The Act, section 15(1) and (3) do not apply to a licensee if—
(a) the goods being offered for sale to the licensee have been, or will be, imported to Australia by the licensee, and
(b) the licensee has made an import declaration for the goods under the Customs Act 1901 of the Commonwealth.
