141Withdrawal of applications

#### 141 Withdrawal of applications (1) A patent application, other than a PCT application, may be withdrawn if all of the following conditions are met: (a) the applicant lodges a written notice of withdrawal signed by the applicant; (b) if the application has been opposed under section 59—the Commissioner has consented to the withdrawal; (c) if the regulations prescribe a period within which an application must not be withdrawn—the withdrawal will not occur within the prescribed period. (2) The regulations may prescribe circumstances in which PCT applications may be withdrawn, or are to be taken to be withdrawn.
