The Act defines a small set of interlocking concepts that structure authority, finance and approvals for the redevelopment.

Redeemed land and redevelopment area: the Act resumes the Perry Lakes land (Lot 712) and creates an AK Reserve land parcel (Lot 713) and an AK redevelopment area comprised of the AK Reserve land and any other land declared by regulation (s 3 definitions; s 6(2), (6)). The redevelopment area is the statutory unit for planning and financial arrangements (s 3).
Resumption day and completion day: these are proclamation dates fixed by the Governor on recommendation of the Planning Minister (s 4(1)-(2)). Resumption day brings Part 3 into operation (s 2(2), s 14), extinguishes interests (s 6(4)), suspends planning schemes and certain local laws (ss 14‑16), and starts the redevelopment period (s 3). Completion day ends the redevelopment period and triggers specified transfers and regime transitions (s 4(2), s 9, s 48).
Responsible agencies and decision‑makers: WALA is made the responsible agency for the Perry Lakes land and may exercise its statutory powers to plan, develop and dispose of that land for the purposes of redevelopment (s 11). The AK Reserve Minister is the responsible agency for the AK redevelopment area and is tasked with constructing certain sporting facilities and conserving a flora corridor (s 12). The WAPC has functions in relation to accepting and processing draft redevelopment plans, consenting to public notification, considering development applications and issuing development approvals during the redevelopment period (ss 22‑26, 30, 32‑34). The Planning Minister is the ultimate approving authority for redevelopment plans and for declaring completion day (ss 4, 27, 28).
Redevelopment plans as scheme instruments: draft redevelopment plans and amendments are treated as schemes for the purposes of the Environmental Protection Act 1986 (EP Act) (s 10). That mapping triggers EPA processes under the EP Act Part IV Division 3 including submissions, possible requirement for environmental review, and the need to incorporate environmental conditions set or agreed under the EP Act into redevelopment plans before final approval (ss 21, 27(2)).
Suspension of existing planning and building controls: on resumption day, any planning scheme that applied to the redevelopment area ceases to apply, and building local laws cease to apply to the redevelopment area (ss 14(2), 16(2)). Amendments to the Metropolitan Region Scheme or local planning schemes that are made during the redevelopment period in so far as they affect the redevelopment area have no effect until completion day (s 15).
Financial structure and liability: the Perry Lakes Trust Account is established (s 41). The account receives proceeds from sale of Perry Lakes land, borrowings, appropriations and other moneys and funds specified liabilities including most redevelopment costs, specified shares of sport facility costs, a $5 million maintenance contribution, and up to $1 million for corridor enhancement (ss 42‑43). Borrowing by WALA or the AK Reserve Minister requires Treasurer approval and may be guaranteed by the Treasurer, with amounts payable under guarantee charged to the Consolidated Account (s 44(1), (3), (7)). The Treasurer can also advance funds to the Account as temporary loans repayable when funds are available (s 45).
Enforcement and remedies: the Act criminalises unauthorised developments and contraventions of approvals during the redevelopment period with maximum fines set at $50,000 and $5,000 for each further separate offence (ss 31(3), 38(5)). The WAPC has powers to serve removal/stop directions and to undertake works and recover costs if directions are not obeyed (s 38).

These concepts structure who decides (Planning Minister, WAPC, WALA, AK Reserve Minister), who pays (Account, Treasurer guarantees, Consolidated Account in guarantee events, Town of Cambridge payment triggers), the timeline for the regime (resumption day to completion day), and how redevelopment is to be justified, approved and enforced through integration with the EP Act process and specific development approval procedures (Divisions 4 and 5).

The Act creates concentrated impacts on several identifiable groups and alters the legal position of landholders, public authorities and project participants.

Former registered and unregistered interest holders in the resumed land: on resumption day all registered and unregistered interests in the resumed land are extinguished except one specified easement (s 6(4)). For the Perry Lakes land specifically, no compensation is payable to those whose interests are extinguished (s 7(1)-(2)). For certain AK Reserve parcels the Town of Cambridge receives a fixed payment of $1,700,000 but other interest holders in the AK parcels and associated road portion are similarly deprived of compensation (s 8(1), (3)). The State is not liable to indemnify persons for expenses incurred before resumption day in relation to the resumed land (ss 7(3), 8(5)).
Local government(s): the Town of Cambridge is an identified counterparty. It receives the specific $1.7 million payment (s 8(1)) and may receive transfers of fee simple title of parts of Perry Lakes land before completion day or within six months after completion day (s 9(1)-(2)). Local government building local laws cease to apply to the redevelopment area from resumption day and resume operation on completion day (s 16(2), (6)). The relevant local government also receives copies of building approvals and application files from the Housing Minister on transfer of powers at transition day for building laws (s 36(5)).
WALA and AK Reserve Minister: WALA is empowered to plan, develop, hold and dispose of the Perry Lakes land and must perform those functions in accordance with approved redevelopment plan(s) and must cease functions after completion day (s 11(1)-(6)). The AK Reserve Minister must ensure construction of specified sporting facilities, apply sustainability principles, conserve flora corridors, and is similarly constrained to act in accordance with approved plans and not beyond completion day (s 12(1)-(9)). Both are responsible agencies for preparing drafts and are subject to directions from WAPC and the Planning Minister during the plan process (ss 19, 22‑27).
WAPC and Planning Minister: WAPC controls public notification consent, considers drafts and applications and recommends to the Planning Minister, while the Planning Minister gives final approval and must be satisfied of specific environmental and sustainability contents before approving (ss 23, 26‑28). The Planning Minister also controls the Perry Lakes Trust Account (s 41(2)) and must publish a notice under s 47 as a condition before recommending completion day (s 4(3)(c)).
Private developers, purchasers and contractors: during the redevelopment period development can only occur if authorised by a development approval from WAPC (s 31(1), 32). WALA may subdivide and sell land (s 11(3)(a), (c)). Developers face altered approval pathways (WAPC rather than local planning scheme) and must address mandatory plan provisions if the Planning Minister has imposed them (s 27(3)-(4)). Offences and removal directions carry fines and potential cost recovery by WAPC (ss 31, 38). The Account finances many activities, so ability to undertake projects may depend on Account receipts and Treasurer approvals for borrowing or advances (ss 41‑45).
Public authorities and service providers: the WAPC must notify public authorities of development applications and those authorities may make submissions (s 33). The EPA participates in environmental assessment of draft redevelopment plans (s 21). The Housing Minister temporarily exercises building law functions for the Perry Lakes land until transition day (s 36).
The taxpayers: the Consolidated Account may be called upon to meet payments under Treasurer guarantees for borrowing by WALA or the AK Reserve Minister (s 44(7)), and the State funds the $1.7 million payment to the Town of Cambridge from Consolidated Account appropriation (s 8(2)). The Perry Lakes Trust Account itself may receive parliamentary appropriations and investment income (s 42).

Who decides: Governor by proclamation on Planning Minister recommendation (resumption/completion) (s 4); Planning Minister approves and gazettes redevelopment plans and controls the Account (ss 27, 28(1), 41); WAPC manages public notification consent and development approvals (ss 23, 32‑34); WALA and AK Reserve Minister prepare drafts and deliver redevelopment functions (ss 11, 12, 19). Who pays: Account receipts (sales, borrowings, appropriations) pay redevelopment costs (s 42‑43), Treasurer may guarantee borrowings or advance funds (s 44‑45), Consolidated Account pays guarantee calls and the $1.7 million compensation (ss 44(7), 8(2)).

The Act sets out clear duties for public agencies and rights for certain private parties, tightly linked to the redevelopment timeline and plan content.

Duties of public agencies

WALA: must plan, undertake, promote and coordinate the redevelopment of the Perry Lakes land and may exercise WALA statutory powers for that purpose (s 11(1)-(3)). WALA must perform its functions in accordance with the approved redevelopment plan and must cease performing functions after completion day (s 11(4), (6)). WALA must prepare a draft redevelopment plan and submit it for local government comment, EPA review and WAPC consideration in the required order and timeframes (ss 19‑26).
AK Reserve Minister: must ensure construction of athletics facilities serving the State, and basketball and rugby facilities at standards determined by the Minister (s 12(1)). The Minister is subject to specific sustainability principles in choosing design and operation measures (s 12(3)). The AK Reserve Minister must comply with the approved redevelopment plan (s 12(7)) and must not perform functions after completion day (s 12(9)).
WAPC: must consider drafts and may consent or refuse to consent to public notification, give directions for amendments, consider development applications and issue or refuse development approvals, have regard to submitted plans, submissions, orderly planning and amenity (ss 23, 34). WAPC must notify relevant public authorities on receipt of a development application and provide decision notices (ss 33, 34(7)).
Planning Minister: must approve or refuse redevelopment plans (s 27(1)), must not approve until environmental processes under the EP Act are satisfied or resolved (s 27(2)), and must be satisfied that specified sustainability and planning outcomes are achieved before approving plans for Perry Lakes land and AK redevelopment area (s 27(3)-(4)). Planning Minister administers the Perry Lakes Trust Account (s 41(2)) and along with the AK Reserve Minister must prepare an annual redevelopment report (s 40).

Rights and entitlements of private parties

Right to make submissions during public review: any person may make a written submission on a draft redevelopment plan within the minimum 60‑day public review period (ss 24(3), 25).
Right to apply for development approval and to seek review: any person may apply to the WAPC for development approval during the redevelopment period, and an applicant may seek review by the State Administrative Tribunal of WAPC decisions under s 34 in accordance with the Planning and Development Act 2005 Part 14 (ss 32, 35).
Right to notice and participation for affected public authorities: the WAPC must notify public authorities and the local government of development applications and those authorities may make submissions (s 33).

Constraints, prohibitions and duties on all persons

Prohibition on unauthorised development: undertaking development during the redevelopment period without a development approval is an offence punishable by fines (s 31(1)-(3)). Contravening development approval conditions is also an offence (s 31(2)). WAPC may direct persons to remove or stop unauthorised development and may remove works and recover costs (s 38).
Compliance with written laws: the Act does not grant WALA or the AK Reserve Minister immunity from other written laws when performing functions (s 13).

Financial duties

Charging of specified costs to the Account: the Account is charged with a range of costs and payments including 52% of athletics facility costs, full costs for basketball and rugby facilities, a $5 million maintenance contribution and up to $1 million for corridor enhancement, as well as typical redevelopment costs and debt servicing (s 43). The Treasurer may advance funds to the Account and any advance is a charge on the Account until repaid (s 45).

Ministerial discretions and limits

Planning Minister cannot fix completion day unless satisfied that the Metropolitan Region Scheme and local planning schemes as they will apply on completion day neither permit nor prohibit developments inconsistent with the approved redevelopment plan, that aggregated values and funds will be at least $50 million as valued by the Valuer General and that a notice under s 47 has been published (s 4(3)). This creates preconditions on the Minister’s discretion.

Administrative duties

Preparation and tabling of an annual report: Planning Minister and AK Reserve Minister jointly must prepare and lay a redevelopment report before Parliament each year (s 40).

Delegation and regulations

Ministers may delegate functions in writing excluding the power to delegate itself (s 49). Regulations may prescribe procedures and fees for development approval applications and fees for obtaining copies of plans (ss 51, 24(4)).

These duties and rights allocate responsibilities for design, approvals, environmental process integration, and finance, while preserving some procedural rights for the public (submissions, reviews) and review rights to the State Administrative Tribunal for development decisions and certain directions (ss 35, 38(2)-(4)).

The Act sets a mix of criminal penalties, administrative directions and remedies, and cost recovery powers. Enforcement tools are concentrated in the WAPC and the Planning Minister with rights of review provided to the State Administrative Tribunal.

Criminal penalties

Unauthorised development: undertaking any development in the redevelopment period without a development approval is an offence carrying a fine of $50,000 and, for each separate and further offence under the Interpretation Act 1984 s 71, an additional fine of $5,000 (s 31(1), (3)). The offence covers any person, including the WALA and AK Reserve Minister (s 31(4)). Contravening conditions of a development approval when undertaking development is similarly an offence (s 31(2)).
Failure to comply with WAPC directions: failure to obey a written direction from the WAPC served under s 38 is an offence attracting the same penalty structure , $50,000 and $5,000 for each separate and further offence (s 38(5)).

Administrative directions and powers

WAPC removal/stop directions: the WAPC may direct a person to remove, pull down, take up or alter an unauthorised development, or to stop undertaking it immediately, with a minimum period of 21 days for removal directions (s 38(1)(a)-(b)). If the person does not comply and does not pursue review in the SAT within the allowed time, WAPC may itself undertake the removal and recover costs from that person as a debt (s 38(6)-(7)).
Planning Minister emergency powers for environmental compliance: after receiving advice from the Environment Minister under EP Act s 48H(4), the Planning Minister may direct a person undertaking development implementing an assessed scheme to stop work for up to 24 hours by written notice, or cause the WAPC to serve written notice directing steps to comply with environmental conditions (s 39(2)(a)-(b)). Non‑compliance with notices under s 39(2) is a strict statutory offence with the $50,000/$5,000 penalty scale (s 39(3)).

Enforcement process protections

Review rights by the State Administrative Tribunal: a person served with a WAPC direction may apply to the SAT for review in accordance with the Planning and Development Act 2005 Part 14 (s 38(2)). If the application concerns a removal direction under s 38(1)(a), that direction is suspended pending determination of the SAT application (s 38(3)). Applicants for development approvals may also seek review of WAPC decisions by SAT (s 35).

Cost recovery

Recovery of removal costs: where WAPC carries out work to remove unauthorised development because the person failed to obey a direction under s 38(1)(a), the WAPC may recover costs incurred as a debt in a court of competent jurisdiction from the non‑complying person (s 38(7)).

Enforcement interface with the EP Act

EP Act unaffected: the provisions in s 39 do not limit the application of EP Act Part V to developments or environmental harm; s 39(4) expressly preserves other enforcement pathways under the EP Act for pollution and harm resulting from non‑compliance.

Practical enforcement implications

Fines are fixed maxima; the Act does not specify an imprisonment alternative or a different penalty regime for corporations versus individuals. The fines apply to all persons including public agencies (s 31(4)).
The WAPC’s ability to physically remove works and recover costs imposes a financial exposure on developers and land users who undertake unauthorised works; recovery is treated as a civil debt enforceable in court (s 38(7)).
The Planning Minister holds short‑term stop powers for environmental non‑compliance in assessed scheme implementation (s 39(2)(a)), creating a potential for immediate operational interruption of works for up to 24 hours on environmental advice.

Overall, the Act combines criminal sanctions, administrative stop/removal directions and civil cost recovery, while preserving SAT review rights and other EP Act enforcement avenues. Enforcement actions can be taken against private parties and public agencies alike during the redevelopment period.

The Act is explicitly designed to operate in concert with, and at times to displace, other statutory planning and environmental frameworks. The Act maps, suspends and bridges a number of Acts and regulatory processes.

Integration with the Environmental Protection Act 1986

Declared a “scheme Act” for EP Act purposes: for the purposes of the EP Act the Act is a “scheme Act,” draft redevelopment plans and amendments are “schemes,” responsible authorities are designated (WALA for Perry Lakes land; AK Reserve Minister for AK redevelopment area), the Planning Minister is the “responsible Minister,” and the public review period and final approvals are mapped to EP Act procedures (s 10(1)(a)-(g)). This means EP Act Part IV Division 3 assessment rules apply to draft redevelopment plans as they would to traditional town planning schemes.
EPA processes: the responsible agency must submit draft plans to the EPA with sufficient information to enable the EPA to comply with EP Act s 48A and must comply with EPA directions to undertake environmental reviews where required (s 21). If the EPA requires assessment under Part IV Division 3, the responsible agency must supply submissions and responses from public consultation to the EPA (s 21(2)).
Environmental conditions and ministerial powers: the Planning Minister may not approve a draft redevelopment plan until the EP Act processes are completed, including agreement on environmental conditions or resolution under EP Act s 48J, and may rely on Environment Minister advice when exercising powers to ensure compliance with environmental conditions (s 27(2); s 39).

Relationship to the Planning and Development Act 2005 and planning schemes

Planning schemes suspended: on resumption day any planning scheme (Metropolitan Region Scheme or local planning scheme) that applied to the redevelopment area ceases to apply and any planning scheme declared later to be included in the AK redevelopment area also ceases to apply (s 14(2)-(3)). Amendments to the Metropolitan Region Scheme and local planning schemes made in the redevelopment period in so far as they affect the redevelopment area have no effect until completion day (s 15(1)-(2)).
Planning and Development Act powers used with adaptation: the Act directs that the Planning and Development Act 2005 s 132 (which allows suspension of written laws for carrying out approved redevelopment plans) applies with changes so that references to an Act are read as references to any written law and the responsible authority is WALA or the AK Reserve Minister as appropriate (s 17). The Act also requires the WAPC to have regard to the approved development plan when exercising powers under the Planning and Development Act ss 135 or 136 (s 30).
Development approvals and review: development approvals during the redevelopment period are handled under the Act’s Division 5 via the WAPC (s 32), with review rights under the Planning and Development Act Part 14 via SAT (s 35). If the WAPC has not decided an application by completion day, the application is forwarded to the authority under the Metropolitan Region Scheme or an applicable local planning scheme and taken to be an application under that scheme (s 34(5)-(6)).

Building laws and local government laws

Suspension of building local laws: building local laws made by the local government cease to apply to the redevelopment area on resumption day and resume on completion day (s 16(2), (6)). The Act contains transitional arrangements for building laws on Perry Lakes land where the Housing Minister exercises local government functions under the building laws until transition day, after which the relevant local government takes over and is supplied with all approvals and applications the Housing Minister handled (s 36).

Land title and Land Administration Act interface

Transfer and revesting into Crown and exemptions: the resumption transfers fee simple estates to the Crown and removes the Avenues land from the Transfer of Land Act operation (s 6(2)-(3)). The Registrar of Titles is directed to effect necessary entries and is exempted from fees under the Transfer of Land Act for matters required by s 6 (s 6(5), (8)). Part 2 expressly excludes Land Administration Act Parts 9 and 10 from application to the compulsory acquisition effected by the Act (s 7(2), s 8(4)).

Financial and guarantee regimes

Financial Management Act and Treasurer powers: the Perry Lakes Trust Account is an agency special purpose account established under the Financial Management Act 2006 (s 41(1)). Borrowing by WALA or the AK Reserve Minister requires Treasurer approval and may be guaranteed by the Treasurer; amounts payable under guarantee are charged to the Consolidated Account (s 44(1), (3), (7)). Treasurer advances to the Account are permitted and are repayable, and are charged to the Account until repaid (s 45).

Regulations and other Acts

Regulations may declare additional AK redevelopment area land or exclude parts, prescribe fees for obtaining copies of draft and approved redevelopment plans and provide for procedures for Part 3 Division 5 applications (ss 3 definition, 24(4), 51). The Act also cross‑references duties, uptake and other defined terms in the Planning and Development Act, EP Act, Land Administration Act and Transfer of Land Act.

In short, the Act creates a temporary statutory planning and delivery overlay that displaces ordinary planning schemes and building local laws for the redevelopment area for the redevelopment period, while integrating with the EP Act’s environmental assessment regime and using Financial Management Act and Treasurer guarantee mechanisms for finance. It preserves certain EP Act enforcement pathways and sets out how authorities and responsibilities revert or transition on completion day and transition day.

The source compilation table in the Act provides the statutory amendment history up to its reprint. Key amendments and commencement dates given in the source are:

Perry Lakes Redevelopment Act 2005 (Act No. 43 of 2005), assent 19 December 2005. The Act commenced other than Part 3 and s 53 on 19 December 2005; Part 3 commenced on 3 February 2006 (s 2(2) and Gazette 3 Feb 2006 p. 607); s 53 commenced 9 April 2006 (s 2(3) and Gazette 21 Mar 2006 p. 1077). See the compilation table.
Financial Legislation Amendment and Repeal Act 2006 (No. 77 of 2006) affected ss 4, 5(3) and 17 of this Act and other provisions; those amendments commenced 1 February 2007 (see compilation table entry for No. 77 of 2006). The Act notes amendments by s 17 in several places (see marginal notes after s 3 and other sections).
Duties Legislation Amendment Act 2008 (No. 12 of 2008), s 52, amended s 9 to exempt transfers under s 9 from duty and came into operation 1 July 2008.
Perry Lakes Redevelopment Amendment Act 2010 (No. 53 of 2010): the compilation table records amendments and a transition day for building law matters in s 36; the Act received assent 8 December 2010 and most provisions commenced 9 December 2010.
Building Act 2011, s 167 (No. 24 of 2011) made consequential changes to building law references and related transitional arrangements; the provision came into operation 2 April 2012.
Directors’ Liability Reform Act 2023 Pt 3 Div 46 (No. 9 of 2023) is listed in the compilation table with assent 4 April 2023 and commencement 5 April 2023. The compilation table notes that Reprint 1 of the Act is current as at 17 October 2008 and subsequent amendments are included in later updates.

Other editorial notes in the source

Section 53 is omitted under the Reprints Act 1984 s 7(4)(e) and Part 6 (s 54) is omitted similarly (notes at the end of the Act).
The Act text contains marginal amendment notes indicating where specific sections were altered by the amendment Acts named above (for example, s 3 amended by No. 43 of 2005 s 53(2); No. 77 of 2006 s 4 and 17). The compilation table in the Act is the source for the dates and enactments cited here.

This listing is from the Act compilation table included in the source. It is the prescribed amendment record available in the Act text and should be checked against official reprints and WA legislation databases for any further amendments after the compilation table’s date.

The Act text contains no references to case law, judicial decisions or litigation arising under the Act. It does, however, establish administrative review routes which provide a statutory path into adjudicative bodies:

State Administrative Tribunal (SAT) review rights are provided for decisions of the WAPC concerning development approvals and for review of WAPC directions regarding unauthorised developments (s 35; s 38(2)). These statutory review rights map to the Planning and Development Act 2005 Part 14 processes for SAT review.
The Act provides for consultation and environmental processes under the EP Act Part IV; that framework includes internal EPA decision and review rules (s 21, s 27(2)) and EP Act s 48J dispute resolution paths referenced where relevant by the Act (s 22(5)).

Because the compilation of the Act in the source is not a litigation database, and the Act itself does not list cases, no specific reported litigation history is supplied in the text. For actual litigation arising under the Act (for example SAT appeals or judicial review applications in state courts), one must search WA case law databases and SAT records; the Act itself provides the procedural hooks (ss 35, 38) but does not record outcomes.

This section flags concrete legal and practical pitfalls that arise directly from the Act’s text and mechanics.

Extinguishment without compensation for Perry Lakes land: section 6(4) extinguishes all registered and unregistered interests on resumption day (except one easement) and section 7(1)-(2) makes clear there is no entitlement to compensation for those interests in respect of the Perry Lakes land and that Land Administration Act Parts 9 and 10 do not apply. Parties with expectations of compensation or indemnity for pre‑resumption costs have no statutory entitlement under this Act (s 7(3)). That is a direct statutory removal of property remedies for those interests.
Limited compensation to Town of Cambridge only: section 8(1) mandates a $1.7 million payment within six months after resumption day for specified AK Reserve land interests, and section 8(3)-(5) bars compensation for other interest holders in the same AK parcels. The Act fixes the State liability in this respect and does not provide for variation or indexation.
Suspension of planning schemes and local building laws: on resumption day, the Metropolitan Region Scheme and local planning schemes in their operation over the redevelopment area cease to apply (s 14(2)), and building local laws cease to apply (s 16(2)). This shifts approval pathways to the WAPC/approved redevelopment plan during the redevelopment period and may disrupt prior permissions or expectations based on local planning rules. Amendments to regional or local schemes made during the redevelopment period take effect only on completion day (s 15), which may create planning timing mismatches or uncertainty for third parties.
Required content in redevelopment plans: before approving a plan for the Perry Lakes land the Planning Minister must be satisfied of specific sustainability targets, public open space ceding (minimum 15% on subdivision), tree and flora conservation and maximum building height (no more than five storeys), and inclusion of aged accommodation (s 27(3)). Drafting that fails to meet these requirements risks refusal or directions for amendment.
Integration with EP Act creates additional environmental hurdles: draft plans are schemes for EP Act purposes and may be assessed under EP Act Part IV Division 3, requiring environmental review and possibly environmental conditions that must be incorporated before final approval (ss 10, 21, 27(2)). This can extend timeframes and impose conditions enforceable by the Planning Minister under s 39.
Financial contingency risks: the WALA and AK Reserve Minister may borrow with Treasurer guarantee approval and the Consolidated Account can be charged for payments under guarantee (s 44(3), (7)). This creates a contingent State liability and means project finance may depend on Treasurer discretion and required securities (s 44(5)).
Enforcement penalties apply to public agencies too: the offences for unauthorised development and non‑compliance with directions apply to any person, including WALA and the AK Reserve Minister (s 31(4)). Agencies must therefore ensure internal compliance when acting under the Act.
Timing traps around completion day: if WAPC has not decided an application by completion day, the application is forwarded to the relevant authority under the Metropolitan Region Scheme or local planning scheme and treated as an application under that scheme (s 34(5)-(6)). Applicants may face changes in applicable controls and assessment frameworks at that point.
Account closure and transfer of funds to Town of Cambridge: on completion day any funds in the Perry Lakes Trust Account are to be paid to the Town of Cambridge and the Account closed (s 48). This creates a timing incentive for how receipts and expenditure are managed and a single recipient at closure.
Fees and procedural rules left to regulations: fees for obtaining copies of plans and development application processes are largely left to regulation (s 24(4), s 51). Uncertainty on fees and precise procedural steps may exist until regulations are made or consulted.
Delegation limits: Ministers can delegate powers but the power to delegate itself is not delegable and delegations must be in writing (s 49). Careful administration and proper written delegations are necessary to ensure lawful exercise of powers.

Each of these points is grounded in the Act text cited above and creates concrete consequences for affected parties, from landholders and the Town of Cambridge to WALA, the AK Reserve Minister and developers.

This section outlines concrete compliance paths, responsibilities and checklists for the principal actors: developers/land users, the responsible agencies (WALA and AK Reserve Minister), the WAPC, the Planning Minister, the EPA and the Town of Cambridge.

For any person or entity proposing to undertake development in the redevelopment period

Apply for development approval to the WAPC in the prescribed form with any prescribed fee and provide full plans and specifications and any further information reasonably required (s 32(1)-(3)). Note: applications cannot be made on or after completion day (s 32(4)).
Expect WAPC to notify public authorities and the local government of the application; those notified parties may make submissions within 42 days or sooner, and WAPC must wait at least 42 days after notification before acting, or until final submissions are received (s 33(1), s 34(4)). Ensure contact details for notification are accurate and respond to any queries from WAPC promptly.
Do not commence any development before a development approval is issued. Undertaking development without approval or in breach of approval conditions is an offence with significant fines (s 31). If a development approval contains a time limitation, comply strictly or seek extension via WAPC before expiry (s 34(3)).
If served with a WAPC direction to remove or stop works under s 38, either comply within the period specified or apply immediately to the SAT for review (s 38(1)-(3)). Note removal directions under s 38(1)(a) are suspended while a timely SAT application is pending (s 38(3)).

For WALA and the AK Reserve Minister preparing a draft redevelopment plan

Prepare the draft in accordance with s 19: include provisions promoting orderly planning and management, make reasonable endeavours to consult public authorities and persons likely to be affected, and, for the Perry Lakes land and AK area drafts, include the additional Plan content specified in s 27(3)-(4).
Submit the draft to the local government for comment (s 20), to the EPA with sufficient information to permit EP Act s 48A compliance (s 21(1)), and to the WAPC only after allowing 35 days since local government submission and after any required environmental review processes and consultation timelines are satisfied (s 22(2)).
If the EPA requires an environmental review under EP Act s 48C(1)(a), undertake that review in accordance with the EPA’s instructions and submit the review to the EPA (s 21(3), s 22(2)-(4)). If dispute arises about review adequacy consult the Environment Minister and, if unresolved, follow EP Act s 48J dispute process (s 22(4)-(5)).
When WAPC consents to public notification, publish notice in the Gazette and in two local newspaper issues, stating where copies can be inspected and obtained and setting a submissions period not less than 60 days from Gazette notice (s 24(1)-(3)). Preserve records of notices and the timing of publication for proof of compliance.
After the submission period, collate submissions, prepare a summary and an agency report on merits and submit these with the draft to WAPC, which will forward the draft with recommendation to the Planning Minister (s 26(2)-(4)). Ensure responses to environmental submissions are prepared within the 42‑day EP Act windows where EPA requested them (s 21(2)).

For the WAPC and Planning Minister

WAPC: when considering a draft, decide to consent to public notification, to refuse, or to consent subject to amendments (s 23(1)). If refusing, provide directions as to preparation of a further draft (s 23(2)). Any directions given must be complied with by the responsible agency (s 23(3)).
Planning Minister: before approving a plan for Perry Lakes land, be satisfied of the specific sustainability, water and energy consumption targets, public open space ceding (minimum 15% on subdivision and location criteria), tree/flora conservation aims, five‑storey maximum height and inclusion of aged accommodation (s 27(3)). For AK redevelopment area plans, be satisfied the plan preserves and enhances a broadly east‑west flora corridor (s 27(4)). Do not approve until EPA / EP Act processes and environmental conditions are finalised or resolved under EP Act dispute mechanisms (s 27(2)).

Financial compliance and borrowing

The Planning Minister controls and administers the Perry Lakes Trust Account; ensure accounting complies with Financial Management Act requirements and that receipts (including sales proceeds) and prescribed expenditures are correctly credited/charged (ss 41‑43).
For WALA and AK Reserve Minister borrowings: obtain the Treasurer’s written approval and provide any security the Treasurer requires before borrowing (s 44(2), (5)). Understand that Treasurer guarantees may expose the Consolidated Account to calls (s 44(7)) and that any Treasurer advances will be a charge on the Account until repaid (s 45).

Post‑completion and transfer actions

Before recommending completion day, ensure preconditions in s 4(3) are met: alignment of post‑completion Metropolitan Region Scheme and local planning scheme applications with the approved redevelopment plan so that they neither permit nor prohibit new developments inconsistent with the approved plan (s 4(3)(a)); confirm the Valuer General’s valuation-based aggregate statutory $50 million threshold is met including transfers and funds (s 4(3)(b)); and publish the s 47 notice about no costs chargeable to the Account or satisfactory alternative arrangements (s 4(3)(c)).
On completion day: the WALA and AK Reserve Minister must stop performing their functions (ss 11(6), 12(9)), any existing valid development approvals remain in force after completion day until the development is completed unless limited by a time condition (s 34(8)), and funds in the Account must be paid to the Town of Cambridge and the Account closed (s 48).

Record‑keeping, consultation and public process

Keep meticulous records of consultation with local government and public authorities, publication of notices in the Gazette and newspapers, submission summaries and EPA correspondence and reports. The EP Act mapping makes these records relevant to final approval decisions and potential environmental dispute processes (ss 21, 24, 26, 27).

Delegations and statutory review

Use written delegations for ministerial functions as required by s 49 to ensure lawful exercise of delegated powers. Be aware of the statutory requirement for the Minister to carry out a review of the Act five years after commencement and table a report (s 52).

By following these steps and tracking the statutory timelines and preconditions in the Act (notably the requirement to obtain WAPC consent for public notification, EPA processes, minimum 60‑day submission periods and the specific content tests in s 27), agencies, developers and third parties can align project actions with the Act’s procedural and substantive obligations.
