What it does
These Regulations implement discrete, technical measures under the Payment Systems (Regulation) Act 1998. They do four principal things, stated in the text: they define key cross‑references (s 4), specify two Reserve Bank interchange fee standards for use under the Act (s 5), expressly authorise conduct that complies with a Reserve Bank Access Regime for the ATM System under a provision of the Competition and Consumer Act 2010 (s 6), and prescribe a set of regulators, heads, eligible delegates, persons authorised to use or disclose information and persons protected from civil liability for particular purposes in the Act (ss 7-9). The Regulations are formally named the Payment Systems (Regulation) Regulations 2006 (s 1).
Mechanically, the most consequential incorporations are in s 5 and s 6. Section 5 specifies for the purposes of paragraph 18A(2)(b) of the Act two Reserve Bank standards, named Standard No. 1 of 2016 and Standard No. 2 of 2016, each determined by the Reserve Bank on 26 May 2016. That specification operates by reference: the Regulations do not reproduce the content of those standards, they declare those external documents to be the standards for the specified provision of the Act. Section 6 does an analogous incorporation and authorisation, stating that anything done in accordance with the Access Regime for the ATM System, imposed by the Reserve Bank on 3 March 2009, is "specified, and specifically authorised" for the purposes of subparagraph 51(1)(a)(ii) of the Competition and Consumer Act 2010. The Regulations include a note that an electronic version of that regime is accessible on the RBA website.
Sections 7, 8 and 9 are forms of machinery provisions. Section 7 prescribes entities as "special regulators" for the Act, prescribes the head of each special regulator, and prescribes eligible delegates in relation to a nominated special regulator. The table in s 7 lists the Australian Competition and Consumer Commission (the Commission), the Australian Prudential Regulation Authority (APRA), the Australian Securities and Investments Commission (ASIC) and AUSTRAC, together with the persons who are heads and the categories of persons who may be eligible delegates. Section 8 prescribes, for the purposes of paragraph 26A(4)(d) of the Act, which persons within a nominated special regulator may be authorised to use or disclose information. Section 9 prescribes, for the purposes of paragraph 30B(4)(d) of the Act, which persons within a nominated special regulator are protected from civil liability.
