Peel Region Scheme

The Scheme organises the Peel Region around several core legal and planning concepts. These are set out as definitions, classifications and procedural mechanisms that determine how land is treated and how decisions are made.

Reserved land (cl.9-10). Land shown as Reserved Lands on the Scheme Map is reserved for the public purposes identified on the Map (cl.9). Clause 10 lists specific reserved purposes: Regional Open Space, Primary Regional Roads, Other Regional Roads, Railways, Waterways, State Forests and Other Public Purposes (cl.10(a)-(g)). Reserved land owned or vested in a public authority extends to land where a public authority holds an easement, right of occupation or other interest (cl.2(2) definition).

Zones and zone purposes (cl.11-13, cl.12). The Scheme divides the region into zones depicted on the Scheme Map (cl.11). Each zone is assigned a purpose statement: Urban, Urban Deferred, Regional Centre, Industrial, Rural and Private Recreation, with specific planning rationales (cl.12). The Commission may convert Urban Deferred land to Urban by Gazette notice (cl.13).

Special Control Areas (SCA No. 1 and SCA No. 2) (cl.14-18D). The Scheme establishes two SCAs in addition to underlying zones and reserves (cl.14). SCA No. 1 (Water Catchments) is intended to identify proclaimed surface water catchments and prevent land uses prejudicing public drinking water quality/quantity; decision‑makers must have regard to catchment impacts and consult the Department of Water (cl.15-17). SCA No. 2 (Wastewater Treatment Plant Odour Buffers) identifies land likely subject to offsite odour impacts, requires plans for future use and development of land within the SCA, and mandates consultation with the Water Corporation; the Commission must have regard to compatibility with wastewater infrastructure and any approved plans (cl.18A-18D).

Planning approval and exemptions (cl.18-27). The default rule is that development on reserved land and development specified by Commission resolution requires Commission planning approval (cl.18). Clause 19 lists permitted development on reserved land that does not require Commission approval, including certain fences, interior works, demolition exceptions, specified signage, public authority works and other classes declared exempt by Gazette resolution (cl.19(a)-(g)). Clause 20 clarifies that reserved land owned/vested in a public authority may be used by that public authority for the reserved purpose or any lawful purpose without Commission approval (cl.20).

Application procedures and material (cl.28-32). The Scheme prescribes a mandatory application form (Schedule 1 Form 1) signed by the owner (cl.28). Applicants must provide detailed plans to scale (not less than 1:500), ground levels, structures, access, parking, landscaping and may be required to supply specialist studies and management plans (cl.29). Applications are lodged with local government which forwards them to the Commission within 7 days (cl.30); local governments may recommend within 42 days. The Commission may require public notice and provide public inspection rights (cl.31).

Decision criteria and powers (cl.33-42). The Commission may consult with public authorities, must consult the relevant public authority before deciding reserved land applications (cl.33). Clause 34 lists a comprehensive, largely discretionary range of matters the Commission may consider (scheme aims, State planning policies, environmental policies, heritage, access, traffic, public utilities, amenity, submissions and other relevant planning considerations). The Commission may grant approval with conditions, refuse, or grant approvals with later detailed approval requirements; it must notify the applicant in Form 3 and provide reasons on refusal (cl.35-36, cl.40). If the Commission does not determine an application in prescribed timeframes, the application is deemed refused (cl.41). Applicants aggrieved by Commission discretion may apply to the State Administrative Tribunal under Part 14 of the Act (cl.42).

Enforcement, registers, certificates, and compensation (cl.43-47; Sched.2). The Scheme provides for injurious affection compensation claims under Part 11 of the Act, including a 6‑month lodging period for claims (cl.43). The Commission can enter agreements with landowners, enter buildings or land to check compliance, maintain environmental condition registers, and issue certificates about land’s status under the Scheme on payment of fees (cl.44-47). Schedule 2 sets environmental condition mechanisms such as required management plans, biological surveys, reticulated sewerage connection triggers, and a specific Old Coast Road Wetland requirement (Sched.2(1)-(4)).

Interplay and primacy (cl.7-8). The Scheme expressly prevails over inconsistent local planning schemes to the extent of inconsistency (cl.7). Commission determinations should conform with relevant provisions of the State Planning Framework, insofar as the Framework is not inconsistent with the Scheme (cl.8).

Overall, the Scheme combines land classification, subject‑matter specific SCAs, a centralised approval pathway with scoped exemptions, procedural requirements for application and public notice, broad discretionary assessment criteria, environmental condition instruments, and administrative powers including compensation and inspection.

The Scheme defines a wide set of actors whose rights, obligations and incentives change as a result of its classifications and processes.

Landowners and prospective developers. All owners of land in the Peel Region (as defined in cl.3) are affected. The Scheme imposes obligations on owners to obtain Commission planning approval for development on reserved land and for development classes the Commission specifies by resolution (cl.18, cl.21). Owners must sign the application form (Schedule 1 Form 1; cl.28). Applications require detailed plans and potentially specialist studies and management plans (cl.29; Sched.2(1)). Owners also bear the administrative and opportunity costs of advertising if the Commission requires notice of an application (cl.31). Owners whose land is injuriously affected by reservation or Scheme operation have a statutory compensation route under Part 11 of the Act and must lodge claims within 6 months of Gazette publication (cl.43(1)-(3)).

Public authorities and utility providers. Public authorities and the Water Corporation are explicitly engaged. Reserved land owned or vested in a public authority can be used by that authority for the reserved purpose without Commission approval (cl.20). The Commission must consult the relevant public authority before determining planning applications on land reserved for that public authority (cl.33(2)). For SCA No. 1 the Commission must consult the chief executive officer of the Department of Water (cl.17); for SCA No. 2 the Commission must consult the Water Corporation (cl.18D). The Water Corporation’s recommendations are a specific matter of regard for SCA No. 2 applications (cl.18C(c)).

Local government. Local governments in the Peel Region (City of Mandurah, Shire of Murray, Shire of Waroona; cl.3) act as application lodgement points (cl.30(1)) and must forward applications to the Commission within 7 days (cl.30(2)). Local governments may make recommendations to the Commission within 42 days (cl.30(3)) and receive notice if the Commission resolves that certain development on zoned land requires Commission approval (cl.21(3)). Local governments may also hold delegations from the Commission to determine Scheme applications; a local government determination can be deemed a Commission determination if the local government had delegated power and the application was lodged concurrently under both the local planning scheme and the Scheme (cl.22).

The Western Australian Planning Commission. The Commission is the central decision maker: it decides planning approvals required by the Scheme, makes resolutions altering the approval regime (cl.21), endorses management plans for reserved Regional Open Space (cl.19(e)(iv)), maintains registers of environmental statements (cl.46(3)), issues certificates about land on payment of a fee under s.20 of the Act (cl.47), and has the power to enter into agreements and inspect land for compliance (cl.44(1)-(2)). The Commission also controls scheme amendment and rezoning of Urban Deferred land (cl.13).

Third‑party stakeholders and nearby owners/occupiers. The Scheme provides public notice rights where the Commission considers a proposal should not be granted without notice (cl.31). Nearby owners and occupiers who the Commission considers likely to be affected may be served notice and can make submissions within a minimum 14 day period (cl.31(1)(a), (2)). The Commission must have regard to submissions received (cl.34(z)).

Environmental and heritage authorities. Environmental considerations are elevated in cl.34(d) and Sched.2, which requires management plans, biological surveys and connections to reticulated sewerage in specified circumstances (cl.34(d); Sched.2(1)-(3)). The Heritage of Western Australia Act 1990 is referenced in cl.19(b)-(c) with exemption exceptions for buildings on the Register of Heritage Places or subject to orders. The Scheme therefore affects heritage and environmental regulators by creating a statutory overlay that triggers consultation and adherence to their policies as matters of consideration (cl.34(c)-(d), cl.16(e)).

Investors, land buyers and financiers. The Scheme affects market actors through land classification, approvals risk and timing. The Commission’s authority to require approvals, environmental conditions and the ability to impose conditions or refuse in a discretionary manner (cl.35, cl.36, cl.40) influences project timelines and feasibility. Certificates under cl.47 can be obtained on payment of a fee to clarify how land is affected by the Scheme, which is a transactional instrument for conveyancing and due diligence.

The community at large. The Scheme’s stated aims include protecting coastal foreshores, rivers, Peel Inlet/Harvey Estuary, surface water catchments, strategic agricultural land and planning for future urban and industrial uses (cl.6(c)-(g)). Those community interests are represented procedurally through public advertising of proposals (cl.31), statutory regard to social issues and amenity (cl.34(k), (o)), and environmental register maintenance (cl.46(3)).

In short, the Scheme alters the regulatory environment for property owners, public authorities, local governments, environmental and heritage regulators, market participants, and the local community by centralising Commission control over regionally significant land use decisions, prescribing consultation pathways and procedural requirements, and imposing environmental and heritage considerations as statutory matters of regard.

The Scheme puts in place a set of affirmative duties, qualified discretions and rights for interested parties. These are duties to obtain approvals, file and provide information, consult and, for the Commission, powers and obligations to assess, notify and maintain registers.

Duties to obtain planning approval. The primary duty is on persons not to commence or carry out development on reserved land or on land or development classes specified by Commission resolution without first obtaining the Commission’s planning approval (cl.18). This duty is subject to the exceptions enumerated at clause 19, which lists specific permitted development on reserved land that does not require Commission approval (cl.19(a)-(g)). Clause 23 requires prior Commission approval for alteration, extension or change to a non‑conforming use (cl.23(1)), with non‑conforming use defined by reference to s.172 of the Act (cl.23(2)).

Duties regarding application content and form. Applicants must use the prescribed form (Schedule 1 Form 1), have the owner sign, and provide plans and information to the minimum standards set out in clause 29 (scale not less than 1:500, ground levels, existing and proposed structures, access, car parking, landscaping, etc.) and any specialist studies or management plans the Commission requires (cl.28-29). Failure to provide required material would impede the application proceeding.

Advertising, public inspection and consultation duties. Where the Commission considers notice necessary, it or the applicant must give notice by serving neighbouring owners/occupiers, publishing in a local newspaper or erecting signs on site for at least 14 days, with the notice in the form of Schedule 1 Form 2 (cl.31(1)-(3)). The Commission must permit public inspection of the application and its material at Commission offices during business hours (cl.31(3)).

Local government duties. Local governments must accept applications lodged by applicants and forward them to the Commission within 7 days (cl.30(1)-(2)), and may forward recommendations within 42 days (cl.30(3)). Where a local government holds a delegation, it may determine the Scheme application and its determination can be deemed a Commission determination subject to cl.22’s conditions (cl.22).

Commission duties and powers. The Commission has several duties and powers:

• Determine applications after specified processes and times (cl.32).
• Have regard to a broad list of matters in cl.34 when deciding applications (cl.34).
• Grant approvals with or without conditions or refuse (cl.35).
• Provide written notice of determination in Form 3 and provide reasons if refusing (cl.36).
• Impose conditions limiting the approval period, require later approval of details, and set terms of commencement (cl.37-40).
• Maintain a register of environmental statements published under s.48F and s.48G of the Environmental Protection Act 1986 and make them publicly inspectable (cl.46(3)).
• Enter into agreements with landowners about scheme matters and authorise officers to enter land/buildings for compliance checking (cl.44).
• Issue Scheme certificates on payment of the relevant fee set under s.20 of the Act (cl.47).

Rights to compensation and acquisition. Affected landowners have a right to claim compensation for injurious affection under Part 11 of the Act, with claims to be lodged at Commission offices within 6 months of publication in the Gazette of the approval or amendment causing the injury (cl.43(1)-(3)). For injurious affection under s.174(1) of the Act, the Commission may elect to acquire the land instead of paying compensation (cl.43(4)).

Rights of review and appeal. An applicant aggrieved by the exercise of a discretionary power by the Commission under the Scheme, or by a decision not to transfer land from Urban Deferred to Urban, may apply to the State Administrative Tribunal for review under Part 14 of the Act (cl.42). The Form 3 notice of determination explicitly records an appeal right with a 60 day time limit (Schedule 1 Form 3).

Deemed refusal default. If the Commission fails to determine an application within 60 days (or 90 days where notice under cl.31 has been given), the application is deemed refused (cl.41(1)-(2)). Despite that, the Commission may issue a valid determination after those periods (cl.41(3)).

Environmental and heritage duties. The Scheme requires consideration of environmental protection policies and the Heritage of Western Australia Act where applicable (cl.34(d), cl.19(b)-(c), cl.34(i)). Schedule 2 places further duties on applicants and approving authorities to prepare and implement specified management plans, undertake biological surveys prior to rezoning potentially sensitive land, and, in certain locations, require connection to reticulated sewerage as a condition of subdivision or development (Sched.2(1)-(3)).

Administrative duties related to scheme instruments. The Commission must publish a resolution when it requires zoned land development to obtain Commission approval and must serve notice of that resolution on each local government (cl.21(3)). The Commission must also maintain the Scheme Map and keep environmental conditions and the register of statements (cl.4, cl.46).

In sum, duties fall mainly on applicants and landowners to follow application procedures, obtain approvals, provide technical material and advertise as required; local governments have duties on processing and recommending applications; the Commission has both procedural duties (notice, publication, registers) and discretionary powers in assessment and enforcement; and affected owners retain statutory rights to compensation and review.

The Scheme sets out compliance obligations, inspections and remedial options rather than a comprehensive schedule of monetary penalties. Enforcement tools in the Scheme are administrative and civil in character; criminal sanctions or specific penalty amounts are not stated in the text provided.

Primary compliance obligation. Clause 45 establishes the core legal prohibition: a person must not contravene the provisions of the Scheme or use a building or commence or continue to carry out any development otherwise than in accordance with the Scheme and conditions imposed on any approval under the Scheme (cl.45(a)-(b)). This creates a statutory duty to follow Scheme rules and approvals. The Scheme text does not specify penalty amounts or summary offence provisions within its clauses.

Entry, inspection and agreement powers. Clause 44 gives the Commission power to enter into agreements with owners, occupiers or others having an interest in land affected by the Scheme about any matters pertaining to the Scheme (cl.44(1)). Clause 44(2) authorises the Commission to appoint officers who may, at reasonable times and with assistance, enter any building or land in the region for the purpose of ascertaining whether the Scheme provisions are being observed. Those powers facilitate administrative compliance monitoring and negotiated outcomes.

Remedial administrative actions. The Scheme allows the Commission to revoke or amend a planning approval on written application by the owner before development commences (cl.24). Clause 25(1) permits the Commission to grant retrospective planning approval for developments already commenced or carried out, subject to the continued operation of clauses 18, 23 and 45 and Part 13 of the Act (cl.25(1)-(3)). That gives the Commission discretion to regularise unauthorised works, but also preserves other enforcement provisions in the Act.

Environmental and statutory registers. Clause 46 requires the Commission to maintain a register of statements published under ss.48F and 48G of the Environmental Protection Act 1986 and make them publicly inspectable (cl.46(3)). That creates transparency and evidentiary resources for enforcement decisions, but the Scheme does not itself set sanction mechanisms tied to entries on that register.

Compulsory acquisition and compensation. Clause 43 preserves compensation rights under Part 11 of the Act for injurious affection and gives the Commission the option to elect to acquire land instead of paying compensation in certain cases under s.174(1) of the Act (cl.43(1), (4)). Acquisition is a form of state remedial action with transfer of title rather than a fine, and it alters property rights directly. Timing constraints on compensation claims are strict: a claim for injurious affection to land or property other than reserved land must be lodged within 6 months of Gazette publication of the Scheme approval or amendment (cl.43(2)). That limitation is an administrative constraint on remedies.

Deemed refusal and procedural consequences. The deemed refusal regime (cl.41) has enforcement and reputational effects: if the Commission does not determine an application within 60 days (or 90 days if advertising was required), the application is deemed refused, though Commission can later validly determine the application (cl.41). While not a penalty, deemed refusal can impose opportunity costs and project delays on applicants.

Appeal and review mechanisms. Clause 42 affords applicants an administrative review right to the State Administrative Tribunal (SAT) for grievances about the Commission’s discretionary exercise under the Scheme or refusal to convert Urban Deferred to Urban (cl.42). SAT review is a judicially enforceable remedy that provides substantive redress and potential orders, though the Scheme itself does not specify fines.

Omitted or external penalty mechanisms. The Scheme does not list monetary penalties, infringement notices or criminal offences within its clauses. Enforcement measures such as fines or prosecution for breaches would, if available, derive from the Act or other written laws (the compilation note indicates the Scheme was made under the Planning and Development Act 2005). Users should consult the Act and other statutes referenced in the Scheme to identify specific penalty provisions and enforcement avenues beyond what the Scheme itself sets out.

Practical enforcement implications. The available practical enforcement levers within the Scheme are inspection, negotiated agreements, conditional approvals (including approvals that can be later revoked or amended), option of acquisition in lieu of compensation, maintenance of public environmental registers and the procedural teeth of deemed refusals and SAT review. The Commission’s ability to require environmental management plans and consultations with statutory agencies such as the Department of Water and the Water Corporation (cl.16-17, cl.18C-18D; Sched.2) also institutionalises external scrutiny that can be mobilised in enforcement contexts.

In summary, enforcement under the Scheme is largely administrative and civil in nature, emphasising compliance, negotiation and regulatory oversight; monetary penalties and criminal sanctions are not contained in the Scheme text provided and must be sought in the Act or other laws where applicable.

The Scheme is framed as part of a legislative ecosystem and explicitly cross‑references several statutes and policy instruments. Its text assigns roles and hierarchies between the Scheme, the Planning and Development Act 2005 (the Act), State planning instruments, environmental and heritage laws, water law, and local planning instruments.

Planning and Development Act 2005. Clause 2 states that, subject to exceptions in cl.2(2), words and expressions used in the Scheme have the same meanings as in the Act (cl.2(1)). The Scheme is made under the Act (see compilation note: formerly under the Western Australian Planning Commission Act 1985 and continued under s.33 of the Act). Key procedural references link to the Act: applications for planning approval in planning control areas declared under s.112 of the Act must be obtained under s.116 of the Act (cl.18 note). Compensation references are to Part 11 of the Act (cl.43(1)), appeals to the State Administrative Tribunal are under Part 14 of the Act (cl.42), and the meaning of non‑conforming use is taken from s.172 of the Act (cl.23(2)). The Scheme therefore operates within the Act’s wider regulatory and institutional architecture; enforcement details, penalties and many procedural rules will be governed by the Act.

State Planning Framework and State planning policies. Clause 8 requires Commission determinations under the Scheme to be consistent with relevant provisions of the State Planning Framework except where they are inconsistent with the Scheme (cl.8). Clause 34 explicitly lists State planning policy as a matter the Commission may regard in decisions (cl.34(c)). The Scheme also refers to the Statement of Planning Policy No. 2 for the Peel Harvey Coastal Plain Catchment in Schedule 2(3) as a trigger for requiring reticulated sewerage connection (Sched.2(3)(1)). These references make State policies operational in Scheme assessments.

Environmental Protection Act 1986. Clause 34(d) requires the Commission to have regard to any environmental protection policy approved under the Environmental Protection Act 1986. Clause 46(3) requires the Commission to maintain a register of statements published under ss.48F and 48G of the Environmental Protection Act 1986 and make them available for public inspection (cl.46(3)). Schedule 2’s Management Plans are tied to the Minister for the Environment and Heritage’s “Statement that a Scheme may be Implemented” No. 000601 (Sched.2(1)), linking scheme implementation to ministerial environmental statements.

Heritage of Western Australia Act 1990. Clause 19(b)-(c) exclude certain internal works and demolitions from the requirement for Commission approval except where those works affect places entered in the Register of Heritage Places or the subject of an order under the Heritage Act (cl.19(b)(i)-(ii), cl.19(c)(i)-(ii)). Clauses 34(i) and related parts require the Commission to have regard to the conservation of places on the Register of Heritage Places and those in local heritage lists (cl.34(i)). Thus the Heritage Act’s protections are preserved as matters of statutory regard and carve outs.

Water law and Water Corporation Acts. The Scheme defines Department of Water and Water Corporation in clause 2(2) by reference to the Water Agencies (Powers) Act 1984 and Water Corporation Act 1995 respectively. The SCA for Water Catchments requires consideration of impacts on drinking water, adherence to best management practices, drainage management and consultation with the Department of Water (cl.15-17). The SCA for WWTP Odour Buffers requires consultation with the chief executive officer of the Water Corporation and that the Commission consider recommendations of that officer (cl.18A-18D). Schedule 2(3) requires consideration of reticulated sewerage within specified groundwater catchment contexts, linked to the Statement of Planning Policy No.2. These provisions embed water management law and utilities input into planning decisions.

Main Roads Act 1930 and rail/transport law. Clause 10(b) defines Primary Regional Roads as roads declared under the Main Roads Act 1930, and cl.19(e)(i) exempts works that are for or in connection with a road within the meaning of the Main Roads Act from requiring Commission approval when on reserved road land (cl.10(b); cl.19(e)(i)). Rail reserve purposes and exemptions are likewise specified (cl.10(d); cl.19(e)(iii)).

Town Planning Regulations 1967 (and local planning instruments). Clause 34(g) requires the Commission to have regard to any Local Planning Strategy of the local government as approved under regulation 12B of the Town Planning Regulations 1967, as amended (cl.34(g)). The Scheme prevails over inconsistent local planning schemes (cl.7), but the local planning scheme remains part of the matters considered in cl.34(a). Local planning scheme determinations can also be concurrent with Scheme applications and, where delegation exists, determinations by local government can be deemed determinations under the Scheme (cl.22). This establishes a layered relationship where the Scheme is superior in case of inconsistency but local schemes and regulations still have operative relevance.

Other statutory and policy instruments. The Scheme references catchment management plans approved by the Commission (cl.34(f)), policies or strategies of the Commission and policies adopted by the State Government (cl.34(e)), and the Minister for the Environment’s statement referred to in Sched.2(1). Applications must have regard to any environmental protection policy approved under the Environmental Protection Act (cl.34(d)). The Scheme therefore sits within an interlocking network of statutory and administrative policy instruments.

Practical consequence. Practitioners must read the Scheme alongside the Act, State planning policies, environmental protection instruments, heritage legislation, water legislation and local planning schemes. The Scheme’s references create mandatory consultation pathways (Department of Water, Water Corporation) and conditions that operationalise external environmental and infrastructure requirements (Sched.2). Where the Scheme is inconsistent with a local planning scheme the Scheme prevails (cl.7), but local schemes continue to matter in assessment (cl.34(a)) and local government remains a statutory actor in processing and possibly determining applications (cl.30, cl.22). Certificates under cl.47 are available to clarify how land is affected by the Scheme, but payment of fees is governed by s.20 of the Act (cl.47).

The Scheme includes a compilation table that records its gazettal and subsequent amendments. The compilation table at the end of the document is the Scheme’s own record of amendment events and commencements; it should be relied upon for tracking textual changes published in the Gazette.

Key dates and instruments recorded in the Scheme compilation table:

The Scheme’s clause notes indicate which clauses were amended at certain Gazette dates. For example, clause 2 was amended (Gazette 3 Jun 2005 p. 2503; 21 May 2013 p. 2004-5), clause 5 amended (Gazette 21 May 2013 p. 2005), clause 12 amended (Gazette 21 May 2013 p. 2006), and the new Part 5 heading and subsequent Division headings were inserted in the 2013 Gazette (21 May 2013 p. 2006) reflecting the introduction of SCA provisions. Many clauses carry marginal notes indicating the precise amendment citations.

Practical implications of amendment history. Amendments in 2013 are significant in that they introduced the operational Special Control Areas (cl.14-18D), which add procedures and consultation duties for water catchments and wastewater treatment plant odour buffers. The 2012 instrument and the 2005 amendment modified definitions and other technical provisions. Parties conducting due diligence must check the Scheme Map and the consolidated Scheme text with these amendments in place, and consult the Gazette notices for any additional conditions, schedules or map changes tied to those amendments. Where the Commission has published environmental conditions or ministerial statements linked to Scheme implementation (such as the Minister for the Environment and Heritage’s Statement No. 000601 referenced in Sched.2), those documents also form part of the practical amendment and implementation history.

Where to locate authoritative amendment records. The compilation table at the end of the Scheme text is the document’s record of amendments. For contemporary practice, practitioners should consult the Government Gazette entries listed in the compilation table for the authoritative amendment instruments and any further Gazette notices postdating the compilation table. The Scheme also relies on external instruments (e.g. statements under the Environmental Protection Act) that are separately gazetted and should be checked in that context.

Risk from future amendments. The Scheme grants the Commission the power to change zoning (Urban Deferred to Urban) by resolution notified in the Gazette (cl.13) and to require prior Commission approval on development in zones by Gazette resolution (cl.21). Those procedural powers mean that amendments and regulatory change can occur administratively and by Gazette notice; interested parties should monitor the Gazette and Commission resolutions for changes affecting development rights and obligations.

The Scheme text, as provided, does not include nor cite any judicial decisions, tribunal determinations, or specific litigation history. No cases are named or summarised in the Scheme document. Clause 42 provides the statutory right of review to the State Administrative Tribunal (SAT) for an applicant aggrieved by the Commission’s exercise of discretionary powers under the Scheme or a decision not to transfer land from Urban Deferred to Urban (cl.42). That provision indicates the available judicial/administrative review pathway but does not record prior judicial outcomes.

What the document shows about dispute resolution. The Scheme channels challenges through administrative review (SAT) rather than embedding an internal merits review process within the Commission. Form 3 (Schedule 1) expressly informs applicants of an appeal right under clause 42 and indicates a 60 day time limit for lodging an appeal (Schedule 1 Form 3 notes). The Scheme’s deemed refusal provisions (cl.41) create an administrative outcome that may itself be the subject of review if a party considers the deemed refusal incorrect or if a valid determination is subsequently issued; cl.41(3) permits the Commission to determine an application after the deemed refusal period, and that later determination is effective from the date of determination.

How to find litigation. Because the Scheme does not list cases, practitioners looking for litigation history must search SAT decisions and court decisions that reference the Peel Region Scheme or the relevant Scheme clauses. Appeals under cl.42 would produce SAT records, and if SAT decisions are appealed to superior courts, those decisions would create judicial precedent. Those searches should be conducted in legal databases and tribunal registers since the Scheme does not record litigation outcomes.

Implication of absence. The absence of an internal litigation history in the Scheme text does not mean there has been no litigation; it simply means the legislative instrument does not carry or summarise decisions. Practitioners should not infer the Scheme’s interpretive history from the instrument itself but should consult SAT and relevant court databases for precedents interpreting Scheme provisions such as the Commission’s discretion under cl.34, the validity of deemed determinations under cl.22, the geographic scope of special control areas (cl.14-18D), or compensation claims under cl.43 (and Part 11 of the Act).

In short, the Scheme provides the statutory route for review (SAT) but the document itself contains no litigation record. For authoritative litigation history, external legal research is required.

The Scheme contains specific provisions and administrative traps that can generate practical or timing risks for developers, owners and advisers. These are items where oversight commonly leads to lost opportunity, compliance cost or procedural exposure.

Mandatory owner signature and formality trap. The application form (Schedule 1 Form 1) must be signed by the owner of the land on which development is proposed and the Scheme states that the signature of the owner(s) is required and that the application will not proceed without it (cl.28(b); Schedule 1 Form 1). Failure to obtain owner signatures can stop an application at intake.

Six‑month compensation deadline. A claim for compensation for injurious affection to land or property other than reserved land must be lodged at the Commission within 6 months of the Gazette publication of the approval of the Scheme or the amendment by which the injurious affection arises (cl.43(2)). That is a strict statutory time window; missing it may foreclose a compensation claim under the Scheme’s stated process.

Delegation and deemed determination. Clause 22 allows a local government to be delegated power by the Commission to determine a Scheme application; where concurrent applications are lodged and the local government determines under its local planning scheme and also has delegation, it is “deemed” to have made the same determination under the Scheme at the same time (cl.22(1)). Practitioners should be alert that a local government determination may bind the Scheme outcome by deeming; conversely, clause 22(2) preserves the Commission’s ability to exercise power under the delegation. This creates potential for coordination failures if applications are not lodged simultaneously or if delegation is not clear.

Deemed refusal timeline. The deemed refusal rule treats applications not determined within 60 days (or 90 days if advertising was required) as refused (cl.41(1)-(2)). However, the Commission may validly determine an application at any time after that period, and that determination is effective from the date of determination (cl.41(3)). Practically, applicants face uncertainty if time limits elapse and may need to lodge appeals in SAT if aggrieved by a deemed refusal or subsequent determination. The deemed refusal does not bar later valid Commission determinations.

Broad discretionary assessment criteria. Clause 34 lists many planning considerations that the Commission may regard as relevant (cl.34(a)-(zc)). The list is expansive and discretionary, including matters such as State planning policies, environmental protection policies, heritage, amenity, traffic and public utilities. The breadth of discretion increases assessment uncertainty and creates potential for inconsistent outcomes between applications unless applicants front‑load comprehensive technical material.

Environmental management plan references outside the Scheme text. Schedule 2(1) requires Management Plans “in accordance with the specifications set out in Attachment 1 in the Minister for the Environment and Heritage’s ‘Statement that a Scheme may be Implemented’ No. 000601 published on 2 August 2002” (Sched.2(1)). The Scheme relies on an external ministerial statement and attachments not reproduced within the Scheme text. Applicants must locate that external statement and any attachments to understand the required plan specifications. Reliance on external documents can cause delays if those documents are overlooked.

Reticulated sewerage triggers. Schedule 2(3) allows the Commission or local government to require connection to reticulated sewerage as part of a local scheme amendment or application to subdivide or develop land in specified groundwater catchment contexts, including where the land lies within the Peel Harvey Coastal Plain Catchment Area and is subject to Statement of Planning Policy No.2 (Sched.2(3)). This can impose infrastructure costs on developers that might not be obvious from the zoning alone.

SCA consultation obligations. For land wholly or partly within SCA No. 1 or SCA No. 2, the Commission must consult the Department of Water or the Water Corporation respectively (cl.17, cl.18D). Practitioners need to plan for agency consultation and possibly additional technical studies or conditions, these are mandatory consultation steps that can extend timelines and impose technical requirements (cl.16, cl.18C).

Permitted development exceptions narrow in heritage places. Clauses 19(b) and 19(c) exclude certain interior works and demolition from approval requirements except where the building/structure is entered on the Register of Heritage Places or is subject to a Heritage Act order (cl.19(b)(i)-(ii), cl.19(c)(i)-(ii)). Heritage listings thus narrow otherwise broad permitted development exemptions and can convert what might seem like a trivial interior alteration into a consented activity.

Commission resolution to require approval on zoned land. The Commission can require development on land zoned under the Scheme to have the Commission’s planning approval by Gazette resolution (cl.21). That means a zone classified as “Urban” under the Scheme could be subject to an additional layer of Commission approval, introduced by resolution and notified by Gazette; developers must check for any such resolutions in force.

Connection between local approvals and Scheme approvals. Where development requires approval under a local planning scheme and the Scheme simultaneously (cl.22), failure to apply under both regimes at the same time or to coordinate with local government may create timing mismatches, risk of deemed determinations, or forfeiture of appeal rights.

Certificate fees and administrative costs. Clause 47 permits the Commission to issue certificates on payment of a relevant fee set under section 20 of the Act (cl.47). Certificate costs should be checked in fee schedules under the Act; failure to obtain a certificate as part of conveyancing or due diligence could reveal Scheme constraints late in transactions.

Acquisition option in lieu of compensation. If injurious affection is claimed as a result of s.174(1) of the Act, the Commission may elect to acquire the land instead of paying compensation (cl.43(4)). This outcome changes the remedy from monetary compensation to acquisition, with significant implications for owners.

Form 3 time limit note. Schedule 1 Form 3 includes a note that an appeal must be lodged within 60 days of the determination (Form 3 notes). Practitioners must manage appeal timetables tightly.

In sum, routine missteps that produce cost or delay include failing to obtain owner signatures, overlooking Gazette resolutions or environmental statements (including the Minister’s Attachment 1), neglecting mandatory consultations with water authorities for SCA land, underestimating sewerage connection triggers, and mismanaging deemed refusal and appeal timeframes.

Compliance with the Scheme requires a mix of procedural discipline, early engagement with statutory agencies, robust technical evidence, and monitoring of Gazette notices and Commission policies. Below are concrete steps and practical checks drawn from the Scheme text.

1. Confirm land classification and Scheme Map status. Before any transaction or project planning, obtain the Scheme Map and the Commission’s certificate under cl.47 (Schedule 3) to verify the zoning, any reserved land status, and whether the land lies in SCA No. 1 or SCA No. 2. The certificate is issued on payment of the relevant fee under s.20 of the Act (cl.47). Check for the EC symbol indicating environmental conditions (cl.46(2)) and review Schedule 2 requirements relevant to the parcel.

2. Determine whether Commission approval is required. Apply clause 18 and clause 21: confirm whether the land is reserved (cl.9-10) or whether the Commission has made a Gazette resolution requiring development on the applicable zone to obtain Commission approval (cl.21). For non‑conforming uses, clause 23 requires prior approval for alterations, extensions or change of use.

3. Pre‑application engagement. Engage early with the local government and the Commission. Lodge pre‑application material and request advice about likely application requirements. Where land falls in SCA No. 1 or SCA No. 2, arrange early consultation with the Department of Water or the Water Corporation as required by cl.17 and cl.18D, and factor in likely recommendations under cl.16(e) and cl.18C(c).

4. Prepare required application documentation. Use Schedule 1 Form 1 and ensure the landowner’s signature(s) are provided (cl.28; Schedule 1 Form 1). Provide plans at scale not less than 1:500 showing site location, north point, dimensions, existing/proposed ground levels, existing and proposed structures, access, car parking layouts, loading/unloading areas, open storage areas, landscaping, and proposed use and hours (cl.29(a)(i)-(ix)). Provide plans, elevations and sections of proposed buildings (cl.29(b)). Anticipate specialist studies (traffic, heritage, environmental, hydrology, geotechnical) and management plans the Commission may require (cl.29(c)-(d); Sched.2(1)). Where the site is subject to Schedule 2 requirements (e.g. biological survey, reticulated sewerage), commission those studies early (Sched.2(2)-(3)).

5. Coordinate local government lodgement and referrals. Lodge the application with the local government (cl.30(1)). The local government must forward it to the Commission within 7 days (cl.30(2)), and may provide recommendations within 42 days (cl.30(3)). Where a local government delegation is in place, confirm the delegation terms and whether concurrent local scheme application was made; simultaneous lodgement may trigger the deemed determination mechanism in cl.22.

6. Plan for advertising and public consultation. If the Commission requires notice under cl.31, be ready to serve nearby owners and occupiers, publish in an appropriate newspaper and/or erect site signs for not less than 14 days. Ensure the notice follows Schedule 1 Form 2 format and provide easy access to application material at Commission offices during business hours (cl.31(1)-(3)). Build these timing requirements into project timelines.

7. Anticipate assessment criteria and frame submissions accordingly. The Commission has a broad list of matters it may regard under cl.34. Ensure applications address relevant items: scheme aims, State planning policies, environmental protection policies, heritage matters, compatibility with setting, social amenity, traffic and access, public transport, utilities, pedestrian/cyclist access, landscaping, erosion/degradation risks, and submissions from neighbours or local government. Where relevant, prepare catchment management plans or show consistency with local planning strategies (cl.34(b), (f), (g)).

8. Seek to avoid or satisfy environmental triggers. For sites subject to Sched.2 requirements, prepare Management Plans in accordance with the Minister’s Attachment 1 if applicable (Sched.2(1)), obtain biological surveys where rezoning could impact regionally significant remnant vegetation or fauna (Sched.2(2)), and demonstrate when connection to reticulated sewerage will be required (Sched.2(3)). For SCA No.1 land, demonstrate best management practices for storage of potentially contaminating substances and drainage/run‑off management (cl.16(b)-(c)). For SCA No.2 land, demonstrate compatibility with wastewater infrastructure and address any Commission‑approved plans (cl.18C(a)-(b)).

9. Manage timing and avoid procedural traps. Monitor statutory timeframes: local government forwarding within 7 days and recommending within 42 days (cl.30); Commission deemed refusal timelines (60 days or 90 days if advertising required) under cl.41. Make written agreements on realistic decision timelines where possible; get confirmation in writing if the Commission requires more time. If a deemed refusal occurs, consider strategic timing of appeals to SAT (cl.42) and check Form 3 appeal notes (Schedule 1 Form 3).

10. Use certificates and due diligence. Obtain a Scheme certificate under cl.47 for conveyancing or financing transactions to disclose how the land is affected by the Scheme (cl.47). Factor in the possibility of the Commission electing to acquire land under cl.43(4) in injurious affection contexts.

11. Prepare for conditions and staged approvals. The Commission may grant approvals subject to later approval of details (cl.40). Where this is possible, ensure the application includes adequate detail to avoid unnecessary staged conditions, but also be prepared to respond quickly to requests for further detail since subsequent approval must be sought within 2 years of the first approval unless another period is specified (cl.40(3)).

12. Protect appeal rights and time limits. If aggrieved by an exercise of discretion, be prepared to seek review in SAT under cl.42; monitor the 60 day appeal period noted in Form 3. If compensation is to be claimed for injurious affection, lodge a claim within the 6 month period after Gazette publication (cl.43(2)) using Schedule 1 Form 4 where relevant.

13. Keep records and monitor Gazette notices. The Commission can introduce new resolution requirements by Gazette (e.g. cl.21 and cl.13). Regularly check the Government Gazette and Commission notices for any resolutions, amendments or environmental statements that affect a site.

14. Engage professional advisers early. Given the technical material required (plans, surveys, management plans, traffic and environmental studies), engage appropriately qualified consultants early and align their work to the Scheme’s specified formats and the Commission’s likely concerns under cl.34.

Following these practical steps should reduce delay, manage compliance costs and limit exposure to enforcement or lost rights. Where doubt exists about the legal interpretation of Scheme provisions or their intersection with the Act or other statutes, seek legal advice and consider pre‑lodgement meetings with the Commission.
