#### 73 Disputes between holders of petroleum titles and other persons carrying on operations on the land 73 Disputes between holders of petroleum titles and other persons carrying on operations on the land > > (1) This section applies where, in respect of any part of any land comprised in a petroleum title, any person is authorised to prospect or mine by virtue of— > > > > > (a) any claim registered, or authority granted, under the [Mining Act 1992](/view/html/inforce/current/act-1992-029), or > > > > > (b) (Repealed) > > > > > (c) the person’s ownership of any minerals, or > > > > > (d) an agreement with the owner of any minerals, or > > > > > (e) the provisions of the [State Coal Mines Act 1912](/view/pdf/asmade/act-1912-70), > > > > and a difference arises between the holder of the petroleum title and the person so authorised about the operations carried out or proposed to be carried out by either party. > > > (2) In the circumstances referred to in subsection (1), any party to the dispute may apply to the Land and Environment Court for a determination of the matter. > > > (3), (4) (Repealed) > > **s 73:** Am 1992 No 29, Sch 5; 2008 No 107, Sch 22 \[7\].
