#### 113N Exchange of information 113N Exchange of information > > (1) The regulator may enter into an arrangement (an information sharing arrangement) with a relevant agency for the purposes of sharing or exchanging any information that is held by the regulator or the agency. > > > (2) The information to which an information sharing arrangement may relate is limited to information that assists the regulator or relevant agency— > > > > > (a) to determine applications made under the resources legislation or legislation made under the corresponding law of another jurisdiction, or > > > > > (b) to determine whether to cancel, revoke, suspend or vary a petroleum title, activity approval or other approval, or an exemption or declaration, that is granted, made or given under that legislation, or > > > > > (c) to facilitate the carrying out of inspections, probity checks or other enforcement action under that legislation. > > > (3) Under an information sharing arrangement, the regulator and the relevant agency are, despite any other Act or law of the State, authorised— > > > > > (a) to request and receive information that is held by the other party to the arrangement, and > > > > > (b) to disclose that information to the other party. > > > (4) In this section— > > > > regulator means the Minister or the Secretary. > > > > relevant agency means any of the following— > > > > > (a) a government agency or holder of a statutory office with any functions similar to or related to those imposed on the regulator by or under the resources legislation, > > > > > (b) any government agency of the Commonwealth or another State or Territory with functions similar to or related to those imposed on the regulator under any of the resources legislation, > > > > > (c) any other person or body, or person or body of a class, prescribed by the regulations. > > **pt 13, divs 1–4 (ss 113D–113N):** Ins 2015 No 40, Sch 2 \[44\].
