Pawnbrokers Act 1902

The Act organises pawnbroking around a small set of transactional and administrative concepts. These include licensure, records and duplicates, redemption period and forfeiture, sale procedure (including auction requirements for higher-value loans), proprietor prohibitions (who a pawnbroker may accept a pawn from), and remedies and enforcement.

Licenced status and premises: “licensed” is defined in the dictionary to mean licensed under the Traders (Licensing) Act 2016. A licensed pawnbroker must carry on business only at premises stated in the licence (s 8(1)). The pawnbroker must produce the licence on demand by a police officer at those premises (s 8(2)). Record and duplicate: When a pawnbroker lends on the security of an article, the pawnbroker must make a written record before handing over money (s 9(1)-(2)). The record must contain specific information: an accurate description of the article; the loan amount; the interest rate by the week or month; the pawn date; the name and home address given by the pawner; and, if the redemption period exceeds three months, the agreed period (s 9(2)). The pawnbroker must reasonably believe the name and address given are accurate before giving money (s 9(3)). Records must be consecutively numbered within each calendar year starting at 1 (s 9(4)). The pawnbroker must give the pawner a signed duplicate of that record free of charge (s 10(1)); if the pawner declines the duplicate, the pawnbroker must return the article (s 10(2)). The duplicate is the operative document for redemption: a person producing the duplicate and claiming to be owner (or authorised by owner) is taken to be entitled to redeem (s 12(1)-(2)) unless the pawnbroker has notice from the real owner that the duplicate was lost or stolen or reasonably believes the article was stolen (s 12(3)).

Redemption period and forfeiture: The statutory default redemption period is three months (s 13(1)(a)). Parties may agree a longer period (s 13(1)(b)), but any agreement to forfeit earlier than three months is void (s 13(3)). If not redeemed by the end of the redemption period, the pawned article is forfeited to the pawn-taking licensed pawnbroker and may be sold or otherwise disposed of (s 13(2)).

Sale, auction and surplus: Where the advance exceeded $500, any forfeited article must be sold by public auction and the pawnbroker must give public notice on two separate occasions at least four days before the sale, listing items and pawn dates (s 15(1)-(4)); public notice is defined to include notice on an ACT government website or in a daily newspaper circulating in the ACT (s 15(3) note). If the pawnbroker sells otherwise than required, the pawnbroker must pay the owner $500 (s 15(5)). When a pawned article is sold and there is a surplus after deducting the advance and interest due, the person pawning or on their behalf may claim the surplus within 12 months; the pawnbroker must pay the surplus within two days of the claim, less necessary sale charges (s 17(1)-(3)).

Duties of a licence-holder pawnbroker

• Operate only at premises stated in the licence: s 8(1). • Hold duplicates and copy procedure: If a pawner loses the duplicate and gives a statement explaining the circumstances, the pawnbroker must, if satisfied and if the article is unredeemed and the person asks, give a signed copy of the record (s 11(2)-(3)). • Conduct sale/auction requirements: Do not sell or otherwise dispose of a pawned article before the end of its redemption period (s 14, maximum 50 penalty units). • Pay surplus proceeds: If a sale produces a surplus and the pawner claims the surplus within 12 months, the pawnbroker must pay the surplus within 2 days of the claim, less necessary sale-related charges (s 17(1)-(3), maximum 50 penalty units for non-compliance).

Rights of pawnbrokers

• Statutory ownership on forfeiture: An article not redeemed by the end of the redemption period is forfeited to the licensed pawnbroker who has the article and may be sold or otherwise disposed of (s 13(2)). This transfers economic control of the article to the pawnbroker subject to the sale and surplus rules.
