10 Requirement to negotiate in good faith (1) For the purpose of obtaining an approved access agreement, an interest holder and a designated person must negotiate on the agreement, and participate in any other process under this Part, in good faith. (2) Without limiting subregulation (1), if an interest holder or a designated person provides a report or advice about a particular matter as part of the negotiations, the interest holder or designated person (as the case may be) must take reasonable steps to ensure that the report or advice is in a finalised form.
