What it does
This instrument, the Payroll Tax (Pandemic) Order 2020, creates a limited, time- and cohort‑specific waiver of certain payroll tax lodgement and payment obligations that would otherwise arise under the Payroll Tax Act 2008. Mechanically it does three things.
First, it removes the requirement to lodge payroll tax returns under Part 7 of the Payroll Tax Act 2008 for specific months, being March 2020, April 2020 and May 2020, but only for two classes of employers: small and medium business payroll tax employers and industry specific payroll tax employers (clause 6(1)).
Second, it relieves small and medium business payroll tax employers from paying payroll tax in respect of taxable wages paid or payable to an employee for the entire 2019-2020 financial year (clause 6(2)). That is a blanket payment waiver for those employers’ taxable wages in that financial year, as defined by the order.
Third, it relieves industry specific payroll tax employers from paying payroll tax in respect of taxable wages paid or payable to eligible employees for the 2019-2020 financial year (clause 6(3)). This latter waiver is narrower: it applies only to wages paid to eligible employees, where “eligible employee” is defined by the industries in which the employee works (clause 3(1)).
The order sets out who counts as a “relevant business employer” (clause 4) and who counts as a “small and medium business payroll tax employer” (clause 5). These definitions use 2019-2020 financial year wage figures as the reference period, and they treat single employers and employer groups differently for aggregation purposes (clauses 4 and 5). The order also contains industry and activity definitions (tourism, hospitality, seafood, short‑stay accommodation, tourist), and it adopts the Payroll Tax Act 2008 as the underlying Act for cross‑reference (clause 3(1)). The instrument takes effect on the day it is notified in the Gazette (clause 2) and was notified on 9 April 2020. Administration responsibility is vested in the Department of Treasury and Finance (instrument footer).
