##### 35. Pipelines to be operated continuously (1) Except with the consent in writing of the Minister and subject to compliance with such conditions, if any, as are specified in the instrument of consent, a licensee shall operate continuously the pipeline specified in his licence. Penalty: a fine of $50 000 or imprisonment for 5 years, or both. (2) It is not an offence against subsection (1) if the failure of the licensee to operate the pipeline continuously — (a) was in the ordinary course of operating the pipeline; or (b) was for the purpose of repairing or maintaining the pipeline; or (c) was in an emergency in which there was a likelihood of loss or injury.
