58 Inconsistency with Act, regulations or conditions of permit or licence (1) This regulation applies if there is an inconsistency between: (a) a provision of an approved access agreement; and (b) a provision of the Act, any Regulations under the Act, or a condition of an exploration permit or a licence. (2) The provision or condition referred to in subregulation (1)(b) prevails and the agreement is unenforceable to the extent of the inconsistency.
