Pemberton National Park and Recreational Reserve By-laws

The by-laws rest on a handful of repeatable legal constructs that structure permitted activity, delegated discretion, and enforcement.

Reserve scope and dynamic application (By-law 1)

• The by-laws apply to Reserve No. 19857 as described by cadastral references, and explicitly extend to “any other reserve vested in the Board from time to time for the purposes of national park and recreation” (By-law 1). That makes the instrument deliberately portable to future reserves vested in the same Board.

Defined terms that constrain authority (By-law 1A)

• “Board” is the Pemberton National Park Board as constituted under the referenced Act; “permission” is expressly defined as the written permission of the Board; “Reserve” is the named reserve and other reserves vested in the Board; and “the Act” is the Parks and Reserves Act 1893 (By-law 1A). The written-permission definition is a controlling interpretative rule for all by-law provisions that require permission.

Delegated regulatory discretion (By-laws 1B, 2, 11, 16, 17, 18)

• The Board is given multiple discretions: to affix and custody a common seal subject to meeting rules (By-law 1B), to open the Reserve “subject to the provisions of these By-laws” and charge admission and pool fees (By-law 2), to set bathing costume requirements by notice (By-law 11), to designate fire sites (By-law 16), to debar persons for periods the Board thinks fit (By-laws 4 and 17), and to grant leases or permits that may confer exclusive use (By-law 18).

Permission as a gatekeeping mechanism (By-laws 1A, 3, 5, 7, 10, 14)

• Many activities are permitted only subject to the Board’s prior written permission. Where the by-law uses the word “permission” without more, By-law 1A prescribes that it must be “in writing” from the Board. That rule converts nominally permissive requirements into an administrative gate requiring written authorisation.

Prohibitions and behavioural rules (By-laws 6, 8, 9, 11-17)

• The instrument lists specific prohibitions: firearms and hunting (By-law 6), damage to vegetation and property (By-law 8), interference with workers during improvement works (By-law 9), campsite restrictions (By-law 10), bathing rules and pool hygiene (By-laws 11-14), waste disposal (By-law 15), fires only in set places (By-law 16), and obligations as to behaviour and intoxication (By-law 17).

Enforcement architecture (By-laws 4, 7, 19, 20)

• Enforcement tools are removal from the Reserve by police constables or Board personnel (By-law 4), destruction of certain animals found within the Reserve by authorised persons and recovery of compensation via a Justice of the Peace (By-law 7), authorisation to enforce and to institute proceedings vested in Board members and persons authorised in writing, and where a lease exists, in lessees or permit-holders (By-law 19). Penalties are a maximum on summary conviction of twenty pounds (By-law 20).

Exclusivity and crowding-out by lease or permit (By-law 18)

• Where the Board grants a lease or permit for games to a club or persons, the by-laws prohibit other games that would interfere or compete with that lessee’s use for the lease term. That installs a property-right-like exclusivity against other users.

Administrative particulars: seal and formalities (By-law 1B)

• The Board’s common seal must bear specific words, be affixed pursuant to a regular meeting resolution and in the presence of two Board members, and be kept in custody of the Secretary or another authorised person (By-law 1B). This establishes basic corporate formalities for Board actions requiring a seal.

Currency and penalty framing

• Monetary figures in the by-laws are expressed in pounds, shillings and pence: admission fees adults 2s., children 6d.; annual pool charge 5s.; and a maximum summary conviction penalty of twenty pounds (By-laws 2, 20). That currency framing is textual in the instrument and reflects the historical drafting.

Collectively, these concepts make the Board the central decision-maker over permission, fees, exclusion, and enforcement, while giving operational powers to police and Board personnel and to lessees where a lease exists.

The by-laws identify a set of affected actors and stakeholders by naming roles and behavioural categories.

Members of the public and Reserve users

• The Reserve is open to the public “at all times” subject to by-law conditions (By-law 2). Members of the public who wish to visit, swim in the pool, camp, play sports, sell goods, or otherwise use the Reserve are directly regulated. Admission and pool charges apply when the Board so determines for entertainments or special occasions (By-law 2).

Visitors seeking to use facilities regulated by permission

• People or groups who wish to play games, hold entertainments, sell goods, camp, bring stock or boats, or otherwise engage in actions that the by-laws make subject to “permission” will need the Board’s written permission (By-laws 3, 5, 7, 10, 14). Permission-holders are a distinct subset that will hold contractual or regulatory obligations set by the Board.

Lessee or permit-holder

• A person or club who obtains a lease or permit to enable a game to be established receives a strengthened position under By-law 18, namely the ability to prevent other games that would interfere with the leased activity. Lessees and permit-holders also have enforcement powers under By-law 19 to enforce the by-laws and take proceedings.

Board members, officers and servants

• The Pemberton National Park Board is the central decision-maker and is vested with formal corporate trappings including a common seal (By-law 1B). Members, officers and servants of the Board are expressly empowered to remove persons from the Reserve (By-law 4) and to enforce the by-laws and institute proceedings when authorised (By-law 19).

Police

• Police constables are explicitly authorised to remove persons found committing breaches (By-law 4). That gives police powers of removal in addition to Board-authorised personnel.

Owners of animals and stock

• Owners whose animals enter the Reserve face specific consequences. Stock may only enter with permission (By-law 7). Dogs, goats and poultry found within the Reserve may be destroyed by authorised persons, and the owner must make compensation recoverable before a Justice of the Peace for damage done by those animals (By-law 7).

Vendors and traders

• Persons who sell or expose goods for sale on the Reserve must obtain written permission from the Board before doing so (By-law 5). Vendors that operate without permission are in breach.

Workers, gardeners, caretakers and rangers

• Employees or contractors engaged in constructing or maintaining greens, beds, buildings or other improvements are protected against interference by the by-laws; the public is prohibited from interfering with them during such works (By-law 9). This creates duties for visitors to avoid disrupting maintenance.

Bathers and swimmers

• All bathers are subject to decency requirements, and required costume standards as posted by the Board (By-law 11). There are also hygiene restrictions such as a prohibition on the use of soap in the pool (By-law 12) and prohibitions on dogs, sticks, stones and rubbish being thrown into the pool (By-law 13).

Those seeking to light fires

• The public cannot light fires except in places set apart by the Board (By-law 16). Persons intending to use open flame or barbecues will need to comply with designated locations.

Court and administrative officers

• Justices of the Peace have a role in recovery of compensation for damage caused by animals (By-law 7) and magistrates or infringing courts will be the forum for summary conviction proceedings under By-law 20, which sets the monetary ceiling for penalties.

General public with behavioural obligations

• The by-laws require decency and decorum and allow removal and debarment of persons in a state of intoxication or misconduct (By-law 17).

Overall, the by-laws affect a broad set of actors: private individuals who visit or seek to trade or recreate in the Reserve, the Board and its personnel, lessees or permit-holders, police, animal owners, and court officers. The Board is the gatekeeper for written permissions and for leasing authority that can create exclusive rights.

Duties imposed on the public and specific actors

• Obtain written permission before undertaking activities for which the by-laws require permission. The instrument defines “permission” as the Board’s written permission (By-law 1A), and multiple by-laws make activities conditional on such permission including sport or entertainment (By-law 3), sale of goods (By-law 5), permitting stock to enter (By-law 7), camping (By-law 10), and canoe use on the swimming pool (By-law 14).
• Do not carry or discharge firearms on or through the Reserve, nor shoot, snare or destroy birds or animals, except as the by-laws expressly permit (By-law 6).
• Prevent entry of stock without permission. The by-laws require prior permission for stock entry and authorise destruction of dogs, goats and poultry found on the Reserve by authorised persons (By-law 7).
• Refrain from damaging or removing vegetation, walking on beds and borders, or otherwise injuring flora or park property (By-law 8).
• Refrain from interfering with workmen, gardeners, caretakers and rangers during maintenance and construction works (By-law 9).
• Do not camp except with permission (By-law 10).
• Bathers must wear costumes preserving decency and in accordance with Board notices posted on the Reserve (By-law 11).
• Do not use soap in the swimming pool (By-law 12); do not throw dogs, sticks, stones, rubbish or any matter into the pool (By-law 13).
• Canoes require permission to be used on the pool and must have a float attached to a suitable rope (By-law 14).
• Deposit rubbish in receptacles provided (By-law 15).
• Light fires only in places set apart by the Board (By-law 16).
• Behave with decency and decorum; persons intoxicated or misconducting themselves are liable to removal and debarment (By-law 17).

Duties and liabilities for animal owners

• Owners whose dogs, goats or poultry are found within the Reserve may suffer destruction of those animals by authorised persons. Owners are liable to make compensation for any damage done by such animals, and compensation is recoverable before any Justice of the Peace (By-law 7).

Duties of the Board

• The Board has a duty to post notices as to bathing costume requirements (By-law 11) and to set apart places for lighting fires (By-law 16). The Board is also responsible for administering permissions, charging fees for entertainments and pool users when it decides to do so (By-law 2), and for instituting enforcement and debarment decisions (By-laws 4, 17, 19). The Board must observe its own corporate formalities for affixing the common seal, namely resolution at a regular meeting and presence of two members and custody rules (By-law 1B).

Rights and powers of the Board and authorised persons

• Remove persons committing breaches from the Reserve (By-law 4).
• Debar persons from entering the Reserve for periods the Board thinks fit (By-law 4 and 17).
• Enforce the by-laws and take proceedings in relation to breaches. The power to enforce and take proceedings at any time is given to Board members, persons authorised in writing by the Board, and, when the Reserve is leased, to the lessee or permit-holder (By-law 19).
• Authorise certain persons to destroy specific animals found in the Reserve (By-law 7).
• Impose fees for admission to entertainments and an annual swimming pool charge, at rates specified in the by-laws (By-law 2).

Rights of lessees and permit-holders

• Where a lease or permit is granted to a person or club for a particular game or games, that lessee has the right to exclude other games that would prevent, hamper, interfere or compete with its use for the lease term (By-law 18). The lessee or permit-holder also acquires enforcement powers to take proceedings (By-law 19).

Legal remedies and penalties

• Compensation for damage caused by animals is to be recovered before a Justice of the Peace (By-law 7).
• Breach of any by-law is a punishable offence on summary conviction with a maximum penalty of twenty pounds (By-law 20).

Formality obligations

• The Board must keep its common seal in custody of the Secretary or another authorised person and affix the seal in the presence of two members following a resolution at a regular meeting (By-law 1B).

Taken together, these duties impose written-permission gatekeeping at many points, create liability for animal owners and vendors operating without permission, grant the Board and authorised persons enforcement and exclusion powers, and give lessees significant protective rights when a lease or permit is granted.

Enforcement agents and mechanisms

• Removal: Any person committing a breach of these by-laws “may be removed from the Reserve by a police constable, or any member, officer, or servant of the Board” (By-law 4). That provision creates dual-authority removal power for both police and Board personnel.
• Debarment: The Board may debar persons for such period as the Board thinks fit from entering any Reserve (By-laws 4 and 17). This is a discretionary administrative exclusion whose duration is not statutorily capped in the by-laws.
• Destruction of animals: Dogs, goats and poultry found within the Reserve “may be destroyed by any of the persons hereinafter referred to as being authorised to prosecute for the breaches of this By-law” (By-law 7). Read with By-law 19, those authorised to enforce and take proceedings include any member of the Board, any person authorised in writing by the Board, and, where the Reserve is leased, the lessee or permit-holder. The by-laws therefore authorise certain persons to destroy specific animals found within the Reserve as a direct enforcement tool.
• Recovery of compensation: The owner must make compensation for any damage done by such dogs, goats, or poultry, and the compensation is specifically stated to be recoverable “before any Justice of the Peace” (By-law 7). This identifies a judicial-adjacent remedial route for property or damage claims arising from animal intrusion.
• Prosecutions and proceedings: By-law 19 expressly empowers Board members, persons authorised in writing by the Board, and lessees or permit-holders (in the event of Lease) to enforce the by-laws and “take any proceedings thereunder at any time.” That language contemplates instituting civil or criminal proceedings under the by-laws against alleged contraveners.

Penalty quantum and procedural form

• By-law 20 sets the maximum penalty on summary conviction for breach of any of the by-laws at twenty pounds. The by-laws do not elaborate the procedural court architecture for summary proceedings, but the text identifies summary conviction as the liability route and a penalty ceiling.

Administrative enforcement discretion and limits

• Several enforcement powers are discretionary: debarment is for a period the Board “thinks fit” (By-laws 4 and 17); fees and admission are charged “when permission being first obtained” and the Board “reserves the right” to charge for entertainments and an annual swimming pool charge of 5s. per head (By-law 2). Discretion over fees, debarment duration and permission creates administrative latitude.

Interaction of Board enforcement with police and magistrates

• Police may remove contraveners (By-law 4), which provides immediate operational support for ejection. Subsequent proceedings can be pursued by the Board or those authorised under By-law 19. Compensation actions for animal damage are to be pursued before a Justice of the Peace (By-law 7), and summary conviction proceedings for by-law breaches implicate the courts with a twenty pound penalty cap (By-law 20).

Enforcement scope and evidence issues implied by the text

• The written-permission regime (By-law 1A) suggests an evidentiary threshold: permissions are to be written, which creates documentary evidence for lawful activity. Conversely, the by-laws do not specify notice requirements other than the bathing costume notice (By-law 11) or a public register of permissions or leases, which could affect proof of entitlement or permission in disputes.

Immediate remedial measures vs. penal measures

• The by-laws give authorised persons immediate remedial measures (removal, destruction of certain animals) as well as access to court-based remedies (compensation before a Justice of the Peace, summary conviction penalties). This creates parallel enforcement tracks: on-the-spot remedies for preservation of Reserve order and statutory penalties via summary conviction.

Overall, enforcement is a mix of administrative discretion exercised by the Board and its authorised agents, operational support from police, and access to judicial remedies for compensation and criminal penalties. The by-laws concentrate significant enforcement initiation power with the Board and its authorised persons (By-law 19), while also providing police authority for immediate removal (By-law 4).

Statutory linkage to the governing Act (By-law 1A)

• The by-laws explicitly situate themselves under the Parks and Reserves Act 1893 by defining “the Act” as that statute (By-law 1A). They define the Board as the Pemberton National Park Board constituted under subsection (4) of section 3 of that Act (By-law 1A). That references a parent statute for the Board’s constitution and primary powers, meaning the by-laws operate within the broader statutory framework created by the Act. The by-laws do not reproduce the Act but presuppose its existence and enabling authority.

Interaction with policing and criminal process

• By-law 4 entrusts police constables with the power to remove persons committing breaches. By-law 20 frames offences as subject to summary conviction with a monetary ceiling. These provisions imply interaction with criminal procedure and local magistrates courts which handle summary proceedings. The by-laws assume the ordinary criminal and summary enforcement architecture without setting out procedural detail.

Interaction with judicial officers for civil recovery

• By-law 7 specifies that compensation for damage by animals found in the Reserve is to be recovered “before any Justice of the Peace.” That gives a statutory link to local judicial office-holders who have authority to hear certain summary civil matters. The by-laws therefore interface with magistrates and justices’ processes for civil recovery.

Leases, permits and private contractual relations

• By-law 18 contemplates leases and permits granted by the Board that create exclusive use rights for games. Those leases or permits will be contractual or statutory authorisations under the Act and the by-laws and will interact with property law principles and contract law in disputes over exclusivity, termination, or interference by third parties. The by-laws grant the lessee a statutory right to exclude competing games; how that converts to private-law remedies will depend on the terms of the lease or permit and the enabling Act.

Administrative law and review (implication)

• The by-laws vest discretion in the Board to grant permissions, set fees, and debar persons “for such period as the Board thinks fit.” While the by-laws themselves do not provide a review mechanism, decisions made by the Board are administrative acts that in contemporary law could attract review on standard administrative law grounds. The by-laws do not address internal appeal or review, which means external judicial review remedies under the governing statute or general administrative law would be the likely path where available under controlling law.

Overlap with public order and safety laws

• Prohibitions on firearms, restriction on fires to places set apart, and prohibition of hunting and snaring will coexist with broader statutory regimes controlling firearms, bushfire safety and animal welfare in other legislation. The by-laws create distinct park-level rules that operate in tandem with state-wide statutory schemes. The by-laws do not abrogate or replace other statutory obligations; they operate in the Reserve’s regulatory envelope.

Local government, health or sanitation statutes (implication)

• Provisions about pool hygiene, prohibition on soap in the swimming pool, and waste disposal into receptacles (By-laws 12, 13, 15) may intersect with local public health and sanitation laws. Enforcement of those wider statutory schemes is not detailed in the by-laws; instead the Board sets internal rules enforceable under the by-laws themselves.

Currency and penal amounts in historical terms

• The monetary amounts and penalties are expressed in older currency (pounds, shillings and pence). If other statutes or modern legal instruments adjust penalty scales or update currency through subsequent legislation, the by-laws’ monetary figures may require interpretative alignment with later amendment mechanisms. The compilation table shows amendments made in 1960, but no further changes are recorded in the provided text.

In sum, the by-laws are designed to be read as a local regulatory overlay under the Parks and Reserves Act 1893 and interact operationally with ordinary criminal process, justices’ courts for recovery, leases and contractual relationships, and other state statutes without expressly displacing them.

Gazettal and subsequent amendment entries

• The compilation table at the end of the instrument records the original gazettal and a later amending instrument. The original Pemberton National Park and Recreational Reserve By-laws were gazetted on 6 November 1931 and commenced that day (Compilation table). Amending by-laws were gazetted on 8 December 1960, pages 3912-3913, with the same gazettal date shown as the commencement date for those amending provisions (Compilation table).

Textual amendments noted in the body

• The by-laws themselves bear inline amendment notes identifying specific clauses amended or inserted on 8 December 1960. For example:
  • By-law 1 is annotated “By-law 1 amended: Gazette 8 Dec 1960 p. 3912.”
  • By-law 1A was “inserted: Gazette 8 Dec 1960 p. 3912.”
  • By-law 1B was “inserted: Gazette 8 Dec 1960 p. 3913.”
  • By-law 4 and By-law 17 are noted as amended on 8 December 1960 (p. 3913).
  • By-law 20 is identified as “By-law 20 inserted: Gazette 8 Dec 1960 p. 3913.”

Nature of amendments reflected in the text

• The 1960 amendments introduced definitional clarity and administrative formality. By-law 1A introduced defined terms including Board, permission (written), Reserve, and the Act reference. By-law 1B established rules for the common seal. By-law 20 introduced the express maximum penalty on summary conviction. The amendments to By-laws 4 and 17 added or clarified removal and debarment powers (By-law annotations). The insertion of those by-laws reflects an expansion and formalisation of Board powers and procedural definitions in 1960.

Compilation status

• The instrument presented is a compiled set of the by-laws incorporating the original 1931 text and the 1960 amendments. The compilation table lists these two registration events. No further amending by-laws, repeal provisions, or later consolidations are recorded in the provided compilation table.

Implications of the amendment history

• The amendment history shows that the by-laws were actively reviewed and updated at least once in the mid-20th century to add administrative definitions and enforcement mechanisms. That history implies that decisions about procedural formalities such as written permission and the Board’s seal were later additions, as were explicit penalty ceilings. The by-laws do not show subsequent amendments or modernisation in the provided compilation table.

What the by-laws do not show about amendment mechanics

• The by-laws refer to the Board as constituted under subsection (4) of section 3 of the Act, but the compilation does not reproduce that Act or any later statutory amendments. The by-laws therefore presuppose the parent Act provides enabling authority, and the compilation table does not document whether later Acts modified the Board’s statutory basis or repealed the by-laws.

For audit and compliance purposes, the relevant recorded amendment dates are 6 November 1931 (original gazette) and 8 December 1960 (amendments inserting By-law 1A, 1B, By-law 20 and amending others). Any practitioner seeking the current valid position must verify whether later legislation or orders have further amended, superseded or repealed these by-laws; the compilation table here does not supply that information.

No cases or judicial authorities are cited in the instrument. The text contains no references to any litigation, appellate decisions, or judicial interpretations of these by-laws. The compilation table and by-laws themselves make procedural references to judicial officers such as “Justice of the Peace” for recovery of compensation (By-law 7) and to “summary conviction” for breaches (By-law 20), but they do not record any decisions or litigation outcomes.

What is in the source

• The instrument is a stand-alone set of by-laws and a compilation table. It lists gazettal dates (6 November 1931 and amendment on 8 December 1960) but no litigation or case citations.

Practical consequence for research

• Because the instrument does not cite cases, a legal practitioner seeking a litigation history or judicial interpretation must independently search court databases and law reports for matters that reference these by-laws, the Pemberton National Park Board, or disputes arising under Reserve No. 19857. The by-laws themselves do not supply precedent or interpretative example.

Historic implications

• The absence of litigation references in the text is not evidence that disputes have not occurred; it simply means the legislative compilation contains no litigation notes. Where parties have contested debarment, compensation for animal damage, or exclusivity under By-law 18, such decisions would appear in court records rather than in the by-laws.

For current compliance and risk assessment, practitioners should assume that enforcement and litigation are possible under the by-laws (removal, debarment, destruction of animals, recovery before a Justice of the Peace, and summary conviction penalties) and should search contemporaneous judicial records for further guidance.

Written permission requirement is binding and repeated (By-law 1A)

• The by-laws define “permission” as the Board’s permission in writing (By-law 1A). Many operational provisions use the plain word “permission” without stating “in writing.” Practically that means oral assurances are not sufficient under the text. Visitors, vendors, clubs and anyone intending to bring stock, camp, sell goods, or use canoes must hold the Board’s written permission to be compliant (By-laws 3, 5, 7, 10, 14). Failure to secure written permission creates exposure to removal, debarment and prosecution.

Destruction of animals and owner liability (By-law 7)

• Dogs, goats and poultry “found within the reserve may be destroyed” by authorised persons and owners must make compensation recoverable before a Justice of the Peace (By-law 7). That is an immediate risk to animal owners. The by-laws do not require a warning or process prior to destruction; the authority is expressed in permissive language. This creates potential fast-moving enforcement outcomes where animals are found on the Reserve.

Broad discretionary debarment with no stated appeal (By-laws 4 and 17)

• The Board may debar persons “for such period as the Board thinks fit” (By-laws 4 and 17). The by-laws do not set out any internal appeal mechanism, time limits, or criteria for proportionality. That leaves substantial administrative discretion and potential uncertainty for persons debarred from the Reserve.

Lessee exclusivity can suppress other activities (By-law 18)

• A lease or permit for games grants the lessee the ability to prevent competing games that would “prevent, hamper, interfere, or compete” with the lessee’s use (By-law 18). Because the by-laws do not define “prevent,” “hamper,” “interfere,” or “compete,” disputes may arise over the scope of exclusivity and whether a proposed activity conflicts with the lease. Lessees also have enforcement powers under By-law 19.

Scope of authorised persons and “authorised to prosecute” language (By-laws 7 and 19)

• By-law 7 refers to destruction of animals by “any of the persons hereinafter referred to as being authorised to prosecute for the breaches of this By-law.” By-law 19 then identifies who may enforce and “take any proceedings thereunder,” namely any member of the Board, any person authorised in writing by the Board, and lessees/permit-holders where a lease exists. The cross-reference implies that the same set of persons may have power to destroy animals, but the exact process for authorisation in writing is not set out, which can create ambiguity about who may lawfully act.

Evidence and burden of proof issues for permission

• Because permission must be in writing and many powers and defences hinge on the existence of written permission, failure to keep the documentary permission on person or to produce it on demand could expose a defendant to summary proceedings. The by-laws do not set out a public register of permissions or leases.

Formality of the Board’s common seal and internal control (By-law 1B)

• The by-laws require seal affixation only by resolution at a regular meeting in the presence of two members and custody by the Secretary or authorised person (By-law 1B). Failure to comply with those formalities may raise challenges to the validity of sealed documents. The by-laws do not specify consequences for non-compliance with the sealing rules.

Archaic currency and penalty framing

• Monetary figures in the by-laws use pounds, shillings and pence (By-laws 2 and 20). Practitioners should verify currency and penalty modernisation in subsequent law. The by-laws as compiled do not describe conversion or updating mechanisms, so the nominal figures may be out-of-date relative to contemporary penalty regimes.

Lack of procedural detail for summary conviction and compensation

• By-law 20 sets a maximum penalty but does not specify procedures for prosecutions, time limits or fine enforcement mechanisms. By-law 7 directs compensation to be recoverable before any Justice of the Peace but gives no procedural rubric. Practitioners should expect standard criminal and civil procedure to apply, but the by-laws do not elaborate.

Potential overlap with other statutory regimes

• The by-laws prohibit firearms and restrictions on fires, but they coexist with other legislation governing firearms control, public safety and environmental protection. Parties should not assume a by-law’s prohibition displaces or replaces obligations under other laws.

Taken together, the principal practical risks are documentary: ensuring written permissions exist and are produced; immediate enforcement consequences for animals found on the Reserve; discretionary debarment without internal appeal; and potential ambiguity about who has written authorisation to prosecute or destroy animals. These are concrete points likely to generate disputes and enforcement action.

Obtain and retain written permissions

• For anything conditioned on “permission” under the by-laws obtain the Board’s prior written permission. This includes, but is not limited to, organising sports or entertainments (By-law 3), vending goods (By-law 5), bringing stock onto the Reserve (By-law 7), camping (By-law 10), and placing or using a canoe on the swimming pool (By-law 14). Maintain the written permission on site while conducting the permitted activity and retain a copy for record and evidentiary purposes (By-law 1A).

If seeking exclusive use, obtain a lease or permit and note the exclusivity effects

• Where a group seeks to establish a particular game or games, secure a formal lease or permit from the Board so that the lessee’s statutory exclusivity under By-law 18 is effective. Ensure lease terms are in writing and clarify the scope of exclusivity and any conditions for termination, use, and dispute resolution. Lessees should also obtain written authorisation under By-law 19 if they wish to exercise enforcement powers.

Vendor compliance

• Traders must obtain the Board’s written permission before selling or exposing goods for sale on the Reserve (By-law 5). Traders should retain documentary evidence of permission and comply with any conditions attached by the Board.

Animal control and stock management

• Do not bring stock onto the Reserve without written permission (By-law 7). Owners of dogs, goats and poultry should keep animals out of the Reserve to avoid destruction and compensation liability. If animals are present inadvertently, act promptly to remove them; do not rely on oral assurances to justify presence.

Pool and bathing compliance

• Bathers must wear costumes that preserve decency and comply with the Board’s posted notices (By-law 11). Do not use soap in the pool (By-law 12) and do not throw objects, rubbish or animals into the pool (By-law 13). If intending to use a canoe on the pool, obtain written permission and ensure the canoe is fitted with a float attached to a suitable rope as required (By-law 14).

Waste and fire management

• Deposit rubbish in the receptacles provided and avoid littering the Reserve (By-law 15). Do not light fires except in places expressly set apart by the Board (By-law 16). If undertaking activities that generate waste or require fuel, coordinate with the Board to use allocated facilities and avoid breach.

Avoid interfering with maintenance and staff

• Do not interfere with workmen, gardeners, caretakers or rangers engaged in constructing or maintaining beds, borders, greens, links or buildings (By-law 9). Where maintenance is in progress, observe posted restrictions and instructions from authorised staff.

Conduct and intoxication standards

• Behave with decency and decorum. Persons intoxicated or misconducting themselves are liable to removal and debarment (By-law 17). Establish on-site protocols for staff to recognise and report intoxication and to seek police assistance where necessary.

Responding to enforcement and proceedings

• If removed or debarred, seek information about the basis for the action and whether written decisions exist. For animal-damage compensation claims, expect proceedings to be recoverable before a Justice of the Peace (By-law 7). For alleged by-law breaches that may give rise to summary conviction, seek legal advice promptly and preserve evidence of any written permissions or notices that justify the conduct.

Board corporate formalities

• If acting for the Board, ensure common seal use complies with requirements: the seal must bear the words “Pemberton National Park Board,” be affixed by resolution at a regular meeting in the presence of two members, and be kept in the custody of the Secretary or an authorised person (By-law 1B). Ensure meeting minutes and a register of sealed documents are maintained to support validity.

Record-keeping and signage

• The Board should publish or post clear signage of prohibited activities, bathing costume requirements (By-law 11), permitted fire locations (By-law 16), and rubbish disposal points (By-law 15). Keep a written register of permissions, leases and permits with dates and conditions to assist in enforcement and to defend against alleged breaches.

Engage police for removal where necessary

• Where removal is required, engage local police as the by-laws authorise police constables to remove persons committing breaches (By-law 4). Coordinate with police about the circumstances in which police attendance is appropriate for safety and evidence collection.

Review penalty and currency implications

• Because the by-laws use historical monetary terms for fees and penalties (shillings, pence, and pounds), parties should confirm the current legal effect of the specified monetary amounts in light of subsequent currency or penalty modernisation in other statutes. Where a contemporary penalty or fee regime supersedes the figures in the by-laws, align practices to modern equivalents as advised by counsel.

Seek written authorisation if intending to prosecute or enforce

• Persons whom the Board wishes to empower to prosecute or otherwise act under By-law 19 should obtain formal written authorisation from the Board so their enforcement actions, including animal destruction authorised in By-law 7, are clearly grounded in the by-laws’ authorisation pathway.

In short, compliance is document-driven: secure and retain written permissions, leases and authorisations; follow posted notices on bathing and fires; avoid prohibited conduct and interference with staff; and keep robust records to evidence lawful activity in the Reserve.
