Perth Diocesan Trustees (Special Fund) Act 1944

The Act is narrowly framed and centres on a small set of legal concepts, all drawn from the Preamble and three short sections.

Special Fund (defined term): Section 2 defines "Special Fund" as "the capital sum with accretions thereof vested in The Perth Diocesan Trustees for or towards the support of the Anglican Church of Australia clergyman from time to time stationed at York pursuant to the provision in that behalf created by the will of Samuel Evans Burges, deceased, mentioned in the Preamble." The definition links the operative corpus (capital plus accretions) to the testamentary origin described in the Preamble (s 2; Preamble).

Trustees (defined term): Section 2 identifies "Trustees" as The Perth Diocesan Trustees (s 2). That term is the decision-maker under section 3.

Mandatory baseline distribution: The Act establishes that, before any surplus is considered, the annual sum of £20 is to be paid to the clergyman stationed at York (s 3). That payment is drawn from income of the Special Fund, as originally established by the Preamble description of the 1910 Order.

Surplus income: The Act uses an annual accounting concept of "surplus income arising from the special fund remaining in the hands of the Trustees in any year after payment ... of the sum of £20" (s 3). The phrase sets the temporal order: pay £20, then any remaining income is "surplus" for the year. The Act does not itself define precise accounting rules (cash v. accrual, permissible deductions, treatment of realised gains, or what investments or expenses are chargeable to income).

Discretion to capitalise or pay: Section 3 gives the Trustees a permissive choice,"may, at the discretion of the Trustees, be capitalised or paid",in relation to that surplus. The statutory language uses an either/or formulation, but does not expressly address partial capitalisation/distribution or the mechanics for effecting capitalisation (for example, whether capitalised sums are to be invested in the same manner as the original capital) (s 3).

Historical legal context and vesting: The Preamble recounts the chain of events creating the fund: Samuel Evans Burges's will charged land to provide an annuity; a 1910 Order (under the Redemption of Annuities Act 1909) fixed a cash surrender value (£500) and directed investment of that sum, with income to the extent of £20 per annum applied for the York clergyman and surplus to be capitalised with power for Trustees to draw on capital to make good deficiency (Preamble). The Preamble therefore supplies background as to the legal origin of the fund and references the prior Order's investment and capitalisation directions, which are background facts preserved in the statute (Preamble).

Defined-term interaction with Preamble: The Act ties its operational reach to the testamentary provision described in the Preamble and the corpus defined in s 2. The Special Fund is not an abstract fund newly created by the Act; it is the specific capital sum (and accretions) historically vested in the Diocesan Trustees for the York clergyman as recounted in the Preamble (Preamble; s 2).

Amendments and textual continuity: Compilation notes identify later amendments affecting terminology and the short title (for example, the Anglican Church of Australia Act 1976 s 7 changed the "Church of England" name to "Anglican Church of Australia"; Statutes (Repeals and Minor Amendments) Act 2003 amended the short title) (Compilation table; notes 1-6). The notes also state that references to old currency remain in the Act for historical interest only (Compilation note 3).

Legal silence: The Act contains no provisions about reporting, trustees’ investment powers in the present text, fiduciary duties (beyond those that may exist at general law), taxation, dispute resolution, or enforcement mechanisms, nor does it prescribe a mechanism for translating the historic £20 figure into modern currency; the compilation notes flag that old-currency references are of historical interest (Compilation note 3).

Primary parties named by the Act:

• The Perth Diocesan Trustees (the Trustees): the statutory decision-maker; vested with the Special Fund and empowered to choose to capitalise or pay the surplus income in any year (s 2; s 3). The Trustees bear the duty to make the annual choice and to hold and apply the Special Fund consistent with the will and the Act.
• The Anglican Church of Australia clergyman for the time being stationed at York (the beneficiary): the named recipient of the mandatory £20 per annum and of any surplus if the Trustees elect to pay rather than capitalise (Preamble; s 3).

Other parties implicated by the statute and Preamble:

• The estate and will of Samuel Evans Burges: the corpus originates from his testamentary charge and the Preamble recounts that origin and subsequent dealing under a 1910 judicial Order (Preamble).
• The Standing Committee of the Synod and predecessor corporate entities: the Preamble recounts prior statutory vesting of property in diocesan trustee corporations under earlier Acts (Preamble). The current statutory trustee is The Perth Diocesan Trustees (s 2).

Who bears outcomes and costs:

• The immediate economic beneficiaries when Trustees elect to pay surplus are the clergyman stationed at York (s 3). That is a single, concentrated benefit to whoever occupies that office at the relevant time.
• When Trustees elect to capitalise surplus, the immediate monetary benefit shifts from present consumption (the clergyman) to augmentation of the capital base of the Special Fund; the capitalisation increases future income potential generated by the trust corpus, but does not provide immediate cash to the incumbent clergyman (s 3; definition of Special Fund in s 2).

Indirect and practical stakeholders:

• Other diocesan claimants or church purposes are not provided any power under this Act; the statute is narrowly confined to the Special Fund and the York clergyman (Preamble; s 2; s 3).
• Persons or bodies responsible for administering diocesan trust records or accounting will be affected in practice because they must determine annual surplus calculations and implement the Trustees' discretionary decision (s 3, implied).

Administrative actors not mentioned but implicated by silence:

• No departmental regulator, court, or minister is given a statutory role in supervising the Trustees’ exercise of discretion under this Act. The Act imposes the choice on the Trustees without prescribing external oversight or enforcement mechanisms (s 3; absence of enforcement provisions).

Geographical and temporal limits:

• The beneficiary is explicitly the clergyman "for the time being stationed at York" in Western Australia (s 3; s 2). The Special Fund is tied to that location and that office, not a broader class of beneficiaries (s 2; s 3).
• The Act operates on an annual cycle: surplus is assessed "in any year" after payment of £20 and then capitalised or paid (s 3). The recurring nature of the choice creates a perpetual, year-by-year decision point.

Operative duty and mandatory payment

• Mandatory precondition: Section 3 requires that the sum of £20 be paid to the clergyman for the time being stationed at York in each year before any "surplus" is identified. The payment of £20 is therefore a statutory baseline obligation on the Trustees to satisfy from income before considering surplus (s 3; Preamble describing the original Order’s direction to apply income to the extent of £20 per annum).

Discretionary authority

• Discretion to capitalise or pay: The core right granted to the Trustees is the statutory discretion to decide annually whether the surplus income is to be capitalised (added to capital) or paid out to the clergyman (s 3). The statutory text says the surplus "may, at the discretion of the Trustees, be capitalised or paid," indicating the Trustees may choose either course.

No statutory prescription of exercise rules

• The Act does not prescribe procedural or substantive standards for how the Trustees must exercise their discretion: there is no statutory duty within the text to consult the beneficiary, to publish reasons, to apply a best-interests test, or to follow particular accounting rules when computing "surplus income" (s 3; s 2). Any fiduciary obligations would arise under general law or from the trust instrument and historical Order, not from the operative sections of this Act.

Recordkeeping and administrative duties (implied)

• The statute implies an administrative duty to identify and hold the Special Fund ("capital sum with accretions thereof vested in The Perth Diocesan Trustees") and to track annual income so that surplus can be identified after the £20 payment (s 2; s 3). The Act does not specify the form of accounts or required records.

Investment and capital powers (background)

• The Preamble recounts that the 1910 Order required investment of the cash-surrender proceeds (the £500) "in the securities mentioned in the said Order" and provided that income to the extent of £20 be applied for the clergyman and surplus capitalised with power for the Trustees to draw on capital to make good any deficiency (Preamble). That historical statement suggests the investment strategy and some capital-drawing power were previously prescribed by Order, but the Act’s operative sections do not themselves restate or formalise present-day investment mandates or ongoing borrowing/draw-down powers.

No statutory remedies, enforcement or penalty provisions

• The Act contains no sections creating statutory penalties, enforcement regimes, or civil remedies specific to failure to pay the £20 or to misuse the Special Fund. Enforcement therefore will, if necessary, depend on general trust law, historic Orders, or other relevant statutory law, none of which are set out in this Act (absence of enforcement provisions in the Act).

Definition-linked duty

• The Act identifies the Special Fund as capital plus accretions, which places an implicit duty on the Trustees to distinguish income from capital when applying the statutory mandate to pay £20 and to treat accretions as part of the capital corpus if capitalisation is chosen (s 2; s 3).

Interaction with prior instruments

• Because the Preamble references a judicial Order under the Redemption of Annuities Act 1909 which directed investment and capitalisation practices, the Trustees may have duties arising from that Order or the original trust instrument; the Act does not remove those historical facts from legal relevance and they may continue to influence trustees’ obligations (Preamble).

The Act does not establish statutory penalties, fines, criminal offences, or a specific enforcement mechanism for non-compliance with its requirements. There is no section creating a private right of action, no provision authorising a regulator to act, and no express power for a court to supervise or enforce the Trustees' exercise of the discretion set out in section 3 within the text of the Act.

Implications of statutory silence

• Enforcement, if required, would rest on general law mechanisms rather than statutory sanctions contained within this Act. That means:
  • Remedies for a beneficiary alleging breach of trust or misapplication of funds would likely be pursued under general equity and trust law principles rather than under any bespoke statutory enforcement scheme in this Act (the Act contains no enforcement sections).
  • Historical instruments referenced in the Preamble (the 1910 Order under the Redemption of Annuities Act 1909 and the original will) may provide enforceable obligations or interpretive guidance; any application to enforce those pre-existing instruments would proceed under the applicable procedural and substantive rules outside this statute (Preamble).

Practical enforcement actors not named

• There is no ministerial, regulatory, or administrative entity given statutory oversight or enforcement powers in this Act. The decision-maker is the Trustees themselves (s 2; s 3). Any supervisory role would arise from other statutory regimes, the Trustees’ own constitutional documents, or judicial intervention under general law.

Judicial intervention potential

• Because the Act confers discretion on the Trustees but does not oust the general law, parties with standing (for example the beneficiary) who allege misuse of trust property or a failure to perform trust duties could seek relief in court under ordinary trust law remedies. The Act itself does not create a special tribunal or process.

No civil penalty framework or criminalisation

• The Act neither criminalises failure to pay the £20 nor creates a civil penalty for failing to capitalise or for wrongly capitalising; it simply sets the entitlement and the Trustees’ discretion over surplus (s 3). Any claim that a trustee has acted improperly would therefore be pursued under general trust and equity principles.

Record and audit duties absent

• The Act does not require auditing, reporting to a public official, or publication of trustee decisions as part of its enforcement or compliance structure. If public accountability is required, it must derive from other statutory obligations or from the Trustees’ own governance arrangements, not from this Act as such.

The Act situates a specific trust administration choice within a network of earlier statutory and judicial instruments. The text itself refers to prior legislation and a 1910 judicial Order; the compilation notes record later amending Acts. Relevant interactions recorded within the Act and compilation notes include:

Redemption of Annuities Act 1909 and the 1910 Order

• The Preamble recounts that an Order made on 19 April 1910 pursuant to the Redemption of Annuities Act 1909 fixed the cash surrender value of the perpetual charge at £500, ordered payment to the Diocesan Trustees, and required investment of that sum in specified securities with income applied to the extent of £20 per annum and surplus income capitalised, with power for Trustees to draw on capital to make up any deficiency (Preamble). That Order is part of the factual and legal history; any continuing legal effects of that Order, including investment directions or draw-down powers, must be examined in that Order itself and in the post-Order legal context. The Act does not expressly repeal or restate the Order’s terms.

Diocesan trustees and lands statutes

• The Preamble references earlier Acts that vested land and property in diocesan trustee corporations and renamed the corporation as "The Perth Diocesan Trustees" under later Acts (Preamble). Compilation notes identify those Acts' current names (Anglican Church of Australia (Diocesan Trustees) Act 1888 and Anglican Church of Australia (Diocesan Trustees and Lands) Act 1918) and record the later name-change effected by the Anglican Church of Australia Act 1976 s 7 (Compilation notes 4-5; note 2). The 1944 Act operates alongside those Acts in the sense it addresses a discrete fund vested in the diocesan trustee corporation.

Anglican Church of Australia Act 1976

• The compilation notes record that the name "Church of England" was changed to "Anglican Church of Australia" by the Anglican Church of Australia Act 1976 s 7, and that section 2 of this 1944 Act was amended by that 1976 Act (Compilation table; notes 1 and 2). The Act’s definitions have been modernised to refer to the Anglican Church of Australia in s 2.

Decimal Currency Act 1965

• Compilation note 3 states that references in the Act to old currency are of historical interest only and have not been amended under the Decimal Currency Act 1965. The operative text of section 3 retains the figure "£20" and the Act does not supply a statutory conversion or contemporary figure; conversion of historical monetary references must be addressed in the wider legal and administrative context outside this Act.

Statutes (Repeals and Minor Amendments) Act 2003

• The short title of the 1944 Act was changed by s 145 of the Statutes (Repeals and Minor Amendments) Act 2003; that amendment affects citation only (Compilation table).

General trust law and equity

• The Act is a statutory overlay on an existing trust structure created by a will and a judicial Order. The Trustees’ duties and the beneficiary’s remedies for alleged breaches are therefore likely governed by general trust law and equity, not by additional procedural mechanisms in this Act. The statute’s silence on enforcement, accounting standards, and investment choices means ordinary trust law principles and any express terms of the original trust instrument or the 1910 Order will influence outcomes.

Taxation, superannuation, and regulatory regimes

• The Act contains no provisions addressing taxation, reporting to revenue authorities, or interactions with corporate or charity regulation. Any tax consequences for payments or capitalisation will depend on the applicable taxation law and administrative practice external to this Act. The Act does not address those regimes.

Interpretation of older instruments

• Because the Preamble records a 1910 judicial Order and testamentary direction, interpretation and enforcement of the fund’s operational parameters could require reference to those primary instruments and to the judicial record producing the Order. The 1944 Act does not displace those instruments in its operative text; rather it frames trustees’ discretion in the context of that history.

The Act is short and has a concise amendment and reprint history as recorded in the compilation table and notes appended to the reprint.

Original enactment

• The Perth Diocesan Trustees (Special Fund) Act 1944 was enacted as 25 of 1944 (8 and 9 Geo. VI No. 25) and received assent on 23 December 1944, commencing 23 December 1944 (Compilation table).

1976 amendment (Anglican Church of Australia Act 1976)

• Section 2 and section 3 of the 1944 Act were amended by s 7 of the Anglican Church of Australia Act 1976 (No. 121 of 1976). The compilation table records that the 1976 Act's amendments to the 1944 Act came into effect on 24 August 1981 (see s 2(2) and Gazette notice cited in the compilation table). Note 2 explains that the name "Church of England" was changed to "Anglican Church of Australia" by the 1976 Act and that references in the Preamble to "Church of England" have not been altered due to context (Compilation table; note 2). The 1976 amendments modernised terminology in the Act’s operative sections.

Reprints

• A reprint of the 1944 Act as at 3 May 2002 incorporated the 1976 amendments (Compilation table).
• A second reprint as at 7 August 2015 incorporates amendments up to that date (Compilation table).

2003 amendment (Statutes (Repeals and Minor Amendments) Act 2003)

• The Statutes (Repeals and Minor Amendments) Act 2003 s 145 altered the short title of the 1944 Act; the compilation table records assent and commencement on 15 December 2003 (Compilation table).

Currency and textual notes

• Compilation note 3 records that references to old currency in the Act remain for historical interest only and have not been amended under the Decimal Currency Act 1965. Consequently, the statutory figure of £20 remains in the text, even though the compilation notes signal that reference is historical (Compilation note 3).

Consequences of amendment history

• The main substantive content of the Act,section 3’s discretionary capitalisation or payment of surplus, has been retained through the amendments; the 1976 amendment updated terminology, and the 2003 amendment adjusted citation practice (s 3; compilation table; notes). The Preamble remains as the historical statement of origin, and its references to prior judicial Orders and Acts remain part of the reprinted text.

What the compilation table does not show

• The compilation table and reprint notes record the statutory changes to the text and short title but do not indicate any repeal of the historical 1910 Order or of prior Acts mentioned in the Preamble. Whether those prior instruments continue to have legal force, or have been varied or discharged by subsequent court orders or instruments, is not recorded in the Act’s reprint material and would require inspection of those instruments and records.

The reprinted text provided contains no case citations, judicial decisions, or litigation record referencing this Act. The Preamble refers to a specific judicial Order made on 19 April 1910 by Mr Justice McMillan under the Redemption of Annuities Act 1909, which fixed the cash surrender value at £500 and set out investment and application directions (Preamble). That Order is a matter of historical judicial action, but the reprint does not supply any subsequent judicial determinations, appeals, or litigation history concerning the Trustees’ exercise of discretion under the 1944 Act.

What is in the source

• The only judicial proceeding mentioned in the text is the 1910 Order by Mr Justice McMillan pursuant to the Redemption of Annuities Act 1909; the 1944 Act itself does not record any later court supervision, variation, or litigation concerning the Special Fund or the Trustees’ actions (Preamble).

What is not present

• The reprint and compilation do not list any reported cases, litigation outcomes, or judicial oversight arising after the Act’s enactment. There are therefore no cases named in the Act to shed light on how courts have interpreted "surplus income", how discretion should be exercised, or whether the historical Order’s investment requirements continue to bind the Trustees.

Practical implication

• Because the Act is silent about litigation outcomes, any practitioner seeking precedents on the interpretation or enforcement of these provisions will need to search case law and the original 1910 Order outside the reprinted text. The Act itself does not supply a litigation record or judicial interpretations of its operative provision.

The Act is short but contains several points where legal or practical ambiguity may cause unintended outcomes if not attended to. The following issues are drawn from the operative text, definition, Preamble and compilation notes.

Historic currency remains in operative text

• Section 3 continues to refer to the annual sum of "£20" as the mandatory baseline payment. Compilation note 3 states that old-currency references are of historical interest only. The Act itself does not provide a statutory conversion or contemporary equivalent figure. Practitioners and trustees must recognise that the statutory language retains the historical figure; any practical conversion into current monetary terms is not specified in this Act and requires attention to wider legal and administrative practice (s 3; Compilation note 3).

Narrow beneficiary description and occupancy risk

• The beneficiary is the clergyman "for the time being stationed at York" (s 3; s 2). That creates a single, concentrated beneficiary class tied to office occupancy. If a vacancy exists or if the incumbent declines payment, the Act does not specify alternative arrangements. Trustees should note that the statutory entitlement attaches to the office-holder rather than, for example, the parish or multiple beneficiaries (s 3).

Ambiguity over partial capitalisation or partial payment

• Section 3 states the surplus "may ... be capitalised or paid" in the Trustees' discretion. The drafting is permissive and framed as a binary choice. It does not expressly contemplate splitting the surplus between capitalisation and payment in the same year, nor does it specify whether capitalisation must be in whole sums or may be fractional. This textual ambiguity is an implementation risk because reasonable trustees might reach different interpretations (s 3).

Undefined accounting rules for "surplus income"

• The Act does not define what constitutes "income" for the Special Fund, nor does it specify allowable deductions (trust administration expenses, investment management fees, realised vs unrealised gains). The phrase "remaining in the hands of the Trustees in any year" implies an annual accounting period, but the Act does not fix the accounting date or methods. Different accounting approaches will generate different surplus figures and thus different available distributions (s 3).

Preamble references to historical investment directives

• The Preamble recounts an order directing investment "in the securities mentioned in the said Order" and granting power for the Trustees to draw on capital to make good deficiencies (Preamble). The Act’s operative sections do not restate those investment or draw-down prescriptions. Trustees should not assume the Act itself defines current investment powers; the legal status and continuing effect of the 1910 Order require separate examination (Preamble).

No statutory supervision or reporting

• There is no statutory requirement to publish decisions, keep specific records beyond ordinary trust practice, or submit to an external reviewer for the annual decision to capitalise or pay. The absence of statutory oversight could create accountability gaps and procedural uncertainty in contested circumstances (s 3).

Potential generational trade-off left to trustees

• The Trustees’ choice between immediate payment and capitalisation is an intertemporal allocation decision that affects present incumbents and future incumbents differently. The Act gives discretion but does not provide guidance on criteria (s 3). Trustees will need to adopt an internal policy or decision-making criteria to manage this trade-off to reduce dispute risk.

Name mismatch in Preamble vs operative text

• The Preamble refers to "Church of England" in historical narrative; section 2 and section 3 use "Anglican Church of Australia" as updated terminology (s 2; Preamble; Compilation note 2). The difference is explained in compilation notes but could be a source of confusion if the Preamble is relied on for interpretation without consulting the amended definitions.

Unstated tax and regulatory consequences

• The Act does not address tax consequences for either capitalisation or payment. Whether a payment is taxable to the recipient, or whether capitalisation has different tax treatment, is determined by other laws and not governed by this Act. Trustees should be aware that the split between income and capital has tax and accounting consequences not addressed in the statute (s 3).

No prescribed dispute procedure

• If a beneficiary contends that Trustees have exercised discretion improperly, the Act supplies no bespoke dispute-resolution process; recourse would be through general legal remedies. Practitioners should plan for potential litigation costs and evidentiary burdens when advising clients.

The Act imposes a narrow set of actions and decision points on the Perth Diocesan Trustees. Compliance focuses on proper identification and handling of the Special Fund, annual accounting to determine surplus, and formalised, documented exercise of the statutory discretion in section 3. The following steps are grounded in the Act’s text and the Preamble.

1. Establish and maintain clear accounting procedures for the Special Fund

• Maintain distinct records identifying the Special Fund as "the capital sum with accretions thereof vested in The Perth Diocesan Trustees" for the York clergyman (s 2).
• Annually calculate gross income attributable to the Special Fund and record permissible deductions and administration expenses so that the amount "remaining in the hands of the Trustees in any year after payment ... of the sum of £20" can be precisely identified (s 3). Because the Act does not define income or accounting method, trustees should adopt and document a consistent accounting policy to determine income versus capital and to calculate surplus.

2. Pay the statutory baseline sum before making any discretionary decision

• Each year ensure payment of the sum described in section 3, the statutory baseline of "£20," to the Anglican Church of Australia clergyman for the time being stationed at York before identifying any surplus (s 3). Note that the Act retains the historical currency figure; trustees should be aware of the compilation note that this reference is historical and ensure their practice aligns with any external prescriptions or administrative guidance on currency conversion or equivalent value (s 3; Compilation note 3).

3. Record and document the Trustees' discretionary decision

• Where surplus remains after the £20 payment, make a formal, contemporaneous decision recorded in the Trustees’ minutes indicating whether the Trustees have elected to capitalise the surplus or to pay it to the clergyman (s 3). The Act confers discretion but does not prescribe process, so internal documentation will help demonstrate reasoned exercise of discretion in the event of future challenge.

4. Consider whether to adopt written policy or decision criteria

• Because the Act is silent as to factors guiding the Trustees' choice, adopt a written policy or set of decision criteria (for example, considerations of present income needs of incumbents, long-term sustainability of the fund, investment returns, and preservation of capital) to ensure consistent annual decision-making. While the Act does not mandate such a policy, doing so reduces dispute and supports defensible trustee conduct (s 3).

5. Review the historical Order and trust instrument

• The Preamble recounts an Order made in 1910 under the Redemption of Annuities Act 1909 that fixed the cash surrender value, set out required investments, directed application of income to the extent of £20, and provided for capitalisation and draw-down of capital to make good deficiencies (Preamble). Trustees should locate and review that Order and the original testamentary instrument to confirm any persisting investment mandates, any draw-down authority or constraints, and whether those instruments impose duties or restrictions beyond the 1944 Act's operative discretion.

6. Ensure proper beneficiary identification

• Confirm the identity of the "Anglican Church of Australia clergyman for the time being stationed at York" each year before paying the statutory baseline and any paid surplus (s 3). The entitlement is to the office-holder rather than to the parish; ensure processes for payment when vacancies or disputes over incumbency occur.

7. Address tax and reporting implications with advisers

• The Act does not address tax treatment or external reporting; trustees should consult tax and accounting advisers to determine the tax consequences of distributions versus capitalisation and to ensure compliance with any statutory reporting obligations outside this Act (s 3; absence of tax provisions).

8. Implement a procedure for dealing with partial or split distributions (if desired)

• If Trustees wish to split the surplus between partial capitalisation and partial payment, recognise that section 3 is ambiguous on this point ("capitalised or paid") and that splitting may invite challenge absent clear authority. Document the legal advice relied upon and the rationale if a split approach is adopted, and obtain any necessary consents or court directions where uncertainty might be resolved by judicial clarification (s 3).

9. Retain governance records to address absence of statutory oversight

• Because the Act imposes no external reporting or oversight, Trustees should maintain robust minutes, accounts, and records of investment decisions and of the annual surplus computation to demonstrate proper exercise of discretion under the Act and to supply evidence in any future dispute (s 3).

10. Seek legal advice where ambiguities or disputes arise

• The Act is silent on several operational details (accounting rules, partial payments, conversion of the £20 figure, and continuing force of the 1910 Order). Where legal uncertainty affects decision-making,particularly where beneficiaries contest trustee choices, seek legal advice and consider applying to court for directions to avoid protracted disputes (Preamble; s 3; absence of enforcement provisions).

These steps reflect the practical obligations and choices the Act places on the Trustees: identify the Special Fund (s 2), pay the £20 baseline (s 3), compute annual surplus (s 3), and make and record the discretionary choice to capitalise or pay that surplus (s 3). The Act does not prescribe procedural safeguards; prudent trustees should therefore adopt internal governance and consult historical instruments and legal advisers to ensure defensible compliance.
