What it does
This instrument establishes the ABCB Special Account 2019 as a special account under the Public Governance, Performance and Accountability Act 2013. Clause 1 names the instrument the PGPA Act Determination (ABCB Special Account 2019). Clause 3 states that the instrument is made under subsections 78(1) and 78(3) of the Act. Clause 4 provides that for subsection 78(1)(a) of the Act, the ABCB Special Account 2019 is established as a special account. Clause 5 specifies that for subsection 78(1)(d) of the Act, the accountable authority responsible for the special account is the Secretary of the Department of the Treasury.
The instrument is structured in three parts. Part 1 covers establishment matters. Part 2 sets out definitions that apply throughout the instrument. Part 3 addresses credits that may be made to the special account and the purposes for which amounts may be debited. Clause 6 defines the former special account as the Australian Building Codes Board Special Account 2017 established by the PGPA Act Determination (Establishment of Australian Building Codes Board Special Account 2017). The current instrument therefore continues funding arrangements previously operated under that 2017 determination.
Clause 7 lists the amounts that may be credited to the special account for the purposes of subsection 78(1)(b) of the Act. These are an amount received from a government for a purpose of the special account, an amount received in the course of the performance of functions that relate to a purpose of the special account, and an amount received from any person for a purpose of the special account. Clause 8 lists the purposes of the special account for the purposes of subsection 78(1)(c) of the Act. These purposes govern all debits from the account and include disbursing amounts to create, maintain, enhance and make accessible nationally consistent building and construction codes, standards, regulatory requirements, regulatory systems, model legislative and regulatory provisions, and guidance materials and tools including information technology systems. Further purposes cover developing, promoting and disseminating educational and training resources for the building and construction industry, associated stakeholders and the broader community. Additional purposes encompass research, investigation, consultation, implementation and administration of programs and initiatives for the preceding purposes, including product certification schemes such as the WaterMark Certification Scheme. The purposes also extend to disbursing amounts in connection with services performed by the ABCB for or on behalf of governments and other bodies including Commonwealth entities and Commonwealth companies, and in connection with joint activities performed by the ABCB for, on behalf of or together with a Commonwealth entity, Commonwealth company, government, organisation or person. Incidental activities, repayments required by court order, Act or other law, repayments to original payers after necessary payments, and reductions in the balance of the special account without a real or notional payment are also included.
