Petroleum Products Subsidy Act 1965

The Act is structured around a few core legal and administrative concepts which determine who benefits, who enforces, how subsidy amounts are determined, and what compliance obligations follow.

Scheme as primary determinant. The Act repeatedly defers substantive questions to the "scheme" formulated by the Commonwealth Minister for the purpose of the States Grants (Petroleum Products) Act 1965 of the Commonwealth. Definitions, the calculation of subsidy, and the content of advances on account are all framed as "in accordance with the scheme" (s 3(1), s 4, s 5). Consequently, the Act supplies enabling and enforcement law, while leaving rate-setting, detailed eligibility, and product characterisation to the Commonwealth instrument. The Act retains an express saving that where the Commonwealth scheme directs certain goods be treated as particular eligible products those directions control for the purposes of the Act (s 3(2)).

Registered distributor. The legal beneficiary under the Act is a "registered distributor of eligible petroleum products" (s 3(1)). Registration under "the scheme" is a precondition to claim. The Act does not set registration criteria itself; it assumes registration under the Commonwealth scheme. The registration requirement channels the subsidy to commercially recognised distributors rather than to end-users.

Payment-by-certificate. The Act makes payment contingent on an authorised officer's certificate. The authorised officer examines the claim and, if satisfied, issues a certificate which the Minister must use to authorise payment (s 8(1), s 9). Certificates can also be issued to record sales or uses (s 8(2)), and certificates can be used to demand repayment where an authorised officer finds a payment was not payable or was excessive (s 8(3)-(5)). The Auditor-General is required to treat such certificates as correct in all respects (s 8(4)) and documents purporting to be such certificates are presumed genuine unless the contrary is proved (s 8(5)). The certificate regime places evidentiary and administrative weight on authorised officers' findings.

Advances and conditions. The Minister may authorise advances on account of subsidy payments on such terms as the Minister thinks fit; that includes terms requiring a distributor to pass the benefit of an advance to purchasers (s 5). The Act gives the Minister discretion over the terms and conditionality of advances, which creates a lever to influence downstream pricing behaviour without setting mandatory conditions in the Act itself.

Investigatory powers. Authorised officers have significant powers to verify claims: entry to premises and vehicles used for carriage, inspection and stocktaking, sampling of products, and inspection of accounts, books and documents (s 12(1)). They may also require persons to attend, answer questions and produce documents (s 13(1)) and may administer oaths or affirmations (s 14(1)). Their powers explicitly extend to enforcement of subsidy schemes of other States, enabling cross-jurisdictional verification and co-operation (s 12(1)).

Limited use immunity. Section 13(3) removes the right to refuse to answer or produce documents on grounds that doing so may incriminate, but preserves a restricted exclusionary protection: answers compelled under s 13 are not admissible against the witness in proceedings other than proceedings for specified offences (proceedings under s 15(1)(c) or s 15(2)(c)). This creates a qualified testimonial compulsion framework.

Record-keeping and inspection obligations. Persons receiving payments must preserve relevant accounts, books and documents until twelve months after the date of making the claim (s 11(1)). They must provide reasonable facilities and assistance during inspections (s 12(2)). Failure to preserve or to give reasonable assistance attracts fines (s 11(2), s 12(3)).

Offences, recovery and enforcement. Offences cover obstruction, refusal to comply with attendance or production requirements, and obtaining payments by false or misleading statements (s 12(3), s 15(1), s 15(2)). Penalties are statutory monetary fines or imprisonment for the most serious offence (s 15(2)). Over-payments are recoverable as a debt and a court order for refund can be reduced to judgment by filing a court certificate (s 10, s 15(4)-(5)). The Act therefore combines criminal sanctions with a civil recovery pathway.

Ministerial control and delegation. The Minister appoints authorised officers (s 6), may make advances and attach conditions (s 5), and may delegate powers in writing (s 16). Regulations may govern the manner of claims and related procedural matters (s 17). The Ministerial and regulatory architecture centralises decision-making and delegates operational functions.

Interstate and Commonwealth interplay. The Act is expressly designed to operate with a Commonwealth-administered scheme and to be compatible with other States' subsidy regimes, both substantively and procedurally (s 3(1), s 12(1)). This concept of co-operative legislative reliance is central to the Act's mechanics: the State pays under this Act, but the content of the subsidy is driven by Commonwealth policy.

In short, the main concepts are: statutory enabling for subsidy payments with calculation outsourced to a Commonwealth scheme, a payment-by-certificate model with administrative inspection powers, preservation and disclosure obligations, limited use immunity for compelled testimony, and Ministerial discretion over advances and delegation.

The Act creates obligations, rights and investigatory encounters that primarily affect a defined set of actors. The distributional flows and control points are clear from the text.

Registered distributors of eligible petroleum products. These are the direct beneficiaries and duty-holders under the Act. They must be registered "in accordance with the scheme" in order to claim payments (s 3(1), s 7). Their practical obligations include making claims in the form required by regulation, preserving accounts and documentation for the statutory minimum period after claim-making (s 7, s 11(1)), and facilitating stocktaking, inspection and sampling by authorised officers (s 12).

Purchasers from distributors. Although purchasers are not named as primary parties, the Minister may require an advance to be conditional on passing the benefit to purchasers (s 5). This creates a potential contractual or pricing implication for distributors who accept advances: redistribution of subsidy to consumers may be a condition. Purchasers may therefore be indirectly affected by terms attached to advances.

Authorised officers and the Minister. The Minister authorises advances, appoints authorised officers, delegates powers, and pays amounts pursuant to certificates (s 5, s 6, s 16, s 9). Authorised officers are the front-line administrators who examine claims, issue certificates, conduct inspections and compel attendance and production (s 6, s 8, s 12, s 13). The Act allows Commonwealth officers to be appointed as authorised officers (s 6(2)), enabling Commonwealth personnel to operate under the Act.

The Auditor-General. The Auditor-General is expressly bound to treat certificates under s 8 as correct in all respects (s 8(4)). That gives certificates a specific relationship with audit processes and may constrain initial audit positions pending contrary proof.

Occupiers of premises and those in charge of vehicles. s 12 obliges occupiers and those in charge of vehicles to provide reasonable facilities and assistance to authorised officers (s 12(2)). Failure to do so risks an offence (s 12(3)).

Courts and enforcement officers. Courts determine debt recovery actions for over-payments, impose fines and imprisonment for specified offences, and may make orders to refund wrongfully obtained payments (s 10, s 15). Section 15(5) contemplates filing of a court officer’s certificate in a civil court to enforce a refund order as a final judgment.

Corporate directors and officers. For the offence of obtaining payments by false or misleading statements, the Act deems matters within the knowledge of a director or officer to be within the knowledge of a corporate body (s 15(3)). This creates personal knowledge attribution risks for corporate prosecutions under s 15(2).

Other State subsidy schemes and their registrants. The Act contemplates cross-jurisdictional operation. Authorised officers may enter premises of registered distributors whether registered under "the scheme" or the scheme in relation to another State (s 12(1)). Claims may relate to this State or to Acts of another State relating to subsidy for eligible petroleum products (ss 12(1), 13(1)). This means distributors operating interstate must expect inspection and information sharing under the Act.

Members of the public and statutory registries. The Act’s operation affects public finances because the State makes payments under the scheme as adopted. The Act also creates evidentiary presumptions in favour of authorised officers' certificates that are relevant to public auditors and potential litigants (s 8(4)-(5)).

In summary, the Act primarily affects registered distributors, authorised officers, the Minister, the Auditor-General, occupiers and vehicle controllers, courts, and corporate officers. It also has indirect effects on purchasers and on distributors operating across State borders due to co-operative inspection and scheme interaction provisions.

The Act allocates a compact set of duties to distributors and administrative rights to the Minister and authorised officers. Those duties and rights create compliance obligations and enforcement levers.

Duties of registered distributors

• Registration and claims. A distributor must be registered in accordance with the scheme to be eligible to claim payments, and must make a claim to an authorised officer in accordance with the regulations (s 3(1), s 7). The form and content of claims are regulatory matters (s 17(a)-(b)).

• Record preservation. A recipient of a payment must preserve accounts, books and documents relating to the sale or use of eligible petroleum products until twelve months after the date of making of the claim in respect of which the payment was made (s 11(1)). Non-compliance is an offence punishable by a fine not exceeding $200 (s 11(2)).

• Facilitation of inspections. The occupier of premises or person in charge of a vehicle must provide authorised officers with reasonable facilities and assistance for effective exercise of powers under s 12 (s 12(2)). Obstructing, molesting or hindering an authorised officer is an offence with a maximum penalty of $100 (s 12(3)).

• Veracity of claims. Distributors must ensure claims are accurate, because obtaining a payment knowing it is not payable, or obtaining a payment by false or misleading statement, is an offence carrying significant penalties: up to $1000 or imprisonment for up to twelve months (s 15(2)). If the offender is a corporation, knowledge of directors or officers is attributed to the corporation (s 15(3)).

• Compliance with advance conditions. If the Minister gives an advance on account of a payment, the advance may be subject to terms including a requirement to give the benefit of the advance to purchasers (s 5). Acceptance of an advance therefore creates contractual and compliance obligations to pass on benefit where so specified.

Rights of registered distributors

• Payment upon certificate. When an authorised officer issues a certificate that an amount is payable, the Minister is required to authorise payment of the amount specified in the certificate (s 8(1), s 9). The issuer of a legitimate certificate thus triggers ministerial payment.

• Contestability of certificate. A document purporting to be a certificate is presumed to be such a certificate, "unless the contrary is proved" (s 8(5)). That places the evidentiary burden on the claimant seeking to rebut a certificate’s correctness when a certificate has been issued. The Act, however, does not remove judicial avenues to challenge improper certification or to seek remedies against wrongful non-payment.

• Limited testimonial privilege. A person required to answer questions or produce documents under s 13 is not excused on the ground that the answer or production might incriminate, but answers are not admissible against the person in most proceedings (s 13(3)). This creates a limited right against compulsory questions being used in unrelated prosecutions, albeit with exceptions (see below).

Ministerial and authorised officer powers and duties

• Making and authorising payments. The Minister may authorise advances on account, and must authorise payment where an authorised officer issues a certificate of entitlement (s 5, s 9). The Minister therefore controls payment flows.

• Appointment of authorised officers. The Minister appoints authorised officers; Commonwealth officers may be appointed (s 6(1)-(2)). Authorised officers have significant active duties: examine claims, issue certificates, inspect and sample products, take stock of products and inspect accounts and documents (s 8, s 12).

• Certification of over-payments. Authorised officers may certify that an amount paid was not payable or was in excess, creating a statutory repayment obligation and opening recovery by the State (s 8(3), s 10).

• Powers to compel. Authorised officers may require attendance, answers and production of documents by notice in writing where they believe a person can give relevant information (s 13(1)-(2)). They may administer oaths or affirmations for such examinations (s 14(1)).

Rights and limits on use of compelled information

• Limited exclusionary protection. Answers given under compulsion are not admissible in evidence against the person except in proceedings for an offence under s 15(1)(c) (refusal/failure to answer or produce) or s 15(2)(c) (presenting false or misleading claim/account/document) (s 13(3)). This means compulsory answers can be used in prosecutions relating directly to obstructive or deceptive conduct under the Act, but are excluded from use in other prosecutions.

Auditor-General and evidentiary effects

• The Auditor-General must treat certificates issued under s 8 as correct in all respects (s 8(4)). That confers administrative finality in audit processes unless the "contrary is proved".

Enforcement and recovery rights

• Over-payments are recoverable by the State as a debt, enforceable in court (s 10). Where a court orders refund, the court may issue a certificate that can be filed in civil court and enforced as a final judgment (s 15(4)-(5)). These provisions create both a civil recovery route and criminal penalties for misconduct.

Delegation and regulation

• The Minister may delegate his powers in writing, which are revocable and do not prevent the Minister from exercising those powers personally (s 16). Regulations can prescribe claim procedures and information requirements and impose regulatory penalties up to $100 (s 17).

Taken together, the duties place day-to-day compliance burdens on distributors in documentary accuracy, record-keeping and co-operation with inspections. The rights, particularly payment on certificate and limited exclusion of compelled answers, shape both administrative predictability and legal risk.

The Act uses a mixture of fines, imprisonment, civil recovery and evidentiary presumptions to enforce compliance. Enforcement mechanisms are procedural and substantive, involving authorised officers, courts and audit functions.

Monetary penalties and imprisonment

• Record-keeping breach. Failure to preserve the accounts, books and documents required by s 11(1) is an offence carrying a fine not exceeding $200 (s 11(2)). The Act places the preservation obligation on payees for twelve months after claim date.

• Obstruction. Any person who obstructs, molests or hinders an authorised officer in the exercise of powers under s 12 is guilty of an offence punishable by a fine not exceeding $100 (s 12(3)).

• Failure to attend, be sworn or answer, or to produce documents. A person who refuses or fails to attend before an authorised officer, to be sworn or to answer a question or produce documents when so required is guilty of an offence punishable by a fine not exceeding $100 (s 15(1)).

• Fraud and false claims. The most serious statutory offence is obtaining a payment that is not payable knowing it, obtaining a payment by a statement that is false or misleading in a material particular, or presenting a false or misleading claim, account, book or document, or making such a statement (s 15(2)(a)-(c)). These offences attract a penalty not exceeding $1000 or imprisonment for a term not exceeding twelve months (s 15(2)). For corporations, knowledge of a director or officer is attributed to the corporate body (s 15(3)).

Civil recovery and enforcement as debt

• Repayment and recovery. Where an authorised officer certifies that an amount paid was not payable or exceeded what was payable, the person is liable to repay and the State may recover the amount in a court of competent jurisdiction as a debt due to the State (s 10). This is a civil recovery route that operates separately from criminal sanctions.

Judicial orders and conversion to judgment

• Refund orders. Where a person is convicted of an offence under s 15(2), the court may, in addition to imposing penalty, order the person to refund any amount wrongfully obtained (s 15(4)). Such orders are civil in character and may be enforced.

• Enforceability of court certificate. A certificate signed by the appropriate court officer specifying the amount ordered to be refunded and the person liable may be filed in a court having civil jurisdiction and is enforceable "in all respects as a final judgment" of that court (s 15(5)). This provision accelerates enforcement by converting the criminal court’s monetary order into a civil judgment.

Evidentiary presumptions and audit effect

• Certificates by authorised officers. A document purporting to be a certificate under s 8 is assumed to be such a certificate unless the contrary is proved (s 8(5)). The Auditor-General must treat such a certificate as correct in all respects (s 8(4)). Those two provisions create strong evidentiary weight behind authorised officers’ determinations, which supports administrative finality and enforcement efficiency while placing a burden on claimants seeking to repudiate certificates.

Compulsion, testimonial immunity and exceptions

• Compulsory production and answers. Authorised officers can require attendance, answers and production of documents by notice in writing (s 13(1)). Compelled answers are admissible in proceedings for a limited set of offences, namely obstruction/ refusal to answer/produce (s 15(1)(c)) and presenting false or misleading documents or statements (s 15(2)(c)),but generally not in other prosecutions (s 13(3)). This carve-out creates both an enforcement tool for the Act’s own offences and a limit on broader criminal use of compelled evidence.

Administrative discretion and ministerial conditions

• Advances on account. The Minister’s discretion to grant advances on account of payments, with terms including requiring that the benefit be given to purchasers, gives an administrative mechanism to influence conduct without necessarily invoking criminal sanctions (s 5). Non-compliance with conditions attached to advances could give rise to recovery obligations, though the Act leaves details to the Minister’s terms and the Commonwealth scheme.

Regulatory offences. Regulations made under s 17 may create offences and penalties not exceeding $100 for breach of regulatory prescriptions (s 17(c)). These represent a secondary enforcement layer for procedural requirements.

In enforcement terms, the Act pairs modest summary fines for procedural non-compliance with stiffer penalties for fraudulent conduct, and with a civil route for restitution. The conversion of court-ordered refunds into enforceable civil judgments reduces enforcement friction. The evidentiary presumptions in favour of authorised officers’ certificates reinforce the State’s position in both audit and recovery, while s 13(3) balances compulsory questioning against use in unrelated criminal prosecutions, subject to specified exceptions.

The Act is explicitly designed to operate in concert with Commonwealth and State subsidy schemes and to function within the broader legal framework governing evidence, oaths, audit and civil recovery. The text contains direct references and structural links to other instruments.

Dependence on a Commonwealth scheme. The Act repeatedly defers substantive matters to the "scheme" formulated by the Commonwealth Minister for the States Grants (Petroleum Products) Act 1965 of the Commonwealth. Definitions of eligible products, the calculation of subsidy amounts and the form and effect of registration are tied to that scheme (s 3(1), s 4). Section 3(2) makes clear that if the scheme directs goods to be treated as particular eligible petroleum products, that direction controls for the Act. Consequently, the Act functions as a State-level implementation of Commonwealth subsidy policy; changes to the Commonwealth scheme will directly alter entitlements and operational practice under this Act.

Interstate subsidy regimes. The Act contemplates interplay with Acts of other States relating to subsidy for eligible petroleum products. It expressly authorises authorised officers to enter premises of distributors registered under this State’s scheme or under another State’s scheme, and to inspect products and documents accordingly (s 12(1)). Likewise, the power to issue notices under s 13 is available where the officer believes the person can give information relevant to a claim under this Act or under an Act of another State relating to subsidy for eligible petroleum products (s 13(1)). The Act therefore provides statutory authority for cross-jurisdictional information collection and inspection, supporting co-operative enforcement among States.

Evidence and audit law. The Act contains specific evidentiary presumptions that interact with audit and judicial procedures. Documents purporting to be authorised officer certificates are prima facie deemed genuine unless the contrary is proved (s 8(5)), and the Auditor-General must treat certificates as correct in all respects (s 8(4)). These provisions interact with audit practice by producing administrative conclusions the Auditor-General must accept unless rebutted. They influence how audit reports and evidence in court will treat subsidy payments certified under the Act.

Oaths and affirmations. The Act permits authorised officers to administer oaths or affirmations in the course of examining persons who have been required to attend and give evidence (s 14(1)). Amendments to s 14 have been made in connection with the Oaths and Affirmations Act 2018, as recorded in the Table of Amendments. This ties the Act into the statutory regime governing admissibility and form of sworn evidence.

Criminal and civil law. The Act creates offences with criminal penalties and provides for civil recovery of over-payments as a debt (s 10, s 15). Where a court orders a refund, the Act creates an expedient conversion to a civil judgment through court-issued certificate filing (s 15(5)). Thus, the Act straddles criminal sanctions and civil enforcement, operating within both streams of legal remedy.

Delegation and administrative law. The Minister may delegate his powers in writing (s 16). Delegation raises standard administrative law issues (not spelled out in the Act) such as the correctness of delegations, scope of delegated authority, and reviewability of delegated decisions. The Act expressly preserves the Minister’s power to act notwithstanding delegation (s 16(3)).

Regulations and subordinate legislation. Section 17 empowers the Governor in Council to make regulations prescribing the manner of making claims, required information for claims, and penalties not exceeding $100 for breaches of regulations (s 17(a)-(c)). Regulatory instruments will therefore interact with the Act to define procedural rights and duties.

Interaction with Commonwealth financial and grants law. Because the Act implements a subsidy regime linked to the Commonwealth States Grants (Petroleum Products) Act 1965, payments under this Act are effectively State disbursements in a co-operative federal funding context. That connection may engage Commonwealth grant terms, conditionality, and inter-governmental arrangements that are executed outside this Act but have direct effect on entitlements and accounting.

In sum, the Act integrates with other laws at three principal interfaces: the Commonwealth scheme (which defines substantive entitlement), other State subsidy acts (which trigger cross-jurisdictional inspection and information exchange), and general administrative, audit, and evidentiary law (which governs how certificates, sworn evidence and recovery mechanisms operate). Practitioners must therefore read the Act together with the Commonwealth scheme and any relevant regulations or other State statutes to understand operative entitlements and obligations.

The version provided incorporates identified amendments up to 31 July 2019. The Table of Amendments in the source lists four amending Acts that have affected the Petroleum Products Subsidy Act 1965; the text of those changes is reflected in the consolidated version.

Key amendments documented in the source:

• Petroleum Products Subsidy (Amendment) Act 1978, No. 9140/1978 (assent 23 May 1978, commenced 23 May 1978). The 1978 amendment substituted several definitions in s 3(1), including the definition of "registered distributor of eligible petroleum products", the definition of "Commonwealth Minister" and the definition of "scheme". The Table of Amendments and marginal notes indicate that s 3(1) definitions were replaced by No. 9140 s 2(a)-(c) and s 3(2) was amended by No. 9140 s 2(d).

• Public Sector Reform (Miscellaneous Amendments) Act 1998, No. 46/1998 (assent 26 May 1998, commencement s 7(Sch.1) on 1 July 1998). That amending Act repealed the definition of "Minister" from s 3(1) (the source records "S. 3(1) def. of Minister repealed by No. 46/1998 s. 7(Sch. 1)").

• Oaths and Affirmations Act 2018, No. 6/2018 (assent 27 February 2018, commencement of s 68(Sch. 2 item 94) on 1 March 2019). The text notes that the heading for s 14 was inserted by No. 6/2018 s 68(Sch. 2 item 94.1) and that s 14(1) was amended by the same instrument (item 94.2). Subsections 14(2) and 14(3) were repealed by No. 6/2018 s 68(Sch. 2 item 94.3). These changes reflect alignment with the modernised statutory framework for oaths and affirmations.

• Justice Legislation Amendment (Family Violence Protection and Other Matters) Act 2018, No. 33/2018 (assent 14 August 2018, commencement s 95 on 31 July 2019). The text records that s 15(5) was amended by No. 33/2018 s 95. The amendment affects the mechanisms for converting a court order to a civil enforcement certificate.

The Endnotes and Table of Amendments provide cross-references and note that the publication incorporates those amendments. The Endnotes also include explanatory detail referencing the Decimal Currency Act 1965 for historical context on penalty amounts, though the consolidated text now uses dollar amounts with footnote markers (see s 11(2), s 12(3), s 15(1), s 15(2) and s 17(c) with endnote references). The source indicates no amendments were "Not in Operation" at publication.

Practical significance of the amendments recorded in the source:

• The 1978 amendments reworked definitional and scheme-related language, strengthening the Act’s reliance on the Commonwealth-formulated "scheme" and clarifying the role and identity of beneficiaries.

• The 1998 amendment removed a State ministerial definition, consistent with public sector reform reported; the effect in practice is the removal of an internal statutory definition of "Minister" and reliance on more general administrative arrangements for ministerial powers.

• The 2018 Oaths and Affirmations Act amendments updated evidentiary procedure to align with a modern oath/affirmation regime and removed redundant or inconsistent subsections in s 14.

• The 2018 Justice Legislation Amendment updated procedures around enforcement certificates, likely to simplify cross-court enforcement and align criminal refund orders with civil enforcement processes.

The consolidated Act as provided should be read with these amendments in mind, and with awareness that the Act’s substantive operation depends on the Commonwealth scheme referenced in s 3. The source’s Endnotes caution that explanatory memos, tables and notes are not part of the Act, and that style changes under the Interpretation of Legislation Act 1984 apply.

The consolidated Act text and the source material supplied do not include any reported cases, judgments or litigation history. The Act does not cite any judicial decisions, nor does the publication include notes of relevant litigation. Therefore, based on the provided material, there is no litigation history embedded in the text to describe or analyse.

What the Act does provide are procedural and evidentiary features that shape the litigation landscape, should disputes arise. Those features are likely to be focal points in any litigation:

• Certificate weight and challenge. An authorised officer’s certificate that an amount is payable or that an amount was not payable carries significant evidentiary presumptions. The Auditor-General must treat a certificate under s 8 as correct in all respects (s 8(4)), and a document purporting to be such a certificate is deemed to be such a certificate unless the contrary is proved (s 8(5)). Litigation over payment entitlements or recovery of over-payments would therefore be likely to turn on whether a claimant can successfully prove the "contrary" where a certificate has been issued, and whether any procedural or jurisdictional defect undermines the authorising officer’s certificate.

• Compulsion and admissibility. Section 13(3) creates a limited immunity for compelled answers and documents, rendering them inadmissible except in prosecutions under s 15(1)(c) (refusal/failure to answer or produce) or s 15(2)(c) (presenting false or misleading claim/account/document). Any prosecution where the prosecution seeks to rely on compelled testimony for offences other than those specified would face the statutory exclusion, and litigation may focus on the scope of admissibility exceptions and whether compelled evidence was used improperly.

• Recovery as debt and conversion to judgment. The State’s civil recovery route for overpayments (s 10), together with s 15(5) (enabling a court officer’s certificate to be filed in a civil court and enforced as a final judgment), creates procedural devices likely to be used in enforcement proceedings. Litigation could address the proper issuance of refund orders, the conversion mechanism, and due process in criminal proceedings that generate civil orders.

• Attributed knowledge in corporate prosecutions. Section 15(3) deems matters to be within the knowledge of a corporation if they are within the knowledge of a director or officer. Any prosecution of a corporation under s 15(2) would involve litigation over what information was known by relevant directors or officers and whether attribution rules apply.

Absent specific case law in the source, practitioners must consult external case reports and tribunal decisions for precedent on these issues. The Act’s provisions shape potential litigation themes: evidentiary weight of administrative certificates, scope and limits of compulsory powers, interplay of criminal sanction and civil recovery, and corporate attribution of knowledge. Each of those topics would be the likely subject matter of court proceedings if disputes over payments or alleged fraud under the Act arise.

The Act appears compact, but there are several practical and legal pitfalls that practitioners and affected parties should note, grounded in the Act’s text.

Dependence on external "scheme". The Act repeatedly defers substantive matters, including the calculation of subsidy (s 4), the definition of eligible goods (s 3(1)-(2)), and registration, to the Commonwealth-formulated "scheme". That means the Act does not itself protect a distributor against changes or clarifications in the Commonwealth scheme. Practitioners must therefore consult the operative Commonwealth instrument to determine entitlement, product classification and registration criteria. A distributor may comply with this Act but still have claim denied because the Commonwealth scheme treats particular goods differently (s 3(2)).

Payment conditional on certificate. Payment is not an entitlement until an authorised officer issues a certificate that an amount is payable, and the Minister then authorises payment (s 8(1), s 9). Practically, this means administrative delay or discretionary application of certification standards can defer payment. A distributor must present a claim to an authorised officer and satisfy whatever evidentiary threshold the officer applies.

Evidentiary weight of certificates and difficulty of rebuttal. Certificates by authorised officers are presumptively correct and the Auditor-General must treat them as correct (s 8(4)-(5)). While the presumption is rebuttable ("unless the contrary is proved"), the onus is on the distributor to disprove the certificate. Practitioners should therefore maintain contemporaneous documentary and log evidence to meet that burden.

Short record-retention period. The preservation requirement is for twelve months after the date of making of the claim (s 11(1)). That is a relatively short retention period for commercial documents, particularly where recovery or audit cycles may extend beyond that time. Distributors relying solely on statutory minimums risk being unable to rebut certificate findings or to defend against recovery actions. Best practice will be to retain records for substantially longer periods, subject to other legal retention obligations.

Limited testimonial privilege with prosecutorial exceptions. Section 13(3) removes the right to refuse to answer or produce materials on the ground of self-incrimination, but promises limited protection by excluding compelled answers from use in most proceedings. However, that exclusion does not apply to proceedings for offences under s 15(1)(c) or s 15(2)(c). Thus, compelled statements can be used against a person in prosecutions for obstructing or giving false or misleading documents (s 15). Practitioners should brief clients that compelled answers are not categorically safe from use in prosecutions under the Act.

Ministerial discretion over advance conditions. The Minister may attach terms to any advance, including conditions to pass the advance benefit to purchasers (s 5). Accepting an advance could therefore require a distributor to alter pricing or pass through value in a legally binding way. Those conditions are not spelled out in the Act and may be unilateral or negotiable at the Minister’s discretion, so distributors should seek to get clear written terms before accepting advances.

Cross-jurisdiction inspections and obligations. Authorised officers can enter premises of distributors registered under other States’ schemes and may inspect in relation to claims under this Act or an Act of another State (s 12(1)). Distributors operating interstate must be prepared for inspection activity and for providing documents that may be relevant to multiple schemes. Confidentiality claims or privilege issues across jurisdictions may be complex.

Relatively low statutory fines for procedural breaches, higher risk for fraud. Procedural non-compliance attracts modest fines ($100-$200 in the Act), but obtaining payments by false or misleading statements carries a much larger penalty ($1000 or imprisonment up to twelve months) (s 11(2), s 12(3), s 15(1), s 15(2)). The broader risk is reputational and collateral , a criminal proceeding or civil recovery may have wider commercial consequences beyond the statutory penalty amounts.

Corporate knowledge attribution. For corporate defendants, knowledge of directors or officers is attributed to the company under s 15(3). Directors and senior officers should therefore be aware that their actual knowledge can expose the corporation under the Act’s fraud provisions.

Regulatory gaps and delegation. The Act delegates the procedural detail to regulations (s 17) and allows the Minister to delegate powers (s 16). Where the regulations are sparse or absent, and where the Minister has delegated key functions, operational clarity may rely on administrative practice and external documents. Parties should verify applicable regulations and any instruments of delegation to identify decision-makers and appeal routes.

Evidential interplay with the Auditor‑General. Because the Auditor-General must treat authorized officer certificates as correct (s 8(4)), audit challenges to payments may be constrained until the certificate is rebutted. This affects both public accounting and the ability of distributors to rely on audit findings.

In short, the principal "gotchas" are the Act’s delegation of substantive rules to the Commonwealth scheme, the centrality and presumptive weight of authorised officer certificates, the short statutory retention period for records, limited safe harbour for compelled testimony, ministerial discretion over advances and conditions, and potential cross-jurisdictional compliance complexity. Each of those points is anchored to a specific section of the Act set out above.

Compliance requires operational, documentary and governance steps that align with the Act’s procedural architecture. The following practical checklist and legal signposts are grounded in the Act’s text.

1. Confirm registration status and scheme eligibility

   • Verify registration under the Commonwealth scheme that the Act adopts, because entitlement to claim payments is limited to "registered distributors of eligible petroleum products" (s 3(1), s 7). Registration criteria, renewal obligations and de‑registration consequences should be checked against the operative Commonwealth scheme documentation. Ensure products meet the scheme’s definitions, and be aware that the scheme’s instructions on product classification will govern for the Act’s purposes (s 3(2)).

2. Understand claim procedures and regulatory requirements

   • Claims must be made "to an authorised officer and in accordance with the regulations" (s 7). Obtain and follow the current regulations prescribing claim forms, required supporting information and filing procedures (s 17(a)-(b)). Build a standardised claims pack that matches the regulatory checklist to reduce the risk of rejection or certification of over-payment.

3. Maintain robust record-keeping beyond statutory minimums

   • The Act requires preservation of accounts, books and documents until twelve months after the date of making the claim (s 11(1)). In practice, retain documentation for a longer period (typically seven years for financial records) to allow for audit, dispute resolution and potential legal proceedings. The statutory minimum is a floor, not best practice.

4. Create audit-ready transaction trails

   • Because authorised officers may inspect premises, collect samples and take extracts of accounts and documents (s 12(1), s 13(2)), maintain contemporaneous delivery dockets, inventory records, sales invoices, stock reconciliation logs, and chain-of-custody documentation for product samples. Ensure that records allow tracing of product quantity, date, purchaser and point of sale so that an authorised officer’s certification can be substantiated or rebutted.

5. Appoint a compliance officer and document procedures

   • Designate a responsible officer for subsidy compliance and claims. That person should be the point of contact for authorised officers, maintain regulatory filings, manage advances and ensure any advance conditions (s 5) are implemented and documented.

6. Prepare for inspections and cooperate within legal limits

   • Under s 12(2), occupiers must provide reasonable facilities and assistance, and obstructing an authorised officer is an offence (s 12(3)). Develop an inspection protocol that ensures authorised officers can access documents and samples in a controlled way, with legal oversight for confidentiality and privilege issues. Ensure staff know to direct authorised officers to the compliance officer.

7. Manage compelled attendance and evidence risks

   • Where an authorised officer issues a s 13 notice, comply with attendance and production obligations. Counsel staff that compelled answers are not admissible in most proceedings (s 13(3)), but that they can be used in prosecutions for refusal/failure to answer or for false/misleading claims. Seek legal advice prior to giving statements in circumstances where there is risk of implicated wrongdoing.

8. Negotiate and document advance terms

   • If offered an advance, seek written terms from the Minister specifying obligations to pass benefits to purchasers or other conditions (s 5). Contractually document any obligations to pass on benefits to purchasers and adjust pricing, invoicing and reporting systems accordingly.

9. Ensure internal controls to prevent false or misleading claims

   • The Act creates serious criminal exposure for obtaining payments by false or misleading statements (s 15(2)). Implement internal verification, supervisory approval and attestation steps before claims are lodged. For corporations, be aware director and officer knowledge may be attributed to the company (s 15(3)).

10. Maintain a dispute and litigation plan

    • Because authorised officer certificates are presumptively correct (s 8(5)) and the Auditor‑General must treat them as correct (s 8(4)), have a documented evidentiary strategy ready to rebut certificates if wrongly issued. Preserve original source documents, supplier confirmations and independent measurement records, and seek immediate legal advice when notified of an intended repayment certificate under s 8(3).

11. Manage cross-border and multi-scheme activity

    • If operating in multiple States, align record systems to be able to respond to inspections related to other States’ subsidy schemes (s 12(1)). Track which sales relate to which jurisdictional scheme and ensure claims are made to the correct authority.

12. Track regulatory changes and Ministerial delegations

    • Monitor updates to the Commonwealth "scheme", State regulations under s 17, and instruments of delegation under s 16, since decision-making authority and claim processes may shift over time. Seek written confirmation of delegated decision-makers where possible.

13. Engage auditors and legal counsel proactively

    • Because the Auditor‑General must treat certificates as correct (s 8(4)), coordinate with external auditors to ensure audit trails are consistent with expected administrative treatment. Legal counsel should review evidence packages before claims and respond to any authorised officer certificates promptly.

14. Prepare for enforcement and repayment scenarios

    • Have liquidity arrangements and internal mechanisms to handle potential repayment demands or civil recovery as a debt (s 10), and be ready to contest the basis of any repayment certificate through administrative channels or court proceedings where justified.

By adopting these steps, a distributor aligns operational practice with statutory obligations under the Act, reduces legal and financial risk, and positions itself to both obtain lawful subsidies and to defend against over-payment findings. The Act’s text identifies the duties and enforcement levers; compliance requires translating those statutory duties into operational procedures and legal controls.
