50 Qualification of Secretary's contracting power

(1)  The Secretary's power to enter into passenger service contracts under this Division is, in every case, subject to –

(a) the availability of funding; and

(b) the service eligibility guidelines; and

(c) [Section 50 Subsection (1) amended by No. 4 of 2017, Sched. 1, Applied:01 Jul 2019] applicable Treasurer's Instructions issued under section 51 of the Financial Management Act 2016 .

(2)  Nothing in this Division is to be taken as obliging the Secretary to –

(a) enter into any passenger service contract; or

(b) accept, in respect of any prospective passenger service contract, any offer, expression of interest or tender that the Secretary adjudges unsatisfactory.

(3)  In this section –

contract includes a contractual variation.
