sec.97 General obligations of owner of a gas system
The owner of a gas system must take all reasonable steps to ensure— a suitably qualified person carries out the installation, servicing, repair, decommissioning and disposal of all or part of the gas system; and if a suitably qualified person or an inspector notifies the owner that the gas system is unsafe, the gas system is not used until it is safe. Maximum penalty—20 penalty units. For this section and section 98 , owner includes a person in possession of a gas system under— an agreement for sale; or a hire purchase agreement; or a lease; or any other similar arrangement. In this section— suitably qualified person , to carry out gas work for a gas device, means— for a gas system that includes a gas device (type A)—the holder of a gas work licence that authorises the person to carry out the gas work for the device; or for a gas system that includes a gas device (type B)—the holder of, or a person acting under, a gas work authorisation for the device.
