263 Work programs—hydraulic fracturing (1) This section applies if a work program in force immediately before the moratorium commencement provides that the work under the relevant authority to which the work program relates includes any hydraulic fracturing. (2) Despite anything to the contrary in this or any other Act— (a) that provision is taken to no longer form part of the work program; and (b) the holder of the authority is not required to comply with the provision; and (c) the holder is not taken to have failed to comply with the work program or this Act or any other Act merely because the holder has not complied with the provision.
