42 Variation of conditions of authorisation, &c.

(1)  The Commission may, at any time –

(a) place an additional condition on an authorisation; or

(b) vary or revoke a condition of an authorisation.

(2)  The Commission may exercise the power under subsection (1)  –

(a) on its initiative; or

(b) on the application of the service operator in accordance with section 66 .

(3)  Unless the Commission reasonably apprehends that it needs to act speedily because of a threat to public safety, it is not to exercise its power under subsection (2)(a) without giving the service operator notice of its intention, together with reasons, and a reasonable opportunity to be heard.

(4)  If, in response to an application pursuant to subsection (2)(b) , the Commission decides to take an action different from that sought by the applicant, it is to notify the applicant of the reasons for taking the different action.
