Perth Town Hall Act 1950

Several principal legal concepts structure the Act and govern how the parties must implement it.

Statutory authorisation of an agreement: The Governor and The City of Perth are authorised to “make, execute and carry into effect an agreement” for the specified land outcomes (s 2). The Act does not itself set out a single fixed transfer; it provides enabling statutory authority for negotiated terms.

Vesting and reservation under the Land Act: The Act uses the Land Act 1933-1948 classification regime as the legal vehicle for effecting the changes in land status. The lands in the First and Second Schedules are to vest in the City and be “deemed to be so vested under and for the purposes of the Land Act 1933‑1948, as a Class ‘A’ reserve” for town hall site and for beautification and recreation respectively (s 4(a), (b)). The Fourth Schedule lands are to “revest in His Majesty” and be “deemed to be reserved as a Class ‘B’ reserve for hospital purposes” (s 4(d)). In short, the Act reassigns reserve classifications and ties the new status to the Land Act regime.

Deeming and cross‑statutory effect: The Act does not purport to create all duties and powers itself; rather it “deems” the vestings to be under the Land Act and uses cross‑references to the Municipal Corporations Act 1906-1947 to import municipal powers (s 4(a)-(c)). For example, the City’s power to erect and maintain a town hall and municipal offices is qualified by being “authorized under the provisions of the Municipal Corporations Act 1906‑1947” (s 4(a)).

Contractual flexibility with statutory trigger: Section 3 gives broad freedom to the parties to agree terms, including future or conditional delivery of vacant possession (s 3(a)); the vesting of a 24‑foot strip for street widening from State lands abutting Wellington Street (s 3(b)); and provisions about non‑payment between the parties pending vacant possession and the removal of improvements (s 3(c)-(d)). Those contractual arrangements then take statutory effect only after execution and Gazette publication, which is the statutory trigger that effects vesting (s 4).

Dedication as public highways: The Third Schedule parcels are to be “excised from the reserves of which they at present form part and shall vest in The City of Perth and be deemed dedicated as public highways” under the Municipal Corporations Act, creating municipal responsibilities and public rights of way under that Act’s framework (s 4(c)).

Limit on certain carriageways: The Act places a statutory condition on the Second Schedule vesting by limiting carriageway construction thereon unless Parliament approves, except where the carriageway is for widening St. George’s Terrace and Barrack Street (s 2(b)). That embeds a parliamentary oversight mechanism for certain forms of road construction on the beautification/recreation reserve.

Plan and title specificity: The Schedules identify parcels by reserve numbers, Perth Town Lot numbers and Lands and Surveys original plan numbers (First, Second, Third Schedules), and by Certificates of Title volume and folio for various portions of Perth Town Lots in the Fourth Schedule. The Act therefore relies on specific cadastral references to tie the statutory changes to precise parcels.

Administrative effect on land records: The Notes section indicates where Lands and Surveys plans are held today, linking the cadastral references to contemporary land information custody (Notes, point 2; reference to Land Information Authority Act 2006 s 100). This ties the statutory technique of classification and vesting to practical title and plan records.

The Act primarily engages the State represented by the Governor and The City of Perth , the parties expressly authorised to make and implement the agreement (s 2). The immediate legal consequences are transfers of title or reserve status between those two public entities (vestings in the City; revesting to His Majesty), but the practical effects extend beyond the parties in identifiable ways under the Act’s terms.

The City of Perth: The City is the receiving party for multiple parcels. Once the agreement is executed and gazetted, lands in the First and Second Schedules vest in the City and are “deemed” Class “A” reserves under the Land Act for town hall and beautification/recreation respectively, giving the City statutory powers to erect, maintain and improve buildings and lay out and maintain amenities (s 4(a)-(b)). The Third Schedule lands become municipal public highways, which will impose duties and confer powers under the Municipal Corporations Act in relation to construction, maintenance and control of roads (s 4(c)). The City is therefore the primary actor that will decide how the Town Hall site and beautification areas are used, subject to the powers and limits imported from the Municipal Corporations Act and the Land Act.

The State (His Majesty represented by the Governor): The State authorises and executes the agreement and in some instances is the recipient of surrendered lands. Lands in the Fourth Schedule are to “revest in His Majesty” and be “deemed to be reserved as a Class ‘B’ reserve for hospital purposes” (s 4(d)). The State therefore becomes the landholder for hospital reservation purposes in respect of those parcels.

Existing occupiers and tenants: The Act contemplates arrangements for vacant possession at any future time or on the performance of conditions (s 3(a)). It also allows removal of improvements (s 3(d)). The Act, however, does not itself provide detail about compensation to third parties, nor does it set out statutory compensation mechanisms within its text. The parties are given negotiation space to include terms in the agreement, and the Act specifically forbids payments of consideration or rental between the two principal parties pending the giving of vacant possession (s 3(c)), but it is silent on payments between the City/State and private tenants or third‑party owners of improvements. Practically, therefore, private occupiers, tenants, lessees, and owners of improvements on the listed parcels are materially affected by the negotiated terms in the agreement, particularly any clauses dealing with timing and removal of improvements (s 3(a), (d), (c)).

Users of public roads and potential developers: The Third Schedule dedication as public highways changes the land status of those strips, rendering them public thoroughfares under municipal law (s 4(c)). That alters private development rights and access regimes on those strips and may adjust development potential on adjoining lots.

Ministerial/Parliamentary actors: Parliament retains a residual role under s 2(b), because no carriageway shall be constructed on the Second Schedule lands other than for widening St. George’s Terrace and Barrack Street without Parliament’s approval. That places a parliamentary oversight constraint on certain future public works on those reserve lands.

Land record custodians and survey authorities: The Schedules’ reliance on reserve numbers, Perth Town Lot numbers and plan numbers, and the Fourth Schedule’s reliance on Certificates of Title, engages cadastral and land information authorities and requires survey and title reconciliation when the agreement is implemented. The Notes indicate current custody of Lands and Surveys plans (Notes, point 2), which is relevant for those charged with recording the resultant vestings and reservations.

Wider public: The Act changes the classification and use of urban public land parcels in central Perth. Where the City is empowered to lay out paths, lawns, gardens and memorials or dedicate public highways, the general public will have new or altered access, usability and amenity expectations on those lands once actions authorised by the new status are implemented (s 4(a)-(c)).

The Act itself creates no extensive new criminal offences or regulatory licensing regimes; its operative legal effects are the authorisation of an agreement and the statutory consequences of that agreement’s execution and gazettal. Key duties and rights arise through the statutory vestings and the imported statutory frameworks (the Land Act 1933-1948 and the Municipal Corporations Act 1906-1947), which are specifically invoked in s 4. The Act therefore creates rights and duties principally in three ways: (1) by authorising the parties to agree and set terms (s 2-3); (2) by deeming vestings and dedications that import duties under other statutes (s 4); and (3) by embedding express operational constraints in the agreement process (for example s 3(c) and s 2(b)).

Duty to make and execute an agreement in authorised form: The Governor and The City of Perth are authorised to “make, execute and carry into effect an agreement” for the specified purposes (s 2). There is a duty to frame that agreement within the scope described in s 2 and s 3; the Act does not permit agreement terms outside the functions the Act identifies.

Duty to publish and effect registration: The Act requires publication of the agreement in the Gazette after execution, and it is publication which by force of the Act triggers the vestings and reservations (s 4, opening). The parties therefore have a procedural duty to ensure the agreement is published in the Gazette to obtain the statutory effects the Act provides.

Rights conferred on The City of Perth upon gazettal: Once gazetted, the First Schedule lands “shall vest in The City of Perth” and be “deemed to be so vested under and for the purposes of the Land Act 1933‑1948, as a Class ‘A’ reserve for the purpose of a Town Hall site” and with “power in The City of Perth to erect thereon, maintain and improve a town hall, municipal offices and other necessary or incidental buildings or structures authorised under the provisions of the Municipal Corporations Act 1906‑1947” and to lay out or improve roads, paths, lawns, gardens and memorials (s 4(a)). The Second Schedule confers corresponding vesting and powers for beautification and recreation and to construct and maintain memorials and approaches to the town hall lands (s 4(b)). The Third Schedule confers the right to those strips as public highways (s 4(c)). Those rights are legal powers to use and manage the land in the ways specified and are subject to the duties and constraints in the Land Act and Municipal Corporations Act, which are incorporated by deeming.

Duty or constraint about carriageway construction: The Act imposes a constraint on carriageways in s 2(b) , the Second Schedule land is vested for beautification and recreation, but no carriageway is to be constructed on it other than for the purpose of widening St. George’s Terrace and Barrack Street without the approval of Parliament. That is a statutory limitation on what the City may do with the Second Schedule land absent parliamentary approval.

Contractual rights to future vacant possession and removal of improvements: Section 3 allows the parties to include contractual provisions that grant vacant possession at a future time or upon the performance of conditions, and to provide for the removal of improvements then existing on the lands (s 3(a), (d)). These are rights and duties that will be specified in the negotiated agreement and which will determine the City’s and State’s obligations to third-party occupiers and owners.

Prohibition on payments between the principal parties pending vacant possession: Section 3(c) creates an express rule for any agreement under the Act that “no consideration in money and no rental shall be payable by either party to the agreement to the other of them in respect of the premises or of the occupation of any lands by either party or by tenants of either party pending the giving of vacant possession of any land the subject of the agreement.” That is a direct inter-party financial constraint: pending delivery of vacant possession, the State and City do not exchange rent or purchase payments between themselves in respect of the lands or occupation thereof.

Duty to treat Third Schedule lands as public highways: Upon gazettal, the Third Schedule lands become public highways under the Municipal Corporations Act, and the City will have the duties that municipal law imposes in relation to public highways, such as construction, maintenance and control. The Act does not itself enumerate those highway duties; it imports them by deeming the dedication under the Municipal Corporations Act (s 4(c)).

Recording and cadastral duties: Because the Act ties parcels to specific reserve numbers, Perth Town Lot numbers, plans and certificates of title (Schedules), there will be administrative duties to align land records and survey data with the new classifications. The Notes inform where plans are held today (Notes, point 2).

The Act contains no standalone penalty provisions, criminal offences, or specified monetary sanctions within its text. Enforcement of the Act’s operative effects is procedural and administrative rather than punitive. The Act operates by altering legal title and reserve status once the agreement is executed and published; compliance therefore centres on accurate execution, publication and subsequent conformity with the Land Act and the Municipal Corporations Act, which are the legal instruments that will govern future enforcement and compliance obligations.

Effect by operation rather than penalty: The Act gives statutory force to the executed agreement by deeming vestings and reservations when the agreement is published in the Gazette (s 4). The legal “enforcement” of the Act therefore is essentially the statutory change of land status that occurs on gazettal; the Act does not create enforcement mechanisms such as fines or imprisonment for wrongful acts under the Act itself.

Enforcement under other statutes: Because the Act expressly imports the Land Act 1933‑1948 and the Municipal Corporations Act 1906‑1947 by deeming the vestings and dedicating the highways under those Acts (s 4), any enforcement of duties, standards, by‑laws or obligations associated with those lands will fall under the enforcement regimes of those statutes. The Act does not reproduce those enforcement mechanisms, but it changes the legal vehicle through which those existing enforcement and compliance rules apply to the parcels listed.

Administrative enforcement through cadastral and registry processes: Once vesting or revesting takes effect on gazettal, the practical enforcement and recognition of those changes would be reflected in land records and titles, and through local government administration of reserved land and highways. The Act’s Schedules list Certificates of Title for Fourth Schedule lots and plan numbers for other parcels, which indicates that the practical recognition of vestings will require registry and survey action. The Act itself provides no administrative penalty for failure to update records; it simply makes the vesting occur by statute once published (s 4).

Parliamentary approval as constraint: The Act places a statutory constraint on construction of carriageways on Second Schedule lands without Parliament’s approval, other than limited exceptions (s 2(b)). The instrument does not specify a penalty for breaching that constraint; however, any attempt to construct in contravention of that limitation would raise legal questions about authority to construct without parliamentary approval, and remedies or injunctions would be pursued under general legal principles rather than penalties specified in this Act.

Practical enforcement risks and remedies are therefore located outside this short Act: they arise by operation of the Land Act and Municipal Corporations Act and conventional remedies available in administrative or property law, but the Act itself contains no bespoke enforcement or penalty machinery.

The Act is expressly cross‑referential. Its operation is designed to slot parcels into the regimes of two other statutes and to rely on cadastral and title instruments for implementation.

Land Act 1933-1948: The Act repeatedly states that the relevant parcels shall be “deemed to be so vested under and for the purposes of the Land Act 1933‑1948” as specified Classes of reserve (s 4(a), (b), (d)). That means that the treatment, powers, limitations, and administrative processes applicable to Class “A” and Class “B” reserves under the Land Act will apply to the vested or revested lands once the agreement is gazetted. The Act therefore does not displace the Land Act; it uses the Land Act’s classification scheme to define permitted uses (town hall, beautification and recreation, hospital), management rules and any statutory obligations inherent in those reserve categories.

Municipal Corporations Act 1906-1947: The Act imports the City of Perth’s municipal powers under the Municipal Corporations Act by reference. For the First Schedule, the City’s powers to erect, maintain and improve a town hall and municipal offices and to lay out roads, paths, lawns and similar fixtures are qualified by being those “authorized under the provisions of the Municipal Corporations Act 1906‑1947” (s 4(a)). For the Third Schedule, the excised strips are “deemed dedicated as public highways under and for the purposes of the Municipal Corporations Act 1906‑1947” (s 4(c)). In short, the Municipal Corporations Act supplies the operational municipal law rules about municipal buildings, road dedication, maintenance obligations, by‑laws and other local government powers that will apply to the lands after vesting/dedication.

Government Gazette and statutory effect: The Act makes execution and publication in the Gazette the trigger for statutory effect (s 4). This procedural link aligns with standard statutory practice for notifying and effecting public land grants and changes of status. The Act thereby interacts with administrative law and public notification practices.

Cadastral instruments, plans and Certificates of Title: The Schedules reference reserve numbers, Perth Town Lot numbers, Lands and Surveys plan numbers and, in the Fourth Schedule, specific Certificates of Title by volume and folio. The Act therefore interacts with the Torrens system and cadastral/survey systems insofar as land records must be reconciled with the statutory vestings and revestings. The Notes provide that Lands and Surveys plans are held by the Western Australian Land Information Authority today (Notes, point 2), which connects the statutory descriptions to current custodianship under the Land Information Authority Act 2006 s 100.

Parliamentary oversight: Section 2(b) provides that no carriageway shall be constructed on the Second Schedule land other than for widening St. George’s Terrace and Barrack Street without the approval of Parliament. That interaction injects a parliamentary approval requirement into the use and works regime for the Second Schedule parcel and makes Parliament a decision‑maker for certain types of works.

Limitations and scope: Because the Act is an enabling, schedule‑driven instrument, it does not purport to override the substantive provisions of the Land Act or Municipal Corporations Act when it deems the parcels to be vested or dedicated under those Acts. The importation is protective: the lands take on the legal status and regulation associated with those Acts once the triggering event of Gazette publication occurs (s 4). Any subsequent changes to the Land Act or Municipal Corporations Act that affect Class “A” or Class “B” reserves, or municipal powers and highways, will therefore have direct effects on the parcels insofar as those statutes remain applicable.

No express interaction with compensation statutes: The Act does not invoke or detail compensation mechanisms for third‑party occupiers, owners of improvements, or lessees. Where compensation or acquisition issues arise, they will have to be resolved under general property law, contractual terms in the agreement, or other statutes not invoked in the Act itself, unless the parties include specific provisions in their agreement under s 3.

The Act as presented is a short, single‑purpose statute with a narrow historical record contained in the compilation table in the Notes. The Compilation table shows only the original enactment:

• Perth Town Hall Act 1950, No. 67 of 1950; Assent: 5 January 1951; Commencement: 5 January 1951 (Compilation table).

The Notes indicate that this document is a compilation of the Perth Town Hall Act 1950 and “includes all amendments effected by the other Acts referred to in the following Table.” No subsequent amendment entries are shown in the table beyond the original Act. Therefore, as compiled in the text provided, there are no recorded amendments to the Act itself included in the compilation table.

Administrative changes of documentary custody are recorded in the Notes: Lands and Surveys plans referenced in the Schedules are now held by the Western Australian Land Information Authority, with a cross reference to the Land Information Authority Act 2006 s 100 (Notes, point 2). That is a custodial or administrative change in plan custody rather than an amendment to the substance of the Perth Town Hall Act.

Because the Act’s operative mechanics involve the making of an agreement and publication in the Gazette to effect the vestings and reservations, most of the practical change expected under the Act would be implemented by action under that agreement rather than by Parliamentary amendment to the Act. Any future changes to the legal regimes into which the parcels are placed , such as amendments to the Land Act classification regime or to the Municipal Corporations Act , would not be an amendment to this Act but could change how the vested or reserved land is managed or regulated after the fact. Those subsequent changes are not recorded in this Act’s compilation table.

No schedules or notes in the provided text indicate later legislative alterations to the specified Schedules, plan references or the statutory mechanism of gazettal as the trigger for vesting. The compilation table therefore indicates a single enactment and no recorded statutory amendments in the provided material.

The compiled text of the Perth Town Hall Act 1950 supplied does not record any litigation, judicial consideration, or cases that interpret or apply this Act. There are no cases named in the Act text, no footnotes referencing judicial decisions, and the Notes and Compilation table contain only legislative administrative information. Consequently, based on the source provided, there is no litigation history to summarise; no reported decisions are incorporated into this compilation.

Practitioners seeking case law on the Act’s operation (for example, disputes about the effect of gazettal, the meaning of “vacant possession” clauses that the agreement may contain, the legal effect of the carriageway restriction in s 2(b), or compensation disputes arising from removal of improvements under s 3(d)) will need to conduct separate case law research outside the text provided. The Act itself does not cite judicial authorities nor does it include statutory notes summarising judicial interpretation.

Because the Act imports other statutes , principally the Land Act 1933-1948 and the Municipal Corporations Act 1906-1947 , relevant litigation is more likely to arise under those Acts in relation to the operational consequences of the vestings and dedications effected under this Act. But no such litigation is recorded in the text supplied.

The Act is short and procedural, but there are a number of practical and legal pitfalls or “gotchas” that arise from its structure and from what it leaves to the parties to agree.

Statutory effect depends on both execution and Gazette publication (s 4). Until the agreement is both executed and published, the vestings and reclassifications do not take effect by force of this Act. Parties may assume an oral or partially executed agreement has immediate effect; the Act requires execution and gazettal.

Inter‑party non‑payment does not address third parties (s 3(c)). The Act explicitly forbids consideration or rental payments between the State and the City pending the giving of vacant possession (s 3(c)). This does not, however, address payments owed by tenants or occupiers to either party, nor does it address compensation to third parties or statutory acquisition mechanisms. If the agreement contemplates relocation costs, buyouts, or compensation for tenants or owners of improvements, those details must be included expressly in the agreement under s 3, because the Act itself is silent on third‑party compensation.

Vacant possession timing is flexible but legally risky (s 3(a)). The agreement may provide for the granting of vacant possession at any future time, or upon performance of conditions (s 3(a)). That flexibility can leave tenants or third‑party occupiers in limbo and create uncertainty for the City and State as to when obligations and rights vest. Precise drafting of timings, triggers and notice obligations is therefore essential; the Act does not supply default rules.

Removal of improvements is permitted but unallocated as to cost and process (s 3(d)). The Act allows the agreement to provide for removal of existing improvements, but does not mandate who pays for demolition, removal or reinstatement. The parties should explicitly allocate liabilities, environmental remediation responsibilities and standards for removal within the agreement.

“Approximately twenty‑four feet” strip in s 3(b) is imprecise. The Act permits vesting for street widening of “a strip of land approximately twenty‑four feet wide” from State‑held lands abutting the northern boundary of Wellington Street (s 3(b)). The qualifier “approximately” may generate surveying disputes; precise survey dimensions and plan references should be agreed and recorded to avoid cadastral litigation.

Parliamentary approval constraint on carriageways (s 2(b)). The Second Schedule vesting is limited by a clause that no carriageway shall be constructed thereon other than for widening St. George’s Terrace and Barrack Street without the approval of Parliament (s 2(b)). If the City wishes to use the land for vehicular access beyond those widenings, it must obtain parliamentary approval. Parties should not assume that municipal by‑law or council decision alone suffices for such works.

Cross‑statutory compliance obligations not reproduced. The Act deems the vestings under the Land Act and Municipal Corporations Act (s 4). The operational, planning and regulatory obligations that those statutes impose (for example, approvals for building, heritage controls, environmental obligations) are not restated in this Act; compliance with them remains required but must be checked against the current forms of those statutes and any successor legislation or regulations.

Title and registry reconciliation required. The Fourth Schedule lists Certificates of Title by volume and folio for multiple portions of Perth Town Lots W81-W85. Practical effecting of the revesting will require registry work and possibly rectification of title entries or caveats. The Act creates the vesting by statute once gazetted, but practical registry updates and survey evidence must be aligned with the statutory descriptions in the Schedules.

No penalties in the Act: enforcement is external. Because the Act contains no penalty provisions, compliance failures will be enforced under other statutory regimes or via general legal remedies. Parties should consider including contractual remedies, indemnities and dispute resolution provisions in their agreement under s 3 to manage risk.

Plans custody note: The Notes indicate Lands and Surveys plans are now held by the Western Australian Land Information Authority (Notes, point 2). Practitioners must consult those custodial records to verify plan references and metes and bounds rather than relying solely on the Act’s textual descriptions.

Compliance with the Act’s mechanics requires attention to both legal form and practical administrative steps. The operative sequence in the Act is: negotiate and execute an agreement (within the scope authorised by the Act), publish the executed agreement in the Government Gazette, and then effect operational measures under the Land Act and Municipal Corporations Act as applicable (s 2-4). Below is a compliance checklist keyed to the Act’s provisions.

1. Confirm authority to enter the agreement

• Ensure the Governor (on behalf of His Majesty and the State) and the City of Perth are the parties to the agreement, as authorised by s 2. If other State instrumentalities are involved in land interests referenced in s 3(b), ensure those instruments’ holdings are correctly identified and any internal approvals are obtained.

2. Draft the agreement to address the matters the Act contemplates

• Include clauses providing for vacant possession timing and triggers (s 3(a)), specifying precise dates, notice periods, and conditions precedent or subsequent.
• If a 24‑foot strip for Wellington Street is to be vested from State instrumentality holdings, precisely describe the strip and attach survey references (s 3(b)).
• Address the financial interface between the parties and third parties: although s 3(c) forbids inter‑party payments pending vacant possession, allocate costs, compensation, and tenant buyouts explicitly in the agreement where required.
• Include detailed provisions for removal of improvements, allocation of costs, standards for removal, responsibility for remediation, and handling of salvage (s 3(d)).
• Provide dispute resolution, indemnities, insurance and warranties to manage post‑vesting liabilities.

3. Resolve cadastral and title specifics

• Reconcile the Schedules’ reserve numbers, Perth Town Lot numbers, Lands and Surveys plan numbers (Original Plan No. 5838) and any Certificates of Title listed for Fourth Schedule parcels. Use the Western Australian Land Information Authority records for plan verification as indicated in the Notes (Notes, point 2).
• Prepare and, where necessary, commission up‑to‑date surveys to replace any “approximately” measured descriptions (s 3(b)) and to provide clear plan references for the agreement and subsequent gazettal.

4. Obtain any required approvals before committing to works

• Note the constraint in s 2(b): do not plan to construct a carriageway on Second Schedule lands other than for widening St. George’s Terrace and Barrack Street without obtaining Parliamentary approval. Seek legal advice if proposed works may fall outside those exceptions.
• Identify any approvals or licences required under the Land Act or the Municipal Corporations Act, and under contemporary planning, heritage or environmental regimes that apply to the parcels post‑vesting.

5. Execute the agreement formally and publish in the Gazette

• Ensure the agreement is lawfully executed on behalf of the Governor and the City in accordance with governmental execution protocols. After execution, arrange Gazette publication. Section 4 makes publication the statutory trigger for vestings and dedications, so ensure the published instrument accurately mirrors the executed agreement.

6. Record and register changes

• After gazettal, coordinate with land registry and cadastral authorities to ensure land records reflect the statutory vestings and reservations. For Fourth Schedule parcels, reconcile certificates of title to reflect the revesting in His Majesty and class “B” reserve status (s 4(d)); for First and Second Schedule lands, ensure records show Class “A” reserve status (s 4(a)-(b)); for Third Schedule strips, ensure highway dedication entries are recorded under municipal law (s 4(c)).

7. Plan for post‑vesting operations

• For First Schedule lands the City will have powers to erect and maintain town hall and municipal offices and to lay out amenities under the Municipal Corporations Act (s 4(a)). Ensure municipal approvals, design standards, and procurement processes are in place and compliant with the Municipal Corporations Act and any successor instruments.
• For Second Schedule lands, plan beautification and memorial works consistent with the recreational reserve status and the Parliamentary constraint on carriageways (s 4(b), s 2(b)).
• For Third Schedule highways, incorporate maintenance and public access duties under municipal road management schemes (s 4(c)).

8. Address third‑party interests and liabilities

• If third‑party tenants or owners of improvements are present, secure contractual arrangements for relocation or compensation, because the Act itself does not prescribe compensation mechanisms (s 3). Ensure notice, valuation and statutory acquisition processes (if any) are complied with or expressly agreed.

9. Document approvals and chain of title for auditing

• Maintain a clear audit trail: executed agreement, Gazette notice, survey plans, registry updates, council resolutions and any Parliamentary approvals (if required). These will be essential to evidence the statutory vestings and to respond to any future title or administrative challenges.

10. Review other applicable statutes

• Although the Act imports the Land Act and Municipal Corporations Act by deeming, review contemporary equivalents and any subordinate legislation, planning regimes, heritage protection rules or environmental laws that apply to the parcels. The Act does not displace these regimes.

Following these steps will align implementation with the Act’s procedural mechanics (s 2-4) and place the parties in an administratively compliant position to exercise the powers and duties the Act contemplates.
