#### 17 Use or possession of restricted pesticides 17 Use or possession of restricted pesticides > A person must not possess or use a restricted pesticide unless authorised to do so by— > > > (a) a restricted pesticide authorisation, or > > > (b) a pesticide control order. > > Maximum penalty— > > > (a) $120,000 in the case of a corporation, or > > > (b) $60,000 in the case of an individual. > > Note. > > Failure to comply to comply with the conditions of any such restricted pesticide authorisation, or with a pesticide control order, is an offence under this Act. > > An offence against this section committed by a corporation is an executive liability offence attracting executive liability for a director or other person involved in the management of the corporation—see section 112. > > **s 17:** Am 2012 No 97, Sch 1.31 \[10\].
