to the appropriation framework. Clause 7 Note 1 cites subsection 78(4) of the PGPA Act: expenditure for the account’s purposes is appropriated from the Consolidated Revenue Fund up to the balance of the special account at the time of payment. Clause 6 Note 1 draws in Appropriation Acts as a source of credits where applicable.

Accountable authority and operational control: Clause 8 designates the Secretary of the Department of Communications and the Arts as the accountable authority for the special account under paragraph 78(1)(d) of the PGPA Act. That designation determines who legally bears the responsibilities under the PGPA Act for the account.

Transitional linkage: Part 2 modifies FMAD 2006/18 by adding a clause to subsection 5(1) to permit crediting amounts to the Art Rental Special Account 2016, thereby creating a formal channel between the old FMAD account and the new PGPA special account.

Commencement and expiry: Clause 2 provides that commencement is governed by paragraph 79(5)(a) of the PGPA Act, meaning the instrument comes into effect on the day provided by that provision (which the instrument itself references), and the instrument will cease to have effect on 1 October 2026 under the Legislation Act 2003 s 50(1) automatic repeal rule. These timing provisions create a bounded operational window for the account unless renewed.

Legal and practical effects flow to a limited set of actors that the instrument identifies and the categories implied by the credit and debit rules.

Accountable authority: The Secretary of the Department of Communications and the Arts is explicitly named as the accountable authority (clause 8). That means the Secretary is the named decision maker for the account under the PGPA Act framework, and therefore responsible for ensuring the account is managed according to the PGPA Act and this determination. The instrument does not itself provide delegation mechanics, but the designation determines who must allocate funds and authorise debits and credits in practice.

Departmental staff and administrators: Those employed by the Department of Communications and the Arts who administer the account will be the operational actors charging administrative, direct and indirect costs against the special account (clause 7(b)). The instrument authorises administrative costs to be debited, which instructs accounting practice within the department for the account’s operations.

Suppliers, lenders and counterparties: External parties who supply goods or services to the Commonwealth in connection with an art rental collection, or who donate or pay money for related purposes, may have funds credited to the special account under clause 6(b). The instrument therefore affects contractual and financial relationships between the Department and private parties insofar as payments made to the Commonwealth for account purposes can be retained in the account and applied to its purposes.

Beneficiaries of the art rental collection: Entities or activities that receive payments from the account , for example, suppliers for acquisition, conservation, exhibition venues, lessees, lenders and artists , are affected because the account funds those activities (clause 7(a)). The list of permitted purposes covers a wide range of art collection lifecycle activities, meaning that parties engaged in acquisition, deaccession, leasing, conservation, promotion and lending could be paid from the special account.

Appropriations and other Commonwealth accounts: The instrument interacts with Appropriation Acts (clause 6 Notes) and the previous Art Rental Special Account created under FMAD 2006/18 (clause 6(c) and Part 2 transitional variation). Entities that manage or monitor consolidated appropriation flows and government accounting will be affected because this account changes where and how certain flows are recorded and appropriated.

Parliament and oversight bodies: The commencement mechanism references paragraph 79(5)(a) of the PGPA Act, which concerns parliamentary disallowance windows. The instrument therefore engages parliamentary oversight by permitting disallowance within the statutory window, and the instrument’s registration on the Federal Register of Legislation is referenced (clause 1 and clause 2 Note 1). Bodies charged with audit or review of Commonwealth finances will see the account on public registers and will be able to treat it as a distinct pool for the listed purposes.

Citizens and patrons: Members of the public who participate in exhibitions, borrowings, loans or otherwise engage with the art rental collection are indirectly affected because the account funds the activities that shape public access, exhibitions and loans. The instrument allows receipts generated in performing functions (clause 6(a)) to be retained and used for the collection’s activities, which affects pricing, access and project funding in practice.

No express third-party rights or penalties: The instrument does not create contractual rights or statutory penalties in favour of private third parties. It simply sets the accounting and appropriation framework within which payments and receipts are to be treated and administered.

This determination primarily sets out permitted financial movements and the accountable authority rather than prescriptive operational duties. The key duties and rights implicit in the text are:

Accountable authority responsibilities: The Secretary of the Department of Communications and the Arts is the accountable authority for the special account (clause 8). As such, the Secretary holds the office-level responsibility to ensure the account is managed in accordance with the PGPA Act and this determination. The instrument does not enumerate duties in operational detail, but the accountable authority designation places the account within the scope of the Secretary’s statutory responsibilities under the PGPA Act framework (clause 3 makes the instrument under subsection 78(1) of the PGPA Act).

Right to retain particular credits: Clause 6 grants the right to credit to the special account: (a) amounts received during performance of functions relating to the account’s purposes; (b) amounts received from any person for the account’s purposes; and (c) amounts equal to amounts debited from the earlier Art Rental Special Account established under FMAD 2006/18. These are rights to treat receipts as account credits rather than remitting them immediately to Consolidated Revenue Fund, subject to appropriations law as noted in the instrument’s explanatory notes.

Right to expend up to the account balance: Clause 7 Note 1 refers to subsection 78(4) of the PGPA Act, which appropriates the Consolidated Revenue Fund for expenditure for the purposes of a special account up to the balance of the special account at the time of payment. The practical effect is that the account provides an available appropriation for the listed purposes equal to its balance when payments are made.

Authority to incur administrative and incidental expenses: Clause 7(b) permits payments for activities incidental to the main purpose, explicitly including direct and indirect costs of administering the special account. That authorises departmental administrators to debit the account for such costs, subject to the account balance and appropriation constraints.

Authority to correct mistaken credits: The instrument permits debiting where an amount has been incorrectly credited due to clerical mistakes or an exercise of discretion based on a fundamental mistake of fact or law, but the note stipulates that legal advice on the mistaken fact or law should be obtained before acting (clause 7 Note 2(c)). This is a procedural control embedded in the instrument that conditions the exercise of corrective debits.

Authority to reduce balance without payment: Clause 7(c) authorises debits that reduce the special account balance without making a real or notional payment. The accompanying Note 2(b) clarifies that such debits allow for the balance to be reduced with no payment or credit available to another party, account or appropriation. That is an explicit accounting power to diminish the account’s balance for unspecified administrative reasons, which affects the account’s available appropriation.

Repayment duty as required by law: Clause 7(d) allows debiting the account to repay amounts that have been credited to the special account where repayment is required by law. This creates a duty to return monies where a legal obligation mandates repayment, and the instrument recognises that possibility.

Commencement and continuity obligations: Clause 2 binds the commencement to parliamentary processes (paragraph 79(5)(a) of the PGPA Act) and notes the instrument’s automatic expiry under the Legislation Act 2003, which imposes practical duties on the department to monitor and, if necessary, seek renewal or replacement before 1 October 2026.

Interaction with Appropriation Acts and PGPA Rule: Clause 6 Note 1 and the cross-reference to subsection 27(5) of the PGPA Rule 2014 indicate that rights to credit and obligations to repay or treat certain receipts must be observed alongside Appropriation Acts and relevant PGPA rules. The determination itself does not set those rules, but it expressly recognises their relevance.

No specific procedural detail for payments: The instrument does not set out payment authorisation thresholds, delegation mechanics, record-keeping obligations, or audit procedures. Those duties are left to the PGPA Act and associated rules and departmental procedures, as implied by the references to the PGPA Rule 2014 and the PGPA Act.

The instrument does not create standalone penalties, criminal offences or an independent enforcement regime. It is a statutory account determination that authorises certain accounting treatments and designates an accountable authority, and enforcement implications therefore flow from the wider statutory framework referenced in the instrument rather than from the instrument itself.

Absence of specified sanctions: There are no penalty clauses, infringement mechanisms, or specified sanctions in the instrument text. No sections of the determination prescribe fines, imprisonment or civil penalty regimes. Consequently, any enforcement action for misuse, mismanagement or non-compliance with the account’s prescribed uses would rely on the enforcement powers, civil remedies and accountability mechanisms available under the PGPA Act and other applicable statutes and rules, which the instrument references but does not reproduce (clauses 3, 6 Notes, 7 Note 2(c)).

Reference to PGPA Act appropriation rules: Clause 7 Note 1 invokes subsection 78(4) of the PGPA Act, which concerns appropriation of the Consolidated Revenue Fund up to the balance of a special account at the time of payment. Enforcement of appropriation law ordinarily falls under PGPA Act compliance and audit roles, so compliance risk for officials administering this account is tied to obligations and potential sanctions under the PGPA Act rather than to this instrument.

Corrective measures for mistaken credits: Clause 7 Note 2(c) expressly permits debiting an amount that has been incorrectly credited due to clerical error or a fundamental mistake of fact or law, but it instructs that legal advice should be obtained before debiting on that basis. That provision imposes a procedural requirement aimed at limiting improper correction and signalling that corrective action should be legally defensible. While not itself a penalty, failure to seek required advice before debiting could expose administrators to PGPA Act compliance consequences.

Interaction with Appropriation Acts and PGPA Rule: Clause 6 Note 1 and clause 6 Note 2 reference Appropriation Acts and subsection 27(5) of the PGPA Rule 2014 for the treatment of repaid amounts. Enforcement of those statutory and rule obligations lies under their respective frameworks. The instrument’s cross-references indicate that potential enforcement and remedial mechanisms are to be sought in those sources.

Parliamentary oversight and FRL registration: The commencement mechanism (clause 2) subjects the instrument to the parliamentary disallowance process described in paragraph 79(5)(a) of the PGPA Act. The instrument’s registration on the Federal Register of Legislation is noted (clause 1). These processes provide public and parliamentary oversight channels, which can prompt political or administrative consequences, but again the instrument does not itself prescribe sanctions.

In short, the instrument sets accounting permissions and duties; accountability and enforcement are functions of the PGPA Act, the PGPA rule and appropriation law. The determination provides no independent penalty provisions and relies on the broader public governance framework for compliance and enforcement.

The determination deliberately situates the special account within the existing Commonwealth financial architecture and references a number of external legal instruments. Its operation depends on those interactions.

PGPA Act: The instrument is made under subsection 78(1) of the PGPA Act (clause 3) and repeatedly invokes paragraphs and subsections of that Act. Clause 5 establishes the account "for the purposes of paragraph 78(1)(a) of the PGPA Act." Clause 6 addresses credits "for the purposes of paragraph 78(1)(b) of the PGPA Act." Clause 7 addresses purposes "for the purposes of paragraph 78(1)(c) of the PGPA Act," and clause 8 addresses the accountable authority "for the purposes of paragraph 78(1)(d) of the PGPA Act." Clause 2’s commencement reference relies on paragraph 79(5)(a) of the PGPA Act for the timing of effect. The determination thus depends on the PGPA Act for the legal effect of establishing a special account, for appropriation consequences, and for the broader governance obligations attached to an accountable authority.

Appropriation Acts: Clause 6 Note 1 states that Appropriation Acts may provide that if any of the account’s purposes are covered by an appropriation item then amounts may be debited against that appropriation and credited to the special account. That means the account operates alongside, and can be integrated with, the Consolidated Revenue Fund appropriations enacted in Appropriation Acts; such Acts can be the source of credits to the account in practice.

Legislation Act 2003: Clause 1 notes that all special account determinations are registered on the Federal Register of Legislation in accordance with the Legislation Act 2003. Clause 2 Note 2 cites subsection 50(1) of the Legislation Act 2003 to explain that a legislative instrument is automatically repealed on the first of 1 April or 1 October ten years after registration, and states that this instrument ceases to have effect on 1 October 2026. The Legislation Act therefore imposes an automatic expiry which affects continuity and requires attention to reissue or replacement if continued existence is desired.

Financial Management and Accountability Determination 2006/18: Clause 6(c) permits amounts debited from the Art Rental Special Account established by FMAD 2006/18 to be credited to the new account. Part 2 explicitly amends subsection 5(1) of FMAD 2006/18 by adding at the end a power "to credit amounts to the Art Rental Special Account 2016." That transitional variation creates a formal link and transfer mechanism from the prior FMAD-based account to the new PGPA special account.

PGPA Rule 2014: Clause 6 Note 2 references subsection 27(5) of the Public Governance, Performance and Accountability Rule 2014 as the statutory basis under which amounts repaid to the Commonwealth may be credited to the special account (under paragraph 74(1)(b) of the PGPA Act). That indicates that the rules on repaying funds and recording repayments in Commonwealth accounts apply to this special account.

Federal Register of Legislation registration: Clause 1 explicitly links registeration and public availability of the instrument. This interacts with transparency and public record obligations under the Legislation Act 2003.

Accounting and audit frameworks: While not named directly beyond the PGPA Act and PGPA Rule, the instrument’s references make clear that standard Commonwealth accounting and audit practices and parliamentary appropriations oversight apply to the account. Payments from the account are appropriated from the Consolidated Revenue Fund up to the account balance (clause 7 Note 1 referencing subsection 78(4) of the PGPA Act), and repayments and corrections must be treated in accordance with PGPA rules and Appropriation Acts where relevant.

In short, the instrument creates an account whose legal existence and operational constraints are determined by the PGPA Act, Appropriation Acts, the Legislation Act 2003, FMAD 2006/18 (as varied), and the PGPA Rule 2014. It is not an isolated instrument; its practical operation will be shaped by the broader Commonwealth financial statutory framework referenced throughout the determination.

The determination itself is dated 23 August 2016 and bears the Minister’s signature block. The text records two temporal legal mechanics that shape its lifecycle.

Creation date and authorising instrument: The instrument identifies the Minister for Finance, MATHIAS HUBERT PAUL CORMANN, as the person making the determination and records the date of signature (23/08/2016). Clause 3 records that it is made under subsection 78(1) of the PGPA Act. Clause 1 and the Note beneath it state that all special account determinations and compilations are registered on the Federal Register of Legislation (FRL) under the Legislation Act 2003.

Automatic expiry: Clause 2 Note 2 explains that, consistent with subsection 50(1) of the Legislation Act 2003, a legislative instrument is automatically repealed on the first of 1 April or 1 October ten years after registration on the FRL. The instrument therefore ceases to have effect on 1 October 2026 unless remade, extended or replaced prior to that date.

Transitional variation to FMAD 2006/18: Part 2 constitutes a direct amendment to the earlier Financial Management and Accountability Determination 2006/18. It varies subsection 5(1) by adding at the end a new item, "; and (e) to credit amounts to the Art Rental Special Account 2016." That change creates an explicit statutory link allowing credits to be moved or recognised between the prior FMAD account and the new PGPA special account. This is an internal amendment to existing financial management determinations rather than an amendment of primary legislation.

No other amendments recorded: No further amendments, revocations, or variations are included in the text. The instrument does not record previous versions, nor does it record any subsequent amendments after the date of signature. The only recorded textual change affecting another instrument is the Part 2 transitional variation to FMAD 2006/18.

Implication for future amendments: The automatic sunset date and the linkage to the prior FMAD account indicate administrative steps that a department or Minister would need to take prior to 1 October 2026 if continued operation of the account or its purposes is required , namely to remake, extend, or otherwise replace the instrument. The instrument itself contains no process for amendment beyond ordinary legislative instrument processes under the Legislation Act and the PGPA Act.

The determination contains no litigation history, case citations, or references to judicial decisions. The instrument does not identify any disputes, judicial review applications, or litigation that interpret its provisions. It names no cases and does not record any administrative appeals or tribunal decisions.

Practical consequence of the absence of litigation references: Because the text of the instrument contains no judicial or tribunal authorities, there is no internal record here of how courts have interpreted the provision allowing non-payment debits (clause 7(c)), the correction of mistaken credits (clause 7 Note 2(c)), or the scope of permitted credits (clause 6). That means that administrative practice and departmental policies will likely be the initial points of interpretive guidance until authoritative judicial or other external rulings appear, and that monitoring for any future litigation or tribunal decisions will be necessary to obtain settled legal interpretation.

Where disputes would be resolved: The instrument operates within the PGPA Act framework (clause 3 references subsection 78(1) of the PGPA Act). Any litigation about compliance, misuse, or interpretation of the account’s operation would therefore be conducted against the PGPA Act, applicable Appropriation Acts, the Legislation Act 2003 (for matters like registration and expiry), FMAD 2006/18 (as varied), and the PGPA Rule 2014 where relevant. The determination itself provides the factual and textual basis for accounting treatment but does not specify dispute resolution forums.

Recommendation implicit in silence: The instrument’s Note related to correction of mistaken credits (clause 7 Note 2(c)) requires that legal advice be obtained before debiting on the basis of a fundamental mistake of fact or law. That provision functions as a risk mitigation measure and suggests that departments should seek legal clearance to reduce litigation risk. In the absence of precedent or litigation history in the instrument, that legal-advice step is a key compliance control.

The instrument is short, but it contains several features with non-obvious operational effects and compliance risks. The following are potential pitfalls a practitioner should watch for, all grounded in the instrument’s text.

1. Ability to reduce balance without payment (clause 7(c) and Note 2(b)). The determination authorises debits to reduce the balance of the special account "without making a real or notional payment." The Note explains that this allows the balance to be reduced with no payment or credit available to another party, account or appropriation. Practically, such entries will reduce the account’s available appropriation without funds flowing elsewhere. That can affect the department’s funding position and its ability to spend on purposes covered by the account because subsection 78(4) of the PGPA Act appropriates the Consolidated Revenue Fund up to the account balance at the time of payment (clause 7 Note 1). Agencies must therefore document and justify such non-payment debits carefully, and track their effect on available appropriation.

2. Corrective debits require legal advice (clause 7 Note 2(c)). If an amount has been incorrectly credited because of a clerical error or a fundamental mistake of fact or law, the instrument permits debiting to correct the error but explicitly directs that legal advice should be obtained before doing so. This adds a procedural obligation: debiting to correct a mistake without legal advice could expose officials to governance queries or allegations of procedural impropriety.

3. Broad list of permissible purposes (clause 7(a)). The account may be debited for a wide array of activities relating to managing an art rental collection, including acquisition, deaccession, leasing, promotion, development, exhibition, lending and conservation. The breadth increases discretionary spending choices within the department and raises governance questions about prioritisation and auditability. Departments should document how each debit maps to an authorised purpose.

4. Credits from any person and transfer from prior account (clause 6(b)-(c)). The special account may receive amounts "from any person" for the account’s purposes and amounts equal to those debited from the earlier FMAD account. This means private payments, donations or other receipts can be retained in the account. Practically, accepting private funds may bring donor conditions or obligations; this instrument does not regulate such conditions. Additionally, transferring amounts from the prior FMAD account requires coordination with FMAD 2006/18, which Part 2 amends to permit such crediting.

5. Interaction with Appropriation Acts and repayment rules (clause 6 Notes). Clause 6 Note 1 and Note 2 cross-reference Appropriation Acts and subsection 27(5) of the PGPA Rule 2014. Practitioners must be alert to the possibility that some credits or repayments may need treatment under Appropriation Acts or PGPA Rules, rather than simply being credited to the special account automatically.

6. Automatic expiry (clause 2 Note 2). The instrument ceases to have effect on 1 October 2026 due to the Legislation Act 2003 ten-year repeal rule. If the department expects ongoing activity beyond that date, they must arrange for a replacement or extension, otherwise the account will lapse.

7. Commencement timing and parliamentary disallowance (clause 2 and related Note 1). The commencement is governed by paragraph 79(5)(a) of the PGPA Act, meaning the instrument comes into force after the parliamentary disallowance window. Departments should confirm actual commencement via the Federal Register of Legislation to ensure they act only after the instrument takes effect.

8. No procedural thresholds or delegations set in the instrument. The determination does not set out who within the department may authorise particular transactions, nor does it set thresholds for approvals, contestable procurement processes, or reporting lines. Those procedural gaps must be filled by the department’s internal financial management policies and the PGPA Act governance framework.

9. No penalty or enforcement clauses in the instrument. Enforcement and remedial powers lie in the PGPA Act and other rules. Practitioners should be careful to ensure compliance with those external instruments, as the determination itself offers no enforcement guidance.

10. Record-keeping and audit trail requirements implicit but not specified. Because the instrument allows for non-cash debits and accepts diverse credits, sound accounting records will be necessary to demonstrate that debits relate to authorised purposes and that any corrections were undertaken with legal advice when required.

This section sets out practical, source-grounded steps for the Department of Communications and the Arts and its staff to operate the Art Rental Special Account 2016 within the legal limits and procedural expectations established by the instrument.

1. Confirm commencement and registration. Before acting, check the Federal Register of Legislation entry for the instrument to confirm the date on which it came into force in accordance with paragraph 79(5)(a) of the PGPA Act (clause 2 and clause 1 Note). Do not treat the account as operational prior to the instrument’s effective date.

2. Maintain explicit account coding and ledger entries. Because the instrument allows credits of different kinds (clause 6(a)-(c)), set up separate ledger sub-accounts or coding to distinguish: receipts in the performance of functions (6(a)); amounts received from third parties (6(b)); and transferred amounts from the FMAD 2006/18 account (6(c) and Part 2). This will support transparency and auditability.

3. Map each expenditure to an authorised purpose. For every debit, document how the transaction falls within clause 7(a)-(d). Where a debit funds administrative or indirect costs, record how it is incidental to the core purpose (clause 7(b)). For repayments required by law, record the statutory basis (clause 7(d)).

4. Document use of non-payment debits. If using the power to reduce the account balance without making a payment (clause 7(c) and Note 2(b)), prepare an internal legal and accounting memorandum explaining the rationale, the decision maker, and the effect on available appropriation under subsection 78(4) of the PGPA Act (clause 7 Note 1). Retain contemporaneous approvals and audit trail for such entries.

5. Obtain legal advice before correcting credits. The instrument explicitly requires legal advice before debiting to correct an amount incorrectly credited due to a clerical mistake or a fundamental mistake of fact or law (clause 7 Note 2(c)). Implement a mandatory legal clearance process and retain advice on file before making such corrections.

6. Coordinate with FMAD 2006/18 processes. Part 2 modifies FMAD 2006/18 to permit crediting amounts to the new account. Where transfers from the old Art Rental Special Account are contemplated, ensure that the procedural and accounting steps align with the amended FMAD provision and document the transfer.

7. Ensure donor and contract conditions are recorded. For amounts received "from any person" (clause 6(b)), record any conditions attached by the payer. The instrument allows such amounts to be credited, but it does not modify contractual obligations. Ensure contracts and donation agreements are consistent with the permitted purposes set out in clause 7.

8. Reconcile with Appropriation Acts and PGPA Rule requirements. Clause 6 Notes reference Appropriation Acts and subsection 27(5) of the PGPA Rule 2014 for certain credit and repayment treatments. Maintain a process to verify whether particular credits or repayments must be handled under Appropriation Acts or PGPA rules and to reflect that in accounting entries.

9. Delegate authority and set internal thresholds. The instrument names the Secretary as the accountable authority (clause 8) but does not set delegation lines. Establish and document delegations for authorising credits and debits, approval thresholds, procurement oversight, and routine administrative charges, ensuring alignment with the PGPA Act requirements and departmental governance instruments.

10. Prepare for expiry and continuity planning. The instrument will cease to have effect on 1 October 2026 under the Legislation Act 2003 automatic repeal rule (clause 2 Note 2). Plan any necessary remaking or replacement of the determination in good time to avoid interruption of authorised activities. Document required approvals and parliamentary timing considerations.

11. Maintain robust audit trails. Given the possibility of non-cash debits and the diversity of credits, keep comprehensive records that show: source of funds, legal basis for crediting, authorisation for debits, mapping to authorised purposes, and any legal advice obtained in relation to corrections. This will support audit and parliamentary scrutiny.

12. Public transparency via FRL. Ensure relevant public-facing documents and financial statements explain the account’s purpose and activity in line with the instrument’s registration on the Federal Register of Legislation (clause 1).

13. Training and internal guidance. Provide training to finance and program staff on: the scope of authorised purposes in clause 7; the corrective debit rule and legal advice requirement in clause 7 Note 2(c); the non-payment debit mechanism in clause 7(c); and the need to coordinate credits with FMAD 2006/18 as per Part 2.

Following these steps will align day-to-day management with the instrument’s authorisations and procedural notes and reduce the risk of accounting inconsistency or governance queries under the PGPA Act framework.
