87 Criteria that apply to permit, lease and licence areas (1) This section applies if any part of the area in respect of which a special access authorisation is sought falls within an area that is the subject of an exploration permit, a retention lease or a production licence. (2) The Minister must not grant an authorisation in respect of that part of the area unless— (a) she or he has taken into account the work program of the holder of the permit, lease or licence; and (b) she or he is satisfied that the operations proposed to be carried out under the authorisation will not be detrimental to, or unduly interfere with, any current or proposed future operations of the holder of the permit, lease or licence; and (c) the holder of the permit, lease or licence has consented in writing to the issue of the authorisation in respect of that part of the area.
