What it does
These Regulations set fixed dollar figures that operate for specified subsections of section 4 of the Petroleum and Geothermal Energy Resources (Registration Fees) Act 1967. They contain three operative provisions: a citation rule (regulation 1), a commencement rule tying these Regulations to the commencement of a named amending Act (regulation 2), and a schedule of prescribed amounts that the Regulations declare are "the prescribed amount" for particular paragraphs of section 4 of the Act (regulation 3). The prescribed amounts are expressed as discrete dollar figures: $6,010.00 for the purposes of section 4(2), section 4(3) and section 4(6); $9,550.00 for the purposes of section 4(4); and $9,597.00 for the purposes of section 4(7) (see reg 3(1)-(5)). The Regulation text itself does not explain the substantive operation of section 4 of the Act; it functions narrowly to fix amounts that the Act then incorporates by reference.
Mechanically, the Regulations do three things. First, they identify their authorised short title (reg 1). Second, they make their own coming-into-force contingent on the commencement of the Petroleum (Registration Fees) Amendment Act 1990 rather than fixing a standalone commencement date (reg 2). Third, they provide the numerical values that are to be treated as "the prescribed amount" for certain subsection references in s 4 of the parent Act (reg 3). The compilation table appended to the instrument records numerous amendments to regulation 3 dating from 2002 through 2023, indicating that the dollar figures have been varied a number of times by subsequent regulations (see the compilation table and the amendment note appended to reg 3).
The Regulations do not themselves set payment processes, collection agents, or enforcement mechanisms. They do not include penalty clauses, exemptions, indexing provisions, or a schedule of payment dates. Those operational matters, and the triggers for liability, must be located in the parent Act (section 4) or other relevant legislation or administrative instruments. The present instrument performs a single, discrete statutory function: to supply fixed fees for specified subsections of s 4 when those subsections call for "the prescribed amount".
