#### 111 Additional assessment 111 Additional assessment > If, after an assessment has been made in accordance with this Part, it is proved to the satisfaction of the Land and Environment Court— > > > (a) that the whole of the amount paid into court pursuant to this Part has been duly paid out, and > > > (b) that since the date of the payment out, or the last payment out, as the case may be, further compensable loss has been caused to the land to which the assessment relates or to other land, > > the Court must, subject to the terms of any relevant valid agreement between the parties concerned, assess that loss and order that the amount so assessed be paid by the holder of the petroleum title, or by the person to whom the easement or right of way has been granted, as the case may be, within the time and to the persons specified in the order. > > **s 111:** Am 2008 No 107, Sch 22 \[12\]; 2015 No 41, Sch 2 \[36\].
