120 Alternative approvals
(a) a permit is required under any planning scheme to enable the holder of a production licence to carry out any petroleum production operation authorised by the licence; or
S. 120(1)(b) amended by No. 64/2012 s. 60(1).
(b) the holder of a production licence who is not also a holder of a special drilling authorisation may be granted a permit under section 119 to carry out a petroleum production operation in the licence area; or
S. 120(1)(c) inserted by No. 64/2012 s. 60(2).
(c) the holder of a production licence or an offshore petroleum production licence who holds a special drilling authorisation may be granted a permit under section 119 to carry out a petroleum production operation in the special drilling authorisation area.
(2) The holder of the authority is not required to obtain a permit under the planning scheme or section 119 to carry out the operation if—
(a) an Environment Effects Statement has been prepared under the **Environment Effects Act 1978** in relation to the carrying out of the operation; and
(b) an assessment of that Statement by the Minister administering the **Environment Effects Act 1978** has been submitted to the Minister; and

(c) the Minister has authorised the holder of the authority in writing to carry out the operation.
