39 Exemptions relating to retention of goods

39 Exemptions relating to retention of goods

(1) The Act, section 21(1) does not apply to goods if the goods are—

(a) on consignment with a licensee for sale, or

(b) purchased by a licensee at auction, or

(c) purchased from another licensee and, before the purchase, the other licensee complied with the Act, section 21(1)(a), or

(d) purchased by tender from—

(i) a government sector agency, or

(ii) an authority constituted by or under an Act for a public purpose, or

(iii) a state owned corporation.

(2) For the Act, section 21(1)(a), a licensee may keep watercraft at a convenient place in New South Wales.
