163A Minister may require variation of accepted operation plan (1) The Minister may require the holder of an authority to vary the accepted operation plan that applies to the authority. (2) Without limiting subsection (1), the Minister may require the holder of the authority to vary the accepted operation plan— (a) if there have been significant changes to a risk posed by the petroleum operation since the operation plan was accepted; or (b) if the petroleum operation poses a new risk to the environment, to any member of the public, land or property in the vicinity of the operation and to any petroleum, source of petroleum or reservoir that the operation might affect that was not identified or did not exist at the time the plan was accepted; or (c) on the request of the Department; or (d) if there is a significant change to the activities being carried out or to be carried out under the authority; or (e) in circumstances prescribed in the regulations. (3) The Minister may only require the holder of an authority to vary the accepted operation plan after consulting with the holder. (4) The holder of the authority must comply with a request under this section.
